Abstract

The development of digital financial technology is expected to expand access to productive financing and promote inclusive economic growth through the strengthening of micro, small, and medium enterprises (MSMEs). However, despite the rapid growth of peer-to-peer (P2P) lending in Indonesia, which reached IDR 763.14 trillion in 2023, empirical evidence on the transmission mechanism of its impact on economic growth—particularly through the role of MSMEs—remains limited. This study aims to analyze the effect of P2P lending on Indonesia’s economic growth during the 2019–2023 period, with the number of MSMEs serving as a mediating variable. Employing a quantitative approach, this study utilizes provincial-level panel data covering gross regional domestic product (GRDP), total P2P lending disbursement, and the number of MSMEs, and estimates the model using panel regression and mediation analysis. The results indicate that P2P lending has a positive and significant effect on economic growth, both directly and indirectly through MSMEs, with the mediating role being partial. Academically, this study contributes to the digital finance literature by highlighting the role of MSMEs as a transmission channel for economic growth, while from a policy perspective, the findings provide empirical support for strategies aimed at strengthening fintech lending and sustainably empowering MSMEs.

Abstract

Ideally, the inheritance law system in Indonesia is expected to realize inclusive justice for all parties, including in terms of gender. However, in reality, the pluralism of law consisting of Islamic law, customary law, and civil law reveals fundamental differences in inheritance distribution, which often lead to inequality, particularly for women. This study aims to analyze how gender justice is understood and implemented within a plural inheritance law system, as well as how local practices in Aceh reflect the interaction between Islamic law and customary law. This article is categorized as a library research with a qualitative approach. The methodology used is normative legal study and comparative study. The results conclude that the pluralism of inheritance law in Indonesia provides flexibility in legal application but also has the potential to create legal uncertainty and gender injustice. From an Islamic perspective, inheritance distribution is based on distributive justice, while customary law shows variations depending on kinship systems. Local practices in Aceh demonstrate an integration of Islamic law and customary law through deliberation, although they do not yet fully reflect contextual gender justice.

Abstract

Ideally, transactions in Islamic economics emphasize justice (‘adl) and the protection of wealth (ḥifẓ al-māl). However, in reality, the practice of money-based rotating savings (arisan uang) in society contains implications of the Time Value of Money (TVM), which may lead to value disparities among participants. This study aims to analyze the practice of money-based arisan from the perspective of Maqāṣid Syarī‘ah, particularly in relation to transactional justice and the protection of wealth. This article is categorized as a juridical-empirical legal study employing a qualitative approach. The methodology used is descriptive analytical within the framework of Islamic economic law. The findings indicate that money-based arisan implicitly contains the principle of TVM through differences in the timing of fund receipt, where early participants obtain higher economic value. This practice does not involve riba as there is no stipulated monetary increment. From the perspective of Maqāṣid Syarī‘ah, arisan is considered permissible as long as it fulfills the principles of ta‘āwun (mutual assistance), transparency, and distributive justice. However, the potential for gharar remains if disparities arising from the time value of money are not managed fairly.

Abstract

Ideally, MSMEs in North Sumatra are expected to develop innovation based on quality management and integrated entrepreneurial strategies to enhance competitiveness and business sustainability. However, in reality, many MSMEs still face limitations in implementing systematic quality management and have not optimally integrated the pillars of Creativity, Sustainability, Market Orientation, and Leadership as a comprehensive innovation framework. This study aims to formulate an integrative Tetrapreneur-based model combined with quality management to improve the innovative performance and value creation of MSMEs. The research employs a field-based qualitative approach using a case study design involving MSMEs in North Sumatra, with data collected through interviews, observations, and documentation. Data were analyzed using thematic analysis and source triangulation to ensure validity. The findings reveal that the integration of quality management and Tetrapreneur pillars significantly enhances operational efficiency, product consistency, market adaptability, and sustainable innovation capacity of MSMEs.

Abstract

Ideally, the Indonesian criminal law system should be able to encompass all actors within the chain of online gambling crimes, including account sellers as facilitators of financial transactions. However, the Criminal Code (KUHP), the Electronic Information and Transactions Law (UU ITE), and banking regulations have not yet criminalized the practice of buying and selling bank accounts as an independent offense. Law enforcement still relies on Articles 55–56 of the KUHP, which are weak in proving mens rea, resulting in a normative gap and a low deterrent effect amid the rise of digital gambling. This study aims to analyze the practice of buying and selling bank accounts in online gambling, examine criminal liability from the perspective of Islamic law through the concept of ta‘zīr al-mu‘īn ‘alā al-ma‘ṣiyah, and formulate an integrative normative reconstruction. The method used is juridical-normative with a conceptual-comparative approach, analyzing primary and secondary legal materials through qualitative-descriptive methods. The results indicate that account sellers can be classified as mu‘īn (facilitators of sin) who violate the objectives of Islamic law (maqāṣid al-syarī‘ah), particularly ḥifẓ al-māl (protection of property) and ḥifẓ al-dīn (protection of religion). A new legal provision is recommended to explicitly criminalize such acts, with a maximum penalty of 5 years imprisonment or a fine of up to IDR 500 million, in order to close legal gaps and respond to digital crime.

Abstract

Ideally, the migration of Indonesian workers constitutes an important phenomenon in the global economic context, providing strategic contributions through remittances and the improvement of family welfare. However, in reality, although national regulations have evolved to protect the rights of Indonesian Migrant Workers (PMI), conditions in the field still reveal significant structural vulnerabilities, including contract violations, exploitation, limited access to legal remedies, and minimal post-placement assistance. These conditions underscore the need for a comprehensive, integrated, and sustainable protection system to ensure that migrant workers can work safely, with dignity, and with their rights fully protected. This study aims to analyze the forms of legal protection for Indonesian Migrant Workers abroad based on Law Number 18 of 2017, identify challenges in its implementation, and evaluate government strategies in strengthening the protection system for PMI. This article employs a normative legal research approach, using library research as the primary data collection method, complemented by descriptive-analytical analysis of legislation, legal literature, and relevant case studies. The results indicate that a protection framework based on the migration cycle, the integration of legal, social, and economic aspects, as well as the active roles of central and local governments, diplomatic representatives, and local communities, are key to the successful protection of Indonesian Migrant Workers.

Abstract

This study examines the criminal responsibility of biological mothers who commit infanticide in Palangka Raya City by analyzing the legal framework, judicial practice, and the socio-psychological conditions surrounding such cases. Using a normative juridical method complemented by case-based analysis, the research explores how Indonesian criminal law—particularly Articles 341–343 of the Criminal Code—constructs liability for mothers who kill their newborn infants under circumstances of psychological pressure, social stigma, or extramarital pregnancy. Findings indicate that while the law provides specific provisions allowing for reduced sentencing based on maternal mental disturbance or societal coercion, judicial decisions in Palangka Raya still emphasize the need to balance compassion with deterrence. The study concludes that criminal responsibility must be viewed not only through the lens of legal doctrine but also through an understanding of maternal vulnerability, social exclusion, and the need for stronger preventive mechanisms, including reproductive education and supportive social services.

Abstract

Ideally, the transfer of land rights must be conducted before a Notary based on accurate data, with the Village Head providing factual information on land status. Their collaboration should ideally strengthen legal certainty. However, in reality, the practice of double sale of land (dubbel verkoop) remains prevalent due to collaboration between Village Heads who provide false statements and Notaries who neglect their verification duties. This study aims to analyze the construction of tort liability under Article 1365 of the Indonesian Civil Code. The research employs a normative legal method with a case study approach. The findings reveal that the collaboration between Village Heads and Notaries fulfills all elements of unlawful acts. Victims are entitled to legal certainty through the annulment of defective deeds as well as compensation for material and immaterial losses. Village Heads may be subject to Article 263 of the Criminal Code and Notaries to Article 264 of the Criminal Code.

Abstract

Ideally, increased public awareness and the growing accessibility of digital technology should lead to higher interest in Islamic life insurance. However, in reality, the level of market penetration and purchase intention remains relatively low, particularly among online motorcycle taxi (ojek online) drivers, despite their high occupational risk. This study aims to examine the influence of trust, perceived usefulness, and perceived ease of use on the intention to purchase Islamic life insurance by applying the Technology Acceptance Model (TAM). A quantitative approach was employed using Partial Least Squares Structural Equation Modeling (PLS-SEM) on data collected from online motorcycle taxi drivers. The findings reveal that trust and perceived ease of use have a positive and significant effect on purchase intention, while perceived usefulness also shows a positive effect, although with lower statistical significance. These results highlight that enhancing trust, simplifying service processes, and clearly communicating product benefits are critical factors in increasing the adoption of Islamic life insurance among informal sector workers.

Abstract

Ideally, the Business Judgment Rule provides legal protection to directors in making business decisions as long as they act in good faith, with due care, and without conflicts of interest; however, in reality in Indonesia, such protection remains suboptimal due to the dualism between corporate law and state finance law, which creates legal uncertainty and the potential criminalization of business decisions. This study aims to analyze the legal protection of directors in the application of the Business Judgment Rule and to compare its implementation in Malaysia and Singapore in order to formulate a model that ensures legal certainty and utility. The research employs a library research method with a qualitative approach and a normative juridical methodology, using statutory, conceptual, and comparative approaches. The findings indicate that Indonesia has not consistently implemented the Business Judgment Rule, in contrast to Singapore’s more stable application and Malaysia’s hybrid model. Therefore, a reconstruction through an Integrated Business Judgment Rule Protection model is necessary, emphasizing legal harmonization, the distinction between business risk and state loss, and institutional strengthening.
