Abstract

The judicial process prioritizes legal certainty both in time and minimizes costs for the parties as Law Number 48 of 2009 in Article 2 and Article 4 paragraph (2) requires the existence of important principles in civil procedural law, namely Simple, Fast, Low Cost. Settlement of disputes at the first level with the a quo principle is certainly the hope of the whole community, especially those who want to resolve disputes through the courts, with the application of this principle, it is hoped that the settlement of cases, especially in the civil sector, will not be delayed and can be resolved in a short period of time, so that the costs incurred by the parties are not too high. However, the settlement of civil disputes through a simple trial under examination is regulated in a limited manner with a material claim value of a maximum of Rp. 500,000,000.00 (five hundred million rupiah) preceded by a dismissal process and the settlement period of this case is not more than 25 (twenty five) ) working days. The results of this study explain firstly the application of Perma Number 4 of 2019 procedures for resolving simple lawsuits at the District Court in West Sumatra can run effectively such as providing convenience for parties to access and register simple lawsuits both online and offline, educating Registrars and Judges about simple lawsuits so that can degrade errors (human error), as well as proven by a matrix of cases per year that are decided through a simple lawsuit. Abstract

Sexual abuse is an act of violence and treatment that degrades human dignity, which is contrary to the values of God and humanity, and disturbs the security and tranquility of the social community. Handling victims of sexual abuse is very important, because the violence has caused various injuries to victims, such as fear, prolonged trauma, feelings of shame, evidentiary problems, repetitive questions by investigators, and the police investigations report process was not carried out properly so that it was difficult for the victim to recount the sexual abuse they experienced. If we look at many cases of violence against women and children, there are still no clear legal solutions. The promulgation of Law Number 12 of 2022 about sexual violence (UU TPKS), it is an effort to reform the law and overcome problems in legal protection of women and children from sexual abuse, namely as follows: preventing all forms of sexual violence, handling, protecting, and recovering victims, carry out law enforcement and rehabilitate perpetrators, create an environment where there is no sexual violence, and ensure non-repetition of sexual violence. Therefore, the problems statement in this research are: First, how are the regulation for the victims management of sexual violence based on Law Number 12 of 2022 about sexual violence (UU TPKS) and the Penal Code. Second, what are the juridical implications of the Law Number 12 of 2022 about sexual violence (UU TPKS) on victims in an Integrated Criminal Justice System that is gender-equitable. The problem approach in this study is a normative juridical, with data sources being the Criminal Procedure Code, the Penal Code, the Law Number 12 of 2022 about sexual violence (UU TPKS), Academic Papers on the Draft Law on the Elimination of Sexual Violence and other relevant sources. The results of the research show that the regulation of the Integrated Criminal Justice System in the UU TPKS regulated in Articles 20-64 is an effort to complement and strengthen the provisions on the rights of victims as regulated in existing laws and regulations. Meanwhile, the juridical implications of the UUTPKS for the Integrated Criminal Justice System are a guarantee of legal certainty, justice and the benefit of law in law enforcement of the Crime of Sexual Violence. A gender-just criminal justice system is one of the breakthroughs to change a non-gender-oriented legal system into a gender-oriented legal system. The system is expected to be able to respond to situations that are always experienced by women and children who are victims of gender-based sexual violence.

Abstract

Deconcentration is an important element in the administration of the state. Its existence is not only in administrative law order, but also in Constitutional law because - like decentralization - it concerns the foundations and organization of the state. If decentralization gave birth to local government (autonomous region), then deconcentration gave birth to local state government (administrative area). These administrative areas are headed by what is known theoretically as a Prefector. For the Indonesian context, the prefector is held by the governor in such a way that the governor has a dual position, namely as the head of the autonomous region of the province as well as the prefector. The laws governing local government in Indonesia use the term representative of the center in the regions for the designation of prefector. Since the reformation until now, the administration of government from the center to the regions seems to have marginalized deconcentration as the governance structure. There was a strong impression during the reform era that looked at deconcentration as if were the antithesis of democracy. The impression was so strong that deconcentration and administrative areas were no longer included in the post-amendment 1945 Constitution. The deconcentrative authority possessed by the governor to revoke Regency/City Regional Regulations (Perda) that are contrary to higher laws, public interests, and decency, was annulled by the constitutional court in its decision in 2016. Furthermore, budgeting and regulation and formation the apparatus that assists the governor as the central representative in the regions appears to be running slowly. In this way the question arises: is the implementation of deconcentration effective by the governor as the representative of the central government in the regions? To answer this question, research was carried out on the implementation of the deconcentration. The results of the research show that the implementation of the deconcentration has not been effective due to various limitations: limited tools, limited rules, and limited authority

Abstract

The number of acts of terror that have occurred in Indonesia has forced the Indonesian government to always make efforts to prevent and control various acts of terrorism that have occurred. Considering that in carrying out their actions terrorist groups always use weapons and bombs, a strategy is needed to prevent terrorism crimes. The research method used in this study is the Normative Legal Research Method. In this study, 2 (two) approaches were used, namely: Statute approach and conceptual approach. To take a stance on various types of terrorist attack incidents that create fear in the Indonesian people, the government has taken strategic steps in tackling criminal acts of terrorism, including by issuing a Government Regulation in Lieu of Law on the Eradication of Criminal Acts of Terrorism, and a year later a Perpu In 2002 this was confirmed as a regulation regarding the Suppression of Terrorism Delicts. Based on various considerations, it is necessary to regulate the Regulation of the Head of the National Police of the Republic of Indonesia Number 23 of 2011 concerning Procedures for Enforcement of Terrorism Suspects. The stages that must be passed to take action against criminal acts of terrorism are (1) carrying out an agreement (2) carrying out a warning (3) carrying out infiltration (4) thwarting levies (5) carrying out arrests (6) carrying out searches (7) carrying out confiscation of evidence.

Abstract

Berakhirnya kekuasaan orde baru pada tahun 1998, melahirkan harapan yang besar terhadap proses demokrasi termasuk reformasi hukum. Harapan yang begitu besar selama bertahun-tahun semakin berkurang dan nyaris hilang, karena perubahan-perubahan yang dilakukan belum menunjukkan bahwa keadilan hukum telah telah dapat dilaksanakan oleh masyarakat luas. Salah satu masalah dalam masa transisi ialah : bagaimana rejim baru menyikapi kejahatan dari masa lal. Rejim lama telah meninggalkan sejumlah besar kejahatan yang tidak pernah terselesaikan. Kejahatan yang telah menimbulkan penderitaan bagi banyak orang. Persoalan ini coba diatasi dengan menciptakan instrument-instrumen yang bersifat tradisional untuk segera memberi keadilan yang dapat dicicipi oleh masyarakat, sekaligus memelihara proses demokratisasi yang baru berjalan dengan memperkuat rule of law. Praktek demokrasi yang diselenggarakan baik orde lama maupun orde baru melahirkan system pemerintahan yang sentralistik, borokratik bahkan cenderung otoriter. Hasil akhir dari kedua masa pemerintahan ini agalah “kegagalan” akibat ketidakpercayaan masyarakat terhadap pemimpinnya. Hal inilah yang kemudian melahirkan babak baru yaitu “era reformasi” untuk melakukan koreksi dan perubahan terhadap tatanan pemerintahan yang lebih demokratis.

Abstract

The principle of good faith is a fundamental legal principle in the registration and protection of registered trademarks, so it can be a reason for rejecting a lawsuit to cancel a registered trademark in the Commercial Court, if the Plaintiff cannot prove that the registration of the disputed trademark was carried out by the Defendant in bad faith. This article will examine how good faith is regulated in trademark registration based on the 2016 Trademark Law?, and what requirements must be met when filing a lawsuit for canceling a registered mark in the Commercial Court?, as well as how to apply the principle of good faith as a reason for rejecting a lawsuit for canceling a registered mark by the Court. Commerce? This article is the result of normative legal research, using a statutory, case and concept approach, using secondary data, with qualitative data analysis. The research results show that the regulation of good faith is regulated in Article 21 paragraph (3) and Article 77 paragraph (2) of the 2016 Trademark Law, and the requirements that must be fulfilled in filing a lawsuit for cancellation of a registered trademark at the Commercial Court meet the formal and material requirements in Article 76 to Article 79 and Articles 85 to Article 90 Jo. Article 21 of the 2016 Trademark Law, as well as the application of the principle of good faith as a reason for rejecting a claim for cancellation of a registered mark by the Commercial Court, is casuistic and proportional and objective according to the legal facts revealed in the trial.
