Abstract

Government policies by legitimizing the presence of the omnibus law on copyright work, socially and legally have an impact on labor and workers. The reason is that this controversial law is considered to be very detrimental to labor and workers. The purpose of this study was to analyze the extent to which social impacts were generated after the government legal sociological perspective of the work copyright omnibus law was passed. This study uses a qualitative approach and descriptive methods and is equipped with literature study data collection. The results of the study conclude that the sociology of law responds to the rejection of the omnibus law on work copyright done by workers and labor because it will have an effect on social impacts that have implications for demonstrations of labor and workers nationally.

Abstract

AbstractThe unemployment rate in Indonesia has soared high enough since August 2020 with a total of 9,77 million person, while data on foreign labor recorded in 2020 amounted to 98.902 person. From this data, foreign workers from China rank first, namely 35,781 people or the equivalent of 36.17%. The research purposes are, firstly, to analyze the legal aspects of foreign labor in terms of national responsibility which is closely related to Article 27 verse (2) of the Constitution of 1945; secondly, to analyze the efforts to protect Indonesian employment law in terms of the national responsibility which is closely related to Article 27 verse (2) of the Constitution of 1945. This research used descriptive analytical method with normative juridical approach. Aspects of foreign employment law in terms of national responsibility are seen in the regulation of the control of foreign labor which can only be done in a work relationship for a certain time. Even though this needs to be emphasized regarding legal protection and social welfare insurance like domestic workers. In addition, in terms of supervision of foreign workers, there should be no imbalance in rights and obligations between foreign workers and domestic workers.. Efforts to protect Indonesian labor law in terms of the national responsibility can be seen in the implementation of efforts to educate and train domestic labor in order to improve competency standards that are able to compete with foreign labor.AbstrakAngka pengangguran di Indonesia melonjak cukup tinggi terhitung sejak Agustus 2020 dengan jumlah 9,77 juta orang, sementara data Tenaga Kerja Asing (TKA) pada tahun 2020 tercatat berjumlah 98.902 orang. Berdasarkan data tersebut, TKA yang paling banyak di Indonesia berasal dari Negara China yaitu 35.781 orang atau setara 36,17%. Tujuan penelitian ini adalah, pertama untuk  menganalisis aspek hukum ketenagakerjaan asing ditinjau dari tanggungjawab negara yang memiliki kaitan erat dengan Pasal 27 ayat (2) Undang-Undang Dasar Tahun 1945; kedua untuk menganalisis upaya perlindungan hukum ketenagakerjaan Indonesia ditinjau dari tanggungjawab negara yang memiliki kaitan erat dengan Pasal 27 ayat (2) Undang-Undang Dasar Tahun 1945. Penelitian ini dilakukan dengan metode deskriptif analitis menggunakan pendekatan yuridis normatif. Aspek hukum ketenagakerjaan asing ditinjau dari tanggungjawab negara dilihat pada pengaturan atas pengendalian TKA yang hanya dapat dilaksanakan dalam hubungan kerja pada waktu tertentu. Malahan perlu ditekankan mengenai perlindungan hukum dan jaminan kesejahteraan sosial layaknya tenaga kerja dalam negeri. Selain itu, dalam hal pengawasan tenaga kerja asing seharusnya tidak ada ketimpangan hak dan kewajiban antara tenaga kerja asing dan tenaga kerja dalam negeri. Upaya perlindungan hukum ketenagakerjaan Indonesia ditinjau dari tanggungjawab negara ini dapat dilihat pada implementasi mengenai upaya mendidik dan melatih tenaga kerja dalam negeri guna meningkatkan standar kompetensi yang mampu bersaing dengan tenaga kerja asing.

Abstract

Minority groups often get discriminatory treatment from the surrounding socio-political environment .Therefore, They always fight for their right through political path. This study examines the role of an actor in fighting for the minorities’ right in parliament by highlighting the case of Jalaludin Rakhmat when he was a member of the House of Representatives Council in 2014-2019. The focus of this study is highlighting the political role of Jalaludin Rakhmat in fighting for the interests of the Syiah Group in the DPR, including describing the various dynamics along with it. The method used in this study is qualitative by collecting in depth-interview data with Jalaludin Rakhmat, several PDIP politicians, Syiah figures in West Java, and socio-political observers. The documents reading related to Jalaludin Rakhmat’s activities in both scientific journals and national news was also carried out to deepen the context and issues of Syiah in Indonesia. The results of this study revealed that Jalaludin Rakhmat’s role in legislative represents an actor-centered effort to intervene in the political process which aims to provide space for Syia groups to fulfill their various interests. However, from its political intervention efforts, it turned out that there were not many pro-Syia policy products.The success of Jalaludin Rakhmat’s intervention can not be determined only by the ability of the actor, but also by the political structure in the DPR. In addition, the identity attached to an actor also affects the success of his achievements in fulfilling his interests. Minority interest issues are still considered politically disadvantageous for political parties. This study concludes that minority actors who make it into parliament do not necessarily correlate with the opening of the political system to the struggle of minority groups.

Abstract

Abstract: The implementation of electronic business licensing with the aim of encouraging and increasing investment in Indonesia. However, the entire process is still not managed online and the sharing of data that has not been integrated between agencies allows the licensing process to still exist and have long obstacles. This study aims to explain the implementation of business providing services in Indonesia according to Government Regulation Number 24 of 2018 concerning Electronic Business Licensing Services and explain the obstacles to investment licensing in Indonesia based on PP No. 24 of 2018 concerning electronic licensing services with legal certainty. This research uses a descriptive-analytical method with a normative juridical approach. This study explains that investment licensing in Indonesia has not gone well because there are still obstacles such as aspects of regulation, system, and management. So this does not provide legal certainty guarantees to investors who will carry out investment activities in Indonesia. It is hoped that this research will provide a solution to the problem of investment and investment licensing in Indonesia.Abstrak: Penyelenggaraan perizinan berusaha secara elektronik oleh pemerintah dilakukan dengan tujuan untuk mempercepat dan meningkatkan penanaman modal di Indonesia. Namun seluruh proses masih belum diurus secara online dan data sharing yang belum terintegrasi antar instansi mengakibatkan proses perizinan masih menemui hambatan dan birokrasi yang panjang. Penelitian ini bertujuan untuk menjelaskan implementasi layanan pemberian izin berusaha di Indonesia menurut Peraturan Pemerintah Nomor 24 Tahun 2018 tentang Pelayanan Perizinan Berusaha Secara Elektronik, dan menjelaskan hambatan perizinan investasi di Indonesia berdasarkan PP No. 24 tahun 2018 tentang pelayanan perizinan berusaha secara elektronik hubungannya dengan asas kepastian hukum. Pada penelitian ini menggunakan metode deskriptif analitis dengan pendekatan yuridis normatif. Hasil penelitian ini menjelaskan implementasi perizinan investasi di Indonesia belum berjalan baik, karena masih terdapat hambatan-hambatan seperti aspek regulasi, sistem, dan tata laksana. Sehingga hal tersebut belum memberikan jaminan kepastian hukum kepada investor yang akan melakukan aktivitas investasi di Indonesia. Diharapkan melalui penelitian ini dapat memberikan solusi terhadap masalah perizinan investasi dan penanaman modal di Indonesia.

Abstract

In navigating the household ark, disharmony cannot be avoided, one of which is the result of neglecting rights and obligations that lead to the breakdown of the marriage. One of the consequences was the burden on the husband to pay for the madhiyah, iddah, and mut'ah livelihoods. The wife has the right to request payment of maintenance to the Religious Court if the husband does not fulfill his obligation to provide for his services. This study aims to discuss the legal basis and considerations of the panel of judges in determining the levels of the amount of madhiyah, iddah, and mut'ah. This study uses normative juridical research to examine statutory regulations related to determining the amount of madhiyah, iddah, and mut'ah. The results showed that First. The basis for determining the amount of income for the former husband is adjusted according to the ability of the husband as stated in Presidential Instruction No. 1 of 1991 concerning KHI, Law no. 1 of 1974, and SEMA No. 3 of 2018 Results of the Plenary of Religion point 2 as the refinement of SEMA No. 7 of 2012 number 16 and Article 149 letter b of the KHI. In the case of divorce talak (Article 8 number (3) letter (c) PERMA No. 3 of 2017) the maintenance of mut'ah and iddah is paid together with the pledge of divorce when pronounced by the Petitioner. Second, the judges' judgment regarding the determination of the level of the amount of living is based on, a) the wife does not commit nusyuz, b) the economic condition of the husband, c) based on the consideration of the reasonable needs of each party.

Abstract

This study aims to measure the level of appreciation and practice of the values of Pancasila as the ideology of the Indonesian nation as a whole so that the values in it can really be applied in the life of the nation and state. This research uses a normative-empirical method, namely by combining legal research methods that not only view the law as a prescriptive and applied discipline but also have a descriptive nature based on the reality of the development of law itself in society. There are several phenomenal events that are closely related to Pancasila, where these events illustrate that noble values that are actually respected and upheld are still vulnerable to being exploited by their sensitivity by some groups for imaging purposes without paying attention to the noble values of Pancasila. Pancasila is vulnerable to being used as a political commodity so that certain groups feel that it is Pancasilaist and other groups are not Pancasilaist. The results of this study provide an indication that all groups should be able to place Pancasila as an ideology in the nation and state and become a joint evaluation in revitalizing the noble values contained in Pancasila as the basic rules, guidelines, and philosophy of life of the Indonesian nation that must be practiced as the embodiment of Bhineka Tunggal Ika.Penelitian ini bertujuan untuk mengukur tingkat penghayatan dan pengamalan nilai-nilai Pancasila sebagai ideologi bangsa Indonesia secara utuh, sehingga nilai-nilai di dalamnya benar-benar dapat diterapkan dalam kehidupan berbangsa dan bernegara. Penelitian ini menggunakan metode normatif-empiris, yaitu dengan cara melakukan penggabungan metode penelitian hukum yang tidak hanya memandang hukum sebagai disiplin yang bersifat preskriftif dan terapan, namun sekaligus bersifat deskriptif yang didasarkan pada kenyataan perkembangan hukum itu sendiri di masyarakat. Ada beberapa peristiwa fenomenal yang erat hubungannya dengan Pancasila, di mana peristiwa ini memberi gambaran bahwa nilai-nilai luhur yang sejatinya dihormati dan dijunjung tinggi masih rentan dimanfaatkan sensitivitasnya oleh sebagian kelompok untuk kepentingan pencitraan tanpa memperhatikan nilai-nilai luhur Pancasila. Pancasila rentan dijadikan sebagai komoditas politik, sehingga meng­anggap bahwa golongan tertentu merasa Pancasilais dan kelompok lain tidak Pancasilais. Hasil penelitian ini memberikan petunjuk bahwa seharusnya semua kelompok dapat menempatkan Pancasila sebagai ideologi dalam berbangsa dan bernegara, dan menjadi evaluasi bersama dalam merevitalisasi nilai-nilai luhur yang terkandung dalam Pancasila sebagai aturan dasar, pedoman dan falsafah hidup bangsa Indonesia yang harus diamalkan sebagai perwujudan Bhineka Tunggal Ika.

Abstract

To ensure environmental sustainability, environmental management must be supported by the enforcement of environmental law through litigation process, whether on criminal, civil, or administrative aspects.  (In Indonesia, there are numerous cases of environmental losses, as well as examples of environmental damage that have been attempted on the court of mandalawangi, natural kallista and sungailiat cases.) The purpose of this research is to find out the extent of court decisions’s consistencies  on environmental cases Using normative legal research method, this research examined three court decisions form two different types of court, which are criminal court (Sungai Liat case) and civil court (Mandalawangi case and Kalistas case). It was found that these judicial decisions show inconsistencies. This condition may weaken the enforcement of environmental law in Indonesia. On the other hand, this difference in judgments may be apprehended as a new standpoint of environmental law in Indonesia. Keberlangsungan pengelolaan lingkungan hidup harus ditunjang dengan penegakan hukum lingkungan, baik melalui jalur peradilan maupun luar peradilan, baik yang bersifat perdata, pidana, maupun administrasi. Penelitian ini mengkaji tiga kasus lingkungan hidup yang diselesaikan melalui peradilan pidana dan perdata, yaitu Kasus Mandalawangi, Kasus Kallista Alam dan Kasus Sungailiat. Tujuan penelitian ini adalah untuk mengetahui problematika penegakan hukum lingkungan hidup di Indonesia, dan untuk mengetahui dampak dari konsistensi putusan hakim dalam perkara lingkungan di Indonesia yang berbeda-beda. Untuk mencapai tujuan tersebut, ketiga putusan hakim tersebut di atas dikaji dengan menggunakan metode penelitian hukum normatif. Hasil penelitin menunjukkan bahwa ketiga kasus tersebut diputuskan secara berbeda. Inkonsistensi tersebut dapat menjadi faktor pelemahan penegakan hukum lingkungan di Indonesia. Namun di samping itu dapat dimaknai sebagai suatu pandangan baru terhadap ketentuan lingkungan hidup di Indonesia.

Abstract

The phenomenon of inter-state marriage in Indonesia has an influence on legal actions in it, especially the issue of children born and having dual citizenship after Law Number 12 of 2006 concerning Citizenship was passed by the Government. This study aims to measure the extent to which children born from these marriages get inheritance rights with underage positions. In addition, what is the legal status based on Law Number 1 of 1974 concerning Marriage and Law Number 5 of 1960 concerning Land regarding the position of land inheritance rights. This study uses an empirical normative method, which combines legal research methods that not only view law as a prescriptive (determining) and applied scientific discipline, but also descriptive (explaining) based on the reality of legal developments in society. The results of this study indicate that children born from inter-state marriages who have dual citizenship and are still minors are entitled to land inheritance rights in the form of property rights provided that the child must choose Indonesian citizenship at the age of 18 (eighteen) years based on the laws and regulations. valid invitation.Fenomena perkawinan antar negara di Indonesia memberi pengaruh dalam perbuatan hukum di dalamnya, terutama persoalan anak yang lahir dan memiliki kewarganegaraan ganda setelah Undang-undang Nomor 12 Tahun 2006 tentang Kewarganegaraan disahkan oleh Pemerintah. Penelitian ini bertujuan untuk mengukur sejauh mana anak yang dilahirkan dari perkawinan tersebut mendapat­kan hak waris dengan kedudukan masih di bawah umur. Selain itu bagaimana status hukumnya berdasarkan Undang-undang Nomor 1 Tahun 1974 tentang Perkawinan dan Undang-undang Nomor 5 Tahun 1960 tentang Pertanahan terhadap kedudukan hak waris tanah. Penelitian ini menggunakan metode normatif empiris, yaitu melakukan penggabungan metode penelitian hukum yang tidak hanya memandang hukum sebagai disiplin ilmu yang bersifat preskriftif (menentukan) dan terapan, namun sekaligus bersifat deskriptif (memaparkan) yang didasarkan pada kenyataan perkembangan hukum di masyarakat. Hasil penelitian ini memberikan petunjuk bahwa anak yang dilahir­kan dari perkawinan antar negara yang berkewarganegaraan ganda dan masih di bawah umur berhak atas hak waris tanah berupa hak milik dengan ketentuan anak tersebut harus memilih kewarganegaraan Indonesia pada saat usianya 18 (delapan belas) tahun berdasarkan peraturan perundang-undangan yang berlaku.

Abstract

The existence of local political parties in Indonesia is a tangible form of the existence of special autonomy in a certain area. The specificity of a certain area is regulated in the 1945 Constitution Article 18B paragraph (1). In addition, the formation of local political parties is one of the human rights in the political field, as stated in Article 28E paragraph (3) of the 1945 Constitution. The research method uses a normative juridical approach with secondary data and analyzed descriptively qualitatively. Based on research, Papua Province has the right to form political parties (see Article 28 paragraph (1) of the Papua Province Special Autonomy Law). However, the phrase "political party" is considered to have multiple interpretations, thus creating legal uncertainty. Through the decision of the Constitutional Court Number 41/PUU-XVII/2019, the legal uncertainty can be guaranteed by the Constitutional Court Decision. In the future, by looking at the background and real needs of the Papua Province, it is possible to form a Local Political Party in the Papua Province, considering the condition of the Papua Province as a special autonomous region.Partai politik lokal di Indonesia merupakan wujud nyata adanya otonomi khusus di suatu daerah. Kekhususan suatu daerah diatur dalam UUD 1945 Pasal 18B ayat (1). Selain itu, pembentukan partai politik lokal merupakan salah satu hak asasi manusia di bidang politik, sebagaimana tercantum dalam Pasal 28E ayat (3) UUD 1945. Metode penelitian menggunakan pendekatan yuridis normatif dengan data sekunder dan dianalisis secara deskriptif kualitatif. Berdasarkan penelitian, Provinsi Papua berhak membentuk partai politik (lihat Pasal 28 ayat (1) UU Otsus Provinsi Papua). Namun, ungkapan “partai politik” dianggap memiliki multitafsir sehingga menimbulkan ketidakpastian hukum. Melalui putusan MK Nomor 41/PUU-XVII/2019, ketidakpastian hukum dapat dijamin oleh Putusan MK tersebut. Ke depan, dengan melihat latar belakang dan kebutuhan riil Provinsi Papua, dimung­kinkan dibentuknya Partai Politik Lokal di Provinsi Papua, mengingat kondisi Provinsi Papua sebagai daerah otonomi khusus.

Abstract

The public understands early marriage as stated in Law No. 16 of 2019 concerning Marriage as an amendment to Law Number 1 of 1974 that child marriage occurs at the age of under 19 years for both men and women and or those who have not reached puberty. This paper aims to examine the shift in the public's perspective on the practice of early marriage explicitly that occurred in Bone Regency, South Sulawesi, and its relation to Human Rights. This study uses qualitative descriptive data analysis techniques with stages; data reduction, data presentation, and conclusion. Researchers conducted interviews with informants who had been selected through snowball sampling and purposive sampling techniques. This study shows that the community's response to early marriage has changed along with the times, namely that in the past people considered early marriage as a way to maintain family honor, but is now considered a family disgrace. Factors for early marriage include promiscuity; the honor of family and relatives, local customary norms, less educated parents, and the economic burden of the family. Meanwhile, from a human rights perspective, the practice of child marriage is a serious part of child abuse concerning the right to education and employment.Masyarakat memahami pernikahan dini sebagaimana tercantum dalam UU No. 16 Tahun 2019 tentang Perkawinan sebagai perubahan terhadap UU Nomor 1 Tahun 1974 bahwa pernikahan anak terjadi pada usia di bawah 19 tahun bagi laki-laki maupun bagi perempuan dan atau mereka yang belum akil baligh. Tulisan ini memiliki tujuan untuk mengkaji peralihan cara pandang masyarakat terhadap praktik pernikahan dini secara eksplisit yang terjadi di Kabupaten Bone Sulawesi Selatan serta kaitannya dengan Hak Asasi Manusia (HAM). Penelitian ini menggunakan teknik analisis data deskriptif kualitatif dengan tahapan; reduksi data, penyajian data, dan kesimpulan. Peneliti melakukan wawancara terhadap informan yang sudah dipilih melalui teknik snowball sampling dan purposive sampling. Penelitian ini memberikan hasil bahwa respon masyarakat terhadap pernikahan dini berubah seiring dengan perkembangan zaman, yakni yang dulunya masyarakat menganggap pernikahan dini sebagai salah satu cara untuk menjaga kehormatan keluarga, namun sekarang dianggap sebagai aib keluarga. Faktor terjadinya pernikahan dini diantaranya adalah pergaulan bebas; kehormatan keluarga dan kerabat, norma adat lokal, orang tua yang kurang terpelajar, dan beban ekonomi keluarga. Adapun jika dipandang dari perspektif HAM, praktik pernikahan anak merupakan bagian serius dari pelecehan anak sehubungan dengan hak atas pendidikan dan ketenagakerjaan.
