Abstract

The development of popular culture, particularly,in the development of information technology such as as television, mobile phones, and the Internet,  have an impact on the creation of a new reality called hyper-reality. Media,in this case,is able to reconstruct a new reality through the sophisticated technology. The construction of this medium also penetratesthe religious area. This can be seen in the figure of Abdullah Gymnastiar (Aa Gym). Through the medium of information, Aa Gym is not only seen as a religious teacher who offers a depth of spirituality but also as a celebrity through the image formed. This paper aims to identify and describe the phenomenon of celebrity cleric/ ustadzAbdullah Gymnastiar in popular culture, using hyper-semioticsapproachof Yasraf Amir Piliang. This paper attempts to explain the new realityof diversity of Abdullah Gymnastiar. Through the hyper-semioticsapproach, religious hyper-reality form can be described scientifically.

Abstract

This research is motivated by the different opinions among Islamic thinkers about the womens involment in making a living for the family. In this research, the author attempts to reveal the thoughts of Quraish Shihab in Tafsir Al-Mishbah on the verses used as the argument of Islamic thinkers on whether or not women are allowed to earn a living for the family . The method used is analytical description with hermeneutical interpretation approach. This research found that according to the Quraish Shihab, the responsibility for the fulfillment of living in a family charged to men for several reasons, but women were allowed to engage in it for several conditions.

Abstract

Tulisan ini melakukan kajian terhadap praktek jual sanda dalam masyarak Banjar di Hulu Sungai. Praktek ini marak dilakukan sebagai bagian dari mekanisme masyarakat petani, khususnya yang berdomisili di Hulu Sungai Tengah dalam mengatasi persoalan ekonomi yang mereka hadapi. Temuan peneliti menjelaskan bahwa, meski terdapat persoalan hukum, baik dilihat dari kacamata hukum positif dan hukum Islam, praktek jual sanda tetap menjadi pilihan masyarakat. Adanya ketidakmampuan bank dan koperasi dalam menjangkau kebutuhan masyarakat menjadi salah satu penyebab dari tetap langgengnya praktek ini. Pertimbangan agama, tidaklah berlaku dalam masyarakat adat, yang walaupun semua pihak yang bertransaksi memiliki pengetahuan yang cukup dalam agama Islam. Mengutip teori rasionalitas praktisnya Max Weber yang memandang bahwa segala aktivitas manusia yang ada di dunia ini selalu dikaitkan dengan pragmatis dan egoitis, maka praktek ini dapat dipahami, yaitu kedua pihak menginginkan kemudahan dan kepraktisan. Kemudian adanya pihak yang berkuasa (superior) menindak pihak yang lemah.

Abstract

Banjar is famous for its great scholars and have an important role in the Islamic world. In this study, Banjarese scholars had passions and purposes to enhance, strengthen and develop the tradition of writingHadith. The books of hadith they wrote is not only applicable in Islamic boarding school but also for public usage in this country as well as other countries.Banjarese scholars who was related to hadith ArbaCin the 20th century were Kasyful Muhammad Anwar, Anang Syacrani Arif, Muhammad Syukeri Unus, and Ahmad Fahmi Zamzam. This study attempts to explain the background of those scholars and  their roles in the scientific tradition of Hadith in Banjar as an effort to introduce the  Islamic scholars in Nusantara to Islamic world. This research is based on analysis of historical and biographical data obtained from the collection of documentsand processed descriptively. The study found that the role of Banjarese scholars in the 20th century gave a new nuance to the study of hadith in Banjar and Malaysia.

Abstract

AbstractThere are several prohibitions (taboos) in marriage according to Islamic law as confirmed in the Al-Quran and Hadith, such as: prohibition of marriage because of blood relations (nasab), breastfeeding or marriage. However, in Banjar culture, there are some additional taboos that people think are not good to do because they can have negative consequences. Viewing tradition from a Qur'anic perspective is an attempt to collaborate local traditions with universal religious teachings. This paper attempts to discuss the taboo issues surrounding marriage in Banjar culture according to the perspective of the Koran. This research method is qualitative with a field research model and uses an anthropological approach. The research locations are in three areas, namely: Banjarmasin, Martapura and Amuntai. The results of this study indicate that the prohibitions related to marriage contained in the Qur'an are universal and principled, while the prohibitions in Banjar culture are conditional and full of local wisdom. Understanding it wisely as a custom that contains benefits and benefits because it is loaded with good moral messages and does not violate religious teachings is a necessity, although not all Banjar people believe and practice it in the social reality of society.Keywords: Marriage taboo, Banjar culture, Al-Quran AbstrakAda beberapa larangan (tabu) dalam perkawinan menurut hukum Islam sebagaimana ditegaskan dalam Al-Quran dan Hadits, seperti: larangan kawin karena hubungan darah (nasab), sesusuan atau semenda. Namun dalam budaya Banjar ada beberapa pantangan tambahan yang menurut anggapan masyarakat tidak baik untuk dikerjakan karena dapat berakibat yang negatif. Memandang tradisi dari perspektif Qur’ani merupakan upaya untuk mengkolaborasikan tradisi lokal dengan ajaran agama yang bersifat universal. Tulisan ini berupaya untuk membahas masalah tabu sekitar perkawinan dalam budaya Banjar menurut perspektif Al-Quran. Metode penelitian ini bersifat kualitatif dengan model penelitian lapangan (field research) dan menggunakan pendekatan antropologi. Adapun lokasi penelitian di tiga wilayah, yaitu: Banjarmasin, Martapura dan Amuntai. Hasil dari penelitian ini menunjukkan bahwa larangan terkait perkawinan yang ada dalam Al-Quran bersifat universal dan prinsipil, sedangkan larangan dalam budaya Banjar bersifat kondisional dan sarat dengan kearifan lokal. Memahaminya dengan bijaksana sebagai adat yang mengandung maslahat dan manfaat karena sarat dengan pesan moral yang baik dan tidak menyalahi ajaran agama merupakan sebuah keniscayaan, walaupun tidak semua orang Banjar mempercayai dan mempraktekkannya dalam realitas sosial bermasyarakat.  Kata kunci: Tabu perkawinan, budaya Banjar, Al-Quran

Abstract

Tulisan ini bermaksud mengekplorasi suatu tradisi yang biasa dilakukan dalam masyarakat Banjar Pahuluan dalam upacara kematian, yakni bahilah. Tradisi ini tetap lestari sebagai bagian ritual yang dilakukan pada masyarakat di sana. Fenomena ini unik mengingat bahilah dari sudut pandang mazhab syafiie yang notabene mazhab utama yang diikuti oleh masyarakat di sana adalah sesuatu yang diharamkan. Namun, dengan alasan mazhab Hanafi membolehkan, maka praktek ini kemudian dilestarikan. Fenomena perpindahan mazhab inilah yang kemudian menjadi isu menarik untuk dikupas. Karena ternyata dalam keberagamaan masyarakat Banjar, khususnya di pahuluan relatif ada fleksibilitas ketika berhdapan dengan sesuatu yang mendasar dalam kebudayaan Banjar, yakni penghormatan dan kebaktian terhadap leluhur. Inilah sejatinya ajaran dasar keyakinan lokal yang tetap ada, meski kemudian datang agama-agama luar seperti Hindu, Budha, Kristen, dan Islam.

Abstract

Indonesia is a country that is predominantly Muslim, so that Muslim consumers certainly get the protection of the goods and/or services in accordance with Islamic law. Because the protection of the rights of every citizen of Indonesia. Khiyar is one form of consumer protection in Islam. Surely, khiyar as one of the forms to protect the rights of Muslim consumers are contained in the Consumer Protection Law. This thesis aims to determine: (1) Existence khiyar in Law No. 8 of 1999 on Consumer Protection, and (2) Analysis of the existence of khiyar in Law No. 8 of 1999 on Consumer Protection. This research is a normative law (normative legal research), namely legal research conducted by examining the legal material. The approach taken in this study is the statute approach and the conceptual approach. Based on the method used produced the conclusion that the existence khiyar in Law No. 8 of 1999 on Consumer Protection, contained in article 4, which khiyar ‘aib and khiyar syarath with the right to safety (article 4 letter a), khiyar majlis and khiyar ta'yin with the right to choose (article 4 letter b), khiyar tadlis and khiyar ‘aib with the right to be informed (article 4 letter c and h), and khiyar ru'yah with the right to be heard (article 4 letter d ). Existence khiyar in article 4 of the Law No. 8 of 1999 on Consumer Protection in terms of the Islamic economic law in accordance with the rules of fiqh, maqasid shari'ah, and fiqh.

Abstract

Tulisan ini mengkaji para tuan guru Banjar yang terlibat dalam kampanye pemilihan kepala daerah (pilkada) di Kalimantan Selatan. Dengan pilkada gubernur 2005 sebagai studi kasus, penulis ingin menguji apakah para tuan guru tersebut merupakan pemimpin masyarakat dengan kepentingan pribadi semata. Studi ini juga meneliti sejauhmana para ulama Banjar ini mau terlibat dalam kampanye dan apa yang menjadi pertimbangan-pertimbangan mereka. Para ulama yang menjadi narasumber adalah mereka yang dilibatkan, baik secara langsung ataupun tidak, dalam usaha menarik suara pemilih oleh empat dari lima pasangan calon yang bersaing saat itu. Penelitian ini menunjukkan bahwa tuan guru yang diteliti memilih cara yang berbeda dalam membantu calon mereka. Ada yang berkampanye begitu rajin di berbagai ajang dan forum baik yang resmi untuk kampanye atau tidak, namun ada pula membatasi diri hanya pada acara-acara tertentu. Mereka mempunyai motif dan pertimbangan masing-masing baik politik maupun ideologis yang membuat mereka melangkah hingga titik tertentu: mereka berhitung secara rasional. Sebagai imbalan atas kesediaan mereka, para calon memberikan sejumlah ganjaran baik untuk pribadi maupun pesantren, pengajian ataupun organisasi yang dipimpin oleh para ulama ini. Penulis menyimpulkan bahwa tuan guru Banjar yang turut serta berkampanye tidak hanya mengusung kepentingan pribadi.

Abstract

This paper explores the role of Tuan Guru Haji Kasyful Anwar in making some changes in Pondok Pesantren Darussalam Martapura. The changing that he made in that Islamic boarding school can be seen in system of teaching, curriculum, and the facilities of study. Also in his period found the degree of education. He taught his students to have a humble life besides to apply the knowledge as maximal as possible. So that, from his boarding school and his public class that belong to him, came out many ulama.

Abstract

This article is aimed to describe dialectical relation between Islamic philosophy (hikmah) and Islamic religious doctrin (syarî’ah). The tension between two has emerged since declination of rational theology (Mu’tazilite) and since the rise of ortodox theology (Asy’arite). Al-Ghazâlî, one of prominent scholars of the Asy’arite, has attacked Moslem philosophers, such as Ibn Sînâ. This article has came to the conclusion that in such tension, in which religion and rational thought met, the two neither reached utterly different results, nor yet were they identical, but seemed to run parallel to one another.
