Abstract

One indicator of the progress of Islamic banking is the ability to produce financial products that are able to compete in the national and even international markets. Economists view Islamic banking products today as still unable to compete. In fact, some seem to copy-paste conventional products. Even though there are many contract components in Islam that can be formulated to produce products that are not less interesting than conventional products. This combination of single contracts that form the formula of the new contract is known as Al-Uquud Al-Maaliyah Al-Murakkabah. In general terms it is often called hybrid contract. The purpose of this paper is to analyze and refute the views in academic acceleration that hybrid contracts are absolutely prohibited in Sharia. In summary, if the Hybrid Contract formula does not contain usury, gharar, dzulm, maisir or various other kinds of prohibitions, then back to the law as long as muamalah. Namely Al-Aslu fil Mua'malah Al-Ibahah or the original law of the muamalah contract is permissible. The method used in this paper is the library research or library study. The conclusion of this paper is the importance of the innovation of Islamic banking products on a Hybrid Contract basis. The hope is that these products can compete in the market while answering the dynamics of the times. In addition, this paper also offers several hybrid contract development solutions as the basis for Sharia Banking Products.Keywords: multi contract, hybrid contract, double contract, product innovation.

Abstract

Fintech di dunia digital diawali dengan kemajuan teknologi di bidang keuangan. Di Indonesia, perusahaan yang memanfaatkan fintech baru muncul beberapa tahun belakangan. Fintech mulai muncul pada bulan September tahun 2015 yang tergabung dalam Asosiasi Fintech Indonesia (AFI) yang bertujuan untuk menyelenggarakan partner bisnis dan membangun ekosistem fintech di Indonesia. Dalam waktu singkat tahun 2006-2007 mengalami perkembangan dari 7%-78%. Salah satunya yang ikut berkecimpung dalam dunia bisnis fintech adalah PT. Investree. Terkait perkembangan tersebut dapat di indikasi dalam penerapan implementasi fintech di Indonesia. Berdasarkan latar belakang, maka analisa permasalahan dirumuskan dalam bentuk pertanyaan berikut : Pertama, bagaimana konsep Fatwa DSN-MUI No: 117/DSN-MUI/II/2018 Tentang Layanan Pembiayaan Berbasis Teknologi Informasi Berdasarkan Prinsip Syariah. Kedua, bagaimana implementasi produk Peer to peer lending (P2PL) di PT. Investree. Dan Ketiga, bagaimana tinjauan Fatwa DSN-MUI No: 117/DSN-MUI/II/2018 Tentang Layanan Pembiayaan Berbasis Teknologi Informasi Berdasarkan Prinsip Syariah terhadap P2PL di PT. Investree. Investree adalah sebuah perusahaan  fintech, yang menyediakan layanan perantara untuk proses peer to peer lending. Investree tidak turun langsung dalam aktivitas pinjam meminjam. Tetapi hanya menyediakan platform untuk memfasilitasi prosesnya, administrasi akun borrower dan lender. Investree melakukan inovasi dengan mengeluarkan produk berbasis syariah yang dikeluarkan sejak akhir tahun 2017. Beberapa produknya yaitu pembiayaan usaha syariah atau invoicefinancing syariah dan pembiayaan modal kerja (online sellerfinancing sharia). Produk invoicefinancing ini sudah sesuai dengan Fatwa DSN-MUI No.117/DSN-MUI/II/2018 karena produk invoicefinancing ini sama dengan anjak piutang/factoring. Produk Pemberian Modal Kerja juga sudah sesuai dengan Fatwa DSN-MUI No.117/DSN-MUI/II/2018.

Abstract

This study aims to examine the concepts and implementation of Good Corporate Governance (GCG) in Islamic banking in Indonesia. Corporate governance represents the principles of management that have actually existed in the history of human civilization and have been practiced since the first time there was a company. This research is a field research that is sharpened by literature. This research is descriptive in nature, seeks to examine GCG policies and find ideas for strengthening regulations in fulfilling sharia aspects and describing the implementation of GCG in Islamic banking in Indonesia. The method used in data analysis is a qualitative method, namely by presenting in the form of descriptions and concepts. The data obtained were analyzed by descriptive analysis techniques with deductive logic. The results of this research prove that the implementation of GCG on BMI has been implemented quite well, BSM is very good, and BNI Syariah is good. The management performance of Islamic banks, namely the implementation of GCG, consists of Transparency (Openness), Accountability, Responsibility, Professionalism, Independence, and Fairness, also committed with Sharia Compliance. GCG can form an Islamic work culture. Then a periodic and continuous assessment is carried out and strived to be carried out properly in accordance with regulations. The assessment shows that the implementation of GCG in BMI, BSM, and BNI Syariah is in accordance with the rules covering three aspects of governance; governance structure, governance process and governance outcome. The author's research focuses more on the concept and implementation of GCG in Islamic banking

Abstract

The people of Bandar Lampung City are known as religious communities with Islam as the religion of the majority of the population. Its population structure is more Muslim women cause this city to become a market for beauty products that are so potential and become the target of domestic and foreign producers. The formulation of the problem which is the focal point of this research is how the halal label and the price of beauty products can influence the decision to buy a beauty product considering that the products available on the market do not all have a halal logo from the Indonesian Ulama Majlis. This study uses a qualitative (naturalistic) approach which is believed to be able to explain the existing phenomena more comprehensively in seeing the effect of halal labels on packaged products and prices on purchasing decisions that occur in beauty products at Chandra Supermarket and Ramayana Supermarket in Bandar Lampung City. The results showed that the factors considered in the first decision making were the quality and perception of the quality of beauty products, the suitability of individuals with products and information/referrals from 3rd person and advertisements on various media. Information on the following considerations is the brand and prestige of beauty products, product prices and halal status.Keywords: halal labels, prices, purchasing decisions.

Abstract

This study aims to analyze of Sukuk development based on underlying of State Own Property (BMN, Barang Milik Negara) in Indonesia with Islamic Perspective. The data used in this study is the secondary data and the method used Strong Weakness Opportunity Threat Reflexivity Religiosity (SWOTR2) analysis with the help of some literature as sources and interviews conducted during the study. The results of this study indicate that by the end of 2016, the value of Sukuk emission has reached 20,425.4 Billion Rupiah (USD 1,520). With the total of State Budget (APBN) Rp 2,152,695 Billion (USD 159,700), the market share of Sukuk in Indonesia in 2016 reaches 0.95%. To make Sukuk more growing, Indonesia has a new breakthrough by using state assets as an underlying asset in its issuance. However, the use of such underlying assets is only limited to state property (BMN), so it is necessary to extend the state assets used as underlying. Because the wealth of the state is not limited to the existence of a thing in the form of buildings, but also includes all the natural wealth attached to the asset.

Abstract

ABSTRACTSharia products in the capital market develop through a variety of sharia investment products that continue to increase in number and are supported by strong regulations, both in terms of the Financial Services Authority (OJK) and the National Sharia Council of the Indonesian Ulema Council (DSN MUI). The screening process for sharia shares includes two aspects that must be fulfilled by issuers in order to enter the sharia stock index, namely the qualitative and quantitative aspects. This paper will discuss problems that arise and raise debates among academics and Islamic practitioners in the screening process for stocks listed on the Islamic stock index.Keywords: screening, sharia sharesABSTRAKProduk syariah di pasar modal berkembang melalui beragam produk investasi syariah yang terus bertambah jumlahnya dan ditunjang dengan regulasi yang kuat, baik dari sisi Otoritas Jasa Keuangan (OJK) maupun dari Dewan Syariah Nasional Majelis Ulama Indonesia (DSN MUI). ABSTRACTA Digital Ekonomist is a combination of a exonomic litaracy and digital literacy,thats is, skill for understanding and using exonomic information from different sources displayed on the internet. to that end, its done research on middle school teachers in Tanggerang Banten indonesian, The method research used the combination of qualitative and quantitative research, result have shown that this digital era facilitates teachers acces to information in particular, in term of need retrieval. With understanding in the literacy Economic concept of teachers, the more it will make it easier for teachers to be the wisher and the smarter to meet the needs of the industrial era. Keyword : economic literacy, teacher, and industria era digital ABSTRAKLiterasi ekonomi digital merupakan kombinasi antara literasi ekonomi dan literasi digital, yakni keterampilan untuk dapat memahami dan menggunakan informasi mengenai ekonomi dari berbagai sumber yang ditampilkan di internet.Untuk itu, dilakukan penelitian pada guru SMP di Tangerang Selatan, Banten, Indonesia.Metode penelitian menggunakan campuran method yakni kombinasi penelitian kualitatif dan kuantitatif.Hasil menunjukkan bahwa era digitalisasi ini memudahkan para guru dalam mengakses informasi khususnya pengambilan kebutusan berkaitan dengan kebutuhan ekonomi. Abstract

E-commerce is a transaction which is referred to as an online transaction where this transaction uses cyberspace as a place to transact. A business that uses in the present era is not only modeled with the seller and the buyer makes a face-to-face transaction but can be done with an online business or called an e-commerce business.               The purpose of this study is to find out how the business e-commearce business perspective of Islamic economics. This study is a field research (qualitative research) that is qualitative descriptive and library library. The research subject is the owner of a business business @lisdasasirangan and the object of research is the application of a business venture e-commearce perspective of the market structure of Islamic economics. Data collection techniques with interviews are then processed with editing techniques, categorization and interpretation, then analyzed descriptively qualitatively to draw conclusions.               Based on research on business ventures e-commearce perspective of the market structure of Islamic economics. The e-commerce business is a market in the modern era that explores the global market. The e-commerce business will continue to grow along with the development of technology, technological developments not only develop in education but also in the economic field, namely in the field of market structure. The end of an e-commerce business can be compared to the online market. But in this type of online market, there are many sellers and buyers with various kinds of goods sold and offered so that this online market can be called a perfectly competitive market.

Abstract

Penelitian ini bertujuan untuk menganalisis pengaruh lingkungan kerja dan motivasi kerja terhadap kinerja guru SMK Assalam Depok. Populasi dalam penelitian ini adalah 35 Guru SMK Assalam Depok. Teknik untuk menentukan sampel adalah menggunakan teknik sampel jenuh yaitu semua populasi dijadikan sampel yaitu 35 orang. Metode pengumpulan data menggunakan metode survey, dengan instrument penelitian adalah kuesioner. Metode analisis data menggunakan Statistical Product and Service Solutions. Penelitian ini membuktikan bahwa lingkungan kerja berpengaruh positif dan signifikan terhadap kinerja guru. Motivasi kerja berpengaruh positif dan signifikan terhadap kinerja guruKata Kunci: Lingkungan Kerja, Motivasi Kerja, Kinerja Guru

Abstract

Penelitian ini bertujuan untuk mengkaji peran lembaga-lembaga fasilitator bank syariah dan fungsinya terhadap kebijakan kegiatan usaha bank syariah di Indonesia dalam menjalankan sistem manajemen dan sistem kerja bank syariah. Dalam penelitian ini penulis menggunakan metode penelitian kualitatif eksplanatif, data diperoleh dari sumber-sumber resmi yang terkait informasi mengenai peran dan fungsi lembaga fasilitator dengan lembaga keuangan perbankan syariah juga dari sumber referensi buku dan referensi lainnya yang relevan. Penulis menemukan bahwa secara keseluruhan lembaga fasilitator bank syariah berperan penting sebagai lembaga yang mendukung berjalannya kegiatan bank syariah secara proporsional dan tertib aturan. Dan penulis menemukan bahwa menurut informasi LPS hingga saat ini belum ada bank syariah khususnya yang mengalami bank gagal atau bank yang perlu diselamatkan keberadaannya. Inti dari peran dan fungsi lembaga fasilitator amat erat kaitannya terhadap lembaga keuangan khususnya bank syariah. Dan setiap lembaga memiliki wewenang, fungsi dan tugas yang berbeda dalam mengawasi, mengawal, melindungi, menyelesaikan permasalahan, menerbitkan fatwa terkait produk bank dan peraturan mengenai sistem kerja pada perbankan syariah. Fungsi utama lembaga fasilitator bank syariah adalah mendukung kegiatan usaha bank syariah agar berjalan secara efektif, sehat tertib aturan, dan sesuai dengan prinsip syariah.
