Abstract

The transformation of health law through Law Number 17 of 2023 has introduced a radical shift by implementing a lifetime Registration Certificate (STR). This change fundamentally shifts the weight of competency oversight from professional organizations to the government and healthcare facilities. This research aims to analyze the legal accountability mechanisms of hospitals in periodically verifying the competence of medical personnel, as well as the limits of corporate liability in cases of malpractice by doctors whose competencies are outdated. The research method used is normative juridical with statutory and conceptual approaches. The results indicate that in the era of the lifetime STR, competency verification now relies on the Practice License (SIP) renewal cycle via the SATUSEHAT platform and internal hospital re-credentialing mechanisms. Based on the doctrine of Corporate Negligence and Article 193 of Law No. 17 of 2023, hospitals bear systemic legal responsibility for failures in performing clinical oversight functions. Hospitals can no longer hide behind the status of doctors as independent partners if they are proven negligent in ensuring the technical skill updates of their medical staff.

Abstract

Motor vehicle theft crimes (curanmor) in the Surabaya region experienced a significant increase in 2025-2026, with crime patterns that are far more organized and clandestine. This research was conducted with the aim of analyzing legal gaps in addressing curanmor from both preventive and repressive aspects, as well as providing ideal formulations to strengthen the effectiveness of law enforcement in the jurisdiction of Polrestabes Surabaya. The research method used is normative juridical with a statutory approach (statute approach) and a conceptual approach (conceptual approach). The research findings indicate the existence of fundamental legal gaps, due to existing regulations (Criminal Code and Law No. 1 of 2023) being general in nature and curanmor not yet classified as an organized clandestine crime. In addition, there are normative gaps in the preventive aspect that regulate the relationship between the police and the community, which serves as the primary spearhead, by utilizing integrated monitoring technology through administrative recording of vehicle ownership in rural areas. Optimization of repressive efforts is also based on civilian informants as a bridge, equipped with techniques for purchasing stolen motorcycles. This strategy is expected to disrupt the economic chain of crime, which is the fundamental factor behind the proliferation of motor vehicle theft crimes in Surabaya.

Abstract

A Non-Disclosure Agreement (NDA) is an agreement between a company and an employee intended to protect all of the company’s confidential information from being disclosed to third parties, particularly companies engaged in the same line of business. A failure by either party to fulfill their agreed-upon obligations will result in a breach of contract that requires legal proof. The research methodology employed in this study utilizes a normative legal approach through a literature review, supplemented by the South Jakarta District Court decision No. 666/Pdt.G/2024/PN.JKT.SEL as a real-world case example regarding breach of a Non-Disclosure Agreement. This study aims to identify the process and challenges of proving breach of a Non-Disclosure Agreement and to determine the legal consequences that may arise from such a breach. The process of proving breach of contract is carried out by submitting evidence to the competent court. The legal consequences that may arise from a breach of a Non-Disclosure Agreement include reimbursement of costs, damages, and interest in accordance with the provisions of Article 1243 of the Civil Code, as well as the imposition of additional sanctions in the form of imprisonment for a maximum of 2 years and/or a fine of up to 300 million rupiah in accordance with the provisions of Article 17(1) of Law No. 30 of 2000 on Trade Secrets.

Abstract

The development of e-commerce transactions in Indonesia has provided significant convenience for people in conducting online buying and selling activities. However, on the other hand, various problems have emerged, one of which is the loss of goods during the delivery process, even when the goods have been insured.This study aims to analyze the forms of legal protection for consumers, the responsibilities of the parties involved, and the legal remedies that can be pursued in the event of an insurance claim rejection. The research method used is normative juridical legal research, employing both statutory and case approaches.The results of the study indicate that consumer legal protection is regulated under Law Number 8 of 1999 on Consumer Protection, which obliges business actors to provide compensation for losses suffered by consumers. In addition, provisions in the Indonesian Civil Code and Insurance Law also regulate the responsibility of insurance companies in fulfilling claims.However, in practice, claim rejections that disadvantage consumers still frequently occur. Therefore, consumers may pursue dispute resolution through the Consumer Dispute Settlement Agency or through litigation in court.

Abstract

Cyber Sexual Harrasment is sexual violence that occurs through digital and has complex different characteristics from conventional sexual violence. The Characteristic is include the anonymity of the perpetrators, the massive and cross-border distribution of content, and the durability of the content which allows the violence to occur repeatedly. Even though Indonesia has regulated Cyber Sexual Harassment through UU TPKS and UU ITE the implementation of legal protection for victims is still not optimal. Obstacles include the lack of a fast and effective content removal mechanism, as well as the unequal understanding of the context of digital violence among law enforcement officials. These overall conditions indicate a gap between legal norms and their implementation in the field, so that protection for victims of KSBE tends not to reach the specific needs of victims in the digital space. Therefore, a comprehensive evaluation of the effectiveness of regulations and law enforcement is needed so that justice for victims does not stop at the normative level alone.

Abstract

The development of information technology has increased online buying and selling transactions in Indonesia. Online transactions provide convenience for consumers in obtaining goods and services quickly and efficiently. However, this development also creates various legal problems, especially regarding consumer protection. Consumers often experience losses due to goods that are not in accordance with descriptions, online fraud, delays in delivery, and misuse of personal data. This study aims to analyze legal protection for consumers in online transactions and dispute resolution arising from consumer losses in electronic transactions. This research uses normative legal research with statutory and conceptual approaches. The results show that consumer protection has been regulated in Law Number 8 of 1999 concerning Consumer Protection, Law Number 19 of 2016 concerning Electronic Information and Transactions, and Government Regulation Number 71 of 2019 concerning Electronic System and Transaction Operations. Dispute resolution can be carried out through litigation and non-litigation mechanisms. However, the implementation of consumer protection is still not optimal due to low public legal awareness and weak supervision of electronic commerce activities.

Abstract

This study examines the normative construction of post-divorce child maintenance in two legal systems that apply in Indonesia, namely civil law (KUHPerdata) applied by the District Court and Islamic law (Compilation of Islamic Law) applied by the Religious Court. The method used is a comparative juridical-normative approach with a legislative, conceptual, comparative law, and case approach to the 2020–2024 verdict. The results of the study show two findings. First, both legal systems place child support obligations as an inherent obligation on parents, especially fathers, and are not erased by divorce (Pasal 298 KUHPerdata; Pasal 156 huruf d KHI; Pasal 41 UU Perkawinan). Second, the difference lies in the theoretical doctrine, namely civil law constructs it as an inherent and reciprocal alimentatieplicht, while Islamic law discusses it through the doctrine of lil-intifa' versus lit-tamlik which had been the basis for the rejection of the lawsuit in the Decision MA No. 608 K/AG/2003, before being reconstructed through SEMA No. 2 Tahun 2019.

Abstract

This study examines the relevance of Surabaya City's 2024 spatial planning policy to the National Strategic Project (PSN) development plan, which adheres to the principles of integration, sustainability, and spatial equity, in accordance with Law Number 26 of 2007 concerning Spatial Planning. This study also analyzes how spatial planning for the poor in Surabaya City is implemented. The research method used is normative juridical, with an analytical approach to documents and laws and regulations. The results indicate that Surabaya City's spatial planning policy plays a strategic role in supporting the realization of the PSN. However, its implementation remains problematic, such as a lack of spatial equity for the poor. The E-Rutilahu and Kampung Madani programs demonstrate more comprehensive sustainability in spatial planning. However, challenges and issues persist, ranging from limited budgets that hamper these programs, slow government bureaucracy in implementing regulations, and disruptions that occur in the field. This study recommends strengthening regulations, implementing social safeguards, and more meaningful public participation in spatial planning. In addition, this study also suggests replication and strengthening of the E-Rutilahu and Kampung Madani programs, as well as the use of spatial technology and big data in planning.

Abstract

The Constitutional Court plays a crucial role in upholding constitutional supremacy and enforcing the principles of the rule of law in Indonesia through its judicial review authority. As the guardian of the constitution, the Court ensures that regulations enacted by the legislative and executive branches remain aligned with the 1945 Constitution while protecting the fundamental rights of citizens. This study employs a qualitative approach with a literature review method to analyze the roles, authorities, and challenges faced by the Constitutional Court. The findings indicate that although the Court's decisions are final, binding, and applicable erga omnes, their effective implementation still faces serious obstacles. Major challenges include a lack of harmonization between Court rulings and existing legislation, weak commitment from legislative and executive bodies to follow up on decisions, and complexity in field execution. In conclusion, a stronger mechanism for decision implementation is required to guarantee legal certainty and create a more just, democratic, and constitutionally compliant state system.

Abstract

The existence of the Constitutional Court (MK) within the modern constitutional system is a fundamental pillar in upholding the principles of constitutionalism and limiting absolute governmental power. This normative study aims to analyze the strategic position of the Constitutional Court as the guardian of democracy and to identify the impact of challenges to judicial independence and ethical violations within the judiciary. Using statutory and conceptual approaches, data were collected through literature studies and analysis of relevant legal documents. The findings indicate that through the mechanism of judicial review, the Constitutional Court plays a crucial role in ensuring citizens' constitutional rights and in operating a system of checks and balances among state institutions. However, this institution also faces significant challenges related to the integrity and impartiality of its judges. Ethical violations by judges and legal misconduct by judicial actors have significantly reduced public legitimacy, threatened legal certainty, and triggered political distrust. Therefore, strengthening ethical sanctions through the Constitutional Court Honorary Council (MKMK) and enhancing internal oversight functions are essential prerequisites for maintaining the dignity of the highest judicial institution and preserving constitutional supremacy.
