Abstract

Abstract: Gross human rights violations, such as genocide, crimes against humanity, and war crimes, constitute serious challenges in international law. States have an obligation to prevent, punish, and provide reparations to victims of gross human rights violations in accordance with international legal instruments such as the Geneva Conventions and the Rome Statute. However, challenges such as impunity for state officials, the limitations of the International Criminal Court (ICC) jurisdiction, and international political influence hinder the enforcement of justice. This study uses a qualitative descriptive method to analyze the state's efforts in fulfilling its responsibilities related to gross human rights violations. The results show that despite the continued development of international efforts, significant obstacles remain, including political protection of perpetrators and the limitations of the ICC's jurisdiction. Therefore, increased international cooperation is needed to ensure justice for victims and accountability for perpetrators of gross human rights violations.Keywords: Gross human rights violations, State responsibility, International Criminal Court.

Abstract

Mediation is one way for parties to resolve disputes amicably. The advantage of mediation is that if the parties can reach an agreement, the dispute is considered resolved so that it does not require a follow-up trial which of course will require a long time and costs a lot of money. Judge at Sorong District Court in resolving civil lawsuits in accordance with Perma No. 1 of 2016, recommends the parties to discuss through mediation, some are successful but most are unsuccessful. The purpose of this writing is to find out the resolution of civil disputes through mediation at the Sorong Class IB District Court and to find out the obstacles in resolving civil disputes through mediation at the Sorong Class IB District Court.The method used in this research is, the type of research is normative empirical, the type and source of data used is primary and secondary data, data collection techniques are through literature study, interviews and documentation and the data analysis technique used is descriptive qualitative.The results of the research are, Settlement of civil disputes through mediation at the Sorong Class IB District Court, as is done in other district courts, which follows PERMA No. 1 of 2016. Even though there are many lawsuits, there is little possibility of mediation between the parties, but in accordance with existing regulations, the judge at the beginning of the trial always gives the parties the opportunity to discuss and resolve obstacles in resolving civil disputes through mediation at the Class IB District Court. Abstract

Abstract: Puskesmas Simpang IV Sipin is one of the health centers with the highest cases of diabetes in Jambi City. The purpose of the study was to determine the factors associated with the utilization of the chronic disease management program (prolanis) in patients with diabetes mellitus. This type of research uses quantitative research with a cross sectional design. The research was conducted in July-August 2023 at the Simpang IV Sipin Health Center. The sample amounted to 77 respondents. The sampling technique used non-probability using purposive sampling technique. The research instrument used a research questionnaire. Data analysis was performed univariate and bivariate. The results showed that there was a relationship between family support (p value: 0.019) and health worker support (p value: 0.007) on prolanis utilization. It is recommended that the community can find information about DM disease and Prolanis, as well as establish communication with officers regarding the implementation of chronic disease programs so that they can take more advantage of Prolanis to keep their health under control to prevent complications from continuing.Keywords: Family support, Diebetes Mellitus, Prolanis.

Abstract

Abstract: This study examines the practice of the Omnibus Law in the formation of health legislation in Indonesia. The research questions posed are how the Omnibus Law is implemented in Indonesia and its impact on the health sector. The research method used is normative juridical, focusing on the analysis of legislation, official documents, and related legal literature. The findings show that the implementation of the Omnibus Law in Indonesia aims to simplify and expedite the legislative process by consolidating various regulations into a single law. However, in the health sector context, the implementation of the Omnibus Law has various impacts, both positive and negative. Positive impacts include increased efficiency and consistency in health regulations. On the other hand, there are concerns that the rapid and centralized legislative process may overlook public participation and reduce the quality of health policies. This study concludes that although the Omnibus Law has the potential to enhance legislative effectiveness, adequate oversight mechanisms and public participation are necessary to ensure that the resulting health policies truly benefit the public..Keywords: Omnibus Law, Health Legislatio, Public Participation, Regulatory Efficiency.

Abstract

Abstract: Financing institutions are one form of business in the field of non-bank financial institutions. The activities of this financing institution are carried out in the form of providing funds or capital goods without directly withdrawing funds from the public. One form of financing institution in Indonesia is Venture Capital. Venture capital is directed to help small businesses that are experiencing capital difficulties in their business activities or small businesses in the process of growing their business scale. The purpose of this study is to find out about the concept of venture capital as a financing institution in Indonesia. The approach method used is the Juridical approach. The concept of venture capital is basically not the same as ordinary capital participation. Banks that carry out bad credit in other companies by converting it into equity participation are not venture capital, likewise ownership of a company's share capital through the capital market cannot be classified as a venture capital business. However, a bank that finances a company can use the concept of venture capital. Venture capital institutions in Indonesia currently still do not fully use the concept of pure venture capital as is done by venture capital companies abroad. The institutional structure of venture capital that exists at this time is not separated from the legal entity of the venture capital fund on the one hand with the management of venture capital on the other.Keywords: Concept, venture capital, financing institutions.

Abstract

This study aims to examine the influence of murabahah, mudharabah and musyarakah financing on the profitability of Sharia Commercial Banks in Indonesia in 2019-2023. Samples were taken using a purposive sampling method, totaling 10 companies. Based on the simultaneous test results Murabahah, Mudharabah and Musyarakah have a significant effect on Profitability. While partially Murabahah, Mudharabah and Musyarakah financing also have a significant effect on profitability. The contribution of the independent variable to the dependent variable is 54,7% and the remaining 45,3% is influenced by other variables not included in this research. Hypothesis testing was carried out using multiple linear regression using SPSS 25.

Abstract

Abstract: The incidence of low birth weight (LBW) is one of the most important health problems in the world. Nationally, LBW is still a significant problem and affects maternal and child health in various regions. Based on a preliminary survey conducted at RSUD Melawi, there were 6 LBW babies out of 10 mothers who gave birth which was related to the age of the mother. Based on the income aspect, there were 4 low-income mothers and 2 high-income mothers. The purpose of the study was to determine the correlation of demographic and economic aspects of the family with the incidence of Low Birth Weight Infants (LBW). The research design used in this study was case control. The study was conducted in January 2024 at the Melawi Regional General Hospital. The population was pregnant women who gave birth at the Melawi Regional General Hospital during January to December 2023 as many as 248 people. The sample amounted to 35 case respondents and 35 control respondents selected using accidental sampling. The research instrument used a research questionnaire. Data analysis was done univariate and bivariate. The results showed there was a relationship between maternal age (p value: 0.001) and no relationship between family economy (p value: 0.623) with the incidence of Low Birth Weight Infants (LBW). It is recommended for the hospital to improve the ability to handle pregnant women at risk so as to help smooth the delivery and for pregnant women to routinely visit to check their pregnancy in order to know how the development of the fetus in the womb.Keywords: Low Birth Weight Infants, Demographic Aspects, Family Economics.

Abstract

According to the Regulation of the Head of BPOM No. 23 of 2019 concerning Cosmetic Requirements Article 2, business actors are required to ensure that cosmetics produced for domestic distribution and/or imported for distribution in the territory of Indonesia meet the technical requirements of Cosmetic Ingredients. It is not uncommon for skincare entrepreneurs to not comply with the rules and regulations of the "Food and Drug Supervisory Agency (BPOM)." This study aims to investigate how law enforcement works against skincare businesses that violate BPOM regulations and their consequences for buyers and sellers. From the results of the research conducted by the author, the author obtained the formulation of the problem "Are there obstacles in the SKINCARE business that does not comply with BPOM in Indonesia?" and "are there obstacles in the skincare business that does not comply with BPOM in Indonesia? 'so that this study is expected to produce views and knowledge for consumers and business actors in increasing knowledge and compliance in the skincare manufacturing industry, especially in terms of compliance with applicable laws. The method used is a normative method using a "statutory approach" by reviewing and understanding the relevant literature. The results show that efficient law enforcement not only maintains consumer health, but also encourages business actors to comply with applicable parameters.Keywords: Law Enforcement, Busines Actors, Skincare, BPOM

Abstract

Abstract: The elimination of the pure non-residential function of apartment buildings in Apartments Law creates legal uncertainty, leading to issues in certifying the rights of non-residential apartment units, including their legal entity status. The method used is normative, employing secondary data analyzed descriptively with conclusions drawn qualitatively. The legislative gap caused by lawmakers' oversight has led to uncertainty and a lack of legal protection for non-residential apartment buildings without any corrective measures from lawmakers. Consequently, this paper highlights the lawmakers' lack of engagement with stakeholders and apartment building experts, resulting in a focus on residential and mixed-use functions, overlooking the legal reality of pure non-residential apartment buildings that have existed since 1985.Keywords: Legal Status, Apartment, Non-Residential

Abstract

Abstract: To ensure that AI technology is used in a way that is beneficial and does not harm society, this study aims to investigate the need for Indonesia to establish an Artificial Intelligence (AI) Ethics Commission. The main issue raised in this study is whether Indonesia needs to immediately establish an AI Ethics Commission. The methodology used is normative research with descriptive analysis, and secondary data is collected from various legal sources and related literature. Based on the research findings, an ethics commission is very important to monitor and enforce the AI code of ethics in accordance with the regulations of the National Science and Technology System Law (UU IPTEK). In short, the establishment of an Artificial Intelligence Ethics Commission will encourage the ethical use of AI and reduce the possibility of misuse of technology. The establishment of this commission is suggested by this study as a calculated step to support moral standards in the use of AI in Indonesia.Keywords: Urgency, Ethics Commission, Artificial Intelligence
