Abstract

The main issue has always been inspiring the development of the principles of a constitutional state is the limitation of the power and protection of human rights. The presence of women in the life of the nation can not be denied. To that end, Indonesian women also need to study and understand their constitutional rights as citizens within the framework of state law. The question is, when talking about women's rights in the constitution, it will be confronted with several obstacles, including public acceptance of it is still very low. In connection with this, then it should be understood implementation of the values of human rights in the constitution. UUD 1945 as Constitution of Indonesia formulated that the protection of human rights is not aimed only at a particular group of people but to every citizen of Indonesia. This is seen from the formulation that uses the phrase "everyone", or "every citizen", which indicates that the constitutional rights possessed by every individual citizen without distinction, whether based on ethnicity , religion, political belief, or gender. Even the UUD 1945 also affirms that "everyone is entitled to be free from discriminatory treatment on any basis and the right to protection against such discriminatory treatment". Thus, if there are conditions or actions that discriminates against a particular country, it violates human rights and the constitutional rights of citizens, and by itself contrary to the constitution of Indonesia. Therefore, human rights are those rights which is constitutionally recognized, then the violation of human rights is a violation of the constitution. Thus, it can be concluded that every female Indonesian nationals have the same constitutional rights of Indonesian citizens were male. Strengthening women's rights contained in the constitution, it needs the support of all parties, particularly the women themselves by growing a culture of constitutional awareness, especially related to women's constitutional rights

Abstract

The existence of trade liberalization is faced with the fact that the competition of countries in trade especially in this case export and import increasingly felt very rapidly. The existence of international legal instruments that are commonly contained in the General Agreement on Tarriff and Trade (GATT) becomes an important point in the international trade regulatory concept for GATT member countries incorporated in the World Trade Organization (WTO). So the principles are also embedded in the drafting of the concept of national law for States that have ratified GATT. Indonesia, one of the countries that have ratified GATT, is bound by these Principles, one of which is the Most Favored Nation Principle which implies the regulation of import tariff in Indonesia. So protection of local commodities is closed even if limited to maintain the continuity of national production.

Abstract

Factors that cause Indonesia to be selected as a transit country for refugees and asylum seekers, among them are first, Indonesia has a vast marine territory of long coastline, but is not supported by strict rule of law. Secondly, Indonesia's position is very weak in addressing the problem of asylum seekers and refugees from other countries because it has no national regulations that specifically address the issue. Third, the lack of facilities and infrastructure in handling refugees and asylum seekers. Fourth, the presence of UNHCR in Jakarta became a refugee attraction. Fifth, the culture or culture of Indonesia, known for its hospitality, gives the impression that Indonesians can easily accept the arrival and whereabouts of refugees. The setting up of asylum seekers and refugees should be placed in immigration legislation because the issue of asylum seekers and refugees is a foreigner's (immigration status) problem, which touches on international aspects. The handling of refugees, immigrants and asylum seekers faces several obstacles in the process of handling them: First, Internal Constraints; A) the absence of standard standards in legislation regarding the handling of illegal immigrants. b) The legal vacuum that comprehensively regulates asylum seekers and refugees in Indonesian positive law, weakens coordination among agencies in the field. c) Lack of immigration quarantine facilities to accommodate asylum seekers and refugees, d) Limited regular funds. Second, External Constraints. a) Local Government objected to the additional burden of the arrival of troubled foreigners. b) The often sharp distinction between regional culture and the culture of displaced potential foreigners brings about social conflict. c) Arise of social jealousy of the refugees received free humanitarian assistance in the form of shelter and living expenses, while local residents live in a state of deprivation. Residents do not realize that the aid is not from the government, but from UNHCR and or IOM. D) Often the assimilation between asylum-seeker men and refugees with local women, precisely leaves the child's burden. -the children who turn up when repatriation or resettlement are not brought along.

Abstract

Desa Adat telah ada sebelum Negara Indonesia terbentuk. Setelah Indonesia merdeka, Desa Adat masih tetap ada. Akan tetapi, pada masa pemerintahan rezim Orde Baru, Desa-desa Adat yang ada diseragamkan melalui Undang-Undang Nomor 5 Tahun 1979 tentang Pemerintahan Desa. Hanya ada beberapa Desa Adat yang masih terus terjaga eksistensinya. Salah satunya yaitu Nagari yang masih eksis di Sumatera Barat. Dari uraian di atas, kiranya menarik untuk mengkaji mengenai eksistensi Nagari di Sumatera Barat sebagai Desa Adat dalam sistem ketatanegaraan di Indonesia, terutama setelah lahirnya Undang-Undang Nomor 6 Tahun 2014 tentang Desa. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Penelitian ini menggunakan pendekatan peraturan perundang- undangan. Hasil penelitian menunjukkan bahwa eksistensi Nagari di Sumatera Barat merupakan ‗buah‘ dari perjuangan panjang masyarakat Minangkabau dan pemerintah daerahnya. Lahirnya Undang-Undang Nomor 6 Tahun 2014 tentang Desa semakin memperkokoh landasan hukum bagi Nagari untuk tetap menjaga eksistensinya sebagai warisan budaya Minangkabau di Sumatera Barat

Abstract

The existence of customary law in living values in the community despite of not written so that even customary law is not defined by the State (positive) but apply in the midst of society. Customary law as an applicable law is not necessarily to be seen from the sanctions application, but customary law is sufficiently declared applicable when there are statements expressed as a revelation of a sense of justice that is declared as norm, so customary law further ensures a sense of justice that it takes the community as living law in positive law in Indonesia.

Abstract

Forest and Peatland fires that hit several provinces in Indonesia last year. One proof that environmental laws do not go according as it should. As was the case in the province of Riau, South Sumatra, Jambi, West Kalimantan and Central Kalimantan. The case of forest fires and haze become routine every year. Ironically, despite the smoke haze repeated every year with huge losses, the handling remains the same. Reactionary and tend to dwell on purely technical matters outage. The country had neglected its obligations. The fundamental problem of forest fires and land mismanagement of natural resources that have been perpetuated by bad practices, including the monopoly on possession. All these bad practices perpetuated through the legitimacy of such a permit. Disaster fumes resulting from bad practices do corporations with a common pattern. To keep production costs down, the company burned land when land clearing. This is clearly contrary to the Law No. 32/2009 on the Protection and Environmental Management. Companies that obtain permission means subject to the terms and provisions of the law governing how they should be tried, including in it should not be burned, and shall keep the region. If all violations was systematic, it was because there was never any enforcement against corporations in the region found api.Point of views of the repeating pattern of the company which is intentionally doing bad practices that lead to ecological disaster, it can be said that the corporation has done of serious crimes, due to meet the elements of a planned and widespread.

APEC is a forum of economic cooperation for countries in the Asia Pacific region, the forum is based on the principle of equality and mutual respect and understanding. In its development, APEC's goals and missions have shifted from economic cooperation to political and security cooperation. This shift is a formidable challenge for APEC member countries in responding to the strong US domination in the APEC forum which has caused disunity among APEC member countries itself, and this is a very relevant opportunity for APEC member countries to return to the original mission.

Abstract

Tulisan ini bertujuan untuk menggambarkan upaya Indonesia dalam melakukan upaya pengembalian aset tempat wisata sebagai hasil dari korupsi dalam kerangka undang-undang, dengan menggunakan penelitian kepustakaan yang didasarkan pada literatur. Hasil penelitian ini mengungkap bahwa pengembalian aset tempat wisata yang merupakan hasil dari korupsi menjadi tantangan tersendiri untuk Indonesia karena mengingat dampak yang diakibat dari pengembalian aset tersebut akan timbul masalah lagi, seperti tata pengelolaan yang harus direkonstruksi sehingga perlu terus dilakukan secara masif. Hasil laporan dari Indonesia Corruption Watch (ICW) menyatakan kurang lebih Rp 3 triliun total kerugian negara yang ditimbulkan dan 482 kasus korupsi sepanjang 2017, meskipun Indonesia memiliki lembaga yang fokus pada pemberantasan dan pencegahan korupsi seperti KPK. Selain itu, diperlukan juga kerjasama secara kolektif utuk membasmi korupsi serta menyelamatkan aset negara yang ada di Indonesia.
