Abstract

Criminal sanctions cumulatively , impact / consequences of criminal acts in the field of Forestry is detrimental to the country's financial , economic and social sanctions it should not only a criminal sanctions to perpetrators with penalties as severe as a loss , but also must be considered a country with sanctions " action planning orderly " In addition to fulfilling a sense of justice should be the formulation of a criminal sanction criminal acts in the forestry sector carried out by civil servants or government officials , especially the officials who have authority in the field of forestry , which could increase the intensity of Forestry organized crime and formulated specifically that of course the formulation of sanctions the criminal is not the same as that carried criminal sanctions against people / person.

Abstract

This article examines the empirical facts about the failure of the state (government) to eradicate this already acute corruption. Although there are laws that regulate it and there is already a special commission to eradicate corruption, namely the KPK, many still fail. The main cause is that our law still adheres to the all-mechanical-formal-legalistic system built by legal positivism. So on that basis there needs to be a new formulation as an alternative effort to make Indonesia free from corrupt practices. This study uses two theoretical approaches, namely non-systemic law / chaos theory and prophetic law. According to chaos theory, Charles Sampford in his book entitled The Disorder of Law Critical of Legal Legal Theory is not seen as a system-mechanical building, but also as liquid reality. Chaos theory states, legal theory that must be understood as a system-mechanical chaos theory (according to the view of legal positivism) is clearly a mistake, that is a mistake from the beginning in photographing legal reality. The Prophetic law is one approach in understanding the contents of the verses of the Koran. This approach focuses more on empirical, historical and temporal aspects. In the prophetic paradigm, Kuntowijoyo understands that knowing God and learning revelation are important elements in explaining reality. He took this view from a Japanese scholar, Toshihiko Izutsu, who put up his work on the Semantic Al-Qur'an Field, in the title of God and Man in the Koran: Semantics of the Koranic Weltanchauung. Of the two new offers in the effort to eradicate corruption, it was found empirical facts that there is something wrong in understanding corruption itself so that it still remains a disease that threatens the moral of a nation. The key must be courage not to be confined in the shackles of the mechanically-formal-legalistic positivism of law.

Abstract

Pancasila in relation to the law always has a general tendency that Pancasila is placed as the highest part of the Indonesian legal pyramid model. Pancasila becomes contemplation, concerning efforts to put Pancasila at a standstill in accumulating information or continuing it as a national paradigm and if Pancasila is expected to shape the nation's way of thinking, then it should be like what we are behaving in a national context. in fact, Pancasila is an authentic feeling of the national paradigm which must be continually maintained and pass on those values to logical consciousness with intuitive reflection.

Abstract

Conservation of natural resources is a natural resource management whose utilization is done wisely to ensure the continuity of its availability by maintaining and improving the quality of diversity and value. Conservation of natural resources and ecosystems aims to achieve the realization of the sustainability of natural resources and the equilibrium of the ecosystem so that it can better support the efforts to improve the community welfare and the quality of human life. The problem are the implementation of conservation of natural resources and its ecosystem in the region based on Act No. 5 of 1990 and law enforcement against perpetrators of the conservation of natural resources and ecosystems. The research method used is legal research using a statutory and conceptual approach. The conservation of natural resources and ecosystems is based on preserving the ability and utilization of natural resources and their ecosystem in a harmonious and balanced environment. The conservation of natural resources and ecosystems is conducted through the protection of life-supporting systems, preserving the diversity of plant and animal species along with its ecosystem and the sustainable utilization of natural resources and ecosystem.

Abstract

The Board of Directors in carrying out the management of the company is subject to the principles of civil law. If the Board of Directors deviates from the principle, it is called conducting Ultra Vires. This action can certainly have positive and negative consequences for shareholders both majority and minority can test at the General Meeting of Shareholders. The ultra vires action by the directors is detrimental to the creditor, the legal mechanism that needs to be studied in more depth to get the answer. This study aims to analyze the legal protection of creditors for directors of limited companies conducting Ultra Vires and analyze legal remedies against restoring the creditor's rights to directors of limited companies conducting Ultra Vires. (1) Does the law regulate the protection of creditors for directors of limited companies conducting Ultra Vires ?; (2) How does the law restore creditor rights over the directors of the limited company to conduct Ultra Vires ?. With these legal issues, the basis for protecting third parties. These principles include the Goodwill Principle, the Pacta Sunt Servanda Principle and the Modern Ultra Vires Doctrine. By relying on these fundamentals, preventive legal protection and repressive legal protection can be given. Legal remedies for recovery are based on the first, actions containing aspects of repairing and preventing, and secondly, actions or efforts containing aspects aimed at recovering, including ratification and compensation.

Abstract

Selain memiliki nilai ekonomis, tanah dalam Pasal 6 UUPA dikatakan memiliki fungsi sosial, artinya, selain untuk kepentingan individu, tanah juga harus bermanfaat bagi pembangunan untuk kepentingan umum. Setiap kegiatan pembangunan untuk kepentingan umum tidak terlepas dari ketersediaan tanah sebagai ruang penyelenggaraannya. Pengadaan tanah untuk kepentingan umum dapat dilakukan secara langsung dengan para pemegang hak atas tanah, melalui cara jual beli, tukar menukar atau cara lain yang disepakati kedua belah pihak. Dengan demikian berarti pengadaan tanah secara langsung dapat diterapkan ketentuan hukum perjanjian sebagaimana dimaksud dalam Buku III KUHPer. Persoalannya mengapa setiap kegiatan pengadaan tanah yang dilakukan oleh pemerintah selalu menimbulkan sengketa, mengapa terjadi sengketa. Hal ini berarti bahwa ketentuan hukum perjanjian dalam proses pengadaan tanah belum maksimal dan belum menempatkaan masyarakat sebagai pihak yang turut serta dalam proses pembangunan. Oleh karena itu perlu dikaji dan dianalisis bagaimanakah asas-asas hukum perjajian dapat diterapkan pada proses pengadaan tanah untuk kepentingan umum dan menganalisis bagaimana asas-asas hukum perjanjian pada pola penetapan nilai/besaran ganti kerugian pada pengadaan tanah untuk kepentingan umum?. Ternyata pada proses pengadaan tanah bagi pembangunan untuk kepentingan umum yang dilakukan pemerintah dengan pemegang hak atas tanah terdapat asas-asas hukum perjanjian namun dalam penetapan besaran ganti kerugian tidak memungkinkan untuk menetapkan asas-asas hukum perjanjian karena keterkaitan dengan Pasal 6 UUPA dan Hak Menguasai Negara.

Abstract

Human being and living quality of their global community very depends on environmental condition. Then, various policies, regulation managements, law enforcement and technical supervision are conducted in attempts of biological environment conservation. However, a single market of such the global industrialization style gives a complex homework in ecological sector. On the Markplus Conference 2015, Hermawan Kartajaya reminded that the global industrialization, like the single market initiated by the AEC is potentially more dangerous than the AFTA (ASEAN Free Trade Area) and CAFTA (China-ASEAN Free Trade Agreement). He stated that if AFTA and CAFTA are concerned only with flow of goods, but MEA covers free flow of goods, people, services and money (capital and investment). Purpose of the writing is actually to show challenges that should be addressed when MEA establishes a single ASEAN market, especially be related to forest fire’s phenomenon. Results of the study showed that forest fire and the single ASEAN market has, consciously or not, created a new myth called rationality of commodity efficiency. Horkheimer and Adorno in their ' enlightenment dialectic' explained that efficiency, in economic, is a principle of market surpassing all kinds of feudal and religious restrictions. Thus, rationality is equated with efficiency. When efficiency is applied in dynamics of capitalist economy, then the entire field of human life is considered a commodity. Consequently, reification is in effect, namely when everything is a commodity so people is no longer enjoying but consuming and consuming without building any social relationships in a real sense. At such nadir, ecological damage is inevitable or it is even considered a reasonable price worth paying. The Law which is essentially an ethical conversation of human beings to produce justice is easily forgotten because of greed. However, all such excesses of reification can be avoided when the law is still pursued progressively, so the law must arrive at radicalism in order to demolish assumptions of law. Thus, it can be concluded that forest should not only be explored for its resources solely according to the reification trap of global industrialization market, but it must be preserved for future human posterity because of considering the deep ecology.

Abstract

Pancasila sebagai cita hukum (rechtsidee) bangsa Indonesia. Kedudukan Pancasila sebagai cita hukum mengandung konsekuensi bahwa tatanan norma dan norma-norma hukum harus bersumber dari nilai-nilai Pancasila. Nilai-nilai ideal yang terkandung dalam cita hukum tersebut kemudian diderivasi menjadi seperangkat asas-asas hukum umum yaitu asas negara hukum, asas demokrasi, asas perlindungan terhadap hak asasi manusia serta asas partisipasi publik dalam sistem penyelenggaraan negara. Asas-asas hukum di atas merupakan dasar sekaligus pedoman dalam membentuk norma-norma yang berlaku umum dan asbtrak. Dalam konteks pembentukan norma-norma hukum yang bersifat abstrak-umum, asas-asas hukum harus dijadikan landasan dan atau pedoman. Dalam konteks Mekanisme Seleksi Dewan Pengawas KPK ini, digunkan dua asas yng sudah diderivasi dari Nilai Cita Hukum Pancasila yaitu asas negara hukum material atau negara hukum material atau asas negara hukum kesejahteraan dan asas pembatasan kekuasaan atau pebatasan kewenangan. Penulis berpandangan dengan adanya Presiden dan DPR dalam Mekanisme Seleksi Dewan Pengawas KPK jutru menggnggu sifat independen dari KPK tersebut, sehingga penulis mempunyai gagasan sebagai berikut: (1) pemerintah harus membuat panitia seleksi Dewan Pengawas KPK yang diangkat secara administratif oleh Presiden dan diberikan tugas yang independen dalam menentukan keputusn terkait ketua dan anggota Dewan Pengawas KPK , (2) penghapusan kewenangan Presiden dan DPR sebagai lembaga negara yang ikut serta membentuk Dewan Pengawas KPK , (3) Pembaharuan mekanisme seleksi Dewan Pengawas KPK harus dituangkan dalam suatu peraturan perundang-undangan.

Abstract

Latar belakang penelitian ini dilakukan bahwasanya di tingkat daerah dengan semangat otonomi daerah, daerah memiliki kesempatan yang seluas-luasnya untuk mengembangkan potensi lokal demi kemajuan daerah dan meningkatkan kesejahteraan masyarakat lokal oleh karena itu Pemerintah Daerah melakukan kegiatan pembangunan daerah dengan menyusun kebijakan-kebijakan strategisnya. Negara Indonesia sebagai negara hukum yang demokratis memberikan jaminan perlindungan terhadap hak setiap warga negara (Hak Asasi Manusia) untuk berpartisipasi dalam setiap proses pembangunan di segala bidang kehidupan demi kesejahteraannya. Dalam kajian ini pola hubungan antara Pemerintah Daerah dengan masyarakat dalam pembangunan daerah di bidang lingkungan hidup difokuskan pada partisipasi masyarakat dalam mengelola sampah dan kebersihan kota yang secara yuridis dijamin oleh Peraturan Daerah Kabupaten Polewali Mandar Nomor 5 Tahun 2012 tentang Pengelolaan Persampahan Dan Kebersihan Kota Kabupaten Polewali Mandar junto Peraturan Daerah Kabupaten Polewali Mandar Nomor 8 Tahun 2012 tentang Partisipasi Masyarakat. Oleh karena itu permasalahan yang dirumuskan adalah bagaimana bentuk partisipasi masyarakat dalam pengelolaan sampah dan kebersihan kota di Kabupaten Polewali Mandar Provinsi Sulawesi Barat? Metode pendekatan yang digunakan adalah peraturan perundang-undangan (statute approach) dengan menelaah keberadaan berbagai produk hukum daerah yang memberikan jaminan perlindungan kepada masyarakat untuk berpartisipasi mengelola sampah dan kebersihan kota di Kabupaten Polewali Mandar Provinsi Sulawesi Barat.

Abstract

Dinamika yang muncul dimasyarakat yang merasa hak hak asasinya dilanggar oleh beberapa ketentuan dalam Peraturan Daerah Provinsi Bali Nomor 16 Tahun 2009 tentang Rencana Tata Ruang Provinsi Bali Tahun 2009-2029 maka analisa secara normatif terhadap Peraturan Daerah Provinsi Bali Nomor 16 Tahun 2009 tentang Rencana Tata Ruang Provinsi Bali Tahun 2009-2029 mutlak dilakukan untuk menghindari konflik yang berkepanjangan sekaligus menciptakan keadilan bagi seluruh masyarakat Bali.Adapun rumusan masalah yang diambil : Apakah pembentukan peraturan daerah provinsi Bali No 16 tahun 2009 sudah memenuhi unsur filosofis, yuridis dan sosiologis dalam aspek keberlakuannya?dan Apakah peraturan daerah provinsi Bali No 16 tahun 2009 sudah mencerminkan nilai keadilan dalam masyarakat? Metode Penulisan yang dipergunakan metode hukum Normatif dengan pendekatan konseptual (conceptual approach) dan pendekatan perundang-undangan (statute approach) yang dianalisis dengan metode analisis kritis (critical analysis) melalui pendekatan analisis komprehensif (comprehensive analysis). Adapun Simpulan yang didapat Pertama, menurut teori keberlakuan hukum, pembentukan Peraturan Daerah Provinsi Bali Nomor 16 Tahun 2009 sudah memenuhi unsur filosofis, yuridis, dan sosiologis dalam pembentukannya dan kedua Peraturan Daerah Provinsi Bali Nomor 16 Tahun 2009 Belum mencerminkan keadilan bagi masyarakat.
