Abstract

The implementation of the act of number 25 years 2009 about the public services in an effort to create the principle of good governance ( good governance ) in the province of Riau and Jakarta west important because of anything services for the community of course there has been a the command of implementation , procedures and authority so that the recipient the service will be satisfied for what he received . The implementation of law number 25 years 2009 concerning public services in west sumatra still has not been effective, because of year to year still happens reporting by the community for government agencies, soe, who do not give public services such as delays , abuse, received in exchange for money and services and goods. Constraints that have been faced in the delivery of public among other: the low the quality of public services , public service system not clearly regulated , overlapping authority , the low external supervision from the community , the ineffectiveness of the decentralised system .The efforts being done to deal with the obstacles is besides built supervision external by the community through active provided a report on the ombudsman representatives to Riau and Jakarta , so internal control each agencies needs to be improved the system , if a long considered be unable to improve the quality of public services . The concept of public services ideal is well applied by ombudsman when is supervision public service done with activities investigation initiative , supervision public services , systemic investigation , and the compliance.

Abstract

Perjanjian Kredit dengan menggunakan model standar baku/perjanjian baku merupakan model perjanjian yang digunakan di dunia perbankan. Dengan meningkatnya kegiatan berbagai bidang mensyaratkan adanya pelayanan cepat dan tepat tanpa mengabaikan kepatutan dan keadilan semua pihak yang akan terikat pada perjanjian itu. Salah satu cara untuk memberikan pelayanan yang cepat dengan cara mempersiapkan terlebih dahulu blanko perjanjian yang akan digunakan untuk kegiatan transaksional. Perjanjian kredit dengan perjanjian baku di dunia perbankan merupakan cara mencapai tujuan ekonomi yang efisien, praktis, dan cepat. Tetapi bagi konsumen, hal tersebut merupakan pilihan yang tidak menguntungkan, karena konsumen hanya dihadapkan pada pilihan menerima atau menolak perjanjian tersebut. Berdasarkan ketentuan tersebut, muncullah fenomena adanya ketidakseimbangan dalam kontrak/perjanjian. Dengan dibentuk nya Badan Otoritas Jasa Keuangan (OJK) sebagai lembaga pemeriksa dan pengawasan terhadap Perbankan, dan dikeluarkannya POJK No 1/POJK.07/2013 tentang perlindungan konsumen di sektor jasa keuangan diharapkan dapat mengurangi pelanggaran terhadap perlindungan konsumen di sektor jasa keuangan. Permasalahan dan tujuan dari penelitian ini antara lain untuk mengetahui penerapan asas keseimbangan dalam perjanjian kredit perbankan berdasarkan ketentuan peraturan perundang-undangan yang berlaku dan pasca dikeluarkanya POJK No 1/POJK.07/2013 dan bagaimana akibat hukum terhadap perjanjian kredit yang tidak menerapkan asas keseimbangan. Metode penilitian yang digunakan dalam tesis ini yaitu tipe penilitian yuridis empiris. Sumber bahan hukum yang digunakan adalah sumber bahan hukum premier, sekunder, dan tersier. Berdasarkan hasil penelitian, penulis menemukan bahwa, pertama, bahwa tidak ada perubahan pada perjanjian kredit pada Bank Nagari dan Bank BNI cabang dobi padang pasca dikeluarkanya POJK, karena masih ditemukan klausula-klausula yang bertentangan dengan peraturan per Undang-Undangan yang berlaku dan tidak terpenuhinya asas keseimbangan pada perjanjian kredit tersebut. Kedua, akibat hukum terhadap perjanjian kredit yang tidak memenuhi asas keseimbangan akan mendapatkan sanksi sebagaimana yang tercantum dalam pasal 53 POJK No 1 tahun 2013. Namun sampai sejauh ini apabila ditemukan pelanggaran, pihak OJK hanya memberikan sanksi berupa teguran. Kata Kunci : Perjanjian Kredit, Asas Keseimbangan, Otoritas Jasa Keuangan

Abstract

In the consideration of Law No. 23 of 2003 regarding Child Protection, it is stipulated that a child is bud, potential and young generation who will become the successor for aspiration of nation struggling and hold strategic value in securing the existence of this nation in the future. That why this law obligates the state and government to provide special protection for child in any condition. In Law No. 11 of 2012 regarding Juvenile Criminal Justice System, the protection is given by establishing special court for children who are committing a crime, which is separated from adult court. This law also mandates as a mandatory that the law enforcement agencies in each stage of criminal justice should apply diversion in solving any child crime or child in conflicting with law. For the police, which stand in the first row of criminal justice system, diversion process is actually can be applied by some procedures available. Those procedures are through the implementation of police discretion, penal mediation, and restorative justice or by solving trough adat law process. The implementation of those procedures in one hand will provide strong protection for child’s rights and on the other hand will secure the best interest of child.

Abstract

Fiduciary is one of the guarantees where the debtor has the right to control and take advantage of the goods that are used as fiduciary security objects. Article 15 paragraphs (1), (2), and (3) of Law Number 42 Year 1999 concerning Fiduciary Guarantee regulates the execution mechanism for fiduciary security objects when the fiduciary giver (debtor) experiences breach of promise to the fiduciary recipient (creditor). So far, the execution mechanism for fiduciary security objects regulated in the Act creates legal uncertainty and harms the debtor's rights. Because it gives too much power to the creditor. The imbalance of power relations between debtors and creditors towards the handling of the problem of breach of contract actually causes an injustice in existing fiduciary institutions. The Constitutional Court, through decision number 18 / PUU-XVII / 2019, tries to return the fiduciary institution to the spirit of equilibrium relations between debtors, creditors, and fair fiduciary guarantees. After the decision of the Constitutional Court Number 18 / PUU-XVII / 2019. Has there been a harmonious power relationship between two legal subjects in fiduciary guarantees. This paper examines the pre and post fiduciary guarantee institutions of the Constitutional Court and analyzes the legal consequences that occur. Abstract

Laws live and develop from patterns of behaviour in society, laws are not free of values, between legality and justice are inseparable. Laws made by the authority of sovereign states that are regulated and have sanctions can work effectively if there is a relationship of moral values that provide essential justice. Medical Criminal Law (MCL) regarding medical action has not been comprehensively regulated in the legal subsystem in the health sector. The complexity of the problems that arise in society is always growing which is followed by rapid advances in medical science and technology so that MCL is needed for legal certainty for medical personnel and legal protection for the community. Literature study in normative analytical research with a conceptual approach offers the idea of moral transplantation in the construction of MCL can be built under the values that live and develop in society (living law) based on the principle of material legality

Abstract

The problem of commercial sexual exploitation of children is a serious problem and is not a new problem that has emerged recently. This crime has been happening for a long time and has been experienced by many countries, including Indonesia. For a long time, the Indonesian government has made various efforts to minimize the increase in the types of crimes that attack the future of children, such as by issuing several policies. However, day by day this crime is getting more and more victims. Moreover, with the development of an increasingly sophisticated era, this criminal activity is growing. With technological capabilities that facilitate the modus operandi of perpetrators, it certainly raises its own concerns in protecting children from sexual exploitation for commercial purposes. This research is a socio-legal research using secondary data consisting of primary, secondary and tertiary legal materials collected through the study of library materials then analyzed qualitatively and presented descriptively so as to obtain a detailed and systematic description of the description of the crime of commercial sexual exploitation of children. divided into several periods and the development of its handling in Indonesia.

Abstract

As a country that maintains a presidential system of government, it is essential to concentrate on creating the framework and structure of government. This is closely tied to the establishment, evolution, and dissolution of such institutions. As a consequence, the President and the DPR will be capable of determining responsive and constitutional legal politics. This legal policy study focuses on how the growth and regulation of state ministries and state institutions were connected to the constitutional system's establishment, modification, and dissolution. Second, how can legal politics address this in a manner that seems to be constitutional? The objective of this study is to assess the arrangements pertaining to the formation, alteration, and dissolution of ministries and state institutions under the constitutional system in order to define the ideal political legislation.This research uses normative legal research methods with descriptive research specifications and is analyzed through library research and data analysis methods using juridical-qualitative. The results of the research and discussion in this study include: First, the arrangements regarding the formation, modification, and dissolution of ministries and state institutions do not yet have a clear legal basis so that the President as the holder of power, is irregular in issuing his policies. Second, the legal politics that was initiated wanted the Government and the DPR to be more synergized in terms of drafting legal considerations and normalizing them based on statutory regulations and principles in a presidential system of government.

Abstract

Protection of Geographical Indications (GI) is contained in The Trade Related Aspects of Intellectual Property Rights (TRIPs), GI is also regulated in other international agreements, such as the Paris Convention, Madrid Agreement, and Lisbon Agreement. In the provisions of TRIPs, the regulation of GI protection is left to each country to regulate it according to their needs and capabilities, TRIPs is only a minimum standard in protection. Thus countries regulate GI according to their needs. However, on the one hand, regarding the registration of GI, a broader mechanism is needed so that GI can be protected internationally. The European Union (EU) and ASEAN have regional/international GI registration mechanisms. This study analyzes the GI registration system through the EU and ASEAN mechanisms and then the legal implications for Indonesia. The method used is normative juridical using secondary data. The system for registration of GIs through the EU and ASEAN mechanisms does not differ much, only the EU regulates GIs that can be registered more broadly and in detail, meanwhile, ASEAN has not regulated the scope of GIs. In addition, the EU has a clear mechanism (starting from registration, opposition (objections), and time of submission, etc.), meanwhile, ASEAN has not regulated in detail like the EU. The legal implications for Indonesian GIs are that Indonesia fixes the laws and regulations related to GIs, and registers Indonesian GIs with the EU and ASEAN.

Abstract

This study aims to find a solution or policy in the case of the termination of the Senior High Officials (Regional Secretary of West Pasaman Regency) by Civil Service Officers (Regent of West Pasaman Regency). The Regional Secretary of West Pasaman Regency who was terminated then filed a lawsuit to Padang Administrative Court (PTUN Padang) which court stating that the decision that termination was invalid, so the Terminated Official had the right to be reinstated. The court decision could not be implemented and came to a dead end because the position had also been filled by another Official (the new Regional Secretary of West Pasaman Regency) by the merit system according to the State Civil Apparatus Law (ASN Law) which was elected by the Committee. The selection of the leaders of the Primary High Offices are based on the recommendations of the State Civilian Bureaucracy Commission (KASN). This research was conducted using a sociologic and juridical method that analyzes the application of laws and regulations. The results showed that the termination of the Regional Secretary of West Pasaman Regency in terms of authority was in accordance with the regulations but in terms of procedural the Regent did not follow the provisions contained in the Civil Servant Discipline Regulation because the tenure of the regional secretary was less than 2 years without any summons, but immediately issued a Termination Letter based on the recommendation from the Inspectorate and the Governor of West Sumatra. Implications of the reappointment of Manus Handri as regional secretary based on the court decision which states that the termination of the regional secretary is illegal, but cannot be implemented because the new regional secretary has been elected based on KASN recommendations during the process of resolving Manus Handri's lawsuit at court. Termination and reinstated are difficult to be implemented because there are unclear provisions on how long the Human Resources Officer can reinstate terminated Officials who submit their cases to the Court. Therefore, there must be clear provisions in Law Number 30 Year 2014 and / or in Law Number 5 Year 1986 concerning the position of Officials who challenge the Decree on Transfer or termination during the trial process until the court's decision has permanent legal force. There should be a clause so that the Civil Service Officer (PPK) does not fill a new official with a position that is currently being processed in court.

Abstract

This writing aims to understand law enforcement by the existing criminal justice system and to understand the existing legal system models in the world and Indonesia along with their characteristics. The method used in this writing is normative legal research through literature study with data collection methods in the form of secondary data. The results of the research show that law enforcement has not been implemented optimally, so it is very important that the existing criminal justice system can work well to create and realize a sense of justice in society. In this world, there are two models of the rule of law concept that have been developed, namely the Continental European model called rechstaat and the Anglo Saxon model called the rule of law. The concept of rechtsstaat was born from a struggle against absolutism so that it is revolutionary in nature. The concept of rechtsstaat relies on the Continental Law system called civil law. Meanwhile, the concept of the rule of law develops evolutionarily, which is based on a legal system called common law.
