Abstract

Tulisan ini bertujuan untuk menggambarkan upaya Indonesia dalam melakukan upaya pengembalian aset tempat wisata sebagai hasil dari korupsi dalam kerangka undang-undang, dengan menggunakan penelitian kepustakaan yang didasarkan pada literatur. Hasil penelitian ini mengungkap bahwa pengembalian aset tempat wisata yang merupakan hasil dari korupsi menjadi tantangan tersendiri untuk Indonesia karena mengingat dampak yang diakibat dari pengembalian aset tersebut akan timbul masalah lagi, seperti tata pengelolaan yang harus direkonstruksi sehingga perlu terus dilakukan secara masif. Hasil laporan dari Indonesia Corruption Watch (ICW) menyatakan kurang lebih Rp 3 triliun total kerugian negara yang ditimbulkan  dan 482 kasus korupsi sepanjang 2017, meskipun Indonesia memiliki lembaga yang fokus pada pemberantasan dan pencegahan korupsi seperti KPK. Selain itu, diperlukan juga kerjasama secara kolektif utuk membasmi korupsi serta menyelamatkan aset negara yang ada di Indonesia.

Abstract

Currently, the country of Indonesia is experiencing unresolved narcotics problems. various efforts to eradicate and prevent narcotics have been done, but have not caused a deterrent effect in law enforcement. There is a difficulty in eradicating it to its roots, it becomes one of the obstacles experienced by our law enforcement officers, in this study using normative juridical research method with historical approach, conceptual approach which has been studied the customary criminal sanction which is applicable during the reign of the buton sultanate and obstacles in the application of gogoli punishment. The results of this study indicate that the renewal of national criminal law in relation to criminal sanctions may originate from customary law prevailing in the sultanate of buton as intended is gogoli punishment, while the concept of gogoli punishment is a rope encircled on the body of a person convicted and withdrawn by in opposite direction until the loss of endurance or death, the punishment is included in the type of death penalty, this is relevant to immigrants who commit a narcotics criminal act in Indonesia which has been sentenced to death several times but apparently until now still not cause effects, the authors has the hope that the punishment can be applied nationally considering narcotic criminal acts that occur almost throughout the region and will damage the morale of the nation today.

Abstract

This article aims to find out and analyze the protection of whistleblowers or reporters in election crime, here the author uses a type of normative juridical research with the statutory approach, conceptual approach and case approach, this is motivated by elections held once every 5 years. It is undeniable that violations often occur before the election and when the election is held, according to Bawaslu that there are 3,133 cases of violations either in the form of findings or reports as referred to in the 2018 elections in 171 regions. So that in following up on election crime, there must be a role from whistleblowers from the public, but there is fear from the reporter so that he does not dare to report the crime, so protection against whistleblowers is needed. The election has not clearly stipulated in the form of protection given, one of the problems is that the reported party reports the reporter again so that the consequences are not continuing the case from investigation to incrach decision but only limited to the level of investigation caused by obstacles experienced is evidence that is owned by the complainant, then the whistleblower should be given protection such as having the right of immunity as cannot be prosecuted criminal or civil, protecting in order to avoid ri from economic, political and social discrimination.

Abstract

Nowadays, Indonesia is undergoing a corruption problem unresolved. a variety of efforts to combat corruption a criminal offence has been committed, but not yet scrapped in law enforcement. as can be eradicated up to its roots, it is to be one of the barriers that were experienced by our law enforcement officers, the overthrow of criminal sanctions as deterrent effects do not cause against the corruptor, then should the overthrow criminal sanctions heavier again. As well as administering Gogoli penalty or death sentence applied in the Sultanate of Buton at the time of his reign, but in execution i.e. a rope twirled and drawn in a manner opposite direction until a dead, Surely the concept of the overthrow of the current criminal sanctions imposed during the reign of the Buton Sultanate. pose a deterrent effect and a structural officials have feelings of fear to commit irregularities such as corruption, then the author represents the hope that the punishment could be applied nationally Gogoli considering the criminal act corruption happens almost throughout the regions and regional officials who are often exposed to cases of criminal acts of corruption.

S.H,.M.S.Fakultas Hukum Universitas Brawijaya muhsutrimansyahr@gmail.com  ABSTRAK Artikel bertujuan untuk mengetahui dan menganalisis mengenai keterangan palsu sebagai salah satu kasus obstruction of justice, disini penulis menggunakan jenis penelitian yuridis normatif dengan pendekatan perundang-undangan, pencekatan koseptual dan pendekatan kasus, hal ini di latarbelakangin oleh terdakwa atau saksi memberikan keterangan di persidangan sebagai pembuktian namun dalam proses pemberian keterangan ternyata terdapat permasalahan yakni terdakwa atau saksi memberikan keterangan palsu dipersidangan, hal ini tentunya akan menghambat proses pembuktian yang sedang berjalan dan hakim atau penuntut umum menjadi sulit untuk mencari kebenaran materiil. Maka oleh karena itu dalam hasil penelitian ini menyatakan bahwa keterangan palsu sebagaimana diatur dalam pasal 22 Undang-Undang Nomor 31 Tahun 1999 jo Undang-Undang Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi merupakan bagian dari obstruction of justice atau upaya mengahalang-halangi karena dengan keterangan palsu dalam persidangan tersebut mengakibatkan bisa terganggunya proses persidangan serta membutuhkan waktu yang lama dalam proses persidangan meskipun tidak secara langsung akibatnya, sehingga penuntut umum tindak pidana korupsi dapat memberlakukan Pasal 21 Undang-Undang Nomor 31 tahun 1999 jo Undang-Undang Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana mengenai obstruction of justice atau mengahalang-halangi. Kata Kunci: Obstruction of Justice, Keterangan palsu, Tindak Pidana  Korupsi. ABSTRACT This article is aimed to investigate and analyze false information as a form of obstruction of justice. Normative-juridical research method was employed with statute, conceptual, and case approach. This research was based on the fact in which a defendant or a witness gave false information in the court, which hinders the Judge and General Prosecutors from discovering material truth. From the research result, it is found that false information, as regulated in Law Number 20 years 2001 on Corruption Eradication, is one of the causes of obstruction of justice, for this false information could get in the way as obstruction to searching for justice, and it is time consuming. Therefore, general prosecutors handling the case of corruption could stipulate Article 21 of Law Number 31 Year 1999 jo Law Number 20 Year 2001 on Corruption Eradication regarding obstruction of justice. Abstract

This study aims to examine and analyze the integrity of investigators in handling criminal cases committed by witnesses (Case Study of Alleged Criminal Acts of Vandalism in Central Buton Regency), through a juridical-empirical research approach and analysis of qualitative methods. The results show. To reveal the integrity of investigators, two indicators are used, namely honesty and objectivism. So the results of the study showed that there was dishonesty by the investigators, namely asking for the summons of witnesses at night, the investigator denied the question and said it was not true while regarding objectivism, the investigator allegedly sided with the reporter based on the alleged threat to the witness to admit that he did it. Suggestions in realizing investigators with integrity can be formed through two aspects, namely internal aspects, and external aspects, internal aspects of the police institution must be seriously fostered through quality education of cultural maturity, spiritual maturity, psychological maturity, cultural maturity, conscience maturity, and moral maturity that originates from, external aspects, namely synergies between institutions and integration into a supervisory system.

Abstract

This paper investigates the critical issue of immunity rights for experts who provide statements in trials, with a specific focus on the analysis of Decision No: 47/Pdt.G/LH/2018/PN Cbi. Employing a normative research approach, the study adopts a comprehensive methodology, encompassing a case and statutory perspective alongside grammatical and systematic interpretation. The pivotal finding of the research centers on the rejection of a lawsuit by the Panel of Judges, attributing it to the absence of relative competence in the presented case. Notably, the decision contains a notable directive, proposing that "experts in the future should have the right not to be prosecuted criminally." This forward-looking perspective accentuates the significance of extending immunity rights to experts. The paper underscores the urgent need for recognizing and formalizing these rights within the legal framework, advocating for the incorporation of immunity provisions for experts in the Witness and Victim Protection Law. The research contributes to the broader discourse on legal reforms, highlighting the evolving landscape concerning the legal status and protection of experts involved in legal proceedings. In navigating these complex legal dynamics, this paper calls for a proactive approach from policymakers and legislators to address and safeguard the immunity rights of experts, ensuring a fair and conducive environment for their participation in legal processes.

Abstract

Criminal acts of sexual violence are widespread in society, and the aim of the research is to study and analyze a decision. The research methods used by researchers are normative juridical with case, statutory, and philosophical approaches. The primary legal material is the Sexual Violence Crime Law and Decision Number 72/Pid.Sus/2023/PN.Bau. while secondary materials: books, journals, etc., the interpretation used is grammatical and systematic interpretation. The results of the research show that the paradigm used by the Panel of Judges does not have a victimology perspective, as evidenced by the statement expressed by the victim witness who explained that the defendant was not the perpetrator of a crime of sexual violence, while the actual perpetrator had been appointed by the victim witness based on the photo submitted by the Counselor. The law and the perpetrator are still at large, while the defendant was legally and convincingly found guilty of committing the crime of sexual immorality. Therefore, the Panel of Judges ignored the facts of the trial. Apart from that, the panel of judges did not interpret the victim's witness statement as a standalone piece of evidence as regulated in the Sexual Violence Crime Law. So the author's suggestion is that it is important for the judge to have the victim's perspective, in this case, what the victim said is information that must be acknowledged at trial and It is necessary to evaluate the panel that examined and decided the case.
