Abstract

Penelitian ini bertujuan Untuk mengetahui peran Kantor Badan Pertanahan Nasional dalam menyelesaian Sengketa Pertanahan melalui Mediasi sesuai dengan Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional nomor 11 tahun 2016 tentang Penyelesaian Kasus Pertanahan. Penelitian ini merupakan penelitian normatif empiris, yaitu suatu penelitian disamping melihat aspek hukum positif juga melihat pada penerapannya atau praktek di lapangan. Teknik analisis data yang digunakan adalah deskriptif kualitatif, yaitu setelah data terkumpul kemudian dituangkan dalam bentuk uraian logis dan sistematis, selanjutnya dianalisis untuk memperoleh kejelasan penyelesaian masalah, kemudian ditarik kesimpulan secara deduktif, yaitu dari hal yang bersifat umum menuju hal yang bersifat khusus. Hasil dari penelitian ini menunjukkan bahwa Sebagai mediator, Kantor Pertanahan Kota Makassar mempunyai peran membantu para pihak dalam memahami pandangan masing-masing dan membantu mencari hal-hal yang dianggap penting bagi mereka. Mediasi di lingkungan instansi pertanahan dalam hal ini Kantor Pertanahan Kota Makassar sebenarnya juga secara tidak di sadari telah di jalankan olah aparat pelaksana secara sporadis dengan mengandalkan kreatifitas dan seni di dalam gaya kepemimpinan masing-masing pejabat, tetapi baru pada saat sekarang ini upaya mediasi telah memiliki payung hukumnya di lengkapi pedoman serta petunjuk teknis yang memadai sehingga tidak ada keraguan lagi bagi aparat pelaksana untuk menjalankannya. Kata Kunci: Kantor Pertanahan, Mediasi, Penyelesaian Sengketa.

Abstract

Corruption in Indonesia is currently a serious crime that is carried out systematically and has a broad impact on people's lives. State’s assets which should be used for development in order to benefit the society, are used for personal interests. Through the Corruption Law, the State tried to eradicate corruption and restore assets that have been corrupted. The restoration is endeavored by the application of additional punishment in the form of payment of substitute money. In order to optimize the implementation of the payment, the Supreme Court has issued a regulation of Substitute Money to provide the same understanding for the Law Enforcers, specifically Judges, in the imposition of the regulation on Defendants of Corruption. The problems in this research are: How is the implementation of Supreme Court Regulation on Substitute Money in the verdict to the defendants of corruption. The method used in this research is sociological juridical method. The type of the research is descriptive by using primary data and secondary data. The results of the study revealed The Judges have implemented some of the clauses of the regulation on making the decision, however the implementation have not evenly stated on each verdict

Abstract

The development of the corporate function as a means of organizing socially oriented societies towards profit-seeking activities not least triggers negative impacts. One of the negative impacts is the emergence of criminal acts committed by corporations. In order to get as much profit as possible, corporations take actions that can cause losses to consumers, one of which is by mixing non-halal content into products labeled as halal. The purpose of this article are, First, to provide an overview of corporate legal policy as a criminal law subject and Second, to be able to know the corporate responsibility for non-halal content in halal-certified food products as an effort to protect consumers. The results of this study are policies regarding corporations as subjects of criminal law in which their actions can be prosecuted and held criminal liability are contained in special legislation outside the criminal code. Corporate liability regarding non-halal content in halal-certified food products follows a direct accountability system. This means that criminal liability for violations of the halal label can be addressed either to individuals or corporations where corporate responsibility is imposed on its management as stipulated in Article 61 of The Consumer Protection Laws

Abstract

The role of corporations in applying sustainable principles cannot be separated from the commitment of corporations in carrying out social and environmental responsibility or corporate social responsibility (CSR). In practice, corporations must also have clear CSR commitments. However, the implementation of CSR in Indonesia has not been optimally carried out by corporations from a sustainable development perspective. Corporate Social Responsibility is still considered an obligation, it has not become a good character inherent in the corporation. This paper will discuss about the optimization of CSR in Indonesia by analyzing the normative legal measures that can be taken against the CSR legislation seen from the prospects and challenges that Indonesia has. The approach method used in this study is a normative juridical approach with descriptive analytical research specifications and analyzed by qualitative normative methods. The problem in managing CSR in Indonesia is that the concept of CSR is not aligned with sustainable principles. From this, an understanding can be drawn that basically the optimization that is felt to be the most appropriate when viewed from the existing gaps in CSR regulation is the making of pentahelix policies that involve the government, society, non-governmental organizations, academics, and the media.

Abstract

Traditional medicine (herbal medicine, standardized herbal medicine, phytopharmaca (clinical-based herbal medicine), imported traditional medicine) is an ingredient or herb ingredients in the form of plant ingredients, animal ingredients, mineral ingredients, galenic preparations, or a mixture of such ingredients that have been used for treatment for generations, and can be applied by the norms prevailing in the society. This study aims to find out and analyze related to the supervision and registration of traditional medicine brands in Indonesia. This research uses a qualitative method with a normative juridical approach. Data collection techniques are carried out through library studies. It can be concluded that the supervision of traditional medicine brands' registration must be carried out to the maximum by the National Agency of Drug and Food Control (NADFC). This avoids the problems that will arise in the event of the obscurity of the surveillance process. Good and proper supervision must be based on the rule of law because Indonesia recognizes the Law's existe.

Abstract

This study is a study of the existence of Nagari Regulations (Perna) in the legal system in Indonesia. Perna is a form of delegation from Law Number 6 of 2014 concerning Villages. However, Perna is not listed in Law No. 12 of 2011 concerning the Establishment of Legislation. This study is a normative legal research with a statutory and conceptual science approach. The results of this study indicate that the existence of Perna does not have a clear legal basis after the enactment of Law no. 12 of 2011. The reason is that the Perna which is a regulation at the level of a village regulation has been issued in the hierarchy of laws and regulations. That is why, if the a Perna conflicts with higher regulations or the public interest, it cannot be tested through the Supreme Court as the institution which is authorized to examine statutory regulations under the law against the law. In addition, Perna also experiences weaknesses in terms of law enforcement, which is carried out by Parik Paga Nagari (Nagari Law Enforcement Agency) which basically does not provide a solution to the enforcement of Perna, but could create new problems in the community.

Abstract

Technological advancements in Indonesia's Construction have initiated a digital transformation in the sector. The necessity of incorporating automated systems in contract performance to meet future digital needs has become increasingly apparent. This paper presents to spearhead research into the possibility of the Indonesian construction industry adopting smart contracts. The chosen research approach is a qualitative scientific methodology involving a systematic review highlighting the benefits and obstacles associated with adopting smart contracts within the construction industry. Further data were collected from construction contract management experts through interview sessions. The findings reveal that the self-execution feature of smart contracts could better distribute risks within a contract. However, the study also uncovers substantial challenges in applying smart contracts, such as their immutability, irreversibility, and vulnerability to human errors. The study concludes that smart contracts are best suited for short-term contracts that do not require variations. Smart contracts could streamline contract management, reducing time and effectively addressing conflicts and disputes during the contract's lifespan. The devised implementation framework holds significance for construction professionals, particularly those involved in contract administration. Incorporating smart contracts into construction could enhance contract administration and management discipline by fostering investment in this emerging technology

Abstract

Tulisan ini membahas mengenai gagasan perbaikan terkait kementerian dan jabatan Menteri yang ada di Indonesia. Situasi pelik terkait jabatan Menteri disebabkan adanya potensi penggunaan jabatan menteri untuk kepentingan politis. Disisi lain terdapat harapan public untuk mendapatkan menteri-menteri professional yang tidak politis. Dalam momentum UU 39 Tahun 2008 tentang Kementerian Negara yang masuk dalam long list program legislasi nasional, tulisan ini berupaya memberikan masukan terhadap pembaharuan UU Kementerian tersebut. Menggunakan metode doktrinal, tulisan ini memberikan rekomendasi pembatasan terhadap wakil menteri, menteri koordinator, rangkap jabatan dan kewenangan pembentukan peraturan menteri. Gagasan ini menjadi penting, utamanya untuk memperkuat checks and balances dalam sistem presidensial di Indonesia untuk tidak kehilangan jati dirinya. Penelitian ini menggunakan metode doktrinal dengan mengkaji bahan-bahan kepustakaan untuk mencari landasan teoritis, serta menganalisis data sekunder. Keberadaan menteri dan wakil menteri yang cukup banyak dan merata pada hampir semua partai koalisi membuat mekanisme pengawasan dan legislasi parlemen menjadi lemah, sehingga diperlukan suatu pembatasan. Pembatasan lainnya yang perlu dilakukan adalah terkait kewenangan menteri dalam membentuk peraturan. Dalam hal ini salah satu jalan keluarnya adalah dengan mengembalikan kedudukan delegasi pengaturan dari undang-undang kepada Presiden, bukan peraturan menteri.

Abstract

This article aims to examine the reduction of criminal penalties as a form of reward or incentive for justice collaborators. This is prompted by the pro and con debate over the verdict of the Panel of Judges in the case of Barada Richard Eliezer, who was sentenced to 1 year and 6 months for the planned murder of Brigadir Nofriansyah Yosua Hutabarat. The legal issue revolves around the absence of clear criteria for the extent of such leniency, as it remains within the prerogative of the judge. This research is conducted using normative legal research, involving an analysis of all relevant laws and regulations related to the legal issue under investigation. These include the Supreme Court Circular Letter Number 4 of 2011 on the treatment of crime reporters (whistleblowers) and justice collaborators in specific criminal cases, and the Republic of Indonesia Law Number 31 of 2014 concerning Amendments to Law Number 13 of 2006 on Witness and Victim Protection. The research results suggest the need for consistency in judicial decisions regarding the extent of sentence reduction for justice collaborators. The author recommends considering the Italian regulations in dealing with organized crime, where defendants who are willing to become justice collaborators, thereby assisting in uncovering criminal groups and providing necessary evidence, may receive reduced prison sentences. A life sentence can be replaced with a prison term of 12 to 20 years, and other sentences can be reduced by one-third to two-thirds. According to the author, this reduction can be determined based on the maximum criminal penalty they face, as stipulated in Article 199 of the Draft Criminal Procedure Code (RUU KUHAP).

Abstract

In a legally valid marriage, parents share responsibilities for their children's rights and obligations. This becomes more challenging for parents of children with disabilities, especially in ensuring proper education. This study examines parental obligations in providing educational facilities for children with disabilities in Percut Sei Tuan sub-district, Deli Serdang district, according to Law Number 8 of 2016 concerning Persons with Disabilities and Islamic law. The research employs an empirical juridical approach with qualitative methods, emphasizing descriptive analysis and field research. It aims to align the research process with real-world facts encountered during the study. Findings reveal that some parents fulfill their obligations responsibly, implementing various strategies to support their disabled children's education. These include acting as friends and caregivers, providing transportation, creating suitable play environments, supporting home learning, and teaching social adaptation. Parents also strive to manage their emotions for stable interactions with their children. However, some parents fail to meet their obligations due to indifference towards their children's education, limited knowledge in child-rearing, and economic constraints. The study concludes that while many parents in PercutSei Tuan sub-district strive to fulfill their obligations under both national and Islamic law, challenges remain. It recommends increased support and education for parents of children with disabilities to ensure better compliance with legal and religious obligations in providing appropriate educational facilities limitations.
