A manuscript describing society and culture outside Indonesia is expected to be analyzed comparatively with the issues and context in Indonesia. Abstract

Pluralisme hukum sebagai salah satu produk dari modernisasi telah membuka wawasan masyarakat bahwa ada sistem hukum lain di luar tertib sosial yang telah berlaku di masyarakat. Sistem hukum yang plural akan mengkondisikan norma, nilai, dan aturan dari masing-masing sistem hukum tersebut untuk saling berinteraksi. Dengan kondisi tersebut masyarakat “dipaksa” untuk “memikir ulang” konsep-konsep validitas dan justifikasi atas nilai-nilai dan norma-norma yang ada sebelumnya dengan nilai dan norma yang berasal dari luar. Dengan berbekal lifeworld/dunia kehidupan (interaksi antara budaya dan ajaran suatu agama) ketika berhadapan dengan sistem (sistem hukum nasional), bagaimanakah masyarakat melihat dan menempatkan diri mereka dalam upaya mencari penyelesaian konflik yang valid sekaligus menjustifikasinya dengan sistem hukum yang plural? Melalui paradigma teori tindakan komunikatif (communicative action) yang diancang oleh Jűrgen Habermas, makalah ini mengkaji hal-hal sebagai berikut: apakah sistem hukum yang diikuti oleh masyarakat? Mengapa mereka memilih untuk tunduk pada sistem hukum tersebut? dan, Apa yang mempengaruhi perilaku hukum masyarakat yang hidup dalam kondisi sistem hukum yang plural? Pada tataran yang lebih luas, kajian antropologi hukum tidak hanya memberikan pemahaman dan penjelasan mengenai perilaku hukum suatu masyarakat, bagaimana konsep tentang hukum terbentuk, maupun tentang ada tidaknya batasan-batasan antara satu sistem hukum dengan sistem hukum yang lain dalam pluralisme hukum, tetapi juga memberikan gambaran mengenai karakteristik masyarakat yang bersangkutan dan relasi antara individu dan masyarakat. Abstract

Kepercayaan animisme beserta emosi dan ritual kepercayaannya masih berkembang di masyarakat yang sudah beragama monoteisme. Praktik-praktik animismenya didorong oleh adanya anggapan bahwa kekuatan yang disucikan itu memberikan banyak manfaat bagi kehidupannya. Hal ini juga terlihat pada kepercayaan Petta Ale’e bagi masyarakat Palippu. Penelitian ini mendeskripsikan kepercayan terhadap Petta Ale’a di mata masyarakat Desa Palippu. Sebagai penelitian kualitatif maka teknik pengumpulan data menggunakan observasi, wawancara dan dokumentasi. Hasil penelitian menunjukkan makam Petta Ale’e yang berada di tengah hutan, hingga kini masih memberi pengaruh kuat bagi kehidupan sosial keagamaan masyarakat di sekitarnya bahkan masyarakat dari luar. Petta Ale’e diyakini memiliki kelebihan dan kekeramatan sehingga masyarakat senantiasa memberikan persembahan kepadanya sebagai ucapan terima kasih karena dipercaya telah melindungi dari malapetaka, memberikan rejeki dan sebagainya. Kepercayaan initelah mentradisi secara turun temurun, jika dilanggar dipercayai akan memberikan kesengsaraan, walaupun masyarakatnya juga melaksanakan ajaran Islam dengan baik sehingga sebahagian besar masyarakat menganggap bahwa kepercayaan terhadap Petta Ale’e dinilai sangat bertentangan dengan aqidah Islam. This research aims to describe to the beliefs of Petta Ale'e the community's to the in Palippu Village. As a qualitative research, data collection techniques use observation, interview and documentation. The results show that Petta Ale'e, is a tomb that is in the middle of the forest, until now still give a strong influence for the religious social life of the surrounding community and even the community from outside. Petta Ale'e is believed to have advantages and sanstutyso that people always give offerings to him as a thank you for protecting from calamity, giving fortune and so forth. This belief has traditionally, if violated is believed to bring misery, although the people also practice Islam well so that most of the people consider that belief in Petta Ale'e is considered very contrary to Islamic aqidah.

Abstract

Abstract The problem of destruction of the ecosystem of Muria has occured for years. Unfortunately, there are no serious and effective efforts to address that problem. This ineffectivity is the result of the lacks of collaboration amongst stakeholders in managing natural and environment resources in Muria Area. Although there are initiatives from various parties, including government, universities, NGOs, and local community, those are sporadic and not integrated. Moreover, those exclude the community’s social capital for Muria forest conservation. This papers aims to draw the social capital in Rahtawu, particularly associated with forest conservation efforts in Muria. Using phenomenological approach, the writer tries to explore social capital in Rahtawu, Kudus through interviews and participant observation. The findings underline (a) social norms, trust and networks as social capital forms and (b) sedekah bumi, sambatan, not to performing wayang puppet show, and not to chopping woods as the social capital manifestation to preserve Muria ecosystem. Keywords: social capital, sedekah bumi, sambatan Abstrak Permasalahan kerusakan ekosistem Muria sudah berlangsung demikian lama, tetapi belum tampak adanya upaya penyelesaian yang berarti, berbagai upaya yang dijalankan oleh berbagai pihak terlihat masih kurang efektif. Salah satu penyebab ketidakefektifan ini adalah lemahnya kolaborasi antarpihak yang berkepentingan dalam pengelolaan sumber daya alam dan lingkungan di kawasan Muria. Masing-masing pihak yang berwenang dan berkepentingan belum mampu bersinergi dengan baik dan masih berjalan sendiri-sendiri. Beberapa inisiatif dari beberapa pihak, baik dari instansi pemerintah, universitas, LSM maupun masyarakat bermunculan, tetapi masih bersifat sporadis dan belum terintegrasi Selain itu, inisiatif tersebut tampaknya melupakan modal sosial yang ada dalam komunitas yang peduli dengan pelestarian hutan Muria. Tulisan ini bertujuan untuk mengetahui modal sosial yang ada di Desa Rahtawu dan bentuk modal sosial yang berkaitan dengan upaya pelestarian Hutan Muria. Melakukan pendekatan fenomenologis, penulis berusaha menggali dan mengetahui modal sosial yang ada di Desa Rahtawu, Kabupaten Kudus melalui wawancara dan p e n g a m a t a n t e r l i b a t . Hasil temuan menunjukkan bahwa: (a) terdapat modal sosial berupa norma sosial, kepercayaan dan jaringan; dan (b) bentuk modal sosial yang berhubungan dengan upaya pelestarian hutan Muria mencakup sedekah bumi, sambatan, tidak nanggap wayang, dan tidak menebang pohon sembarangan. Abstract

Memperkuat adat bisa bermata dua jika hanya terfokus pada romantisasi “ideologi harmoni” tanpa memeriksa relasi produksi dan kelas dalam masyarakat adat kontemporer. Merespon kebijakan-kebijakan yang dilakukan oleh negara dan investasi, gerakan masyarakat adat di Tanah Papua harus mampu merefleksikan diri dalam hubungan dengan perubahan di internal diri mereka merespon perubahan yang diangkut oleh pembangunan dan investasi. Hanya dengan memahami konteks inilah masyarakat adat di Papua akan mampu untuk mengambil langkah-langkah aksi dalam menegakkan martabatnya.

Abstract

This article is aimed at reporting some socio-cultural factors that may have constrained the improvement of the competitive advantage of Indonesian small and medium enterprises (SME). Based on the data collected from metal industries in four locations, namely Sukabumi, Tegal, Ceper and Pasuruan, the study found that the products of these industries, especially automotive parts and components have not been not able to compete in local markets with those from China, not to mention those from Japan and other advanced industrial nations, both in quality and price. Using social capital approach in depicting the existing industries’ situation the study puts forward some important socialcultural factors that have contributed to the competitive disadvantage. These include: (1) the inability to depart from traditional way producing goods in which the quality of products is largely dependent on the skills of a master or “mpu” instead of systematic scientific knowledge as a characteristic in modern industries; (2) a subsistent mentality indicated by the reluctance to develop into a bigger industry which is beyond the controllability of the owner/manager; and (3) the reluctance to form and commit in an industrial association, while this kind of organization may prevent members from cut-throat competition as has prevailed until recently. The study concludes as long as the situation remains, the products of these industries will remain to stay in the lower segment of the market, and more importantly, these industries will have very little chance of becoming business partners and suppliers of parts and components for big assembling industries. This means that in the foreseeable future the local markets will still be flooded by imported metal industrial products, and foreign small and medium metal industries will still hold a dominant position as suppliers for local automotive assembling industries.

Abstract

This paper explains the ways state universities construct the meaning as well as implementing the idea of autonomy and governance. Cases studies were conducted, which involved three Indonesian state universities, namely the University of Indonesia, the Syarif Hidayatullah Islamic State University, and the Jakarta State University. Through the Trakman’s model (2008) about the university governance, this paper underlines that there is no appropriate model to explain the autonomy and governance of Indonesian state universities. Result shows that the state’s role in the state universities is still dominant, both in the academic area, such as curriculum and dissemination of knowledge, and in the nonacademic area, such as finance; therefore, the autonomy seems to be taken for granted instead of being embedded. Moreover, there is ambivalence due to the state’s limited budget, which then allows the market and the global providing fund for higher education.

Abstract

Stigma nelayan kecil tidak memiliki konstribusi pada ketahanan pangan tidak selalu benar. Nelayan kecil adalah satu-satunya kelompok sosial yang memberikan asupan makanan dengan mudah untuk penyediaan kebutuhan ikan konsumsi. Paling tidak kebutuhan ikan konsumsi untuk keluarganya terpenuhi. Hal ini tidak terjadi pada perikanan tangkap skala besar yang lebih ditujukan untuk memenuhi kebutuhan ekspor ikan. Pemerintah Indonesia tampaknya lebih memilih meningkatkan ekspor hasil perikanan dibandingkan dengan memikirkan kebutuhan konsumsi ikan dalam negeri. Tulisan ini merupakan hasil penelitian yang menggunakan pendekatan kualitatif dengan menyebar kuesioner kepada rumah tanggal nelayan kecil secara terbatas di kota Kendari, Sulawesi Tenggara. Dari Hasil penelitian menunjukan bahwa kontribusi nelayan kecil untuk kebutuhan konsumsi ikan lokal terpengaruh sejak adanya kebijakan moratorium perikanan tangkap karena sebagian nelayan kecil mulai tertarik untuk memasok kebutuhan industri pengolahan hasil ikan. Hal ini tentu saja mempengaruhi pasokan kebutuhan ikan konsumsi lokal. Stigma against small scale fishery as poor fisherman who doesn’t contribute toward country still often happens. Stigma against that small fisherman is not always true. Fishermans are the only social group that gives food intake for people provision of food. In developed country, including Indonesia, Government’s awareness against food security is so low. Government prefer to increase fish export product than food security. This article is written from research result in Kendari, which shows that small scale fishery contribution is large enough, which is more than the local fish consumption. Problem comes with the decrease of fish supply for local consumption because so many small scale fisheries begin to supply fishery industry need as the impact of government policy. This actions greatly affects the local food security.

Abstract

This article discusses political poetry that occurs during Indonesian’s election campaign, specially presidential campaign 2014. Both of competed parties, such as Prabowo’s side (KMP) and Jokowi’s side (KIH) peformed their own political poetry and reciprocate each other, on the contrary there are some of poetry made by society. Apart from read out, the poetry also appears in social media. The emersion of this poetry is quite enticing, although it is not an utterly new phenomena. The political poetry 2014 adds new polemic space, diversity of vision and mission and program that offered by candidate and elector. The political poetry indeed is a form of moderate media, thrifty, cultured, and have high moral standard in campaign besides using open campaign and mass support. It is just still be found some of poetry that contain mockery, agitation, shows resentment and jealousy, moreover offend president candidate personal.
