Abstract

The provision of medical information (informed consent) is a mandatory duty of physicians that is frequently misdelegated to nurses or midwives, thereby increasing the risk of medical errors and malpractice. Objective: This study aims to analyze the legal framework governing medical explanations and identify the forms of legal liability arising from errors in this process under Indonesian regulations. Method: This study employs a normative legal research method with a statute approach and a conceptual approach. Results: The findings indicate that based on Article 293 of Law No. 17 of 2023 concerning Health juncto Minister of Health Regulation No. 290/2008, medical explanations must be delivered directly by the attending physician. Delegation to other healthcare professionals is only legally valid if it adheres to Standard Operating Procedures (SOPs) and remains under the physician's supervision. Errors or defects in fulfilling informed consent due to negligent information transfer can trigger three cumulative clusters of legal liability: administrative sanctions, civil liability based on breach of contract or torts, and criminal liability under Article 440 of the Health Law if negligence results in severe injury or death.

Abstract

This research examines the shift in legal culture among workers in Indonesia as a result of the implementation of the Job Loss Insurance Program (JKP) under Government Regulation Number 37 of 2021. Applying Lawrence M. Friedman's legal system theory encompassing three components of legal substance, legal structure, and legal culture, this study quantitatively analyzes changes in workers' legal behavior by comparing data before and after the JKP implementation. Data reveals that the JKP claim ratio against total layoff cases increased dramatically from 40.85% in 2022 (first year of implementation) to 84.20% in 2023, and 89.83% in the January-May 2024 period. The number of active JKP participants grew from 12.56 million (2022) to 16.47 million (April 2025). Benefits paid surged from IDR 44.38 billion (2022) to IDR 366.58 billion (2023). These empirical data reflect a significant shift from passive and paternalistic legal culture toward an active, rights-aware, and participatory legal culture among Indonesian workers. The study concludes that the JKP program has succeeded in driving external legal culture transformation, although implementation gaps remain, particularly regarding structural barriers for fixed-term contract workers and informal sector workers.

Abstract

The governance of music royalties in Indonesia has reached a critical juncture due to ongoing tensions among songwriters, performers, and Collective Management Organizations (CMOs/LMKN). This study aims to analyze the legal standing of direct licensing practices undertaken by songwriters who remain affiliated with Collective Management Organizations under Law Number 28 of 2014 concerning Copyright (Copyright Law), and to examine the legality of such independent royalty collection through the perspectives of John Locke’s Property Rights Theory and Jeremy Bentham’s Utilitarian Theory. Employing a normative legal research method through statutory, conceptual, and comparative approaches, this study finds that the legal position of independent direct licensing by songwriters bound to CMOs is contractually weak. Nevertheless, recent jurisprudential developments through Supreme Court Decision Number 825 K/Pdt.Sus-HKI/2025 and Constitutional Court Decision Number 28/PUU-XXIII/2025 have reaffirmed the reallocation of responsibility for the payment of royalties arising from commercial performances from performers (singers) to event organizers (promoters), while also requiring the application of restorative justice prior to the imposition of criminal sanctions. From a theoretical perspective, direct licensing is justified under Locke’s Property Rights Theory as a form of self-help remedy aimed at restoring individual rights in response to the malfunctioning of the collective management system. However, it is rejected under Bentham’s Utilitarian Theory in the long term because it undermines market efficiency and significantly increases transaction costs. This study recommends the adoption of a hybrid licensing system and the implementation of a transparent and digitally integrated SILM platform.

Abstract

This study aims to analyze the authority of customary institutions and traditional leaders in Sausu Peore Village, Parigi Moutong Regency, in the implementation of polygamous marriages under Balinese customary law and its relationship with Indonesian national law. This research employed an empirical juridical method using statutory and socio-legal approaches. Primary data were collected through interviews with customary leaders and representatives of the Indonesian Hindu Council (Parisada Hindu Dharma Indonesia/PHDI), while secondary data were obtained from legislation, books, and scientific journals. The findings reveal that customary leaders have the authority to validate the implementation of polygamous marriages based on Balinese customary law by ensuring compliance with Hindu religious teachings, obtaining the consent of the parties involved, and conducting the required customary ceremonies. Customary institutions are also authorized to regulate marriage procedures, provide guidance, and reprimand or reject marriage ceremonies that do not comply with customary and religious requirements. Nevertheless, the implementation of polygamous marriages must also fulfill the legal requirements stipulated in Law Number 1 of 1974 on Marriage to obtain recognition under national law. Therefore, the authority of customary institutions serves as a complementary mechanism to national law by regulating the social, cultural, and religious aspects of marriage within the Balinese customary community in Sausu Peore Village.

Abstract

This study aims to examine the implementation of the Bhabinkamtibmas function in problem solving within the jurisdiction of the Meranti Islands Police Resort (Polres Kepulauan Meranti), the obstacles encountered, and the efforts made to overcome those obstacles. Bhabinkamtibmas plays a significant role as the frontline of the Indonesian National Police in maintaining public security and order through partnership approaches, community development, and the preventive and restorative resolution of social problems within society. This research employs a sociological legal research method with an empirical approach. Data were collected through interviews, observations, and literature studies. The research was conducted at the Meranti Islands Police Resort. Data were analyzed qualitatively and conclusions were drawn deductively. The results indicate that the implementation of the Bhabinkamtibmas function in problem solving at Polres Kepulauan Meranti has been carried out through mediation, deliberation, and facilitation of the settlement of social conflicts and minor criminal cases occurring in the community. The implementation of this function has contributed to maintaining public security and order while reducing the potential for conflicts to proceed to formal judicial processes. Nevertheless, several obstacles remain, including the limited number of Bhabinkamtibmas personnel compared to the size of their assigned areas, the low level of public understanding regarding problem-solving mechanisms, and inadequate supporting facilities and infrastructure. Efforts to address these challenges include increasing public awareness and socialization programs, strengthening coordination with village governments and community leaders, and enhancing personnel capacity through education and training.

Abstract

Forest burning is an environmental crime that causes significant damage to ecosystems, public health, and the economy. Within the jurisdiction of the Rokan Hilir Regional Police, forest burning continues to occur despite being prohibited and subject to criminal sanctions under several Indonesian laws, including Law Number 32 of 2009 on Environmental Protection and Management as amended by Law Number 6 of 2023, Law Number 41 of 1999 on Forestry, and Law Number 1 of 2023 concerning the Criminal Code. This study aims to analyze the criminal law enforcement against forest burning offenders within the jurisdiction of the Rokan Hilir Regional Police, identify the factors hindering law enforcement, and formulate efforts to optimize criminal law enforcement against such environmental crimes This research employs a sociological legal research method with a descriptive-analytical approach. Data were collected through interviews with law enforcement officers at the Rokan Hilir Regional Police and literature studies of statutory regulations, legal literature, and other supporting documents. The collected data were analyzed qualitatively and presented descriptively. The results indicate that criminal law enforcement against forest burning in the jurisdiction of the Rokan Hilir Regional Police has been carried out through investigation, inquiry, arrest, detention, and prosecution processes. However, its implementation has not yet been fully effective due to several obstacles, including difficulties in proving the perpetrators' involvement, the vast area affected by forest fires, limited personnel and infrastructure, challenging geographical conditions, low public legal awareness, and economic factors encouraging land clearing by burning. Efforts to optimize law enforcement include strengthening integrated patrols, enhancing inter-agency coordination, utilizing hotspot monitoring technology, conducting legal awareness campaigns for local communities, and consistently imposing criminal sanctions on offenders in accordance with applicable laws and regulations.

Abstract

Pada proses hukum yang dilakukan oleh para penyidik dan penuntut umum dalam suatu perkara banyak terjadi kesalahan-kesalahan yang dilakukan terutama dalam tindakan upaya paksa yang dapat merugikan setiap orang yang menjadi korban dari tindakan penyidik dan penuntut umum, sehingga hak asasi manusia tidak dapat terwujud. Penelitian ini bertujuan untuk mengetahui Perlindungan Ham Dalam Bingkai Praperadilan Pada Sistem Peradilan Pidana Di Indonesia. Metode penelitian yang digunakan yakni penelitian hukum normative dengan pendekatan perundang-undangan, konseptuan dan perbandingan. Temuan dalam penelitian ini menunjukan bahwa dengan adanya KUHAP yang baru yang mengedepankan due process of law serta memberikan ruang dengan adanya langkah hukum melalui praperadilan yang dapat di tempuh untuk mendapatkan kepatian, kemanfaatan dan keadilan hukum di Pengadilan. Sehingga kesewenang-wenangan para aparat penegak hukum dalam tindakan hukum pada upaya paksa dapat di hentikan melalui putusan Praperadilan di Pengadilan.

Abstract

Legal compliance and Good Corporate Governance (GCG) represents sound corporate principles that must be applied in company management, solely to safeguard the company's interests in pursuit of its aims and objectives. These sound principles entail a balanced relationship among corporate organs, shareholders, and stakeholders; a clear division of duties, authority, and responsibilities among corporate organs in accordance with the company's structure; and operational mechanisms aligned with the Limited Liability Company Law and the company's Articles of Association—all implementing GCG based on the principles of transparency, fairness, and accountability. This study employs doctrinal legal research. The concrete application of GCG principles aims to benefit the company by: first, facilitating access to domestic and foreign investment; second, securing a lower cost of capital; third, enabling better decision-making to enhance economic performance; fourth, boosting stakeholder confidence and trust in the company; and fifth, protecting the board of directors and board of commissioners from legal claims. Factors such as patrimonialism, family capitalism, and crony capitalism must be carefully considered regarding the implementation of GCG in Indonesia. These obstacles can impact independence, monitoring, control, and operational mechanisms, ultimately affecting the company's performance.

Abstract

The relationship between legal philosophy and human rights is fundamentally rooted in fundamental questions regarding the source of legitimacy of legal norms. Legal philosophy, particularly natural law and legal positivism, plays a significant role in determining the concept of justice that underlies human rights protection. This paper employs normative legal research. The implementation of human rights values has not demonstrated sufficient consistency. The gap between norms and practice remains apparent, particularly in the resolution of cases of gross human rights violations that have yet to achieve legal clarity. Considering these challenges, this study recommends a reorientation of human rights policy through regulatory harmonization, revisions to rules that potentially limit civil liberties, and strengthening state accountability mechanisms in all cases of violation. These steps are expected to establish a system that not only recognizes human rights declaratively but also ensures the actual fulfillment of these rights in people's daily lives.

Abstract

Economic globalization and market liberalization not only open up space for business growth, but also give birth to new forms of crime in the economic sector. In international practice, the recognition of corporations as subjects of criminal law has been going on for a long time: in the United States. Indonesia began to recognize corporations as perpetrators of criminal acts since the Emergency Law of 1951 and especially Law No. 7 Drt 1955 concerning Economic Crimes. However, in law enforcement practices, especially in the old Criminal Code (KUHP) regime, perpetrators of criminal acts still focus on individuals. This often causes problems in the preparation of indictments when criminal acts involve corporations. The research method used in this study is normative. The research findings show that the most fundamental change in the legal policy of corporate crime in Indonesia is the transition from the old Criminal Code (KUHP), which did not recognize corporations as legal subjects, to the new Criminal Code (Law No. 1 of 2023), which explicitly establishes corporations as perpetrators of criminal acts. Thus, the New Criminal Code can be seen not merely as a replacement for the Old Criminal Code, but as an important milestone in the renewal of the national criminal law system that is progressive, adaptive, fair, and relevant to current and future global challenges. The success of this transformation depends heavily on careful implementation, the preparation of comprehensive implementing regulations, and ongoing supervision.
