Abstract

Paper ini bertujuan untuk menjelaskan dan menganalisis tentang syarat in’iqad dari ‘aqidain (para pihak) dan shighat (ijab qabul) dalam pembentukan sebuah akad syariah serta aplikasinya pada kegiatan ekonomi. Berdasarkan studi literatur yang dilakukan penulis, maka dapat diketahui bahwa pembentukan sebuah akad akan dapat terwujud apabila telah terpenuhi segala unsur-unsurnya yang diterjemahkan melalui rukun akad. Rukun akad yang masyhur dalam kalangan pemerhati fiqh muamalah meliputi para pihak yang berakad (‘aqidain), objek yang diakadkan (ma’qud ‘alaih), tujuan atau maksud mengadakan akad (maudhu‘ al-‘aqad), dan sighat al-‘aqad (ijab dan qabul). Syarat in’iqad pada para pihak yang mengadakan akad meliputi tamyiz dan berbilang. Sedangkan syarat in’iqad pada pernyataan kehendak (shighat) harus terjadi persesuaian antara ijab dan qabul serta harus dalam kesatuan majlis. Syarat-syarat tersebut harus dipenuhi agar akad yang dilaksanakan dapat sah dan berlaku kepada kedua belah pihak. Apabila syarat tersebut tidak terpenuhi, maka transaksi ekonomi yang dilakukan tersebut akan bernilai tidak sah sehingga tidak dapat membentuk sebuah akad yang sesuai dengan prinsip syariah.  ABSTRACT This paper aims to explain and analyze the in’iqad requirements of 'aqidain (parties) and shighat (ijab qabul) in the formation of a sharia contract and its application to economic activities. Based on the literature study conducted by the author, it can be seen that the formation of a contract will be realized if all the elements have been fulfilled which are translated through the pillars of the contract. The well-known pillars of the contract among observers of fiqh muamalah include parties who have contracted ('aqidain), objects that are acclaimed (ma'qud' alaih), the purpose or intention of making a contract (maudhu 'al-'aqad), and sighat al-'aqad (consent and qabul). The terms of in’iqad on the parties who enter into the contract include tamyiz and multiplication. Meanwhile, the in’iqad requirement in the statement of the will (shighat) there must be an agreement between consent and qabul and must be in the unity of the majlis. These conditions must be fulfilled so that the contract that is carried out can be valid and valid for both parties. Abstract

Dalam agama Islam, pelacuran merupakan salah satu perbuatan zina. Pandangan hukum Islam tentang perzinaan jauh berbeda dengan konsep hukum konvensional atau hukum positif, karena dalam hukum Islam, setiap hubungan seksual tanpa ikatan pernikahan (yang diharamkan) seperti pelacuran masuk kedalam kategori perzinaan yang harus diberikan sanksi hukum kepadanya, baik itu dalam tujuan komersil ataupun tidak, baik yang dilakukan oleh yang sudah berkeluarga ataupun belum. Para pelacur yang rutinitasnya identik dengan perzinaan merupakan bentuk lain dari penyimpangan seksual dimana terjadi hubungan seksual antara laki- laki dan perempuan tidak berdasarkan pada ikatan tali perkawinan. Pengaturan serta sanksi terhadap prostitusi atau zina dalam  hukum  islam  diatur  dalam  QS Al-Isra’ 17 : 32. Q.S An-Nisa; 24:33, QS An-Nur 24 : 2. Maka upaya yang dilakukan dalam mengatasi prostitusi atau zina adalah meningkatkan keimanan dan ketaqwaan kepada Alloh SWT, memupuk ilmu pengetahuan agama, menciptakan menjaga lingkungan yang kondusif jauh dari praktek prostitusi dan perzinahan, membuat dan membentuk hukum prostitusi dan perzinahan sesuai dengan petunjuk  hadist dan al-quran. In Islam, prostitution is one of the deeds of adultery. The Islamic legal view of adultery is far different from the concept of conventional law or positive law, for in Islamic law any sexual intercourse (prohibited) such as prostitution enters into the category of adultery which must be given a legal sanction to it, whether in commercial or non- , whether done by already married or not. Prostitutes whose routine is synonymous with adultery is another form of sexual deviation in which sexual relationships occur between men and women are not based on the bonds of a marriage rope. Arrangements and sanctions against prostitution or adultery in Islamic law are regulated in QS Al-Isra '17: 32. Q.S An-Nisa; 24:33, QS An-Nur 24: 2. So the efforts made in overcoming prostitution or adultery is to increase faith and devotion to Allah SWT, fostering the science of religion, creating a conducive environment away from the practice of prostitution and adultery, create and form the law of prostitution and adultery in accordance with the instructions of hadith and al-quran.

Abstract

ABSTRACTAgreement is a law relationship which one binds one or more people that cause law consequence. The agreement would be carried out in accordance and it is appropriate by contract that was agreed upon Islamic law or civil law. Agreement of Islamic law are called sharia agreement that implementation systems embrace sharia principle. While agreements of civil law are called conventional agreement that the implementation systems embrace civil law. Every agreement would be raised the rights and obligation of each parties. If the agreement have been fulfiilled or not that caused by deviations. It results bot Islamic or civil law become extinct, it is appropriate with the agreement made by the parties. There is a difference at the end of the agreement in sharia and conventional, it provides a concept for interpreneurs in the field of economics at the sharia or conventional financial institutions which have developed rapidly at this time.Key Words: The End Of Agreement, Islamic Law, Civil Law.

Abstract

ABSTRACTPre-marriage counseling programs or so-called bride-to-be courses can be organized by the Ministry of Religion, the Office of Religious Affairs or Agencies and Institutions that have been established by the Ministry of Religion. This guidance aims to provide knowledge about Islamic sharia in domestic life in order to reach families who are confident in mawaddah warahmah. This research is motivated by the Decree of the Director General of Islamic Community Guidance Number. 373 of 2017 concerning Technical Guidance for Marriage Guidance for Prospective Brides. In these rules only contain material / technical / managerial without any binding legal substance so that the phenomenon is now the pros and cons of the imposition of pre-marital certificate obligations in the requirements of marriage registration. This research is qualitative research with descriptive normative analysis studies. The approach used in this research is library research and field research, from this research that is as a journal so that it can be a source of reference about the pros and cons polemics of the validity of pre-marital certificates both for writing thesis, theses, papers, and journals as well as enriching teaching materials study at Ahwal Syakhsiyyah study program for students. Abstract

ABSTRAK Penelitian ini dilakukan untuk mempelajari dan memahami  posisi dan  metode ijtihad Yusuf al-Qaradawi dalam menyelesaikan permasalahan fiqih kontemporer untuk mengistinbatkan hukum Islam , khususnya ijtihad beliau tentang penyaluran zakat terhadap  mustahiq zakat dalam relevansi masa kini. Penulis menemukan bahwa Yusuf al-Qaradawi  telah mengunakan metode ijtihad lafdziyyah ( kaidah-kaidah kebahasaan) yang langsung pada nash (teks) dan melalui metode Maqasid al-Syariah  berupa qiyas  dan istislah dalam ijtihadnya tentang memaknai fisabilillah  dalam mustahiq zakat. Kata Kunci : Metode, ijtihad, Fisabilillah, Mustahiq zakat ABSTRACT This study is aimed at observing and understanding Yusuf al-Qaradawi’s position and method in ijtihad (independent reasoning in finding a solution to a legal question) pertaining to contemporary fiqh (Islamic law) issues, i.e. in doing istinbat (deducing) towards Islamic laws, particularly his ijtihad in distributing zakat (alms) to the mustahiq (recipients) related to the recent conditions. The study found that he used ijtihad lafdziyyah (language principle) directly to the nash (text) and Maqasid al-Syariah (the objective of shari’ah) method of qiyas (reasoning by analogy) and istisla>h (reasoning by public interest) in his ijtihad pertaining to the understanding towards fisabilillah (those who fight in Allah’s way) in terms of the mustahiq of zakat. Keywords : Method,  Ijtihad ,  fisabilillah , mustahiq of zakat.

Abstract

Abstrak            Praktik perkawinan di negara hukum seperti Indonesia harus mendapatkan pengakuan negara. Hal ini dalam rangka tertib hukum dan perlindungan hukum khususnya bagi pihak anak dan kaum perempuan. Pengakuan tersebut eratkaitannya dengan kepastian hukum disebut juga dengan istilah principle of legal security dan rechtszekerheid, hal tersebut berbeda dengan perkawinan yang tidak tercatat seperti perkawinan sirri.Perkawinan sirri ini dikaitkan dengan UU No. 1 Tahun 1974 bukanlah perkawinan yang sah walaupun sudah memenuhi syarat pada Pasal 2 ayat (1) tetapi Pasal 2 ayat (2) tidak terpenuhi maka perkawinan ini diangap tidak sah menurut hukum negara. Untuk mendapat pengakuan sah dalam perkawinan sirri dibutuh penetapannya oleh pengadilan yang diatur dalam KHI Pasal 7. Dalam ketentuan pasal 7 KHI tentang isbat nikah terdapat kerancun dan ketidaktepatan. Sehingga pasal ini perlu adanya pembatasan dalam penerapannya agar tidak menimbulkan problem baru dalam masyarakat. Permohonan isbat nikah adalah perkawinan yang terjadi sebelum berlakunya UU No. 1 Tahun 1974 tentang Perkawinan, karena perkawinan yang terjadi setelah adanya Undang-undang perkawinan mengandung prinsip pencatatan perkawinan demi menjaga kemaslahatan keluarga. Namun, kondisi di masyarakat saat ini masih banyak yang melakukan perkawinan sirri sehingga membutuhkan solusi khusus saat mereka sadar akan konsekuensi hukumnya. Kata kunci: Perkawinan, sirri, hukum.AbstractMarriage practices in a legal state such as Indonesia must be recognized by the state. This is in the context of legal order and legal protection especially for children and women. This recognition is closely related to legal certainty, also called the principle of legal security and rechtszekerheid, this is different from unrecorded marriages such as sirri marriage. This sirri marriage is associated with Law No. 1 of 1974 is not a legal marriage even though it has fulfilled the requirements in Article 2 paragraph (1) but Article 2 paragraph (2) is not fulfilled, this marriage is considered invalid according to state law. To obtain legal recognition in the Sirri marriage, the determination of the court stipulated in KHI is required in Article 7. In the provisions of Article 7 of the KHI concerning marriage issues there is confusion and inaccuracy. So that this article needs restrictions in its application so as not to cause new problems in society. The application of isbat marriage is a marriage that occurred before the enactment of Law No. 1 of 1974 concerning Marriage, because marriages that occur after the marriage law contain the principle of marriage registration in order to maintain the benefit of the family. However, there are still many conditions in the community that do sirri marriages so they need special solutions when they are aware of the legal consequence Keyword: marriage, sirri, law.

Abstract

ABSTRACTThe implementation of customary inheritance law in Indonesia is very dependent on the defeat applied in indigenous peoples and determines one's position in adat. The Mandailing indigenous community with a patrilineal kinship system applies a system of inheritance only to boys and is only a gift for women or inheritance if a will is available beforehand. The study uses empirical judicial and analytical descriptive methods with observational research methods and interviews with the Chairperson of North Sumatra Muslim Pardomuan (PMSU) and also the main respondents to reach general conclusions. Responding to the Mandailing community per supervision of Palangka Raya City which is incorporated in the Palangkaraya City PMSU applies Islamic inheritance law so that the patrilineal system does not apply to Mandailing indigenous people per supervision and assets are not given only to boys, but daughters of Islamic inheritance, although including the fact that one respondent's family gave up the inheritance to be managed by the sons of seven siblings and used it for the benefit of all, and the delegation began with the distribution of inheritance by Islamic law. Finally, the implementation of customary inheritance law in Mandailing customary tribe per monitoring is still based on Islamic inheritance law. The influence of Islam inherent in the Mandailing indigenous people per the main factor determining their decision in taking Islamic rules in their inheritance system. Keyword: Inheritance Law and Mandailing Customary

Abstract

Pesantren merupakan institusi penting yang telah memiliki peranan besar dalam proses pendidikan di Indonesia. Selain itu, banyak pesantren lebih dahulu memberlakukan pendidikan bebas biaya dibandingan sekolah-sekolah formal yang dikelola dan diatur oleh pemerintah. Meskipun bebas biaya tidak berarti pendidikan dilakukan seadanya, karena banyak pesantren-pesantren yang telah berhasil mencetak lulusannya menjadi para pemimpin di negeri ini. Keberhasilan tersebut didukung faktor kemadirian keuangan pesantren melalu cara membangun usaha-usaha produktif atau memproduktifkan asset-aset wakaf yang dikelola pesantren. Sebagai contoh Pesantren Baitul Hidayah tidak memungut biaya pendidikan untuk para santri selain biaya makan harian, dan itupun hanya 40% dari total santri yang membayar biaya makan, selebihnya semua kebutuhan ditanggung pesantren. Untuk memenuhi kebutuhan biaya tersebut, Pesantren Baitul Hidayah secara bertahap berusaha menciptakan sumber dana dengan cara memproduktifkan asset wakaf melalui kelembagaan wakaf. Dengan demikian penulis memberikan batasan dengan judul “Optimalisasi Aset Wakaf sebagai Sumber Dana Pesantren melalui Pelembagaan Wakaf”. Secara rinci tulisan ini membahas tentang : (1) Pengertian wakaf. (2) Optimalisasi pengelolaan asset wakaf dalam aktivitas produktif. (3) Fundrasing wakaf. (4) Pesantren sebagai nadzir wakaf. (5) Proses pelembagaan wakaf di pesantren Baitul Hidayah. Adapun metode yang digunakan adalah study kasus melalui pendekatan deskriptif kualitatif. Kata kunci : Wakaf, Pesantren, Lembaga Wakaf

Abstract

ABSTRACTInsurance is a form of protection that is present either from the private sector or the government. One way of coverage in Indonesia is the Prudential institution. Prudential comes as an insurance option in which there is a waqf system. Asur waqf that serves for the overall benefit (virtue) of the people. The results show that Prudential comes with a variety of waqf insurance products with all applicable provisions, and is implemented on Islamic principles. The MUI fatwa analysis No. 106 of 2016 performed at the Prudential Insurance Institute found that discrepancies. Regarding endowment, up to 95% applies to the filing of new policies on PSBG and PSIA starting on January 10, 2019, with the condition that the leading participants have existing (conventional and sharia) systems that are still active. This action is not following fatwa no.106 / DSN-MUI / X / 2016, where insurance benefits may e represented at most 45% of the total insurance benefits.Keywords: Waqf, insurance policy, fatwa.

Abstract

ABSTRAK Secara struktural fiqh jinâyat diderivasi dari sumber hukum Islam, yaitu al-Quran dan hadis. Nash-nash (ayat-ayat) al-Qur’an dan hadis-hadis Nabi menjadi guide line dalam pengembangan wilayah kajian atau muatan fiqh jinâyat ini. Salah satu topik kajian dalam hukum pidana Islam adalah ta’zîr. Dan salah satu saknsi ta’zîr yang diperdebatkan oleh para ulama adalah sanksi pidana badan, yakni penjara. Hasil penelitian menunjukan bahwa pertama, ta’zîr ialah saknsi yang diberlakukan kepada pelaku jarîmah (tindak pidana) yang melakukan pelanggaran, baik berkaitan dengan hak Allah maupun hak manusia, dan tidak termasuk ke dalam kategori hukuman hudûd atau kafarat. Karena ta’zîr tidak ditentukan scara langsung oleh Al-Qur’an dan as-Sunnah, maka ini menjadi kompetensi penguasa setempat. Dalam memutuskan jenis dan ukuran sanksi ta’zîr, harus tetap memperhatikan petunjuk nash secara teliti karena menyangkut kemaslahatan umum. Kedua, eksistensi pidana penjara merupakan bagian intergral dari sistem hukum dalam Islam, oleh sebab itu, pidana penjara sudah sesuai dengan konsep ta’zîr yang sepenuhnya merupakan kebijakan penguasa (pemerintah) dan sudah pula sesuai dengan maqâshid al-syarî’ah, yaitu demi tetap terpeliharanya kemaslahatan dan menolak kerusakan. Kata Kunci: Penjara, Jarîmah dan Ta’zîr ABSTRAC Structurally jinâyat fiqh is derived from Islamic legal sources, namely the Koran and Hadith. Nash-nash (verses) al-Qur'an and the traditions of the Prophet became the guide line in the development of this jinâyat fiqh study area. One topic of study in Islamic criminal law is ta'zîr. And one of the functions of ta'zîr which is debated by the ulama is the criminal sanction of the body, namely prison. The results showed that first, ta'zîr was a function that was applied to perpetrators of jarīmah (criminal acts) who committed violations, both related to the rights of God and human rights, and did not fall into the category of hudûd or expiation. Since ta'zîr is not determined directly by the Qur'an and as-Sunnah, this becomes the competence of the local authorities. In deciding the type and size of ta'zîr sanctions, they must pay close attention to the text's instructions because it involves public benefit. Second, the existence of imprisonment is an integral part of the legal system in Islam, therefore, imprisonment is in accordance with the concept of ta'zîr which is fully the policy of the ruler (government) and is also in accordance with the maqâshid al-syarî'ah, namely for the sake of continuing maintain good health and resist damage.
