Abstract

Performance appraisal of civil servants as stipulated in article 77 number (6) of Law Number 5 of 2014 concerning State Civil Apparatus, this article states that a civil servant whose performance evaluation is not in accordance with the established targets is subject to sanctions in the form of administrative sanctions until dismissal. Basically, the performance of civil servants is the result and assessment of work carried out by civil servants in quality and quantity that has been achieved by a civil servant in carrying out the duties, authorities, obligations and responsibilities that have been given. This changes the paradigm that has been formed so far that being a civil servant is impossible to be dismissed, and a civil servant is not an office employee who is assessed based on performance appraisal, from that background we formulate the issue What is the legis ratio of dismissal of civil servants based on performance appraisal in PP Number 30 of 2019 concerning work evaluation? and What are the legal implications of the dismissal of civil servants based on performance appraisal in PP Number 30 of 2019 concerning Performance Appraisal.

Abstract

The business entity regulated in Law No. 23 of 2014 which is then technically regulated in Government Regulation No. 54 of 2017 concerning Regional Owned Enterprises in which requires two forms of BUMD, namely regional companies or in short with Perseroda and the second form is Regional Public Company. In many areas there are many forms of business entities that are still in the form of Regional Companies, as a consequence of the enactment of Law No. 32 of 2004 on Local Government and Government Regulation No. 54 of 2017 on Regional Owned Enterprises, each form of Regional Company must be changed to a Regional Company or Regional Public Company. In this journal, the author will explore the procedures for the change from a Regional Company to a Regional Public Company based on Normative Juridical research methods using a statutory approach and literature studies with various literature books, journals, and articles related to the theme that the author adopted. The purpose of the authors to convey from the results of this study is how the influence of changes in the form of regional-owned enterprises in increasing the original income of the region so that the region.

Abstract

The government provides land for the implementation of transmigration. The land is granted with the status of property rights on the condition that it cannot be traded for 20 (twenty) years. However, many transmigrants do not feel at home and choose to return to their original areas, by selling the transmigration land to other parties before 20 years. The sale and purchase of transmigration land is carried out under the hands without a deed from PPAT. So the problem studied is the legality of buying and selling under the hands and how to resolve it to register land at the Land Office if there is no PPAT deed, because the seller's whereabouts are unknown. This study uses empirical normative legal research methods with primary data sources through interviews. The results of the study show that buying and selling under the hands according to customary law is legal as long as it meets the requirements, namely clear and cash, but buying and selling under the hands without a deed of sale and purchase made by PPAT cannot be registered at the Land Office.

Abstract

he hospital is a health service that contained risks of occupational health and safety for The hospital is a health service that contained risks of occupational health and safety for its medical personnel, so the need for hospital occupational health and safety (K3RS) project to avoid those risks. An organization such as committee needed to ensure optimal K3RS management. This research formulation of the problem are the legal responsibility of the hospital to the medical personnel for K3 due to medical services in the hospital and the legal consequence of the absence of the K3RS Committee. This reasearch used normative juridical with statue approach and conseptual approach. The result showed that the hospital is responsible for problems in the scope of K3RS, responsibility related to the obligations set by the government and legal responsibility in carrying out the regulations. The result was, if the hospital did not formed an K3RS committee, they have to be legally responsible, for both criminal and civil law. Since hospital held responsibility to form a K3RS committee. According to the regulation from Hospital Accreditation Committee (KARS), director of the hospital held the responbility to fulfill this requirement.

Abstract

The condition of the economic and health dilemma in handling covid-19 is due to regulations in the Indonesian legal system forcing the Government to choose to sacrifice one of them. However, the compromising legal politics carried out by the Government has a tendency to deviate from the applicable law. Therefore, a new legal policy is needed in handling the covid-19 pandemic outbreak, including the issuance of a PERPU as legitimacy to provide legal certainty for a number of policies carried out by the Government that deviate from the applicable laws and regulations. The research method in this article is normative juridical. The issuance of PERPU is the most appropriate legal policy to overcome problems related to the covid-19 pandemic which is trapped between economic and health dilemmas.

Abstract

Human rights are rights that must be upheld, guaranteed and protected by law, the state, the government and other human beings. It cannot be reduced, revoked, or even eliminated, because these rights are inherent in humans from the moment they were created (baby in the womb). Cases of human rights violations in the world are so rife in various countries, even rarely that countries do not violate human rights. So it is necessary to make an improvement effort in protecting and guaranteeing human rights. This study aims to provide a complete understanding of human rights through normative juridical research methods with a statutory, comparative, and historical approach. From this research, it is found that there are visible differences ranging from the definition of human rights, mechanisms for resolving human rights violations, to institutions for resolving human rights violations both in international of law and national of law in Indonesia.

Abstract

The existence of indigenous peoples has been recognized and respected by the Constitution. The Wetu Telu indigenous people have traditions from their ancestors with Islamic nuances and their existence is recognized until now. Besides, the local government's strategy to develop the tourism sector to improve the economy and regional development which is designed in regional regulations can affect the existence of Indigenous people. The purpose of this research is to know the changes in the existence of the Wetu Telu community customary law and to know the implementation of Regional Regulations in the tourism sector in Bayan village, North Lombok Regency, West Nusa Tenggara. This research uses juridical empirical or socio-legal research, which is a type of sociological legal research or field research that examines applicable legal provisions. Cultural preservation and tourism development need a Regional Regulation on the Recognition and Protection of Indigenous Peoples to protect normatively and with legal certainty and harmonize Regional Regulations between tourism development and recognition of indigenous peoples.

Abstract

The application of criminal law that was originally as an effort / last way (Ultimum Remedium)became the first effort/way (Primum Remedium)especially in applying Law No. 11 of 2008 as amended by Law No. 19 of 2016 on Information and Electronic Transactions (UUITE) In this research using a type of normative legal research using statue approach, conceptual approach, and case approach. This study aims to find out how the application of ultimum remedial  principle in the study of criminal law, How to reconstruct the criminal policy of the use of Law No. 11 of 2008 on amendments to Law No. 19 of 2016 on ITE. Surely this requires the existence of over criminalization on the application of criminalization that ensures the existence of disharmony in the application of criminal law, which negates the sense of humanity.

Abstract

The Actions of the Board of Directors are legally qualified as the actions of the Company as a legal entity if carried out by the authority and objectives of the Company as stated in the company's articles of association. The actions of directors that are carried out outside the authority or beyond the authority(ultra vires)cannot be qualified as the actions of the company. As a result, such legal action is not binding on the Company and only binds the Board of Directors personally with third parties. The problems examined are the limits of authority of the Board of Directors according to the UUPT and the doctrine and concept of ultra vires directors. Types of normative juridical research with conceptual approach and statute approach. The actions of the board of directors as long as it is carried out within the limits of the authority granted by the law and the articles of association of PT(intra vires)are legally viewed as the actions of PT as a legal entity. Actions of the Board of Directors that are carried out outside the authority or exceed their authority as stipulated in the laws and articles of association of PT(ultra vires)the Board of Directors must be personally responsible with third parties.

Abstract

Indonesia has designated the Covid-19 pandemic as a disease that causes a public health emergency and the government has issued several regulations requiring people to work from home. This research covers two main problems  First, how is the validity of notary deeds made by the cyber notary system? Second, what is the urgency of implementing a cyber notary system amid the Covid-19 pandemic? This writing uses normative juridical research. Notary deeds made by cyber notary have the power of proof as underhand deeds. The importance of implementing cyber notary amid a pandemic is strengthened one of which is the Minister of Health Regulation Number 9 of 2020 and Government Regulation Number 21 of 2020 which requires closing the office sector and working from home to break the line of the spread of the coronavirus in Indonesia.
