Abstract

Pretrial has the authority under the Criminal Procedure Code to order law enforcement agencies (KPK / Police / Prosecutors) to continue the legal process of someone suspected of committing a criminal act of corruption and this does not conflict with the legality principle of criminal procedure as affirmed in Article 2 and Article 3 of the Criminal Procedure Code. The pretrial judge's action is the application of the principle of judicial independence to resolve legal issues. Thus the pretrial judge's ruling does not conflict with the legal principles of procedural law in Article 2 and Article 3 of the Criminal Procedure Code

Abstract

Crime is a very anti-social act that consciously gets a reaction from the state in the form of giving suffering (punishment or action). Crime as a behavior is an act of deviance, is against the law or violates statutory regulations and is detrimental to the community in terms of decency, decency and order of community members. Crime can be defined juridically and sociologically. Crime is part of people's lives and is an everyday event. A philosopher named Cicero said Ubi Societas, Ibi Ius, Ibi Crime which means there is a society, there is law and there is crime. The benefit of studying criminology is that criminology contributes to the formulation of new legislation (the Criminalization Process), explaining the causes of crime (Criminal Ethylogy) which in turn creates efforts to prevent crime. Another issue regulated in the child protection law is how to punish adults who commit crimes against children and also the responsibility of parents, society and the state in protecting children. This research was conducted in North Maluku, precisely in the city of Ternate. This research will use a descriptive type of analysis with a qualitative approach. Abstract

The recognition and respect for the indigenous people along with their traditional rights is affirmed on the article 18B verse (2) of the 1945 Constitution of the Republic of Indonesia; that includes the indigenous people of Hibualamo in North Halmahera regency.  The spatial planning contect requires the involvement of the indigenous people to achive a balance between development and tenure rights so that it will be in line with the local wisdom to support sustainable development.

Abstract

This article discusses legal considerations in court decisions on corruption of village funds at two different court levels based on Decision Number 5/Pid.Sus-TPK/2022/PN Tte at the first level and Decision Number 6/Pid.Sus-TPK/2022/PT Tte at the appeal level. The legal issue lies in the difference in judges' legal considerations related to the application of Article 2 paragraph (1) and Article 3 of the Corruption Eradication Law. This research uses normative legal research with secondary data sourced from primary and secondary legal materials. In the data collection process, data collection techniques are used by means of literature studies which are then processed and analyzed qualitatively. The panel of judges who examined and tried the case of corruption of village funds based on the Corruption Court Decision at the North Maluku High Court Number 6/Pid.Sus-TPK/2022/PT Tte after examining based on legal facts had a different view from the panel of judges at the previous level. The judge at the high court level after examining the case file and based on the legal facts in the trial at the first level concluded that what was proven was not the primary charge of Article 2 paragraph (1) but the secondary charge of Article 3 with all legal considerations. However, in relation to the punishment imposed by the judge at the higher level, there is no difference with the form of punishment imposed by the judge at the first level. Both the imposition of imprisonment, fines and additional punishment in the form of payment of restitution.

Abstract

This research aims to discuss the background to the policy on the obligation to change Village-Owned Enterprises (BUMDes) from business entities to legal entities and the development of BUMDes legal entity status in Banyudono District, Boyolali Regency. Law Number 11 of 2020 concerning Job Creation in Article 117 amends Article 1 (6) of Law Number 6 of 2014 concerning Villages. Before the changes to the Village Law, BUMDes were described as business entities, whereas in the Job Creation Law BUMDes were described as legal entities. The research method used is empirical juridical, located in Banyudono District, Boyolali Regency, Central Java. The results of the discussion showed that 1) The aim of the promulgation of Article 117 of the Job Creation Law is to be able to absorb the widest possible Indonesian workforce amidst increasingly competitive competition and the demands of economic globalization, including at the village level by optimizing BUMDes. 2) In Banyudono District, Boyolali Regency, there are 15 (fifteen) villages and only 5 (five) BUMDes, but there are 2 (two) BUMDes that have not yet been incorporated, namely BUMDes Banyudono and BUMDes Hamlet.

Abstract

Dengan di undangkannya Undang – Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum memberikan peluang untuk peningkatan demokrasi dengan memperhatikan adanya pelanggaran yang dilakukan dan menjadi tugas pokok dari Badan Pengawas Pemilihan Umum Kabupaten/kota. Efektifitas penegakan pelangaran administrasi oleh BAWASLU Kabupaten Halmahera Selatan berdasarkan Pasal 240 Ayat (1) Huruf (k) dan (m) Undang – undang Nomor 7 Tahun 2017 tentang PEMILU, belum maksimal dalam memberikan keputusan kepada Calon Anggota DPRD Kabupaten Halmahera Selatan Dapil II Makian Kayoa yang telah memenuhi unsur formil maupun materil dalam pemeriksaan Persidangan Pelanggaran Administrasi. Selain itu, Faktor yang mempengaruhi penegakan Pelanggaran Administrasi pada Pemilihan Umum serentak Anggota DPRD oleh BAWASLU Halmahera Selatan tahun 2019 yaitu jumlah personil dan sarana fasilitas penunjang dalam pemeriksaan persidangan tidak memadai, antara tugas dengan dana operasional tidak sebanding dalam penganan kasus pelanggaran Administrasi.

Abstract

Laws or legislation are laws that have been passed by the legislature or other elements of resistance. Before being enacted, the law is referred to as a draft law. Laws serve to be used as authority, to regulate, to recommend, to provide funds, to punish, to grant, to declare, or to restrict something. A law is usually proposed by members of the legislature, for example members of the DPR, the executive, for example the president, and then discussed among members of the legislature. Laws are often amended before they are passed or may also be rejected. Law is seen as one of the three main functions of government which derives from the doctrine of separation of powers. The group that has the formal power to make legislation is known as legislators who make laws, while the judiciary of the government has the formal power to interpret legislation, and the executive branch of government can only act within the limits of the powers set by statutory law.

Abstract

Motorcycle riders in southern Halmahera Regency have not complied and obeyed the provisions of Article 293 paragraph (2) of the LLAJ Law concerning the obligation of motorcycle riders to turn on their lights during the day. This happened because in facing the disobedience of the driver, the South Halmahera Sat Lantas Police had not taken repressive measures such as giving a TOSS statement but the action taken was still limited to preventive action. The preventive measure is to disseminate information about the obligation to turn on lights during the day by motorcyclists. In addition, community ignorance and the low level of community discipline. Then the weak sanctions imposed by law enforcement.

Abstract

Penelitian ini bertujuan untuk mengetahui untuk menganalisis penegakan hukum terhadap kasus tambang pasir di Kota Ternate serta untuk menganalisis Faktor-Faktor Yang Mempengaruhi Penegakan Hukum Penyelesaian Kasus Tambang pasir di Kota Ternate. Penelitian ini menggunakan Penelitian Empiris. Data primer dan data sekunder sebagai data penunjang penelitian diperoleh dengan cara wawancara dan studi kepustakaan. Data yang telah diperoleh dianalisis dengan metode analisis Kualitatif deskriptif. Hasil Instansi yang berwenang dalam hal ini Dinas Lingkungan Kota Ternate sejak proses perizinan sudah tidak sesuai dengan mekanisme dan ketentuan hukum yang ada. Selain proses perizinan ternyata pada pengawasan pun tidak berjalan optimal karena secara normatif Dinas Lingkungan Hidup memang pernah melakukan pengawasan. Serta Masih mininya sumber daya manusia sehingga penegakan hukum oleh dinas lingkungan hidup tidak berjalan efektif dan minimnya tingkat kesadaran masyarakat terhadap hukum dan kebiasaan dalam masyarakat penambangan secara ilegal sehingga terjadi pencemaran dan kerusakan lingkungan.

Abstract

This article was written with the aim of knowing and analyzing the policies of the Majalengka Regency Government in providing assistance to people who are self-isolating due to being exposed to or confirmed positive for Covid-19, besides that this paper will also try to describe about how the mechanism for providing assistance as well as analyzing weaknesses and solutions to these problems.This paper is a normative juridical writing made with two main approaches, namely the empirical approach and the case approach.The results of the study indicate that the policy of providing assistance for people who are self-isolating in Majalengka Regency is given by providing cash assistance worth Rp. 45.000,00 (forty five thousand rupiah) with details of 3 (three) meals/improvement of nutrition per day multiplied by Rp. 15,000.00 (fifteen thousand rupiah), wherein the amount is given for 10 days of self-isolation period. If it is calculated as a whole, then the total compensation given to residents/communities who do self-isolation is Rp. 45.000,00 X 10 days, which is Rp. 450,000.00 per one citizen identified as positive for Covid-19. However, the facts on the ground show that there are still many community members who do not and do not know about the program, this is due to the existence of a mechanism for providing assistance that focuses on managing the residents, not the government, so it is necessary to reconstruct/change the distribution mechanism which emphasizes the importance of government activities. in the distribution of assistance to the people of Majalengka Regency who were confirmed positive for Covid-19.
