Abstract

The demand for housing creates business opportunities for private individuals to venture into the residential property sector. Housing development companies, also referred to as developers, can face bankruptcy. When declared bankrupt, the developer often maintains a legal relationship with the homebuyer, based on the Sale and Purchase Agreement. This research aims to determine the legal status of a house in situations where the developer goes bankrupt, in accordance with Law Number 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations. This study employs a qualitative research method with a normative approach, focusing on statutory aspects. The research findings indicate that, as per the Bankruptcy Law, the Sale and Purchase Agreement between the developer and the homebuyer is voided. This occurs because ownership rights to both the land and house remain with the developer, making them assets subject to bankruptcy proceedings. Consequently, the homebuyer may apply as a creditor simultaneously, seeking compensation.

Abstract

Aset Yang Diambil Alih (AYDA) dilakukan oleh Bank sebagai salah satu cara dalam menyelesaikan kredit yang bermasalah. Kredit bermasalah yang dihadapi oleh bank salah satunya dalam Fasilitas Kredit Pemilikan Rumah (KPR) apabila debitor wanprestasi. Penelitian ini melakukan analisis terhadap mekanisme AYDA untuk fasilitas KPR yang bermasalah dan hambatan yang ditemui oleh Bank X. Hambatan yang ditemui oleh Bank X berasal baik dari internal maupun eksternal. Penelitian ini merupakan penelitian hukum empiris berdasarkan hasil observasi penulis dengan didukung data sekunder berupa perundang-undangan yaitu Undang-Undang Perbankan, Peraturan Otoritas Jasa Keuangan, dan Peraturan Menteri Keuangan dan literatur hukum. Penelitian ini menyimpulkan bahwa penyelesaian fasilitas KPR yang macet melalui AYDA dilakukan dengan penjualan di bawah tangan secara langsung dan lelang dengan menggunakan akta de command. Faktor-faktor internal yang menjadi hambatan yaitu besarnya biaya proses AYDA, penjualan kembali AYDA yang membutuhkan waktu lebih dari 1 (satu) tahun, dan minimnya tertib administrasi. Faktor eksternal yang menjadi hambatan yaitu gugatan dari pemilik agunan dan/atau pihak ketiga dan penyitaan aset.

Abstract

Land disputes are conflicts that occur between individuals or groups who have the same relationship or interest in an object of ownership of land rights which give rise to legal consequences for one another. One form of land dispute that occurs between individuals/groups and government institutions is between the Indonesian National Army (TNI) and civilians in Indonesia. Land disputes between the TNI and civilians occurred because there was no proof of ownership or certificate for the disputed land. The TNI is a government institution under the Ministry of Defense, therefore the right to land used for the TNI's interests is the right to use as regulated in Article 41 of the Basic Agrarian Law (UUPA). The land obtained came from state land, land controlled by the Dutch army, historical control by the Japanese army and land obtained by purchasing, acquiring, procuring, revoking and relinquishing land rights. Settlement of land disputes between civilians and the TNI can be carried out through legal channels for resolving land disputes which includes several stages including the preparation stage, the dispute handling and resolution stage and the litigation stage in court.

Abstract

This study examines the impact and legal protection provided to businesses facing fictitious negative reviews on the Google Maps application based on the guidelines recommended by the Fatwa DSN MUI No. 24 of 2017. The research aims to understand how fictitious negative reviews on the Google Maps application affect businesses and to evaluate the extent to which the fatwa has been implemented in protecting the rights and reputation of affected businesses. Additionally, it seeks to identify effective legal protection measures for businesses. The research utilizes a qualitative method with a case study approach, allowing for an in-depth understanding of real cases experienced by businesses suffering losses due to fictitious negative reviews on Google Maps. The research findings indicate that Fatwa DSN MUI No. 24 of 2017 plays a crucial role in providing legal protection guidelines for businesses affected by fictitious negative reviews. The impacts include decreased revenue, damaged reputation, and financial losses. Therefore, the study provides recommendations for protecting against fictitious negative reviews, including through legal approaches and reputation management. In conclusion, this fatwa holds significant relevance in legal protection and maintaining the reputation of businesses in the digital era.

Abstract

Notaries as public officials in carrying out their positions must comply with the Law on Notary Positions and the Notary Code of Ethics. The implementation of administrative sanctions against notaries who have violated their position is the authority of the Notary Supervisory Council and the Minister of Law and Human Rights. MPN in imposing sanctions on notaries cannot act arbitrarily. In the Decision of the State Administrative Court No. 235/G/2019/PTUN.KT, the MPN imposes sanctions for dishonorably dismissing a notary for violations in the form of signing a deed outside the Notary's office area, not providing a copy of the deed to the parties, and in carrying out his or her position not acting in a trustworthy, honest, thorough and effective manner. independent. In this case, the author examines whether the administration of administrative sanctions carried out by MPN is in accordance with the Law on Notary Positions and the Regulation of the Minister of Law and Human Rights concerning Procedures for Imposing Administrative Sanctions. This research is normative legal research which is known as research for academic purposes. namely the process of searching for legal rules, legal doctrines, and legal principles to answer the legal issues being discussed.

Abstract

A notary is a public official whose authority is given by the state to carry out some government functions in terms of making authentic deeds. In carrying out their duties, notaries have the authority regulated in Law Number 30 of 2004 concerning the Position of Notaries which has been amended by Law Number 2 of 2014 concerning the Position of Notaries. A deed made by a notary is a product in which the contents of the deed contain formal data submitted by the person present, or in other words the contents of the deed are the wishes and/or wishes of the parties. The information submitted by these parties is not entirely true, because there are parties who submit false information for personal gain, which can harm or ensnare the notary in a criminal act. Losses resulting from the deed This can cause the notary to be sued by the injured party, or in other words the notary is deemed to have bad intentions, even though the notary has carried out his duties in accordance with what is regulated in the UUJN and the Notary's Code of Ethics and is considered to have committed a criminal act. What is the legal protection for the notary and what is the notary's responsibility for the deed.

Abstract

The goal of this study is to assist the community with case management. Settlement of civil disputes can be carried out through a process in court. The research method used is a descriptive qualitative research approach, namely research on natural objects from experiments. using observational data collection techniques, interviews. Research findings describing the application of Restorative Justice in Indonesia are still limited and face various challenges, such as lack of public understanding of the concept of Restorative Justice, limited resources, and lack of support and coordination between institutions. The findings contribute to an in-depth understanding of the opportunities and barriers for incorporating restorative justice approaches into the civil justice system in Indonesia. Recognition by the community and the judiciary. There are challenges in the implementation of restorative justice, such as the lack of trained human resources and adequate facilities, so improvements and developments are needed for restorative justice to be properly implemented.

Abstract

This research focuses on the construction of wrongful acts related to the duties of curators and the considerations of judges in Supreme Court decisions. The research aims to gain in-depth understanding of wrongful acts by curators and how judges consider such cases. The theoretical contribution of the research is expected to enhance the understanding of wrongful acts in curator actions. Practically, the research results are anticipated to offer new perspectives for legal researchers and practitioners, as well as guidance for those involved in bankruptcy cases, emphasizing the principles of justice, legal utility, and legal certainty. The research has the potential to enrich legal insights related to bankruptcy and support the improvement of legal policies and practices in facing bankruptcy challenges.

Abstract

This dissertation conducted under the title “Reconstruction of Legal Protection Regulation for Service Customers of Payment System in Indonesia was based on the need for a strong legal basis concerning consumer protection of payment system since the existing legal regulation construction. In addition, its implementation is deemed in need of adjustment with the increasing development of product and service of the national payment system which is encouraged by the technological advancement that promote tons of innovation so it may increase the risk for the consumers. The present study was aimed at analyzing and describing three problems related to the construction of legal protection regulation for consumers of payment system services in Indonesia, the implementation of legal protection for the payment system service consumers, and the reconstruction of legal protection regulation for payment system service customers in Indonesia in the future. The theoretical basis employed was the theory of equality, legal certainty, and legal protection. The methodology used was normative with law approach, conceptual and comparison, and descriptive approach obtained from secondary data supported with the primary data which were analyzed qualitatively using deductive conclusion-making. The research result revealed that the construction of legal protection for customers of payment system services regulated in the Peraturan Bank Indonesia (PBI) Number 22/20/PBI/2020 concerning Legal Protection for Bank Indonesia Consumers was still considered low so it needed an adjustment. The implementation of consumer protection of payment system service including consumer complaint handling provided by the Payment Service Provider by Bank Indonesia was deemed in need of improvement or reconstruction in order to be able to give legal certainty to the customers. The reconstruction of PBI was conducted by adjusting and adding some articles including indemnity, personal data protection, establishment of an Alternative Payment System Dispute Resolution Institution, cyber risk, new product testing, and action mechanisms against unlicensed Payment Service Providers. The researcher in this study suggested the formation of new laws regulating the payment system in which consumer protection of the payment system should be regulated by referring to the comparison with other countries that have certain Laws concerning the payment system. The formation of laws will strengthen the legal basis in the activity of the national payment system as well as give legal certainty to the consumers and business practitioners in the payment system service.

Abstract

The implementation of split contract in Engineering, Procurement, and Construction (EPC) projects aims to distinguish between onshore contract or and offshore contract. Split contracts are divided into onshore contracts/domestic work contracts and offshore contracts/foreign work contracts. The application of a split contract structure in EPC projects has fundamental differences compared to the implementation of a single EPC project contract. The fundamental differences are related to taxation and exchange rate risks arising from the execution of the EPC contract itself. The implementation of a split contract structure in EPC projects in Indonesia is expected to be beneficial from the perspective of tax efficiency. The tax efficiency referred to is that onshore contractors performing work in Indonesia do not have to bear taxes on work carried out abroad. This is because the tax liability for offshore work will be borne by the employer. By taking advantage of import tax exemption rules, project owners gain tax efficiency. Split contracts (Split Contract) in EPC projects are not yet widely applied in Indonesia. Companies in Indonesia generally use a single contract structure in the implementation of EPC projects. Therefore, research is needed that discusses in detail the implementation of a split contract structure in EPC projects. This research will explore the correlation between the implementation of a split contract structure and the tax impacts on companies working on EPC projects in Indonesia. The research method used is the normative legal research method. The analysis presented in this research is based on Indonesian Tax Law, Customs and Excise Law, and other applicable legal instruments at present.
