Abstract

Today, the mosque began narrowing its function, not as it used to be especially in the period of the Prophet. Historically, at the time of Prophet Muhammad, the mosque was not restricted to function as a place of worship only (to pray and read the Quran), but served as the hub of all activities of Muslims. Based on what exemplified by the Prophet, in addition to being a place of ritual worship, the mosque also had other functions such as: first, as a place to study; second, a place to issue a fatwa; third, a place to try cases; fourth, a place for Prophet Muhammad to welcome guests/groups/representatives; fifth, a place for people to wed; sixth, a center for social services; seventh, a place for war practice; and eighth, a place for medical or health service. With a historical-theological approach, this study aims to straighten out any misunderstanding of Muslims at this time about the functions of mosques, or to give at least historical description of the mosque in the history of Muslims as a whole, as well as to explain what we should do to enliven the mosque.

Abstract

Domestic violence becomes stagnant when faced with the culture of a society. Bad treatment of a wife by her husband because of disobedience or other reasons seems to be legitimized by religion and culture. A husband seems to have the right to treating his wife as he wishes. To understand domestic violence as a form of violence against women we need to look at it from women’s perspective. Without doing so, we will be trapped in myths leading us to a culture of victimizing women. The beating of a wife by a husband which is allowed in certain cases by religion should not be interpreted in a physical context but rather in a metaphoric-contextual perspective.

Abstract

The problem of unemployment has become such a frightening scourge, especially in developing countries such as Indonesia. Unemployment has impact on people’s income per-capita, and income will subsequently have an impact on the people’s purchasing power. West Kalimantan is one of the provinces in Indonesia which is also experiencing the impact of economic disparity, i.e. unemployment. Employment, the less quality of human resources and labor in excess of available jobs is contributing to unemployment. This paper discusses the influence of unemployment on people’s purchasing power in West Kalimantan. Purchasing power can be seen from people’s spending per-capita rates from year to year. The data used in this paper includes that from 2002 through 2011 obtained from the publications of the Provincial Bureau of Statistics of West Kalimantan. Results of the study showed that the unemployment rate effect is negative and partially significant (individual) on people’s purchasing power. This suggests that when someone is not working or unemployed, it will affect their revenues, and reduced people's income will affect people’s purchasing power in West Kalimantan, Indonesia

Abstract

In reality, the growth of mosques and surau (smaller mosques) in the city of Pontianak is fast, like mushrooms in the rainy season. The data from the Ministry of Religious Affairs of Pontianak in 2008 shows that the number of mosques and surau was 336 in total. However, the number was not accompanied with activities for economic development of the Muslim society. Similarly, in terms of the number, the majority of people in the city of Pontianak is Muslim, and certainly this has the potential for the empowerment, both in terms of human resources and natural resources (including the Muslim funds). This subject is necessary to be studied by considering: first, the economic conditions of the communities in the city of Pontianak lie under the poverty line and the economic underdevelopment. Therefore, it requires a real effort to improve their economic condition. Second, this article is as an effort to re-actualize the role and functions of mosques as well as the shifting paradigm of the Muslim community in the city of Pontianak regarding the mosque.

Abstract

Prenuptial agreement can be used as preparation for entering the household life. Prenuptial agreement is an agreement held before marriage takes place. The history of prenuptial agreement itself was born in western culture, not in Indonesia that still upholds the traditional oriental culture. Even some people consider this to a sensitive issue that is uncommon and considered unusual, rude, materialistic, selfish, unethical, not in accordance with Islamic customs, etc. This research aims to investigate and examine prenuptial agreement in the Civil Code, the Marriage Law and Islamic Law Compilation. The method of this research is a normative legal research which is to conduct the assessment and in depth review of prenuptial agreement, whether the agreement is in accordance with Islamic law and positive law in Indonesia through the collection of books and materials about the prenuptial agreement. The nature of this research is the study of literature which is to examine and study a number of literature through the analysis of the prenuptial agreement. Prenuptial agreement in Indonesia is carried out according to the law applied on each party (husband and wife), both based on the Civil Code, Law No. 1 / 1974 and the Compilation of Islamic Law. Prenuptial agreement is not mandatory. It means that prenuptial agreement is a supplementary agreement binding only when it has been made. In the draft legislation, prenuptial agreement has some similarities and differences both in the Civil Code, Marriage Law and the ILC. The main similarity is that it should be made by a competent authority prescribed by law in this case created by a notary for those who are subject to the Civil Code and by the marriage registrar's office for those who are subject to the Marriage Law and ILC. Prenuptial agreement is formally similar to agreements in general, and the difference is about the content or object of the agreement itself, in this case the Civil Code in principle on property / wealth, while the provisions of prenuptial agreement contained in Marriage Law explicitly does not mention the object of what can be concluded that the agreement can be about various things, as long as it does not conflict with the the law, religion and morality. The provisions of the Compilation of Islamic Law on the object, which is ta'lik, mixing personal property and separating property income.

Abstract

The absenceof Muhammad’slast messages before his death related to the continuation of Moslem’s leader aroused the ijtihâd of al-khilâfah. In the end of 10 th century or at the beginning of 11 th century, al-Mâwardy came with great ideas on khilâfah. It consist of qualification and the process of choosing leader (khalîfah), duties that should be done by khalîfah as and individu and as social responsibilities to the society. His great knowledge abouth Fiqh al-Siyâsah (Islamic political), his ability on writing, his experiences as judge, and his ability on negotiation made him accepted by many people. It was also supported by his attitude; srtick, moderate, and brave, his intelligence proved by his skill and his good behaviour.

Abstract

Ahmad Amin was a modern muslim scholar that produced critical works in the field of Islamic thought, including critical thinking of Hadith.His critical thinking can be found in his most famous book entitled "Dhuha al-Islam" where he criticized forgery of Hadith due to the lack of a written record of Hadith from the beginning. The interpretation of the critical analysis of Ahmad Amin requires extensive a critical approachinvolving many aspects including historical aspects in it.

Abstract

Three basic principles that should be emphasized when we want to apply the principle of cash waqaf (endowment): first, the allocation of waqaf should be viewed as a frame of the integrated project, not part of a separate fee. Second, the hope and welfare of nazir; it's time we made the nazir a profession that gives hope to the best graduate and a profession that provides welfare. Third, the principles of transparency and accountability in which the waqaf agency and the institutions receiving endowments must report the fund management process to the people annually in the form of financial audit report, including the reasonableness of the cost of each item.

Abstract

Penelitian ini berjudul “Jual Beli Online Dengan Memanfaatkan Jejaring Sosial (Studi Kasus pada Mahasiswa Jurusan Ekonomi Islam Institut Agama Islam Negeri Pontianak)”. Adapun tujuan dari penelitian ini adalah untuk : (1) mengetahui bentuk-bentuk praktik jual beli online yang dilakukan mahasiswa dalam situs jejaring sosial, (2) mengetahui kendala apa saja dalam melakukan jual beli online yang dilakukan mahasiswa dalam situs jejaring sosial, dan (3) mengetahui upaya apa saja yang dilakukan mahasiswa untuk mengatasi kendala dalam melakukan jaul beli online dalam situs jejaring sosial. Penelitian ini menggunakan pendekatan kualitatif dengan studi kasus, sumber data diperoleh dengan melakukan wawancara terstruktur kepada mahasiswa Jurusan Ekonomi Islam yang melakukan praktik jual beli online dan studi dokumentasi berupa foto-foto jual beli online mahasiswa Jurusan Ekonomi Islam. Hasil dari penelitian ini adalah (1) Bentuk-bentuk praktik jual beli online yang dilakukan oleh mahasiswa terdiri dari produk yang dijual dan dibeli, media yang dipilih dalam jual beli online, jenis-jenis jejaring sosial yang dimanfaatkan, modal dalam jual beli online, metode pembayaran, dan sumber informasi yang dimanfaatkan oleh mahasiswa dalan jual beli online. (2) Kendala dalam melakukan jual beli online yang dialami oleh mahasiswa dalam situs jejaring social adalah mulai dari konsumenya, keuntungan yang diperoleh, persaingan antar produk, akses internet yang tidak bagus, salah kirim produk dan sulitnya menghubungi produsen dan adanya unsur penipuan. (3) sedangkan Upaya yang dilakukan mahasiswa untuk mengatasi kendala dalam melakukan jaul beli online dalam situs jejaring sosial adalah dengan mencari penjual atau reseller yang dapat dipercaya / yang kita kenal, Memilih ol-shop yang meyakinkan, mendata pemesanan yang baik dan jujur, menurunkan harga saat ada hambatannya yaitu persaingan, meyakini orang yang membelinya dan harus menjaga kualitas barang/ produknya, meminta kepastian kepada pembeli apakah barang akan sampai atau tidak, bersaing melalui harga, melakukan kerja sama untuk menyalurkan barang yang dijual, mencari orang yang dapat di percaya untuk mengantar barang dagangan setelah ready, Untuk antisipasi penipuan disetiap transaksi membuat bukti seperti screen shot proses transaksi disitus dan bukti transfer disimpan, dan membuat konsumen tidak kecewa dengan cara merespon dan mengirim secara akurat dan tepat waktu.
