Jurnal Selisik merupakan media yang diterbitkan oleh Program Magister Ilmu Hukum Sekolah Pasca sarjana Universitas Pancasila. Pada awal berdirinya Jurnal Selisik dikhususkan pada ragam gagasan hukum dan bisnis. Hal ini tidak lepas dari pengkhususan program studi di PMIH, yakni Hukum Dan Bisnis. Sejalan dengan perkembangan dan pengembangan PMIH, yakni dibukanya program studi baru mengenai Hukum Konstitusi dan Tata Kelola Pemerintahan, maka tema dan fokus Jurnal Selisik juga mengalami perluasan, diantaranya Hukum, Bisnis, Hukum Konstitusi dan Tata Kelola Pemerintahan sebagai basis susbtansi kajiannya.

Abstract

The development of the procedure in Administration Court is the consequences from the issuanceLaw No 30 Year 2014 Concerning Government Administration. One of the legal consequence,there is paradigm changes of authority to adjudicate related to the Unlawful Act done by the ruler,in this matter government official which is knows as Onrechtmatige Overheidsdaad (OOD) whichpreviously is the authority of District Court, based on Article 1365 of Indonesian Civil Code, theloses classified as civil law as a result of government action. Further the authorization toadjudicate Unlawful Act by the government become jurisdiction of State Administration Court.Several legal problems are found related to the transition of authority to adjudicate in StateAdministration Court. Supreme Court has issued six (6) Supreme Court Regulations, on theregulation is Supreme Court Regulation No 2, 2019 Concerning Guidelines of dispute resolutionof government action and authority to adjudicate Unlawful Act by government institution and/orofficer Onrechtmatige Overheidsdaad (OOD). Unlawful Act is identical with the claim forcompensation, however there is no regulation as the legal ground related to how much themaximum and minimum limitation could be claimed in the case related Unlawful Act by theGovernment officer and also whether or not there is immaterial claim in the future

Abstract

The global pandemic of Virus Corona (Covid-19) in Indonesia gives impact to legalservice at judiciary institution under the Supreme Court of Indonesia. Due to the condition,The Supreme Court should make a policy about Work from Home (WFH) for the Judges andCourt Officers as a rolling. In urgent condition (force majeure), the courthouse should do thecourt proceedings with online or teleconference. As the fast response, The Supreme Courthad been made an innovation such as the Regulation Letter as legal fundament to do thecourt proceedings with online or teleconference. That policy legitimation by the principle of“Salus Populi Suprema Lex Esto” its mean “The society safety is the highest Law” (Cicero)

Abstract

The development of local region needs many resources, and one of them could be gainedthrough foreign country in the form of cooporation relationship between the LocalGovernment and the foreign party. Such kind of cooporation is reliable in the context ofdecentralization implementation in Indonesia. In the decentralization, the CentralGovernment devolves several powers to the Local Government, so with those powers, itcould manage its own needs based on its unique local condition. In the Indonesian legalsystem, the cooporation between the Local Government and the foreign party is ruledunder several acts and regulations, and the aims are to establish such cooporation workseffectively, efficiently, and not disturb the Indonesian system relating to the relationshipbetween the Central Government and the Local Government

Abstract

Limited land in big cities make business developments flats and apartments increasedsharply, this has an influence on the demand for electricity usage increases. On theother side, PT. PLN (Persero) has not been able to supply power directly to the unithousing project but only reached the main substation, then manager of flats distributeelectric power obtained from PLN through the substation flats to each apartment unit. Itis also related to the billing of electricity cost is PLN submit a bill to the manager, thenthe manager of the apartment to collect electricity dues from residents and owners of theunit. In the collection of the license fee, the manager also divide the other expenses thatare used for the mutual benefit proportionally. These conditions make the occupants andowners of units accused managers inflate electricity rates, as happened to the PPRS andManagement Agency Apartment Mediteramia Marina Residence, ApartmentMediterania Palace Residence and Apartments Gading Mediterania which have beenreported to the Party Police with allegations have been violating Article 49 Paragraph(1) and (2) of Law No. 30 Year 2009 on Electricity

Abstract

Indonesians are protesting the plain packaging policy by Australia which requires thatcigarette packaging be made not to contain logos,manufacturers. This policy by Indonesia isconsidered to violate the provisions of trade relataspects of intellectual property rights andtechnical barriers to trade agreement in the provision of petrochemical legal protection ofIndonesian cigarette products.The Australian policy is intended to protect the health of itscitizens caused by tobacco.This study aims to determine the history on the effectiviteness ofTRIPs and ATBT principle in the legal protection of intellectual property protection, publicorder link with TRIPs and ATBT in legal protection for intellectual property and cigaretteprotection for intellectual property and cigar Indonesia as well as the benefits of TRIPs andATBT for the future of Indonesian cigarette exports. This research uses normative juridicialTheconclusion of this study that all matters relating to the protection of intellectual property law andtrade barriers should not be contrary to public order

Abstract

The use of foreign workers (TKA) in the Indonesian labor market is only for certain positionsand time. It is clearly regulated in Law no. 13 of 2003 on Manpower (Law No. 13 of 2003)and its implementing regulations. In practice, certain time labor agreements betweenemployers and foreign workers are often made by not meeting the applicable requirements.The restrictions are made through licensing system, limitation of foreign worker use incertain positions, and limitation of foreign worker use only in certain time workingrelationship. Meanwhile, PKWT arrangements for foreign workers based on Law no. 13 of2003 can not be implemented in absolute terms in the event of a violation of PKWT offoreign workers. This is due to the inconsistency between the provisions in Law no. 13 of2003 which limits the employment relationship of foreign workers only in certain timeworking relationship, while in others Law no. 13 Year 2003 also allows the transfer ofPKWT by law into PKWTT, in case PKWT is not fulfilled by the employer

Abstract

Community activities that mine today cannot yet be classified as a People's Mining activity(PR), as referred to in the applicable laws and regulations. This is due to not fulfilling theprovisions, both legal aspects and technical aspects that refer to the concept of goodpractice. The community activities that have been going on for hundreds of years have causedmany problems and losses, both for the state, the environment and for themselves. The natureof activities that are generally of the state has been detrimental to the state's income, while theenvironmental damage they have caused has caused long-term loss of ecosystems. Threenational priorities emerge. First, that people's mining includes mining activities in generalwhich have been regulated in mineral and coal laws Second, that Mining Without Permit(PETI) is prohibited according to mineral and coal laws. Third, that from the case studyactivities against violations of the precautionary principle or early prevention by PTIndominco Mandiri proving that there is no principle of early prevention in mining practices

Abstract

Dewasa ini lembaga keuangan di Indonesia kian berkembang sebagai akibat dari laju pertumbuhan perekonomian dan juga perkembangan jaman. Hal ini nampak dari semakin banyaknya variasi instrument keuangan yang telah beredar dalam sistem keuangan baik di bidang perbankan maupun non-perbankan. Kemunculan perusahaan keuangan dalam bidang Fintech Peer to Peer Lending semakin mendapatkan perhatian publik dan regulator dalam hal ini Otoritas Jasa Keuangan dan Bank Indonesia. Hal tersebut tertuang dalam Peraturan Otoritas Jasa Keuangan Nomor 77/POJK.01/2016 Tentang Layanan Pinjam Meminjam Uang Berbasis Teknologi Informasi dan peraturan yang terkait dengan ini yakni Peraturan Bank Indonesia Nomor 19/12/PBI/2017 Tentang Penyelenggaraan Teknologi Informasi. Fintech Peer to Peer Lending merupakan suatu terobosan baru di bidang layanan jasa keuangan khususnya bagi masyarakat Indonesia yang belum mengenal atau memiliki akses pada layanan perbankan (unbanked people). Dalam POJK Nomor 77/POJK.01/2016 Tentang LPMUBTI, tidak ditemukan adanya ketentuan tingkat suku bunga dalam fasilitas Peer to Peer Lending. Dengan tidak diaturnya mengenai tingkat suku bunga dalam peraturan tersebut dikhawatirkan dapat menimbulkan tindakan yang sewenang-wenang dari perusahaan penyelenggara terhadap penerima pinjaman. Berdasarkan latar belakang tersebut, dirumuskan dua permasalahan yaitu perlindungan yang diberikan terhadap penerima pinjaman terkait penetapan tingkat suku bunga yang tinggi oleh perusahaan Peer to Peer Lending yang terdaftar pada Otoritas Jasa Keuangan, serta pemberian sanksi oleh Otoritas Jasa Keuangan sebagai lembaga yang mengawasi dan mengeluarkan peraturan mengenai Peer to Peer Lending terhadap perusahaan P2PL yang telah terdaftar tetapi melanggar peraturan yang telah ditetapkan. Metode penelitian yang Penulis gunakan ialah Yuridis Normatif. Penelitian ini menyimpulkan bahwa OJK didalam memberikan perlindungan telah sesuai dengan POJK Nomor 1/POJK.07/2013 Tentang Perlindungan Konsumen Sektor Jasa Keuangan yaitu salah satunya dengan adanya kewajiban memberikan ganti rugi kepada Penerima Pinjaman oleh Perusahaan Penyelenggara Fintech Peer to Peer Lending, serta sanksi yang dapat diberikan oleh OJK ialah peringatan tertulis, denda, pembatasan kegiatan usaha, sampai dengan pencabutan izin usahanya. Saran yang dapat Penulis berikan ialah OJK perlu menyusun ketentuan dan standar mekanisme penanganan pengaduan dan penyelesaian sengketa pada para pelaku Fintech, serta OJK perlu mengkaji penerapan Online Dispute Resolution pada kegiatan Fintech

Abstract

Polarisasi pendapat terkait dengan badan hukum dalam kepemilikan hak atas tanah sering kali dibicarakan. Penguasaan atas tanah yang dilakukan badan hukum begitu menyita perhatian masyarakat.Terdapat perbedaan pemahaman antara badan usaha dengan badan hukum. Tidak semua badan usaha adalah badan hukum. Banyak ahli hukum berpendapat bahwa Firma dan CV merupakan badan usaha tetapi bukan badan hukum sementara PT dan Koperasi merupakan badan usaha juga badan hukum. Badan hukum tidak hanya badan hukum publik tetapi juga badan hukum privat. Berdasarkan asas nasionalitas sebagaimana tersirat dalam Pasal 21 Ayat (1) UU No.5 Tahun 1960, maka hanya warga negara Indonesia yang memiliki hak milik atas tanah dengan demikian badan hukum tidak boleh memiliki hak milik atas tanah, namun dapat memperoleh hak lain seperti HGU, HGB, dan Hak Pakai sebagaimana diatur dalam PP No. 40 Tahun 1996 kecuali untuk beberapa badan hukum yang ditetapkan oleh Pemerintah (Pasal 21 Ayat (2) UU No.5 Tahun 1960 jo PP No.38 Tahun 1963). Oleh karena dalam UU No.5 Tahun 1960 tidak memberikan definisi mengenai badan hukum namun secara tersirat memaknai badan hukum (korporasi) dalam arti luas yaitu badan usaha maka dalam pandangan hukum korporasi tidak hanya PT dan Koperasi, namun Firma dan CV pun karena memenuhi syarat materiil badan hukum juga tidak boleh memiliki hak milik atas tanah dan hanya boleh memiliki HGU, HGB, dan Hak Pakai. Namun untuk para pemilik badan hukum dapat memiliki hak milik atas tanah meski hak milik tersebut menjadi imbreng pada badan hukum dan badan hukum sebagai penerima manfaat dari hak atas tanah tersebut
