Abstract

The Internet revolutionized the information market by allowing people to access unlimited information with just a computer and a connection. Information on the internet is not only more accessible, but also eternal (Digital Eternity). Social media is not only used to communicate, but is also used for many negative things such as providing information that is incorrect, unethical, even violating legal regulations and disrupting public conversation. In simple terms, it is a spreading activity such as uploading and writing wrong or prohibited things that can harm other people. Therefore, Indonesia is looking for a way to adopt the European legal system regarding human rights, where the right is to maintain one's reputation as a human being worthy of living without the shadow of the past, so that the term Right to be Forgotten is found, which is defined as the right to obtain, automatically or upon request, the deletion of personal information, which is no longer useful, posted by the data owner himself, or a third party, even if the information was posted lawfully. This right will provide major freedoms to victims who feel disadvantaged by their personal data being distributed via electronic media. Currently, Indonesia has included a right-to-be-forgotten clause in several laws and regulations that have been approved, and the implementation system has even been regulated. However, there are still many problems that make it a little difficult to enforce this right, considering that Indonesia also has the right to an opinion and the right to know public information, so the implementation of the right to be forgotten is still often subject to criticism and is strangled by the right to remember/right to know.

Abstract

The development of technology changes the way humans carry out activities to meet their daily needs. In this context, carrying out legal actions in the field of agreements, in this case, electronic contracts (sale and purchase, rental, etc.). This act is of course framed by law, electronic contracts are facilitated by the UU ITE. Of course, legal subjects question the concrete form of electronic contracts referred to in the UU ITE. The research method in this scientific writing is legal research, which uses legal materials such as laws, jurisprudence and legal norms. In simple terms, an electronic contract is a legal act carried out by people in an online network or electronic system, for example in buying and selling via e-commerce (Tokopedia, Shopee, et al) or when people use electronic-based transportation services (Gojek, Grab, et al), or when the public participates in the auction process via an electronic system (lelang.go.id).

Abstract

Dinamika dalam sebuah pemilihan kepala daerah, merupakan konsep yang memperhatikan banyak dimensi pada masyarakat daerah itu sendiri seperti dimensi sosial, politik, dan ekonomi. Artikel yang berfokus pada penelusuran dinamika dalam pemilihan kepala desa Ngadas, Malang pada tahun 2023 akan mendeskripsikan dan menganalisis seluruh dimensi-dimensi dinamika tersebut dalam pembahasan yang cukup mendalam. Penelitian yang sudah dilakukan sebelumnya dinilai belum mampu menelusuri dinamika dalam sebuah pemilihan kepala desa secara mendalam, dan cenderung hanya berfokus pada aktivitas politik yang terlihat jelas ataupun fokus pada salah satu dimensi warga desa saja, tanpa adanya upaya untuk menghubungkan dimensi-dimensi dinamika yang ada dalam suatu fokus penelitian. Oleh karenai itu, pemilihan judul artikel ini yang berfokus pada dinamika didasari pada adanya kesenjangan penelitian terkait dinamika pilkades yang mendalam itu sendiri. Dengan menggunakan metode penelitian kualitatif dan pendekatan deskriptif, artikel ini akan mampu menjelaskan informasi yang ditemukan secara sistematis dan akurat. Dalam artikel ini kemudian ditemukan bahwa meskipun tidak ada konflik substansial yang terjadi pada pilkades Desa Ngadas tahun 2023, terdapat beberapa tantangan seperti rendahnya tingkat partisipasi masyarakat, terutama dalam pengajuan calon kepala desa yang kemudian harus juga disaring oleh panitia untuk dapat mengakomodasi aspek sosial dan budaya yang ada di Desa Ngadas itu sendiri.

Abstract

This article aims to analyze the implementation of compensation in land acquisition for public development in accordance with Law Number 2 of 2012 and to examine the legal resolution mechanisms when there is a refusal of the type or amount of compensation offered. The issue centers on how compensation is implemented for land ownership for development purposes as stipulated by Law Number 2 of 2012, and the legal mechanisms for resolution when landowners reject the form and/or amount of the established compensation. To approach this issue, the theoretical framework used is derived from Law Number 2 of 2012 on Land Procurement for Public Interest and Article 18 of the Basic Agrarian Law. Data was collected through normative research methods (literature studies) by reviewing legal materials through a legislative approach. Thus, in this study, secondary data is prioritized, while primary data (field observation results) are used only as supplementary information. The data are analyzed qualitatively. This study concludes that compensation for land acquisition must be fair and given to the rightful parties. If there is a rejection of the type or amount of compensation offered, the landowner can file an objection to the local district court within 14 working days after the signing of the meeting report.

Abstract

KUA Lowokwaru ialah salah satu unit pelaksana teknis pelayanan bimbingan perkawinan, peruntukkannya terhadap anak-anak muda usia menikah, substansi kegiatan ini adalah edukasi tentang keilmuan keluarga. Sistem penyelenggaraannya, tidak melulu pengajar yang berbicara tetapi adakalanya peserta bersuara. mencaritahu bimbingan perkawinan secara praktis di KUA Lowokwaru, hasil temuan penelitian dianalisa menggunakan teori sistem hukum, Lawrence M.Friedman. Metode penelitian, pendekatan yuridis sosiologis dimana data primer adalah hasil pengamatan lapangan. Hasil penelitian mengungkapkan penerapan bimbingan perkawinan di KUA Lowokwaru secara das sollen berpedoman pada aturan dirjen bimas Islam nomor 189 tahun 2021 tentang petunjuk pelaksanaan bimbingan perkawinan calon pengantin; bertolak dengan fenomena das sein bahwa pelaksanaan bimbingan perkawinan mengedepankan sifat elastisitas bukan tanpa alasan hal ini pula atas pertimbangan latar belakang kesibukkan dari peserta bimbingan perkawinan sendiri; segi kesesuaian dengan perspektif teori sistem hukum Lawrence M.Friedman bahwa didalam substansi hukum kegiatan bimbingan perkawinan belum mempunyai payung hukum yang kokoh lalu dari segi struktur hukum bimbingan perkawinan diaparaturi oleh tenaga kerja Kantor Urusan Agama dan dari segi budaya hukum masih belum membudaya; imbas dari substansi hukum yang lemah.

Abstract

There are many cases of illegal exploitation that occur now based on paper and electronic media reports and many examination results show that cases of illegal exploitation, especially of women and children, need attention. Dealing with women and children in Indonesia generally involves prostitution and pornography. The occurrence of sexual trafficking involving girls reveals violations of women's human rights, depriving them of the opportunity to experience peace and happiness from a young age. Their basic rights to live freely and protect themselves from potential harm have been reduced due to criminal activities. These incidents show a correlation between the trafficking of underage girls (through prostitution) and other sexual offenses such as assault and battery. Many minors and adult women are victims. Brutality against women is thought to stem from a framework that considers women as weak and substandard individuals compared to men. Overall, victims of human trafficking, especially women involved in prostitution and children forced to work, are victims of crime and not perpetrators of crime.

Abstract

This study aims to investigate the conflict between customary and national laws in Sumba Barat Daya, particularly concerning the controversial practice of "kawin tangkap" (forced marriage). The primary objective is to analyze the impact and dynamics of this legal conflict, focusing on human rights violations, especially those affecting women, and to explore solutions to alleviate tensions between customary and national laws. The research methodology employs a qualitative approach, gathering data from various reliable online news sources, conducting interviews, and analyzing public opinions. Thematic data analysis is utilized to identify different perspectives, arguments, and policy implications. Thus, this research integrates legal, human rights, and policy perspectives on the legal conflict in Sumba Barat Daya, providing relevant policy recommendations to address the issues at hand.

Abstract

This research discusses numerous cases of sexual violence in East Seram Regency based on court decisions from 2018–2022. The focus of this research is the protection and fulfillment of the right of sexual violence victims in East Seram Regency. This study is a normative juridical with analytical descriptive method based on theories, concepts and regulations which are analyzed qualitatively. The results of this study indicate that the protection and fulfillment of human rights of sexual violence victims in East Seram Regency is still suboptimal due to the existence of social factors in society that do not recognize the importance of protecting the rights of sexual violence victims. It is shown that a highly unhealthy patriarchal culture, a criminal justice system that does not fully advocate victims and still focuses on criminalizing the perpetrators, as well as a society with low educational and economic standards. The advice given is that it is necessary to provide advocacy to the public regarding healthy sex education and the delivery of the information regarding rights of women and children, to strengthen the capacity of law enforcement officials in protecting the rights of victims of sexual violence, and establishing implementing regulation for the Sexual Violence Criminal Act as a legal basis for providing protection for sexual violence victims.

Abstract

Notaries have obligations, one of which is to keep and maintain notary protocols. In the digital development that continues to accelerate, this then affects the notary profession or what is usually calledcyber notary, including one of them in the case of storing notary protocols to be done electronically. The aim of this research is to explore the arrangements for storing notary protocols electronically in this regardcyber notary in Indonesia as well as exploring the legal strength of electronically storing notary protocols as evidence in the field of civil law. Apart from that, the aim of this research is to explore the legal responsibility of notaries for damage to electronically stored notary protocols. This research uses a normative research type, with an approach to statutory regulations and a conceptual approach. The literature study was carried out as a collection of legal materials, using prescriptive analysis methods. Deductive logic and systematic interpretation are used as the basis for this research. The results of the research found that there are no specific regulations regarding the electronic storage of notary protocols, especially in Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notaries. This then makes its legal strength as evidence in court still doubtful. However, legal liability for damage to notary protocols stored electronically by a notary refers to existing legal arrangements, which are currently in effect, reflecting legal certainty that has not yet been realized.

Abstract

Legal politics of regent regulation number 63 of 2016 Regency Tulungagung is involved in controlling environmental damage due to mining sand is a purposeful field study to answer the questions: 1. What is the Political Basis for Legal Regulations Regent Number 63 of 2016 Tulungagung Regency Under control Environmental Damage Due to Sand Mining and 2. What is the View Siyasah Syar'iyyah Fiqh on the Political and Legal Basis of Regent's Regulations Number 63 of 2016 Tulungagung Regency in Damage Control Environmental Effects of Sand Mining The type of research taken by the author is qualitative research with uses the nature of descriptive research, namely research directed at provide symptoms, facts or events systematically and accurate. The data sources used are primary and secondary data sources. Data Primary data is obtained from the results of analysis of statutory regulations related to research on legal political policy, regent's regulation number 63 2016 Tulungagung Regency in controlling environmental damage while secondary data from the research object is interviews, opinions of para experts in the form of books, journals and scientific works, as well as parties with related agencies. The results of this research show that legal political policy is regulatory regent number 63 of 2016 Tulungagung Regency in control environmental damage according to regent's regulation number 63 of 2016 is experiencing juridical defects and not implemented properly and do not meet standards AUPB, this is the first because there are two regulations that are the same where one of them should be removed and the contents of the implementation can be regulated more detailed and directed according to the rules above, but not here. So that In this case, the regulations alone are not appropriate, let alone the legal content where the Environmental Service should be able to take action against sand mining illegal and reclaiming environmental damage, but what is happening is not possible. that there is poor participation within the scope of correlation and regulation of the Tulungagung Regency government must be fixed immediately. Islam holds the view that it is an act of pollution The environment can be categorized as deep mafasid (damage). the principles of Islamic teachings must be avoided and overcome Regarding the solution, the author concludes that there must be firmness and role which is real for the Tulungagung Regency government, both executive and government legislative as well as improving regulations and repealing old rules with a view tidying up and strengthening the authority of the District Environmental Service Tulungagung through regent regulations
