Abstract

Children are assets of the country that must be preserved, thus their rights must be upheld even if they commit crimes. The effect of their social environment, including their peers, community, and parenting practices, cannot be isolated from children's criminal behavior. The state must be present to protect children because punishment will have a detrimental effect on their mental and physical development. Through Law Number 11 of 2012 Concerning the Juvenile Criminal Justice System, the state has created space to offer special protection to children who commit crimes. Under this law, criminal issues committed by children are resolved through a restorative justice process. What is the sociological perspective on the protection of children who commit crimes from a restorative justice perspective, then, when looking at these issues? In order to examine the truth and reality of the laws that are in place in society with relation to the sociological perspective of defending children from criminal acts based on restorative justice, the research technique used is sociological juridical. According to the study's findings, the prevalence of restorative justice in laws and regulations demonstrates the sociological influence of the process, which includes social control, social services, and accountability to victims and society.

Abstract

Pancasila sebagai ideologi bangsa Indonesia memiliki perbedaan dengan sistem kapitalisme-liberal maupun sosialisme komunis. Pancasila mengakui dan melindungi baik hak-hak individu maupun hak masyarakat baik di bidang ekonomi maupun politik. Dengan demikian ideologi kita mengakui secara selaras baik kolektivisme maupun individualisme. Demokrasi yang dikembangkan, bukan demokrasi politik semata seperti dalam ideologi liberal-kapitalis, tetapi juga demokrasi ekonomi. Dalam sistem kapitalisme liberal dasar perekonomian bukan usaha bersama dan kekeluargaan, namun kebebasan individual untuk berusaha. Sedangkan dalam sistem etatisme, negara yang mendominasi perekonomian, bukan warga negara baik sebagai individu maupun bersama-sama dengan warga negara lainnya. Artinya Pancasila memiliki peran yang sangat penting dalam menegakkan negara hukum, merupakan falsafah, dasar negara dan ideologi terbuka.

Abstract

Penelitian ini bertujuan untuk 1). Mengapa KDRT masih kerap terjadi di banyak tempat di Indonesia khususnya di kecamatan Medan Krio meski produk perundangundangan telah dibuat untuk melindungi hak perempuan. 2). Maka apa yang harus dilakukan dalam rangka mengurangi kekerasan dan memberi keadilan bagi perempuan di Kecamatan Medan Krio.Bentuk kekerasan terhadap perempuan masih terjadi di banyak tempat para perempuan selalu diasosiasikan sebagai kelompok marjinal yang mendapat perlakuan diskriminatif, mengalami depresi, dan subordinasi atas dominasi laki-laki.. Metode yang digunakan dengan teknik pengumpulan data dengan metode studi literatur. Dan kemudian dikumpulkan dari laporan instansi terkait seperti laporan Komnas Perempuan, dan buku-buku ilmiah yang melakukan kajian serupa, data-data sekunder ini kemudian diinterpretasikan secara kualitatif dan didukung dengan beberapa konsep serta teori ilmiah yang telah dikemukakan sebelumnya sebagai pisau analisis. Tulisan ini diharapkan dapat menumbuhkan awareness atas isu kekerasan terhadap perempuan dalam studi akademis dan memberi penajaman analisis serta cara pandang atas isu ini.

Abstract

Restorative Justice according to Article 1 number 6 of Law Number 11 of 2012 is the settlement of criminal cases involving perpetrators, victims, families of perpetrators/victims, and other related parties to jointly seek a fair settlement by emphasizing recovery. return to its original state, and not retaliation. The concept of restorative justice is a critique of the concept of the criminal justice system which sees crime as a violation of state rules. As for the results of this study, namely the reconstruction of restorative justice policies in cases of children as perpetrators of crimes, according to Erna Sofwan Syukri, it provides an understanding of punishment as an effort to awaken the perpetrators of crimes so that they regret their actions, and return them to become good, law-abiding citizens. upholding moral, social and religious values, so as to achieve a safe, orderly and peaceful society. So the reconstruction of Restorative Justice in the case of children as perpetrators of criminal acts must be fair. The value of justice is a balance between rights and obligations and receiving rights and carrying out obligations.

Abstract

Referring to Article 28 paragraph (1) of the Advocate Law as the legal basis for the establishment of a single organization for the advocate profession named PERADI on December 21, 2004, the establishment of PERADI is a manifestation of a single bar association and has implications for the unification of the Indonesian advocate profession in a single organization for the advocate profession. only one, so that it is hoped that advocate organizations will become solid and can take part in improving the quality of advocates, curbing violations of the code of ethics for the advocate profession and eradicating judicial corruption. However, there are camps that disagree with the single bar, namely the Indonesian Advocates Congress (KAI) and the Association Indonesian Advocates (PERADIN) who approve of the multi bar system claim the multi bar system as an ideal system for Indonesian advocate organizations because it is considered in accordance with the mandate of Article 28E paragraph (3) of the 1945 Constitution, even though harmony and alignment are important for good competence for advocate organizations which has implications also to its members, this writing discusses the single bar post-judgment system of the supreme court and also provides input for the upcoming advocate

Abstract

The role of business competition is very important in the context of market balance in order to make a perfect market, in this case run by the Business Competition Supervisory Commission (KPPU). In relation to business competition laws and policies, KPPU has the task of supervising the implementation of MSME partnerships. The problem that the author will examine is the role of competition law and policy in optimizing the potential of SMEs in order to create a balanced and just economy. The approach method that will be used is normative juridical which is focused on conducting a juridical analysis related to business competition law and MSMEs. The research results obtained are the role of law and business competition policy towards optimizing MSMEs in accordance with the objectives of the establishment of Law 5 of 1999, one of which is, creating a conducive business climate through regulation of fair business competition so as to ensure certainty of equal business opportunities for large business actors., medium business actors, and small business actors and so on, to create effectiveness and efficiency in business activities.

Abstract

Creditors are classified into three categories, namely separatist creditors, preferred creditors, and concurrent creditors. This is different from the classification in general civil law, where creditors are only classified into two, namely preferred and concurrent creditors. Separatist Creditors, namely creditors whose receivables are guaranteed and bound by material guarantees such as Mortgage, Mortgage, Pledge and Fiduciary. Separatist creditors or Secure Creditors can exercise their rights based on the material guarantees they have as if no bankruptcy had occurred, in the case studied it was found that PT. Hardys Retailindo signed a Credit Agreement with Bank J. Trust Indonesia, on May 28, 2012 for Working Capital purposes, which is approximately IDR 140,000,000,000 (One Hundred Forty Billion Rupiah), in this case the Bank. J Trust as a separatist creditor whose debt is guaranteed should get legal and preliminary protection from bankrupt debtors, in this study discusses legal protection for separatist creditors

Abstract

In article 16 and Article 18 of UU Kepolisian Nomor 2 Tahun 2002 concerning the Indonesia National Police, The National Police have formulated a new concept to enforce criminal law that accommodates the norm and values prevailing in societyas a solution as well as providing legal certainty, especially fot the benefit of society’s sense of justice. The approach to providing legal certainty by applying the handling of criminal acts based on restorative justice is the settlement of criminal acts by involving the perpetrator, victim, perpetrator’s family, victim’s family, community leaders, religious leaders, traditional leaders, or stakeholders to jointlyseek a fair settlement through by emphasizing restoration to its original state. A form of mediation called Restorative is to repair losses caused by crimes involving victims, to see the perpetrator’s accountability, and prevent similar failures from occurring in the future. Restorative is a legal umbrella to describe programs that can see criminal acts and respond with a restorative perspective.

Abstract

The economy is structured as a joint venture based on the principle of kinship", the meaning is profound, namely that the economic system developed gotong royong. The inherent meaning of people's economic rights to be maintained by the State Ruled Rights. Law Number 3 of 2020, Article 92 provides authority in the form of rights for mining license (IUP) and special mining business permit (IUPK) holders. This arrangement is a form of freedom to trade these mining materials so that it has the potential to obscure the constitutional right of the state, so that the state's position becomes a sub-ordination of business actors. The spirit of regional autonomy is essential to provide flexibility to maximize mineral and coal mining management. The results: the economic rights of the people are attached to the meaning of the right to be controlled by the state is a manifestation of the fulfillment of the economic rights of the people as a subject to obtain prosperity. The regulation that gives the permission holder authority over minerals and coal to possess is legally contrary to the constitution.

Abstract

The 1945 Constitution established constitutional rights for citizens and emphasized the need for public participation to safeguard these rights. Citizen lawsuits serve as a form of public participation, but the absence of a legal basis in Indonesia has created uncertainty in their implementation. This study aims to examine the mechanism of citizen lawsuits within the Indonesian legal system, presenting it as a juridical alternative for protecting citizens' constitutional rights. The author utilized a normative legal research method with a qualitative and case-based approach through literature review. Citizen lawsuits enable citizens to take legal action against state officials who have neglected their rights. Courts have relied on jurisprudence and guidelines for handling environmental cases, such as the Chief Justice of the Supreme Court of the Republic of Indonesia Decree Number 36/KMA/SK/II/2013. Unlawful acts falling under the executive's jurisdiction serve as the subject of citizen lawsuits. Research on various citizen lawsuit cases demonstrates their effectiveness in defending citizens' constitutional rights. However, financial and knowledge limitations pose obstacles. Financial challenges can be addressed through community collaborations, pooling resources. To overcome knowledge limitations in filing citizen lawsuits, a dedicated regulation outlining the mechanism should be established.
