Abstract

The public implementation of flogging in Aceh is a manifestation of Islamic law that has been practiced since the time of Prophet Muhammad SAW, where the process aimed to deter society at large. However, in the digital era, the dissemination of recordings of such punishments through social media has sparked legal controversy concerning privacy violations and defamation, with broad impacts on the convicted individuals. This study aims to analyze the legal certainty regarding the distribution of flogging punishment content in digital spaces and to examine the intersection between Islamic law and Indonesia’s national law. This article is a qualitative library research, using a normative legal study methodology with a descriptive-analytical approach. The results show that the dissemination of flogging punishment recordings in Aceh via social media creates complex legal issues because, although public flogging is legally justified under Islamic law and the Qanun Jinayat, its digital distribution has the potential to violate privacy and defame individuals according to the provisions of the Electronic Information and Transactions Law (ITE Law) and the Indonesian Criminal Code (KUHP). Therefore, specific regulations are urgently needed to integrate Islamic law principles with national law to ensure the protection of human rights and to prevent the misuse of content in the global and permanent nature of digital public spaces.

Abstract

Ideally, cyber law regulations in Indonesia should provide comprehensive protection against digital crime in line with the rapid development of information technology. However, in reality, the existing regulations still face various challenges in law enforcement and have not fully succeeded in reducing the increasing rate of digital crime. This study aims to analyze the existence and effectiveness of cyber law regulations in Indonesia and evaluate the role of the government in combating digital crime. This research employs a qualitative approach with a literature review method, involving descriptive analysis and a comparative study between Indonesian cyber regulations and international regulations. The findings indicate that although Indonesia has an adequate legal basis through the Electronic Information and Transactions Law (UU ITE), its implementation remains ineffective due to infrastructure limitations and lack of inter-agency coordination. Furthermore, a comparison with international regulations reveals the need for revision and policy strengthening to enhance national cybersecurity.

Abstract

Ideally, as Muslims, Generation Z should be able to control their consumptive behavior in purchasing virtual game items through an understanding of religious values and Islamic financial literacy. However, in reality, impulsive behavior in game microtransactions is still prevalent among them. This study aims to analyze the influence of religiosity and Islamic financial literacy on impulsive buying among Muslim Generation Z in Surabaya. This article is categorized as field research with a quantitative approach. The methodology used is an associative quantitative method, which seeks to analyze the relationship between variables. The results of the study conclude that religiosity has a negative effect on impulsive buying, whereas Islamic financial literacy has a positive effect. This indicates that despite having a high understanding of Islamic financial principles, the weak application in daily life leads to continued consumptive behavior.

Abstract

Ideally, Indonesia's land ownership system should have fully adopted the provisions of the 1960 Basic Agrarian Law (Undang-Undang Pokok Agraria or UUPA), which abolished eigendom as a form of property ownership. However, in reality, legal disputes persist regarding former eigendom verponding land, as seen in Case Number 109 PK/Pdt/2022. This case reflects legal issues concerning land rights originating from the colonial system and their implications for legal certainty in land ownership in Indonesia. This study aims to analyze the legal status transformation of eigendom verponding after the enactment of the 1960 UUPA and to examine the legal impact of the Judicial Review (Peninjauan Kembali or PK) decision in Case Number 109 PK/Pdt/2022. This article falls under qualitative library research using a normative legal study methodology. The findings indicate that the legal status of eigendom verponding has been converted according to national agrarian regulations. However, in practice, differences in legal interpretation continue to arise, leading to land ownership disputes. Case 109 PK/Pdt/2022 reaffirms that land title certificates issued under agrarian law provisions hold greater legal recognition than ownership claims based on colonial-era eigendom verponding.

Abstract

Ideally, Islamic banking financing with the Musyarakah Mutanaqisah (MMQ) contract in the BSI Griya Hasanah product should comply with Sharia compliance principles, ensuring the absence of riba, gharar, and maysir elements. However, in reality, the implementation of the MMQ contract at BSI KCP Cemara Asri still faces challenges in Sharia compliance, particularly in the profit-sharing mechanism and legal certainty for customers. This study aims to analyze the financing provision in the BSI Griya Hasanah product and assess its Sharia compliance based on practices at BSI KCP Cemara Asri. This article is classified as a qualitative field research study. The methodology used is an empirical legal study explained through descriptive analytical methods. The analysis shows that the provision of Griya Hasanah financing with the Musyarakah Mutanaqisah contract at BSI KCP Cemara Asri complies with Sharia principles and follows the 5C analysis. However, in terms of Sharia compliance, there is a discrepancy with the DSN-MUI fatwa regarding the distribution of asset acquisition costs and losses. The Sharia Supervisory Board states that while the practice is valid in terms of the contract, it violates the provisions of DSN-MUI Fatwa No. 73/DSN-MUI/XI-2008.

Abstract

Ideally, registered trademark owners receive full legal protection to prevent unauthorized use of their trademarks by other parties. However, in reality, trademark disputes still frequently occur, as seen in the case between PT X and Company Y, highlighting gaps in legal protection for trademark owners. This study aims to analyze legal protection for registered trademark holders and evaluate the effectiveness of regulations in resolving trademark disputes. This article falls under library research with a qualitative approach, utilizing normative legal study methodology. The findings indicate that the trademark dispute between PT X and Company Y underscores the importance of legal protection for registered trademark holders, where the first-to-file registration system grants exclusive rights to the legitimate owner. However, despite existing regulations, disputes persist, necessitating active monitoring and legal enforcement by trademark owners through legal action or dispute resolution in commercial courts.

Abstract

Ideally, the formulation of laws in Indonesia should align with the principles of a state based on law, emphasizing justice, legal certainty, and utility. However, in reality, the legislative process is often influenced by political interests, weak public participation, and the poor quality of academic manuscripts that fail to support legal effectiveness. This study aims to analyze the weaknesses in the legislative procedure in Indonesia and to offer a more effective conceptual reconstruction so that legislative products truly reflect the will of the people and fulfill the principles of a state governed by law. This article falls under library research with a qualitative approach. The methodology employed is normative legal research. The findings indicate that the effectiveness of law in the legislative process has not yet been optimal due to ongoing political dominance, low-quality public participation, and weak academic foundations. Therefore, the reconstruction of the law-making process should focus on improving the quality of academic manuscripts, strengthening mechanisms for public participation, and consistently applying the principles of transparency and accountability.

Abstract

Ideally, the financing of Micro, Small, and Medium Enterprises (MSMEs) in Islamic banks should grow sustainably with controlled financing risks. However, the reality shows that after the revocation of the post-pandemic financing relaxation policy, there has been an increase in the potential for Non-Performing Financing (NPF), which puts pressure on the performance of Islamic banking, particularly Bank Syariah Indonesia. This study aims to analyze the dynamics of NPF in the MSME segment following the revocation of relaxation policies as well as the factors influencing financing smoothness. This article is categorized as qualitative library research using a descriptive-analytical methodology. The findings reveal that the revocation of relaxation policies has led to an increased risk of default, especially in small businesses that have not fully recovered from the pandemic’s impact. Nevertheless, continued restructuring strategies, strengthened risk management, and debtor assistance have proven effective in suppressing NPF growth and keeping it within reasonable limits.

Abstract

Ideally, the Qur’an as a guide for Muslims contains universal principles of justice and equality that place men and women in balanced relations. However, the reality in the Muslim community of Bima shows that patriarchal structures are legitimized through conservative interpretations of the Qur’an, patrilineal customs, and social norms that position women in subordinate roles. This study aims to analyze how the legitimacy of patriarchy is constructed and maintained through Qur’anic interpretation, local customs, and social structures, as well as to propose deconstruction strategies through the reinterpretation of religious texts and gender education. This article employs a qualitative library research method with descriptive analysis. The findings reveal that the legitimacy of patriarchy in the Muslim community of Bima emerges from the close interaction between customs, conservative interpretations, and patrilineal social systems. Nevertheless, deconstruction can still be achieved through egalitarian reinterpretations of the Qur’an and the strengthening of gender education, thereby opening participatory dialogue between local customs, Islam, and human rights. The synergy of these two approaches provides a significant contribution to weakening patriarchy and offers an alternative model of gender justice within Muslim societies.

Abstract

Ideally, the banking sector has a legal obligation to safeguard customers’ funds with a high standard of prudence, yet in reality, cases of fund loss still frequently occur, including at Bank BCA. This situation raises doubts about the effectiveness of the legal protection available to customers when their rights are harmed. This study aims to examine the forms of legal protection for customers from the perspective of civil law and to evaluate the role of the Financial Services Authority (OJK) in resolving and restoring losses caused by fund loss in banks. This article falls under library research with a qualitative approach. The methodology used is normative legal research. The findings show that civil law provides a basis for protection through compensation mechanisms arising from breach of contract or unlawful acts, which may be claimed by customers against the bank. On the other hand, OJK serves as a regulator and external supervisor that plays an important role in ensuring justice for customers through regulation, supervision, and alternative dispute resolution mechanisms outside the court via LAPS SJK. The synergy between civil law instruments and the role of OJK has proven to be an essential instrument in providing legal certainty while maintaining public trust in the banking system.
