Abstract

Kredit yang dikelola dengan prinsip kehati-hatian akan menempatkan pada kualitas yang Performing Loan sehingga dapat memberikan pendapatan yang besar bagi Bank. Pendapatan yang diperoleh dari kegiatan perkreditan berupa selisih antara biaya dana dengan pendapatan bunga yang dibayar para pemohon kredit. Aspek hukum merupakan salah satu aspek yang sangat penting dalam setiap transaksi apapun termasuk pemberian kredit yang merupakan perbuatan hukum perjanjian sehingga setiap analis dan pejabat pengelolaan kredit harus dibekali dengan pengetahuan hukum yang berkaitan dengan pemberian kredit tersebut. Meskipun aspek-aspek lainnya diluar hukum telah memenuhi syarat tetapi kalau aspek hukumnya tidak memenuhi syarat atau tidak sah maka semua ikatan perjanjian dalam pemberian kredit dapat gugur sehingga akan menyulitkan Bank untuk menarik kembali kredit yang telah diberikan. Tujuan penelitian ini adalah untuk mengetahui tindakan hukum yang dilakukan oleh bank dalam penyelamatan kredit yang diberikan kepada debitur, kedua, bagaimana upaya Bank menyelesaikan kredit bermasalah yang dilakukan oleh nasabah debiturnya. Metode Penelitian ini merupakan penelitian yuridis normatif yang didukung oleh penelitian empiris, dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual, yaitu analisis normatif memperlihatkan bahwa tindakan hukum didasarkan pada asas-asas dan norma-norma hukum yang berlaku, sedangkan pendekatan konseptual menyangkut upaya penyelesaian kredit bermasalah. Berdasarkan hasil pembahasan, bahwa tindakan hukum penyelamatan kredit bermasalah antara lain: melalui perundingan kembali antara Kreditur dan Debitur atau dengan istilah lain disebut restrukturisasi, dengan langkah-langkah seperti : penurunan suku bunga kredit, pengurangan tunggakan bunga kredit, pengurangan tunggakan pokok kredit dan perpanjangan jangka waktu kredit. Ada tiga model penyelesaian kredit bermasalah yang dapat dilakukan oleh pihak Bank yaitu sebagai berikut: 1). Penyelesaian secara damai, yang dilakukan terhadap debitur yang masih mempunyai itikad baik (kooperatif) untuk menyelesaikan kewajibannya: 2). Penyelesaian melalui saluran hukum atau melalui bantuan pihak ketiga antara lain: a) Penyelesaian kredit melalui Pengadilan Negeri; b) Pengurusan piutang macet melalui Kantor Pelayanan Kekayaan Negara dan Lelang, dan c). Penyelesaian Kredit Melalui Pengadilan Niaga Dilakukan sesuai dengan ketentuan yang berlaku.

Abstract

Perjanjian perkawinan atau perjanjian pranikah yang diumumkan Notaris melalui media cetak merupakan pelanggaran kode etik Notaris, karena Notaris merupakan pejabat umum membuat akta otentik dibutuhkan masyarakat. Diperlukan tanggung jawab terhadap jabatannya, sehingga diperlukan lembaga kenotariatan mengatur perilaku profesi Notaris. Pada hakekatnya Kode Etik Notaris merupakan penjabaran lebih lanjut Undang-Undang Nomor 2 Tahun 2014 Tentang Jabatan Notaris, mengingat Notaris dalam melaksanakan jabatannya tunduk dan mentaati ketentuan Undang-Undang mengatur jabatannya, termasuk wajib menerapkan prinsip tata kelola perusahaan baik dengan menerapkan prinsip pengelolaan lingkungan hidup seperti diatur dalam Undang-Undang Nomor 32 Tahun 2009 tentang perlindungan dan pengelolaan lingkungan hidup. Tujuan penelitian ini adalah untuk mengetahui Apakah perjanjian perkawinan yang diumumkan oleh Notaris melalui media cetak merupakan pelanggaran kode etik seorang Notaris. Metode yang di gunakan dalam penelitian ini adalah metode penelitian adalah cara-cara berpikir dan berbuat, yang dipersiapkan dengan baik untuk mengadakan penelitian dan guna mencapai tujuan. Berdasarkan hasil penelitian hukum perjanjian perkawinan yang diumumkan melalui media cetak oleh Notaris merupakan perbuatan melanggar kode etik Notaris yang diatur dalam Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris, tercantum dalam kode etik organisasi Ikatan Notaris Indonesia (INI) merupakan satu-satunya organisasi Notaris berbadan hukum sesuai Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris. Artinya seluruh Notaris wajib tunduk kepada Kode Etik Notaris, adapun sanksi dijatuhkan Organisasi Ikatan Notaris Indonesia terhadap Notaris melanggar kode etik berupa : teguran, peringatan, schorshing (pemberhentian sementara), dan Onzetfing (pemecatan) yang ditugaskan Dewan Pengawas Notaris untuk menegakkan sanksi.

Abstract

Phenomena that often occur in decision making or policies which of course are based on applicable regulations or agreements are confiscation or taking guarantees or otherwise the submission of guarantees by the debtor due to a default or unable to carry out their obligations properly. As many have done, it can be seen from the data in PT. Adira Dinamika Multi Finance Tbk, Denpasar II Branch. Based on this background, the formulation of the problem found is how is the form of dispute resolution regarding the fiduciary agreement in the settlement of default at PT. Adira Dinamika Multi Finance Tbk, Denpasar II Branch, and What are the obstacles faced in the execution of fiduciary guarantees at PT. Adira Dinamika Multi Finance Tbk, Denpasar II Branch?This type of research uses empirical legal research methods. The nature of this research is descriptive. Data and Data Sources used are primary data and secondary data. Data collection techniques used are observations, interviews and documentation. After the data is collected, it is analyzed using qualitative analysis methods. The conclusion of this research is the form of dispute resolution at PT. Adira Dinamika Multi Finance Tbk, Denpasar II Branch is divided into 2 stages, namely non-litigation efforts and litigation efforts. Constraints faced in the execution of fiduciary collateral goods at PT. Adira Dinamika Multi Finance Tbk, Denpasar II Branch is in executing the goods that have been transferred by the debtor of the goods. but as a result of the acknowledgment of the droit de suite principle that fiduciary security rights follow the object in the hands of whoever the object is.

Abstract

Penelitian ini akan menguraikan mengenai bentuk pengakuan hukum nelayan tradisional Indonesia dalam menangkap ikan secara tradisional di bawah Hukum Internasional. Dalam perjanjian internasional telah disepakati bersama bahwa adanya jaminan hak serta kewajiban terhadap negara pantai dalam pengelolaan wilayah laut beserta isi di dalamnya. Hal tersebut mencangkup hak kepada nelayan tradisional dalam mengelola hasil laut. Sehingga nelayan tradisional diberikan hak untuk dapat mengambil kekayaan laut seperti ikan secara tradisional tanpa adanya larangan dengan bentuk apapun. Namun demikian hal tersebut nampak berbeda pada Kawasan Ashmore Reef. Beberapa kasus menunjukkan adanya diskriminasi dan larangan terhadap nelayan tradisional Indonesia untuk dapat menangkap ikan di wilayah tersebut. Tujua dalam penelitian ini adalah untuk mengetaui hak penangkapan ikan tradisional nelayan indonesia di kawasan ashmore reef. Metode yang digunakan dalam Penelitian ini adalah menggunakan metode penelitian hukum normative deskriptif. Berdasarkan hasil penelitian yang didapatkan menunjukkan bahwa Australia dan Indonesia merupakan negara yang sama-sama mengakui perjanjian internasional dan sama-sama menyepakati MoU Box 1974. Klaim Australia terhadap kawasan konservasi di Ashmore Reef memberikan pengaruh terhadap kesepakatan atas hak nelayan tradisional.

Abstract

Dibentuk pada Tahun 1999 lalu yang membawa tujuan mulia dan bersahabat bagi antar negara anggota untuk mewujudkan stabilitas perekonomian internasional. G20 mengadakan KTT pertamanya pada November 2008 guna membahas krisis keuangan global yg merupakan dampak dari krisis keuangan di AS pada masa itu. Pertemuan rutin yang diadakan setiap tahun ini memiliki tuan rumah atau Presidensi yang ditentukan secara konsensus yang akan bergiliran setiap tahunnya. Tahun 2022 ini adalah kesempatan milik Indonesia. Negara-negara dalam G20 adalah negara yang punya peranan besar dalam perekonomian. Negara-negara dimaksud diantaranya adalah Argentina, Australia, Brazil, Kanada, Cina, Uni Eropa, Jerman, Prancis, India, Indonesia, Italia, Jepang, Meksiko, Rusia, Arab Saudi, Afrika Selatan, Korea Selatan, Turki, Britania Raya/Inggris, Amerika Serikat. Tujuan dalam penelitian ini adalah untuk mengetahui Bagaimanakah sistem lalu lintas devisa dan sistem nilai tukar di Indonesia dalam mendukung Indonesia menarik penanam modal asing. Metode penelitian ini adalah metode penelitian yuridis normatif yaitu dalam penelitian hukum ini, hukum dikonsepkan sebagai apa yang ditulis dalam peraturan perundang-undangan (law in books) atau hukum dikonsepkan sebagai kaidah atau norma yang merupakan patokan berperilaku manusia yang dianggap pantas. Berdasarkan hasil penelitian dahulu G20 telah membahas mengenai isu bangkitnya dari krisis global. Kini perkembangan dan kemajuan iptek telah membuat perubahan signifikan khususnya di jalur lalu lintas devisa. Telah tercipta dunia tanpa batas negara atau disebut sebagai dunia digital. Segala perubahan tentunya membawa pengaruh buruk dan baik sekaligus. Maka penting untuk mengkaji, meneliti dan menganalisis Optimalisasi model kebijakan yang seharusnya dibentuk dalam pertemuan ini agar sesuai dengan kebutuhan dan perkembangan masyarakat global dan mengkaji, meneliti dan menganalisis langkah preventif untuk dapat mencegah kerugian negara akibat adanya lalu lintas devisa yang crossborderless.

Abstract

LPD as an institution that has the authority to collect public funds for the welfare of traditional villages has many problems today. The root of the problem can be seen from: 1). The void of norms that explains LPD as a legal entity within the framework of legal norms but has operated like other financial institutions; 2). The lack of clarity in the supervision of the LPD has resulted in many problems and even cases of corruption. This void of legal norms creates doubts from the perspective of criminal law with customary law because the LPD is predicted to be an institution belonging to the traditional village but the traditional village does not have adequate tools to solve the problems that exist within the LPD, privately or publicly. Meanwhile, from a criminal law perspective, the Prosecutors and Police consider that the misappropriation of funds by the LPD is a criminal act of corruption and both cannot provide a solution to the problems desired by the community. This paper was written with the aim of providing a new understanding in legal standing of the LPD using the legal construction reasoning method in order to strengthen the status of the LPD as an institution under the customary village using the main legal sources where the expected result is that armed with an understanding of the legal construction, it can be used as a reference for traditional practitioners and law enforcers will be able to formulate good problem solving and fulfill a sense of justice in society. The method used for this research is normative legal research with primary, secondary and tertiary legal materials where what is being researched is to answer the void of norms in the LPD’s position as legal subjects where with clear LPD legal standing there will be a legal discovery to make it easier for the government to formulate regulations.from the authority, supervision and law that is applied in the event of a legal problem.

Abstract

Notary Deed Signing is not in the notary’s office, even though the act is at risk of violating the rules of the notary position law and notary code of ethics, but it is still carried out by certain notaries. This type of research is normative legal research. With normative juridical methods. Legal materials consist of primary, secondary and tertiary legal materials. The analysis method uses the description technique, construction technique, and systematic technique. The validity of a deed not signed before a notary, the deed is only valid as an agreement, where a valid agreement is an agreement that has fulfilled the legal requirements of an agreement such as an agreement, the ability of the parties, the object of the agreement, and the agreement made is not contrary to the law applicable. The validity of the deed is invalid, because in signing the deed that was not performed before a notary, the authentic deed did not fulfill the formal requirements to become an authentic deed as regulated in Article 16 paragraph (1) letter m of Law Number 2 of 2014 concerning Amendment to the Law Number 30 of 2004 concerning Notary Position. Where in this provision that the Notary must be physically present and sign the deed in front of the parties, witnesses, and the Notary himself. Notary Deed that is not signed by the registrar before a notary public and signed outside the Notary’s office, even though on the grounds that one of the registrants cannot be present at the signing of the deed by the tappers, and witnessed by witnesses and Notaries, resulting in the degradation of the authentic deed becomes the only deed has a proof of deed under the deed. In Act Number 2 of 2014 concerning amendments to Act Number 30 of 2004 concerning Notary Position, no regulation is found concerning sanctions against Notaries that are significant for violations of Article 16 paragraph (1) letter m of Act Number 2 of 2014 concerning amendments to Law Number 30 of 2004 concerning Notary Position.

Abstract

Cases of abuse of residence permits committed by foreign nationals are motivated by very easy access to come and go from Indonesian territory. Cases of abuse of residence permits can have a negative impact on the emergence of security threats such as drug smuggling, terrorism and human trafficking. The Immigration as the gatekeeper for the entry and exit of foreign nationals has a strategic role in preventing and taking action against the practice of abusing residence permits. This research will explain about the role of Immigration, especially the Special Class I Border Control Immigration Office Surabaya in handling abuse of residence permits in the Surabaya area. This case study research uses a qualitative approach with primary data sources from interviews and studies of state documents as well as secondary data from articles and journal. The findings obtained indicate the role of Immigration, especially the Special Class I Border Control Immigration Office Surabaya in terms of prevention through supervision and the establishment of a Foreigner Monitoring Team. Meanwhile, prosecution of violators is carried out through administrative, criminal, detention, and projustia measures.

Abstract

Indonesia occupies the position of a country with a high corruption rate. This is shown by the increase in the corruption perspective index which will increase in 2022 to 43 points. In order to reduce the number of corruptions, policy makers provide a serious threat to corruption cases in Law Number 31 of 1999 on Corruption Crimes. Among the criminal threats imposed, the death penalty is one of the considerations as an appropriate method of punishment for massive corruption cases. The death penalty is expected to reduce the number of corruption crimes in Indonesia. Normative juridical research methods are used in this research to review legislation, research journals, and news relating to corruption and the death penalty. The research results obtained are that the death penalty is not solutive threat to reduce corruption in Indonesia.

In the process of buying and selling a house, there is a notary's role in fulfilling the necessary documents, in line with his role and also his authority to make a real deed there are also responsibilities and legal consequences if there are mistakes that violate the law or to the detriment of the parties involved in terms of This is especially related to publishing or making cover notes. Based on this, the authors put forward the formulation of the problem, namely, first, what are the legal responsibilities of a notary in issuing cover notes related to buying and selling houses? and secondly, what are the legal consequences if the notary does not include the cover note at the time of signing the sale and purchase of the house? This research is an empirical research with the sources and types of data used, namely library data sources and field data sources, as well as the types of data used consisting of primary and secondary data, while the data collection technique was carried out by means of documentation studies from literature materials and interviews. to informants, and data analysis was analyzed discretely and qualitatively by compiling the data obtained. The results of this study indicate that the legal responsibility of a notary in issuing a cover note relating to the sale and purchase of a house is to issue a cover note on the authority of a notary according to UUJN (article 15). Make authentic deeds regarding all actions, agreements, and provisions required by laws and regulations and/or which are desired by interested parties, to be stated in an authentic deed, guarantee the certainty of the date of making the deed, save the deed, provide grosse, copies and quotations of the deed, all as long as The making of the deed is not assigned or excluded to officials or other people determined by law.
