Jurnal Masyarakat dan Budaya (JMB) or Journal of Society and Culture is a peer-reviewed journal that aims to be an authoritative academic source on the study of society and culture. We publish original research papers, review articles, case studies, and book reviews focusing on Indonesian society, cultural phenomena, and other related topics. A manuscript describing society and culture outside Indonesia is expected to be analyzed comparatively with the issues and context in Indonesia. Abstract

This article is a brief account on the introduction and development of the concept of social exclusion in the intellectual discourse and national policy, primarily in the western countries. The concept, which is multidimensional in nature, is a new paradigm that seeks to explain deprivation and poverty in the light of asymmetric relations between the exclusive groups who command a variety of resources and the ones who are made disadvantageous. The concept, first introduced in France in 1974 to explain the erosion of solidarity among the French society, has sinced been adopted in many western countries and developing countries alike, to explain the causes social discontents of the excluded. Despite its relatively successful application as policy guidelines to minimize deprivation in many European countries, the concept has not yet been widely known in Indonesia. While, many forms of social exclusion have been part of social and cultural life in the archipelago since the historical past, in fact, the concept of social exclusion as a scientific approach has not been instrumental in explaining factors leading to the disadvantages and impoverishment of the deprivative groups. While another concept, social capital, has entered intellectual discourse since many years and has been used by many international assistance agencies as an approach in their development programs and projects, only a limited number of scientific papers on social exclusion have been found to address this issue. Abstract

Tenggarong Seberang subdistrict had been an agriculture area since the 1980s which was started when migrants were located there. The subdistrict had ever been a rice granary for Kutai Kartanegara Regency. To support the agricultural activity, the regency goverment developed a rice processing unit to increase the quality of rice from that place. However, while the coal mining activity around Tenggarong Seberang is increasing, at the same time the agricultural land has changed its function become a mining concession. Land grabbing has emerged between peasants who are consistant to work in agriculture and those who see the mining as an economic sector which will bring a more advance life. This paper attempts to understand how the peasants survive in their agricultural activity with all obstacles and from mining industry which continuously push to the agricultural areas. Abstract

This article discusses the influence of modern technology of fishing over the social life in a Muslim fishing community in South Thailand or Pattani. The advent of modern fishing technology to peoples fishing ground raises some problems in traditional fisher in Ru sembilan. Firstly, there is a drastically decreasing resource in fishing ground, so that they face difficulties in finding catchers. Secondly, their commercial access to fishing ground raises a conflict among them drives to financial lost. This paper also explains the Thailand government policy in handling fisher conflict to management and conservation on aquatic resources. It seems that the Thailand Monarchic Government is considered discriminate local fisher. When people stop using dangerous catching instrument, in other hands commercial fishers keep operating in their fishing ground. It cause the conflict dragging continuously. Abstract

Tak dapat dipungkiri bahwa selama ini penyandang disabilitas kerap mengalami diskriminasi pada aneka bidang kehidupannya. Kenyataan ini secara umum terjadi akibat stereotype dan stigmatisasi di tengah masyarakat yang maujud dalam bentuk pandangan yang keliru tentang penyandang disabilitas. Prinsip kesetaraan (equality) dan nondiskriminasi sebagai prinsip dasar Hak Asasi Manusia menjadi landasan pijak dalam menghormati hak-hak penyandang disabilitas. Prinsip kesetaraan, dalam arti kesetaraan substantif (substantive equality model), mengandung makna kesetaraan yang memberikan ruang bagi penyandang disabilitas untuk beroleh kesempatan yang sama dengan non-disabilitas pada seluruh lapangan kehidupan. Konsep Kesetaraan substantive ini mendorong dibuatnya langkah-langkah positif (positive measures) yang menekankan pada akomodasi kekhasan yang ada untuk menyingkirkan rintangan (removing barriers) yang selama ini dihadapi. Hingga para penyandang disabilitas sejalan dengan martabat yang melekat, terpenuhi hak-haknya, dan untuk dapat berkontribusi di tengah-tengah masyarakat sesuai dengan pengembangan potensinya masing-masing, sebagai bagian tak terpisahkan dari masyarakat. Kata kunci: penyandang disabilitas, langkah-langkah positif, kesetaraan, hak asasi manusia Persons with disabilities have mostly been experienced a long history of discrimination, exclusion, deprived of liberty, and even dehumanization. A sequence of various stigmatisation and stereotype concerning disability were taken into account. They have been suffered from discrimination on both direct and indirect ways. It was a social model of disability which subsequently led to human rights based approach of disability; appoint a new horizon to perceive disability within a comprehensive pathway in the society as a whole. It comes from human rights values which accented on equality and non-discrimination as the main principles of human rights. Equality in terms of substantive equality model drives its robust landscape of disability in light of protection and fulfilment of the rights of persons with disabilities as disadvantaged group, toward the uttermost participation in the society. Substantive equality is the notion of worth and benevolence. It is sustain to conferring the positive measures as a means to achieve the genuine equality of persons with disabilities, as well as a driving force to make their rights real. Abstract

Marriage,as a holy tie between persons, can be analysed from two perspectives: as a tradition and an aspect regulated by state law. In a certain circumstance, the tradition of marriage can be different or even in opposition to state’s marriage formal law. The marriage system of Wong Sikep in several regions in Central and East Java Provinces can be seen as one important example. Based on library research, this article analyzes the issue of legal pluralism that potentially occurs because of the implementation of multi laws in a certain field in a society - state law and adat law -. It shows how Wong Sikep communities respond differently to marriage formal system implementation, part of them still practice their adat law purely and some others who have conducted adjustment with state’s (marriage) law. Abstract

The technological changes and market economic orientation are factors affecting the change of activities of both male and female workers as well as distribution of work in the household. On the fisher societies, the technological changes have made female workers to involve from productive to pasca productive activities. That also change distribution of work on male and female workers. Firstly, both of husband and wife do together in productive and pasca productive activities, such as fishing and fish processing, and both of them also conduct a domestic activities. Due to technological changes, fishing activitities is only conducted by male (husband), while female (wife) do fish processing, marketing and also domestic activities. In other words, technology changes tend to set free a male from domestic activities (household duties).

Abstract

Studies of the noken system from the legal approach have been thoroughly investigated, particularly in the 2009 and 2014 elections and the 2014 presidential election in Papua. Several studies of state’s law explain that the noken system is legitimate according to Indonesian laws due to cultural characteristics of Papuan following Melanesian traditions. Different from those studies, this paper examines the noken system according to Habermas’ theoretical framework of deliberative democracy. This study argues that the noken system is strongly powerful as various cultural communities of native Papuans discuss it. The discussions are discursive practices and contestations to determine political decisions, such as certain political figure or political party to be voted in the election. The essence of the noken system is, therefore, a community's participation via consultations and discussions in deciding political choices collectively. Using literature review, the author discusses the implementation of the noken system in Papua province related to the concept of deliberative democracy. Findings indicate that the implementation of noken system reflects the practices of deliberative democracy, proposed by Habermas, at the village community level. In some cases, however, Papuan elites, who unilaterally decide all votes without any discussions and consent of their community, manipulate the noken system. Theoretically, the noken system shows that democracy is not only legislative procedures, but also an art of maintaining collectivism and social integration. Studi-studi mengenai legalitas penggunaan sistem noken dalam Pemilu 2009 dan 2014 dan pemilihan presiden 2014 di Papua telah banyak dilakukan. Beberapa studi menyatakan bahwa sistem noken tersebut sah dalam sistem hukum Indonesia karena menyesuaikan dengan karakteristik budaya orang Papua yang mengikuti tradisi Melanesia. Berbeda dengan studi tersebut, tulisan ini melihat sistem noken dalam perspektif demokrasi deliberatif Habermas. Studi ini berargumen bahwa sistem noken masih sangat kuat karena banyak didiskusikan oleh berbagai komunitas budaya orang asli Papua. Musyawarah dalam sistem noken merupakan praktik diskursif dan kontestasi untuk menentukan keputusan politik, seperti kandidat atau partai politik dalam Pemilu. Inti sistem noken adalah partisipasi masyarakat melalui konsultasi dan diskusi dalam menentukan pilihan politik secara kolektif. Dengan tinjauan pustaka, artikel ini membahas pelaksanaan sistem noken di Provinsi Papua terkait konsep demokrasi deliberatif. Temuan penelitian menunjukkan bahwa penerapan sistem noken menggambarkan praktik demokrasi deliberatif di tingkat masyarakat desa. Namun, dalam beberapa kasus, sistem noken dimanipulasi oleh elit Papua, yang secara sepihak memutuskan semua suara tanpa adanya diskusi dan persetujuan dari komunitas. Secara teoritis, sistem noken menunjukkan bahwa demokrasi bukan hanya prosedur legislatif, tapi juga seni dalam menjaga kolektivisme dan integrasi sosial.
