Abstract

Children are very important for human survival and the survival of a country or nation. Children experience very important changes as they grow and develop. Starting from birth and continuing until puberty, childhood is marked by the process of exploring a child's identity. Children during puberty often commit deviant acts or crimes without realizing it. the majority of children who commit crimes without intending to cause harm do not receive adequate and comprehensive legal protection. So it is necessary to protect children who are perpetrators of criminal acts. The research method used in the research is Normative Juridical research. The primary data sources used in normative research are those contained in statutory regulations and other statutory regulations. In normative studies, library research is used to collect data. The data collected was tested through qualitative analysis. This research examines normative or legal variables through the use of descriptive analysis techniques, which include providing descriptive explanations for the data obtained, connecting various pieces of evidence, and drawing inductive conclusions. Legal protection for children as perpetrators of criminal acts in the juvenile criminal justice system in Indonesia is contained in Law no. 11 of 2012 concerning the Juvenile Justice System which aims to protect children who commit criminal acts. Children who commit crimes are given protection at every opportunity in the juvenile criminal justice system. starting from the arrest, detention stage, investigation stage, prosecution, trial stage as well as during the coaching period.

Abstract

The relocation of the National Capital (Ibu Kota Negara/IKN) to East Kalimantan Province has sparked pros and cons regarding potential threats and ways of countering terrorism in the new capital city, called Nusantara. This paper aims to provide a design and framework for mitigating the threat of terrorism in the nation's capital city by using a welfare criminology approach. This paper uses a qualitative approach regarding secondary data sourced from statistical data publications, online media news, journal articles, and previous similar research/studies. The new IKN with the name Nusantara which carries the concept of a "smart city" based on cyber technology, faces the challenge of the threat of terror acts in a hybrid manner. The government needs to design an integrated prevention and counterterrorism strategy in IKN Nusantara and its surrounding areas that is not only cyber-based, but also relies on natural surveillance from the surrounding communities, and in the policy-making process needs to consider the situation of the community and existing local wisdom. The welfare approach can also be in line with the aim of addressing the root causes of radicalization and conflict, such as economic marginalization, social and cultural issues.

Abstract

Humans have been interacting with other people in what is known as civilization since they were born. He first communicated with his parents, and as he grew older, he lived in a society where people interacted with each other. Humans become aware of the fact that certain individuals in a society follow laws that govern their lives. A set of principles and guidelines that govern interactions between humans and society. In general, law plays an important role in social life because it guarantees legal certainty, as well as being a guide to justice, order, peace and order.

Abstract

Everything regarding marriage that has been regulated is a binding provision and must be stipulated for members of society. The legal consequences of divorce is regulated in Article 37 of Law Number 1 of 1974 regarding Marriage. In the verdict the author uses as research material, Verdict Number 1718/Pdt.G/2021/PA. Btm has determined based on the Supreme Court jurisprudence Number: 3405/K/PDT/2012 which confirms that marriage agreements that aren’t registered has no legal force. The author’s goal is to determine the legal consequences of unregistered marriage agreements. The author uses written materials as main sources to analyze with the results of interviews. The results of the research by the author is that the Verdict Number 1718/Pdt.G/2021/PA. Btm has to be cancelled because the jurisdiction verdict number 3405/K/PDT/2012 has been cancelled and the marriage agreement between Nurevi binti Muhammad Mubazzir and Andrew Kevin Plant should be a permenant legal force. The conclusion of the research is after the issuance of Constitutional Court Decision No. 69/PUU-XIII/2015, a marriage agreement is no longer interpreted only as an agreement made before marriage, but also made during marriage.

Abstract

Dalam praktik peradilan, seringkali terdapat kesulitan dalam membedakan antara Wanprestasi dan penipuan. Namun, perbedaan mendasar antara keduanya adalah bahwa Wanprestasi tidak melibatkan niat buruk, sementara penipuan melibatkan unsur itikad buruk sejak awal. Wanprestasi ditangani dalam kerangka keperdataan, sementara penipuan menjadi kasus pidana. Dalam beberapa kasus, Wanprestasi dapat dianggap sebagai penipuan jika terdapat indikasi itikad buruk dari salah satu pihak sejak awal perjanjian dibuat. Namun, dalam kebanyakan kasus, Wanprestasi dan penipuan dipertahankan sebagai dua konsep yang berbeda dan memiliki implikasi hukum yang berbeda pula. Penelitian ini dilakukan untuk mengetahui kepastian hukum terhadap kriteria penentu penipuan dan wanprestasi yang didasarkan pada yurisprudensi MA No. 4/Yur/Pid/2018. Metode penelitian yang penulis gunakan adalah yuridis normatif dan teknik pengumpulan data studi kepustakaan. Data-data yang telah diperoleh tersebut kemudian dianalisis dengan melalui pendekatan secara analisis kualitatif. Hasil pada peneliatan ini adalah jika suatu perjanjian didasari oleh iktitad buruk dengan tujuan merugikan orang lain, maka tindakan tersebut dapat dikatakan sebagai penipuan yang masuk dalam ruang lingkup pidana. Hal tersebut menjadi dasar kriteria dalam menentukan suatu tindakan termasuk ke dalam tindak pidana penipuan atau wanprestasi.

Abstract

This research aims to evaluate the effectiveness of women's protection institutions in Indonesia, such as the National Commission on Violence against Women, in providing support and services to victims of sexual harassment. This research also identifies the obstacles and challenges faced by these institutions in carrying out their functions. The research methods used include qualitative analysis of reports, interviews with women's protection agency staff, as well as literature reviews regarding women's protection policies and practices in Indonesia. The research results show that Komnas Perempuan and similar institutions have demonstrated a strong commitment to supporting victims of sexual harassment through various services, including psychological counseling, legal aid, and assistance during the legal process. In addition, education and public awareness campaigns conducted by these institutions have helped change society's views on sexual violence. However, the effectiveness of these services is still limited by obstacles such as limited resources, social stigma, and challenges in law enforcement.

Abstract

Setiap orang memiliki peluang untuk menjalin hubungan dengan orang berjenis kelamin yang berbeda, yang pada akhirnya dapat mengarah pada pernikahan. Perkawinan harus didasarkan pada peraturan hukum, tetapi seiring waktu, perkawinan antara laki-laki dan perempuan dari agama yang berbeda dapat terjadi. Ini disebut perkawinan beda agama sendiri. Perkawinan ini terdiri dari laki-laki dan perempuan yang ingin membentuk keluarga atau rumah tangga dengan agama yang berbeda. Pasangan yang menikah dengan orang yang berbeda agama seringkali menghadapi tantangan tersendiri. Mereka harus menemukan cara untuk menghormati dan memahami keyakinan masing-masing sambil mematuhi aturan negara. Pernikahan yang berbeda agama juga ada di banyak tempat, baik di kota maupun di pedesaan, karena Pasal 2 ayat (1) dan ayat (2) UU Nomor 1 Tahun 1974 tentang Perkawinan menyatakan bahwa (1) "Perkawinan adalah sah, apabila dilakukan menurut hukum masing-masing agama dan kepercayaannya." (2) Setiap perkawinan dicatat menurut undang-undang yang berlaku, sehingga perkawinan dapat dilaksanakan sesuai dengan agama dan kepercayaan masing-masing. Hakim pengadilan harus membuat keputusan untuk mengesahkan perkawinan beda agama. Surat Edaran (SE) Ketua MA 2/2023 dikeluarkan pada tanggal 17 Juli 2023 untuk membantu hakim memutuskan kasus pencatatan perkawinan antara orang yang berbeda agama. Artinya, SE adalah standar jika pasangan meminta perkawinan beda agama.

Abstract

This study examines the role and duties of notaries serving as members of the Notary Supervisory Council (MPN) in accordance with Law No. 30/2004 on the Notary Position (UUJN). The goal of this study is to understand the role of notaries in the MPN framework and determine the duties and difficulties they face in upholding professionalism and honesty. This study employs a normative analysis methodology with a qualitative approach to investigate the execution of MPN responsibilities at various levels. We achieve this through a comprehensive evaluation of existing literature and the examination of case studies. The comprehensive analysis centres on the interaction between notaries and MPN, as well as their respective responsibilities in maintaining the code of ethics and resolving conflicts. The findings suggest that notaries have a pivotal role in the MPN framework, which comprises three tiers: MPD, MPW, and MPP. Notaries at every level have the responsibility of overseeing, promoting, and enforcing the code of ethics, as well as settling conflicts through mediation. According to the report, the functions and obligations of notaries in MPN are critical for upholding the profession's integrity and professionalism. MPN employs a hierarchical system of supervision to carry out its duties effectively and efficiently, ensuring that all notaries in Indonesia comply with legislation and maintain public confidence in the profession.

Abstract

Komitmen Pemerintah dalam memberikan perlindungan terhadap Pekerja Migran Indonesia (PMI) salah satunya melalui program jaminan sosial. Program Jaminan Sosial mulai diterapkan di Indonesia sejak tahun 2004 dengan berlakunya UU No 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional. Pada tahun 2018, diterbitkan peraturan yang khusus mengatur jaminan sosial untuk para pekerja migran Indonesia yaitu Peraturan Menteri Ketenagakerjaan No 18 Tahun 2018 tentang Jaminan Sosial Pekerja Migran Indonesia. Dalam pelaksanaannya, Permenaker tersebut belum menjawab kesenjangan antara kebutuhan dan layanan yang PMI dapatkan. Permasalahan terbesar adalah mengenai tata kelola dalam implementasi jaminan sosial pekerja migran Indonesia. Pada Februari 2023 terbitlah Peraturan Menteri Ketenagakerjaan Nomor 4 Tahun 2023 sebagai pengganti atas Permenaker Nomor 18 Tahun 2018 tentang Jaminan Sosial Pekerja Migran Indonesia. Permenaker No 4 Tahun 2023 ini diyakini lebih komprehensif dalam memberikan perlindungan kepada Pekerja Migran Indonesia mulai dari sebelum, selama, hingga setelah bekerja. Jurnal ini akan memaparkan penerapan Peraturan Menteri Ketenagakerjaan Nomor 4 Tahun 2023 terhadap perlindungan jaminan sosial Pekerja Migran Indonesia.

Abstract

Fetishism is often hidden and difficult to prove as a criminal offense in Indonesia due to the lack of specific regulations in the Criminal Code. This disorder involves sexual arousal towards non-genital objects and may interfere with social functioning, requiring behavioral therapy. Evidence challenges include difficulty obtaining evidence and social stigma. The solution is clearer laws, specialized law enforcement training, a multi-disciplinary approach, and public education to reduce stigma and increase reporting. The aim of this research is to find out the challenges and solutions in proving criminal acts related to fetishism. The research method used in this article is normative legal research. Normative legal research focuses on the analysis of statutory regulations, legal doctrine, and relevant legal concepts to find solutions to the legal issues raised in this paper. The results of this research are that Fetishistic disorder is a condition where a person has sexual urges towards non-genital objects, which can be a criminal act. In Indonesia, the law does not specifically regulate fetishism, creating a gap in protection for victims. Challenges in evidence include difficulty gathering evidence, social stigma, and lack of understanding. The solution is more comprehensive laws, specialized training for law enforcement, a multi-disciplinary approach, public education, and the use of advanced forensic technology.
