Abstract

The rise of the internet-based medical consultation has opened not only opportunities for consumers easily obtaining medical services but also put them at risk for mistreatment, misunderstanding or taking a wrong medication to be anticipated. This research concerns on how the internet-based medical consultation affects to the health and safety of the consumers. There are several identified legal issues have to be paid attention as follow: (i) the benefit and shortcoming of using internet-based medical consultation, (ii) inter-related and overlapped interest of the parties, (iii) consumer health and safety, (iv) consumer rights, and (v) dispute settlement. Pertumbuhan konsultasi pengobatan berbasis internet telah membuka peluang tidak hanya bagi konsumen. Kemudahan mendapatkan pelayanan medis tetapi juga menempatkan mereka pada risiko kesalahan perawatan, kesalahpahaman atau kesalahan dalam pemberian obat sehingga hal ini harus diantisipasi. Penelitian ini menjelaskan mengenai konsultasi pengobatan berbasis internet yang mempengaruhi kesehatan dan keselamatan konsumen. Ada beberapa masalah hukum yang harus diperhatikan dan diidentifikasi menjadi sebagai berikut, yakni: (i) manfaat dan kelemahan menggunakan konsultasi pengobatan berbasis internet, (ii) hubungan dan tumpang tindih kepentingan para pihak, (iii) kesehatan dan keselamatan konsumen, (iv) hak-hak konsumen, dan (v) penyelesaian sengketa.

Abstract

AbstractCountries throughout the world practice several forms of transitional justice, hoping to attain peace, democratic stability and reconciliation. They apply different mechanisms to achieve these goals. Thispaper offers a theoretical analysis of foundation, proceedings and legacy of the Extraordinary hambersin the Courts of Cambodia (ECCC). First, the Author examines the notion of the analysis of hybrid courts as a way of overcoming constraints that criminal justice mechanisms in post-conflict societies may face. Second, the Author explores the so-called “Khmer Rouge Tribunal”. Due to the significance and controversies that surround the ECCC, its work attracts great attention. Furthermore, political will is critical, so these hybrid judicial institutions should have more international support in terms of political means, funds, dissemination of results, and complementary mechanisms of transitional justice.IntisariNegara-negara di seluruh dunia mempraktikkan beragam bentuk keadilan transisional, dengan harapan untuk memelihara perdamaian, stabilitas demokrasi, dan rekonsiliasi. Mereka menerapkan mekanisme yang berbeda-beda untuk mencapai tujuan tersebut. Penelitian ini menyajikan analisis teori yang dilakukan terhadap landasan, proses, dan pengaruh Extraordinary Chambers in the Courts of Cambodia (ECCC). Pertama-tama, penelitian ini meninjau gagasan mengenai analisa terhadap pengadilan hibrida sebagai cara untuk mengatasi kendala yang dihadapi oleh mekanisme pengadilan pidana di masyarakat pascakonflik, dan kedua, mengeksplorasi apa yang disebut “Pengadilan Khmer Rouge”. Karena signifikansi dan kontroversi yang menyelubungi ECCC, karyanya menerima perhatian yang besar. Tekad secara politis sangat penting, sehingga pengadilan hibrida ini dapat memperoleh dukungan internasional lebih banyak dalam hal sarana politik, dana, penyebaran hasil, dan mekanisme untuk melengkapi keadilan transisional.

Abstract

Resolving environmental dispute through court litigation often ends up with failure. As a consequence, society in ccoperation with Non-Governmental Organization (NGO) and environmental organization prefer to use Alternative Dispute resolution (ADR) to reslove environmental dispute. In this regard, mediation is often chosen by the parties as it promotes a “win-win solution”. Moreover, mediation offers efficient, cheap and fast dispute resolution process. However, Indonesian law has not adequately accomodated the use of ADR in environmental dispute. As a consequence, the problem of legal certainty often come up. In order to overcome this situation, it is important to develop a mediation process that ensures the legal certainty for both of the disputants. This can be done by developing a mediation forum which is legalized by court.

Abstract

AbstractThis paper attempts to discuss intragenerational equity based on the taxonomy of environmental justice, i.e. distributive justice, corrective justice, procedural justice, and social justice. Based on distributive justice perspective, the paper places the polluter pays principle (PPP) and common but differentiated responsibility (CBDR) as two important legal principles in implementing intragenerational equity. Based on corrective justice perpective, the paper considers that the PPP plays an important role in implementing intragenerational equity. The paper explains the implementation of procedural justice in terms of access to participation, access to information, and legal standing. Finally, the paper observes the importance of the integration of environmental protection and social justice.IntisariTulisan ini mencoba untuk mendiskusikan lebih mendalam keadilan intra generasi dengan menggunakan taksonomi keadilan lingkungan, yaitu keadilan distributif, keadilan korektif, keadilan prosedural, dan keadilan sosial. Secara khusus, berdasarkan perspektif keadilan distributif, tulisan ini melihat adanya kaitan erat antara keadilan intra generasi dengan polluter pays principle (PPP) dan common-but-differentiated responsibility. Dalam perspektif keadilan korektif, tulisan ini melihat pentingnya PPP untuk mewujudkan keadilan intra generasi. Tulisan ini melihat perwujudan keadilan prosedural melalui hak untuk berpartisipasi dalam pengambilan keputusan, hak atas informasi, dan hak gugat. Dalam konteks keadilan sosial, tulisan menjelaskan integrasi perlindungan lingkungan dengan penciptaan keadilan sosial.

Abstract

This article discusses the Constitutional Court Judgment No. 36/PUU-X/2012. In this judgment, the majority of the Justices decided that the 1945 Constitution requires the State to exercise direct control over the upstream oil and gas activities. We will criticise the Justices’ deliberation that underlies the decision. The Court failed to shed light on questions pertaining to the legal rationale for ‘five activities’ doctrine that form the framework of ‘State control’ per Article 33 (3) of the Constitution and to the procedures in determining the priority ranking. In addition, the majority Justices are deemed to have left the question of whether the State is able to manage oil and gas industry unanswered. We will also describe how this judgment might result in the declining interest of foreign investors to invest in Indonesia, particularly inthe field of exploration and exploitation of natural resources. Artikel ini membahas Putusan Mahkamah Konstitusi Nomor 36/PUU-X/2012. Dalam putusan tersebut, mayoritas Hakim Konstitusi memutus bahwa UUD NRI Tahun 1945 mensyaratkan Negara secara langsungmenguasai kegiatan hulu Migas. Diuraikan kritik terhadap pertimbangan hukum dari putusan, yakni kelalaian Mahkamah tidak menjelaskan dari mana asal ‘lima kegiatan’ sebagai komponen ‘penguasaan negara’ dalam Pasal 33(3) UUD NRI Tahun 1945, bagaimana menentukan prioritas rangkingnya, dan perihal mayoritas Hakim Konstitusi yang tidak menentukan apakah Negara mampu mengelola industri Migas. Selain itu, diuraikan pula bahwa putusan tersebut berpotensi mengurangi ketertarikan investor asing untuk menanam modalnya di Indonesia, khususnya di bidang eksplorasi dan eksploitasi sumberdaya alam.

Abstract

Well-known marks are trademarks that are registered and advertised in numerous jurisdictions and media. Consumers trust them as they have high quality assurance. However, well-known marks are frequently violated, which not only injures trademark owners, but also harms the state. Therefore, management of well-known marks through licensing agreement is needed.  Merek terkenal adalah merek yang didaftarkan di berbagai negara, disebarluaskan di banyak media, serta dipercayai oleh banyak konsumen karena mutunya yang terjamin. Di sisi lain, sering terjadi pelanggaran merek terkenal yang tidak hanya merugikan pemegang merek, tetapi juga negara. Oleh karenanya, diperlukan penanganan pelanggaran merek melalui pembuatan perjanjian lisensi.

Abstract

Abstract In the mid of free trade era, both in domestic and international level, consumer protection issues has become more relevan to be examined. One of the important aspect in the field of consumer protection that should be strengthened is consumer’s acces to justice. The complexity of global trade marked by unfair commercial practices have often negative impacts for consumer; consumer rights often be ignored and violated by business people. Therefore government must be able to ensure the existence of consumer’s access to justice through the rule making, policy, and the new legal institutionalization in order to create fair business climate. IntisariDi era perdagangan bebas seperti sekarang ini, isu perlindungan konsumen makin penting dan relevan baik dalam konteks perdagangan di tingkat domestik maupun internasional. Salah satu aspek yang masih harus ditingkatkan di bidang perlindungan konsumen ialah akses keadilan konsumen, sebab pertumbuhan perniagaan yang makin kompleks jangan sampai hanya memposisikan konsumen sebagai obyek kepentingan bisnis semata. Oleh karena itu, Negara harus dapat menjamin terciptanya akses keadilan konsumen baik melalui regulasi, kebijakan, maupun kelembagaan hukum baru agar tercipta iklim perniagaan yang berkeadilan. Di samping itu melalui peningkatan akses keadilan konsumen diharapkan dapat menumbuhkan kesadaran konsumen akan hak-haknya.

Abstract

This article criticizes the judicial review practice over trademarks infringement in Indonesia. This article argues that to be fair the court should consider the confusion effect to determine whether there is a trademarks infringement case in accordance with Art. 16.1 of the TRIPs Agreement. This article concludes that Indonesia needs to improve its legislation to meet the requirement of the TRIPs Agreement and to improve the judges quality in applying the Trademarks Law properly by considering its purpose which grants the trademark owner a protection of the trademark’s identity and a protection against confusion against unauthorized use by third parties. Artikel ini mengkritisi praktik yudisial atas kasus pelanggaran merek di Indonesia. Atas dasar itu artikel ini berargumen bahwa supaya adil maka pengadilan seyogianya mempertimbangkan efek kebingungan untuk menentukan apakah ada pelanggaran merek sesuai Art. 16.1 TRIPs Agreement. Artikel ini menyimpulkan bahwa Indonesia perlu memperbaiki legislasinya supaya sesuai tuntutan TRIPs Agreement dan meningkatkan kualitas hakimnya dalam menerapkan Hukum Merek secara memadai dengan mempertimbangkan aspek purposivenya untuk memberikan kepada pemilik merek perlindungan atas identitas mereknya itu sendiri dan perlindungan atas kebingungan yang ditimbulkan oleh penggunaan merek tanpa hak oleh pihak ketiga.

Abstract

This article discusses whether the right of management can be categorized as the state control over land or as land rights. The Basic Agrarian Law is silent on right of management, but rather implicitly mentions it as mere ‘management’. Right of management originates from the right of state control over land. At first, right of management was conceived as the result of the conversion of the right of state control over land. In later development, right of management is sought through the granting of right of state control over land. Rights of management can be classified as land rights, where the holder is only entitled to use the land but cannot transfer the rights and cannot be made as a collateral. Tulisan ini akan menjelaskan apakah hak pengelolaan merupakan hak menguasai negara atas tanah ataukah hak atas tanah. Hak pengelolaan tidak disebutkan dalam Undang-Undang Pokok Agraria, tetapi disebutkan pengelolaan. Hak pengelolaan berasal dari hak penguasaan atas tanah negara. Semula hak pengelolaan terjadi melalui penegasan konversi dari hak penguasaan atas tanah negara. Dalam perkembangannya, hak pengelolaan terjadi melalui permohonan pemberian hak atas tanah negara. Berdasarkan sifat dan kewenangannya, hak pengelolaan dapat dikategorikan sebagai hak atas tanah, yang haknya hanya mempergunakan tanah, tidak dapat dialihkan, dan tidak dapat dijadikan jaminan utang dengan dibebani hak tanggungan.

Abstract

Even though street vendors in Yogyakarta and Sleman bring in a huge amount of income for the city budget, they are often ignorant to public space regulations. This research aims to find an arrangement model for street vendors in accordance to the city spatial plan. Jumlah pedagang kaki lima di Yogyakarta dan Sleman yang relatif banyak memang mendatangkan pemasukan bagi daerah, namun di sisi lain aktivitas mereka mengganggu kawasan ruang publik. Penelitian ini bertujuan mengetahui pola penataan pedagang yang sesuai dengan tataruang kawasan publik sehingga diharapkan dapat menjadi model pengaturan pedagang di Yogyakarta dan Sleman.
