Abstract

The issuance of Presidential Instruction No. 1 of 2022 concerning Optimizing the Implementation of the Health Insurance Program instructs all Ministries to optimize the JKN program, this also instructs the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency to implement the Circular Letter of the Director General of Land Rights Determination and Registration (Dirjen PHP) No.02/ 153-400/II/2022 which contains the Determination of Rights and Registration of Land, as a form of follow-up to Presidential Instruction No. 1 of 2022, so that every application for registration services for the transfer of land rights or ownership rights to apartment units due to sale and purchase must be accompanied by a photocopy of the health insurance social service provider (BPJS) participant card (active participant in the Health Insurance Program (JKN). Type of research The method used is normative (doctrinal) juridical research. land rights because buying and selling are not by legal principles or norms in general, namely the principle of legal certainty, where Presidential Instruction Number 1 of 2022 creates legal uncertainty and is only a policy regulation (beleidsregel/pseudo wetgeving) and is optional or (aanvullendrecht).

Abstract

Tujuan dari penelitian ini untuk menguraikan restorative justice bagi anak yang berkonflik dengan hukum pada tahapan pra adjudikasi, adjudikasi dan pasca adjudikasi, dan posisi lembaga pemasyarakatan dalam menegakkan keadilan restoratif. Penelitian ini menggunakan metode penelitian hukum normatif dengan menggunakan data primer dan data sekunder, dengan analisa deskriptif serta penarikan kesimpulan secara deduktif. Keadilan Restoratif lebih melihat pemidanaan dengan pemikiran yang berbeda, yakni berkaitan dengan pemenuhan atas kerugian yang dialami oleh korban sehingga perdamaian ini menjadi tujuan akhir dari konsep ini. Hasil dari penelitian ini menunjukkan bahwa restorative justice merupakan salah satu alternatif yang berfungsi untuk memecahkan suatu perkara pidana, yang awalnya berfokus pada pemidanaan menjadi proses diskusi serta mediasi dengan melibatkan pelaku, korban, keluarga pelaku atau korban, dan pihak yang terkait, untuk mewujudkan kesepakatan dalam menyelesaikan permasalahan pidana dengan adil dan seimbang. Tujuan dilaksanakannya restorative justice serta diversi ini untuk menghindarkan dan menjauhkan Anak dari peradilan pidana sehingga Anak dapat menghindari stigmatisasi negatif serta harapannya agar Anak dapat diterima kembali ke dalam lingkungan sosialnya secara wajar.

Abstract

Technological developments have brought changes to payments in the form of cash in conventional metal and paper forms, which have now developed in the form of electronic payment instruments. The use of non-cash payment electronic money (FLAZZ) besides being able to facilitate transactions can also cause losses to the owner if the FLAZZ is lost or stolen. Transactions using e-money can be carried out without going through an authorization process such as a PIN (Personal Identification Number) so that e-money can be used easily by unauthorized persons. Bank Indonesia Regulation Number 20/6/PBI/2018 contains regulations related to financial compensation but are not clear and detailed, so these unclear regulations lead to different interpretations between institutions. The purpose of this paper is to find out the legal arrangements for electronic money owners in the event of a loss on an e-money card and to find out the responsibility of the bank as a provider of non-cash payment instruments for losses suffered by e-money. - the owner of the money card. The research method used in this paper is normative legal research method. Studies show that electronic money compensation can only be made if there is damage from the issuer. The bank is not responsible for losses to e-money owners due to user negligence that violates consumer protection principles. Banks as issuers of electronic money are not responsible for losses to FLAZZ owners where this rule violates the principle of consumer protection.

Abstract

Penulisan ini bertujuan untuk memberikan saran terhadap para penegak hukum di negara ini dalam hal ini instansi Kepolisian, Kejaksaan dan Hakim agar dalam menangani suatu permasalahan hukum dengan mengedepankan pendekatan keadilan restorasi dalam penyelesaian kasus hukum ujaran kebencian. Metode penulisan ini menggunakan penelitian hukum normatif dan memakai sumber data sekunder dengan pendekatan deskriptif analitis. Hasil dari penulisan ini mebuktikan bahwa penyelesaian dengan metode pendekatan Restorative Justice dapat digunakan kepada pelaku kejahatan ujaran kebencian sebagaimana ketentuan di dalam “ UU No. 19 Tahun 2016” tentang “Perubahan Undang-Undang No. 11 Tahun 2008” Tentang “Informasi dan Transasksi Elektronik ( ITE )”. Penulisan ini dibuat untuk menjawab apakah penyelesaian secara restorative justice dalam tindak pidana ujaran kebencian merupakan sebuah solusi hukum? karena, semangat dari penyelesaian restortif justice adalah pemulihan terhadap keadaan semua bukan sebagai pembalasan. Oleh sebab itu, tujuannya agar upaya pemidanaan terhadap pelaku tindak pidana ujaran kebencian dapat diminimalisir dan dilakukan pendekatan dengan cara mediasi atau duduk bersama antara pelaku dengan korban tindak pidana ujaran kebencian.

Abstract

This research examines the legal protection of whistleblowers in corruption crimes in Indonesia. The role of the reporter is very necessary or important in law enforcement. The presence of whistleblowers helps law enforcement agencies and makes them more accessible in uncovering cases of corruption criminal activity. Therefore, the state must provide legal protection to the Petitioners to protect their rights by law. Second, the state must also pay tribute to the reporter. Because the award is a form of recognition from the state to the applicants for their participation in helping law enforcement and protecting our country. Like the suspected corrupt journalists in Cirebon, they should be legally protected from prosecution. Nevertheless, he is under suspicion and the LPSK must assist in every way possible to ensure that his rights are protected or fully recognized. This study answers several questions. (1) Legal protection for reporters of corruption cases in Indonesia. (2) legal mechanisms in the criminal justice system to ensure the safety of reporters in corruption cases; This study uses social laws to study with the help of social sciences. First, the research results show that there is legal protection for reporters. This means that, based on Article 10 of Law Number 31 of 2014 concerning Protection of Witnesses and Victims, they do not only receive physical and immaterial legal protection, but also physical and psychological protection. Second, whistleblower regulations have not been regulated clearly so that special rules and legal guarantees are needed for whistleblowers to protect them from threats.

Abstract

After the Amendment of 1945 Constitution, democracy and Rule of Law become two concepts. They are the concept on how to run the power and run the goverment of Indonesia. Both concept, are interconected among each others and can not be separated, because on one side, democracy gives the grounds and mechanisme of power based on the principles of togetherness and equality, while on the other side, rule of law gives guide lines that goverment in the state is not a human but the law of human being. The both of concepts have relation each other. This article are trying to connected and related both concepts in an unseperated function.

Abstract

Media sosial saat ini sudah mengalami perubahan pemanfaatannya secara massif dan signifikan, salah satunya, yaitu sebagai tempat melakukan kegiatan politik (kampanye). Aturan mengenai kampanye hitam berada pada berbagai peraturan perundang-undangan. Walaupun sudah ada aturan, akan tetapi masih banyak kampanye hitam di media sosial. Munculnya kampanye hitam menjadi cerminan bobroknya moral bangsa Indonesia saat ini. Tidak bisa dipungkiri bahwa black campaign amat sangat memberikan dampak yang buruk bagi pendidikan politik masyarakat Indonesia. Fenomena yang terjadi, yaitu keikutsertaan SARA dalam politik. Di mana kita ketahui bahwa negara Indonesia memiliki kemajemukan, tidak hanya memiliki satu agama, budaya, serta suku dan antar golongan. Penelitian ini merupakan penelitian hukum normatif yang memiliki suatu metode yang berbeda dengan penelitian lainnya. Penelitian hukum normatif berfokus pada peraturan-peraturan tertulis berupa literatur-literatur kepustakaan atau pendekatan kepustakaan (library research) baik yang bersandar pada sumber data sekunder yang meliputi bahan hukum primer dan bahan hukum sekunder. Adapun yang dapat dirumuskan dalam penelitian ini adalah: (1) Akibat hukum dari black campaign; (2) Unsur yang mempengaruhi penegakan hukum kampanye hitam (black campaign); dan (3) Upaya Menanggulangi Kampanye Hitam (Black Campaign) di Media Sosial.

Abstract

The goal of this research is to investigate and determine the regulation of environmental offenses under Law 32 of 2009(known as environmental law) and how to be responsible for environmental crimes according to environmental law This research uses normative legal research methods using primary and secondary data, with descriptive analysis and deductive conclusions. Environmental crimes can be include within intentional or unintentional acts. Subjects of criminal law may be individuals, legal bodies, or non-legal entities. In this scenario, both legal entities and non-legal entities are companies. Responsibility in Article 88 means 'absolute accountability,' or the so-called "strict liability idea. Under the liability requirements of this article, the plaintiff is not necessary to prove the existence of an element of error as the basis for compensation. When the principle of strict liability is invoked, the legal subject is held accountable for pollution and environmental harm in the living environment in line with Article 88 of environmental legislation.

Abstract

Pada 20 Agustus 2019 Mahkamah Agung melakukan pembaharuan hukum terkait gugatan sederhana dengan mengeluarkan PerMA No.14 Tahun 2019 , salah satu isinya merubah jumlah nominal kerugian materi yang bisa di akomodir gugatan sederhana menjadi maksimum 500 juta rupiah. Hal ini membawa angin segar bagi para pelaku usaha umkm, besar & para konsumen yang memiliki sengketa perdata umum, karena gugatan sederhana dapat dilakukan untuk nominal kerugian materi sampai maksimal 500 juta rupiah dengan jangka waktu penyelesaian yg cepat dan berbiaya ringan. Gugatan Sederhana di dunia dikenal dengan nama small claim court ( SCC ), di Singapura small claims court sudah diberlakukan sejak tahun 1985 sampai sekarang. dengan jumlah max kerugian materi yang di akomodir 20 ribu – 30 ribu SGD, sementara di Malaysia Small Claims Procedure di berlakukan sejak tahun 2012 sampai sekarang, dengan jumlah max kerugian materi yang diakomodir 5 ribu RM. Dengan melihat perbandingan hukum terkait gugatan sederhana antara Indonesia, Singapura, & Malaysia makan akan terlihat bahwa gugatan sederhana yang diberlakukan di Indonesia lebih baik dalam hal jumlah nominal kerugian materi yang bisa diakomodir dan kecepatan prosesnya. Tetapi jika kita lihat pada sistem informasi penelusuran perkara pengadilan negeri di kota-kota besar Indonesia jumlah perkara gugatan sederhana sangat sedikit sekali jumlahnya dibanding gugatan perdata biasa. Oleh karena itu keunggulan prosedur gugatan sederhana ini perlu di berdayakan secara masif dan berkesinambungan lewat seminar, webminar, talkshow, penulisan artikel, jurnal oleh pemerintah, akademisi, praktisi hukum, pemilik usaha, atau oleh siapapun agar menjadi budaya hukum pilihan utama ketika menghadapi sengeketa perdata umum sejumlah tertentu.

Abstract

The judicial process prioritizes legal certainty both in time and minimizes costs for the parties as Law Number 48 of 2009 in Article 2 and Article 4 paragraph (2) requires the existence of important principles in civil procedural law, namely Simple, Fast, Low Cost. Settlement of disputes at the first level with the a quo principle is certainly the hope of the whole community, especially those who want to resolve disputes through the courts, with the application of this principle, it is hoped that the settlement of cases, especially in the civil sector, will not be delayed and can be resolved in a short period of time, so that the costs incurred by the parties are not too high. However, the settlement of civil disputes through a simple trial under examination is regulated in a limited manner with a material claim value of a maximum of Rp. 500,000,000.00 (five hundred million rupiah) preceded by a dismissal process and the settlement period of this case is not more than 25 (twenty five) ) working days. The results of this study explain firstly the application of Perma Number 4 of 2019 procedures for resolving simple lawsuits at the District Court in West Sumatra can run effectively such as providing convenience for parties to access and register simple lawsuits both online and offline, educating Registrars and Judges about simple lawsuits so that can degrade errors (human error), as well as proven by a matrix of cases per year that are decided through a simple lawsuit. Second, the obstacle that often occurs in the process of resolving simple lawsuits is that judges often do not read the lawsuit comprehensively and immediately set a trial day so that when the trial takes place it is proven that the dispute cannot be resolved with a simple lawsuit (there are provisions in Articles 3 and 4 of this Perma). met) and ended up not being able to continue (NO).
