Abstract

Amid ASEAN’s institutional deadlock and the region’s failure to address grave human rights violations such as the crisis in Myanmar, this study examines Indonesia’s constitutional stance on universal jurisdiction. This research addresses a fundamental paradox: how a state fundamentally built upon the principle of humanity (Pancasila) can constitutionally justify restrictions on jurisdictional instruments designed to adjudicate crimes against humanity. Using a normative legal methodology with a comparative lens (Germany and Argentina), this research evaluates the legal reasoning behind Constitutional Court Decision No. 89/PUU-XX/2022. Rather than merely assessing the legal status of international customary law, the findings highlight how the Court utilised the doctrine of ‘open legal policy’ to reject the mandate of international jurisdiction in the interests of national stability and constitutional identity. Ultimately, this article offers a new conceptual framework for the Global South (developing countries), demonstrating how developing countries can exercise legitimate constitutional resistance to the extraterritorial reach of international criminal law whilst firmly upholding their domestic humanitarian commitments.

Abstract

Mandatory sustainability reporting is an important method for evaluating and monitoring sustainable development. Therefore, this study aimed to explore the feasibility of adapting the principles underlying the EU's Corporate Sustainability Reporting Directive to enhance the sustainability reporting framework in Indonesia. A normative legal study method was used with a comparative approach to provide relevant analysis. The results showed that the direct modelling of the EU’s legal framework for mandatory sustainability disclosure was unrealistic for Indonesia due to the substantial disparity in legal development between the jurisdictions. This study contributed to the literature by proposing a novel regulatory sandbox framework as a transitional legal mechanism for Indonesia to adapt EU CSRD principles into the sustainability disclosure policy. Unlike direct transplantation approaches, this phased experimental model enabled evidence-based policy development while accounting for institutional capacity gaps and a fragmented regulatory landscape. The proposed framework offered a practical pathway for developing economies to bridge the developmental gap in sustainability disclosure requirements without imposing premature financial burdens on enterprises.

Abstract

The use of undercover investigation techniques in combating narcotics crimes has increased in response to the growing complexity of organised crime. However, the Indonesian legal framework governing these techniques remains fragmented across sectoral regulations and is not comprehensively integrated into criminal procedure law, limiting procedural oversight and investigative accountability. This study examines how regulatory fragmentation affects the implementation of the dominus litis principle and proposes a reconstruction model to strengthen procedural supervision. The research uses a prescriptive normative legal method, drawing on statutory, conceptual, comparative, and case approaches. The findings demonstrate that fragmented regulations confine the dominus litis function primarily to prosecutorial control after the investigation stage, preventing effective preventive supervision over investigative legality and evidence acquisition. To address this limitation, the study proposes the Integrated Procedural Supervision Model, which positions public prosecutors as procedural supervisors while preserving investigators' institutional independence. The model is founded on the principles of integrated criminal justice, procedural supervision, accountability, and procedural justice. This study contributes to the development of Indonesian criminal procedure law by reconceptualising the dominus litis principle as a procedural supervisory mechanism and providing normative recommendations for harmonising regulations governing undercover investigation techniques.

Abstract

This study examined the normative legitimisation of diversion and restorative justice within Indonesia's juvenile criminal justice system (SPPA Law) and Islamic criminal law, and explored the implications for strengthening the reform. This study adopted a normative legal approach using statutory and conceptual methods. Primary legal materials included Law No. 11 of 2012 on the SPPA Law, Law No. 1 of 2023 on the Criminal Code, Law No. 1 of 2026 concerning the Adjustment of Criminal Provisions, Supreme Court Regulation No. 1 of 2024, Attorney General Regulation No. 15 of 2020, and Indonesian National Police Regulation No. 8 of 2021, supported by legal doctrines as well as classical and contemporary fiqh jinayah literature. The results showed that diversion possessed dual normative legitimacy, deriving from Indonesia's positive legal framework and Islamic criminal law through the principles of ta'zir, maqāṣid al-syarī'ah, justice (al-'adl), reconciliation (iṣlāḥ), compassion (raḥmah), and public interest (maṣlaḥah). This study proposed a Dual Normative Legitimacy Model that integrated national law and Islamic legal principles as a framework for implementing diversion. The proposed model contributed to juvenile criminal justice reform by strengthening regulatory harmonisation, promoting child protection, enhancing victim restoration, and supporting sustainable social reintegration.
