Abstract

This research aims to explore how state financial recovery is carried out in Indonesia and analyze it using progressive law. Law enforcement against fraud in government activities is still a major problem in Indonesia. This fraud resulted in state losses, but the fines and compensation imposed were far below the value of state losses. The formulation of the problem is how is the state financial recovery carried out in Indonesia? and has the state's financial recovery considered a progressive legal approach? This research is a qualitative research, with normative research methods and carried out by means of literature studies. The data used is secondary data in the form of primary legal materials and secondary legal materials. This research shows that there is a disparity in sentencing that causes recovery against the impact of losses on state finances that is not optimal. The verdict of the panel of judges seems to only focus on the interests of punishing the perpetrators rather than recovering the victims. In conclusion, in law enforcement, punishment alone does not restore state losses, so it has not fulfilled the people's sense of justice. Progressive steps are needed from law enforcement officials to take action to save state finances which are the people's rights. This is in line with progressive legal theory and improves the image of law enforcement in Indonesia for the better through judge decisions that prioritize a sense of justice for the people.

Abstract

Law enforcement against crime relates with placement of Indonesian migrant worker abroad according to Indonesian rules number 39 of 2004 about placement and protection of Indonesian migrant worker Abroad that relation to protection of Indonesian migrant worker. But the reality of legislation is more many set concerning placement rather than protection, and the law is not synchronization with others legislations, whether operate vertical or horizontal, and that has conflicts of authority which raises the dualism of Institutional between BNP2TKI and Ministry of Manpower RI. The objectives of research for analyze: Policy of law enforcement placement of Indonesian migrant worker abroad; protection of criminal law for Indonesian migrant worker abroad; And others crime law enforcement in placement of Indonesian migrant worker abroad. This research is normative juridical research is qualitative, based to primary, secondary and tertiary data, through data collection documentaries and interviews, analyses in qualitative. Presenting conclusion: Policy law enforcement of Indonesian migrant worker to empower Police of Indonesian Investigator who are employed in BNP2TK1, and cases handled by investigators of PPNS BNP2TK1 is just for limited crime law of administration; criminal law protection of Indonesian migrant worker placement abroad is hopeless, because there is not to have synchronization of rules, also legislation is more emphasize of Indonesian migrant worker placement aspect is not protection aspect; and my suggestions: Indonesian police investigator who are employed in BNP2TKI should be empowered; subscribe regulation with placement and protection of Indonesian migrant workers abroad into immediately amendment; BNP2TKI as a non Departmental Government Institutions residing in and responsible indicated to the President, must be independent and free as an institution independent opened, tripartite, proactive, and funded well.

Abstract

Sexual abuse is an act of violence and treatment that degrades human dignity, which is contrary to the values of God and humanity, and disturbs the security and tranquility of the social community. Handling victims of sexual abuse is very important, because the violence has caused various injuries to victims, such as fear, prolonged trauma, feelings of shame, evidentiary problems, repetitive questions by investigators, and the police investigations report process was not carried out properly so that it was difficult for the victim to recount the sexual abuse they experienced. If we look at many cases of violence against women and children, there are still no clear legal solutions. The promulgation of Law Number 12 of 2022 about sexual violence (UU TPKS), it is an effort to reform the law and overcome problems in legal protection of women and children from sexual abuse, namely as follows: preventing all forms of sexual violence, handling, protecting, and recovering victims, carry out law enforcement and rehabilitate perpetrators, create an environment where there is no sexual violence, and ensure non-repetition of sexual violence. Therefore, the problems statement in this research are: First, how are the regulation for the victims management of sexual violence based on Law Number 12 of 2022 about sexual violence (UU TPKS) and the Penal Code. Second, what are the juridical implications of the Law Number 12 of 2022 about sexual violence (UU TPKS) on victims in an Integrated Criminal Justice System that is gender-equitable. The problem approach in this study is a normative juridical, with data sources being the Criminal Procedure Code, the Penal Code, the Law Number 12 of 2022 about sexual violence (UU TPKS), Academic Papers on the Draft Law on the Elimination of Sexual Violence and other relevant sources. The results of the research show that the regulation of the Integrated Criminal Justice System in the UU TPKS regulated in Articles 20-64 is an effort to complement and strengthen the provisions on the rights of victims as regulated in existing laws and regulations. Meanwhile, the juridical implications of the UUTPKS for the Integrated Criminal Justice System are a guarantee of legal certainty, justice and the benefit of law in law enforcement of the Crime of Sexual Violence. A gender-just criminal justice system is one of the breakthroughs to change a non-gender-oriented legal system into a gender-oriented legal system. The system is expected to be able to respond to situations that are always experienced by women and children who are victims of gender-based sexual violence.

Abstract

Deconcentration is an important element in the administration of the state. Its existence is not only in administrative law order, but also in Constitutional law because - like decentralization - it concerns the foundations and organization of the state. If decentralization gave birth to local government (autonomous region), then deconcentration gave birth to local state government (administrative area). These administrative areas are headed by what is known theoretically as a Prefector. For the Indonesian context, the prefector is held by the governor in such a way that the governor has a dual position, namely as the head of the autonomous region of the province as well as the prefector. The laws governing local government in Indonesia use the term representative of the center in the regions for the designation of prefector. Since the reformation until now, the administration of government from the center to the regions seems to have marginalized deconcentration as the governance structure. There was a strong impression during the reform era that looked at deconcentration as if were the antithesis of democracy. The impression was so strong that deconcentration and administrative areas were no longer included in the post-amendment 1945 Constitution. The deconcentrative authority possessed by the governor to revoke Regency/City Regional Regulations (Perda) that are contrary to higher laws, public interests, and decency, was annulled by the constitutional court in its decision in 2016. Furthermore, budgeting and regulation and formation the apparatus that assists the governor as the central representative in the regions appears to be running slowly. In this way the question arises: is the implementation of deconcentration effective by the governor as the representative of the central government in the regions? To answer this question, research was carried out on the implementation of the deconcentration. The results of the research show that the implementation of the deconcentration has not been effective due to various limitations: limited tools, limited rules, and limited authority

Abstract

Kekebalan diplomatik adalah bentuk kekebalan hukum dan kebijakan yang dilakukan antara pemerintah, yang menjamin bahwa diplomat diberikan perjalanan yang aman dan tidak dianggap rentan terhadap gugatan atau penuntutan di bawah hukum negara tuan rumah (walaupun mereka bisa dikeluarkan). pejabat diplomat menikmati kekebalan diplomatik adalah demi kelancaran yang efisien dari tugas-tugas perwakilan diplomatik yang mewakili negara pengirim. Penelitian ini menggunakan metode penelitian normatif. Penelitian ini bertujuan untuk mengetahui tentang Kekebalan diplomatik yang mana merupakan suatu keistimewaan khusus yang dimiliki oleh seorang diplomat, staf diplomatik ataupun konsuler selama menjalankan misi yang diberikan oleh Negara pengirim. Menggunakan pendekatan perundang-undangan yang terdiri dari bahan hukum dan bersifat penelitian pustaka. Hasil penelitian ini menunjukkan bahwa Wakil diplomatik umumnya mempunyai hak kekebalan dan keistimewaan diplomatik, yaitu kekebalan terhadap yurisdiksi hukum negara penerima baik perdata maupun pidana serta kekebalan menjadi saksi. Tetapi kekebalan diplomatik yang dimaksud disini bukan kekebalan atau kelonggaran yang bersifat absolut, dalam arti melekat mutlak pada pribadi pejabat diplomatik. Melainkan kekebalan diplomatik yang bersifat fungsional. Artinya, pejabat diplomat menikmati kekebalan diplomatik adalah demi kelancaran yang efisien dari tugas tugas perwakilan diplomatik yang mewakili negara pengirim.

Abstract

Seperti diketahui bahwa korupsi adalah sebuah kejahatan yang termasuk dalam kejahatan luar biasa “extraordinary crime”. Yang mana harusnya hukuman yang diberikan terhadap seorang koruptor bebeda dengan dengan kasus hukum yang lainnya. Seperti yang tejadi belum lama ini para koruptor berbondong-bondong bebas dari tahanan dikarenakan ada sebuah kebijaka/aturan baru yang dikeluarkan pemerintah mengenai Undang – undang RI Nomor 22 Tahun 2022 tentang pemasyarakatan dan menghilangkan PP Tahun 2012 yang mengatur remisi dan pembebasan bersyarat yang mana aturan ini menyulitkan peluang koruptor mempersingkat masa tahanannya. Didalam aturan baru disebutkan bahwa narapidana dapat bebas bersyarat dengan tekah menjalani 2/3 masa pidana dan juga narapidana harus berkelakuan baik. Maka dari itu tujuan penelitian ini untuk mengetahui apakah aturan baru yang diterapkan sesuai dengan yang seharusnya didapatkan oleh koruptor yang termasuk dalam kejahatan luar biasa. Metode ini menggunakan penelitian normatif untuk mengetahui suatu aturan dan prinsip hukum tentang isu yang di angkat. Korupsi sendiri sudah menjadi penyakit akut yang akibatnya dapat berdampak terhadap berbagai bidang seperti social, ekonomi, dan politik. Salah satu penyebab dari terjadinya korupsi adalah gaya hidup yang tinggi melampaui penghasilan yang di dapatkan. Lemahnya hukum dari Lembaga pemerintahan dan kepolisian membuat masyarakat kurang percaya lagi terhadap elit yang ada di pemerintahan

Abstract

Perkembangan teknologi yang maju mendorong berbagai sektor, salah satunya data pribadi melalui media rekam elektronik. Data Pribadi sendiri merupakan hal yang sangat sensitif, karena sangat melekat dengan pribadi seseorang. Jika dikaitkan , maka data pribadi melekat erat dengan hak pribadi dan hak privasi yang dimana termasuk dalam perlindungan Undang-undang negara Republik Indonesia tahun 1945 terkait dengan hak konstitusional yang dimiliki oleh tiap warganya. Hal ini tidak dapat dipungkiri juga bahwa Hak Pribadi dan privasi ini merupakan hak asasi manusia dimana hak untuk memperoleh keamanan, tidak diganggu yang dijamin oleh negara. Namun pada kenyataan nya di Indonesia sendiri, terkait perlindungan data pribadi masih sangat kurang. Undang-undang data pribadi baru saja diundangkan dalam Undang-undang No. 27 tahun 2022, dan terkait transaksi data elektronik menggunakan Undang-undang No 11 tahun 2008 masih ada yang kabur. Mengacu pada beberapa kasus kebocoran data baik dari transaksi elektronik, maupun pengisian data secara elektronik dapat dipastikan masyarakat Indonesia sendiri juga masih kurang dalam menjunjung tinggi data pribadi tersebut, baik secara Peraturan tertulis, maupun dalam sosiologis masyarakat. Melalui pandangan Sosiologis dimana “Law is a tool of Social Engineering”, diharapkan hukum bisa lebih ditegakan demi membentuk masyarakat untuk lebih perhatian dalam menjaga data pribadi masing-masing dan menghormati privasi orang lain.

Abstract

Women and children are groups that are vulnerable to acts of violence. National and international laws have provided protection for women and children from acts of violence. In addition, customary law as one of the rights of origin also provides protection. In West Sumatra, protection for women and children is provided through customary law contained in the Undang-Undang nan Salapan and in the Petatah Petitih that exist and lives in society. Through the nagari government, protection is provided through the resolution of acts of violence against women and children through customary settlements of acts of violence that are mild in nature. Meanwhile, serious acts of violence are resolved through the criminal justice system. It is necessary to prepare a nagari regulation to provide a legal basis for optimizing legal protection for women and children that is truly in line with the conditions that exist in customary law communities.

Abstract

The existence of pioneering cargo air transportation is an important aspect of people’s need who live in 3T (undeveloped, isolated, and outermost) areas of Indonesia. The main function of pioneering air transportation is to minimize price disparities which are very detrimental to the people of 3T area. However, in practice, the operation of pioneering cargo air transport, encountered various obstacles that resulted in aviation accidents which became the most accidental cases compared to commercial flights. So based on these problems, this research is intended to examine the legal position of pioneering cargo air transportation in Indonesia to further determine the responsibility of pioneer airlines for aviation safety and the losses incurred for the destruction of cargo in the event of an accident. The research method used in this research is normative juridical through a study of concepts and related regulations. The results of the study indicate that the legal position of pioneering cargo carriers is not only as a carrier in a cargo transport agreement but also has a legal relationship with the government based on a contract as part of the implementation of public services. Pioneer airlines are responsible together with local governments, airport authorities, and related parties to ensure flight safety as a preventive measure for accidents. If there has been an accident that destroyed the cargo, the airline is responsible for fulfilling the compensation suffered by the sender in nominal terms based on the provisions of the applicable air transportation regulations.

Abstract

Good Governance berawal dari proses reformasi pada tahun 1998 yang menginginkan suatu perubahan dalam penyelenggaraan pemerintahan yang baik dalam proses transparansi, berkeadilan, dan akuntabel. Tujuan reformasi yang menginginkan penguatan peranan masyarakat dalam penerapan demokrasi tidak akan tercapai jika tidak didukung oleh suatu pemerintahan yang baik dan tanggung jawab. Adapun dalam penulisan ini menjelaskan tentang tata kelola pemerintahan yang baik dalam bidang pertanahan. Hasil dari penelitian ini adalah Kementerian Agraria dan Tata Ruang/ Badang Pertanahan Nasional RI, sebagai penyelenggara pemerintahan berupaya mewujudkan Good Governance terutama dalam pelaksanaan Pendaftaran Tanah Sistematis Lengkap (PTSL). Sabagaimana tujuan PTSL adalah untuk menjamin kepastian hukum bidang tanah dan teruwjudnya satu tata kelola pemerintahan yang baik dan terciptanya tertib administrasi pertanahan.
