Abstract

The Islamic law of tahkim (med-arb) has stipulated certain qualities which must be observed to qualify as a mediator- arbitrator. However, having understood that mediation is actually a method developed under the framework of tahkim and the person who conducts it is by right an arbitrator, it poses the question of whether a mediator-arbitrator is required to possess qualifications similar to those of arbitrator. This paper seeks to examine and analyse the conditions and qualifications of a mediator and an arbitrator from the Islamic law perspective. The study adopts content analysis approach. It is therefore conducted based on and with reference to the Islamic law method of med-arb (tahkim) as discussed by Muslim jurists in classical texts. The findings show that in Islamic law of tahkim, a mediator and an arbitrator share almost similar roles in resolving marital disputes. A mediator and an arbitrator supposedly reflect each other in character and qualifications in many ways if not all.

Abstract

Abstract. Pragmatics is one of linguistic branches which studies about language in used. On the other hand, Semiotics studies about sign and its use. Javanese has a speech tanggap ing sasmita.  Tanggap ing sasmita is an old word or speech that has been passed down for generations and is still very much needed in today's life, especially in the era of the free market with various kinds of information to communicate. The tanggap ing sasmita amrih lantip was then one of the word in the song of the Wulangreh Book written by Sri Susuhunan Pakubuwana IV (PB IV) which is very phenomenal. The purpose of this paper is to analyze the Serat Wulangreh by Sri Susuhunan Pakubuwana IV, especially in the Kinanti 1 song with a pragmatic and semiotic approach. This paper uses a descriptive qualitative research method. Data obtained by documentation and content analysis. Source of the data was Kinanti song (one of macapat songs) by Sri Susuhunan Pakubuwana IV. Data analyzed by interactive model. The results of the analysis reveals that the speech "tanggap ing sasmita amrih lantip" in Serat Wulangreh is full of utterances which indicate the existence of piwulang (teaching) of pragmatic and semiotic competences both for the speaker and his audience. The speeches referring to pragmatics and semiotics are kalbu, lantip, mangan, nendra, dhahar, guling, and batin.Keywords: tanggap ing sasmita, competence, pragmatics, semiotics

Abstract

This paper discusses about the theological thought of Ali Shariati, more precisely  pertaining to the concept of liberation theology. Sub discussions in this paper comprise the biography of Ali Shariati, a list of languages to understand Ali Shariati’s thought and language expressions, Ali Shariati’s world view and ideology, world view Tawhid (theology) that liberates, and the philosophical concept of the creation of man. Ali Shari’ati understands religion not in a ritual dimension only. According to him, religion is the source of awareness, the cornerstone of ethics (morality), responsibility,  and free will that is capable to mobilize its followers into a force of liberation from determination of multitheism ideologies that oppress. Tawhid is the foundation of liberation ideologies that negate all forms of discrimination to move towards egalitarianism (equality) of human beings. Tawhid is the spirit of resistance against tyranny and oppression, based on the values of justice. In the view of Ali Syariati, Tawhid is the ephisentrum of life and mode of existence. Tauhid necessitates teocentric world view leading men in motion of existential evolution to become teomorphis human, men the characteristic of divine attributes.

Abstract

This article issues about the spread and development of Islam in Sabah around 1946-1990. The period was terrible as the society of Sabah mostly went with the belief of animism, paganism, and the practices of khurafat (related to the myth). During the period, the proselytizers considerably faced challenges of Christian action which was massively spread by British colony. In addition to this, the method of this study is the library research along with a number of opinions among graduates towards discussing this issue. Consequently, it is found that the primary role of spreading and development of Islam during the period was much set the group of Sufisms, the merchants, and the moving foreigners from Sabah such Malay Brunei and the Buginese of Indonesia. Furthermore, the existence of Islam over the world and the appearance of Dakwah organization in this country is the result of scarification who did not feel tired at all. In order to continuously survive the values of Islam around Sabah, the proselytizers, after the period, necessarily have short-term and long-term planning.

Abstract

This article discusses the reinterpretation effort of the Muslim feminist movement in Malaysia, Sisters in Islam (SIS,). The article looks at the effort of the group in reinterpreting some verses of the Qur’an and hadiths on the issue of women in marital relationship which in their view had been misinterpreted by Muslim male exegetes. Using the textual analysis method, the article examines some of the works written and commissioned by the association and its authors on this issue. In four sections, the article explores four works of the association on the following issues, namely (i) Are Muslim men allowed to beat their wives?, (ii) Guardianship law and Muslim women, (iii) hadith on women in marriage, and (iv) Islam and family planning or Muslim women’s reproductive rights. While the first and second parts discuss the issue of wife beating and guardianship law and Muslim women, the third and fourth parts examine hadith on women in marriage and Islam and family planning. Through its analysis of these works, the article concludes on the note that these works were mostly influenced by the works of Muslim feminist scholars such as Amina Wadud and Fatima Mernissi and as such contain controversial reinterpretations of the verses of the Qur’an and hadiths.

Abstract

This writing discusses about integration between science and Islam. The main purpose of the writing is to introduce a new paradigm of integration between science and Islam through some models, namely Islamization of science who is introduced by Ismail al-Furuqi and construct a paradigm of Islamic science who is introduced by Ziauddin Sardar. This writing is done by doing research in library and running qualitative research based on philosophical approach. The data is collected from books, journals, and the internet. The study is analyzed through descriptive analysis to get accurate results from the objective of the study. The epistemological theory that is used in this study is “construct of paradigm” theory of Thomas Kuhn to analyze the dichotomy of science and Islam and how to integrate them. The results of the research are: there are two models of integration between science and Islam, viz. Islamization of science and establish of Islamic science paradigm. The paradigms are very important to anticipate the universal problem of science.

Abstract

Humans have been predetermined as social beings for the reason that in meeting their needs they have to interact with others. Accordingly, humans tend to live in groups and society. These groups then agreed to set up rules to deal with the attitudes and behaviors in their environments. These rules later on developed into principles, guidelines, and way of life of a society to be kept hold of by each individual in the community. The worldview of a community greatly influence the behavior of individuals living in that community environment, hence an individual intending to get along and survive in a particular group of people should be able to comprehend and get familiar with the custom, worldview, and norms applied in the pertinent society.

Abstract

Islamic boarding school has types of environments. They are dirty environment and clean environment. In this case it needs activity to create Islamic boarding school that has clean and health environment. This study discussing the form of environmental awareness coaching in the Nurul Asna Islamic boarding school. This study used qualitative approach with the technique of collecting data through observation, and interview so that the conclusion was found: 1) create coaching awareness about clean environment at Islamic boarding school Nurul Asna that guided by headmaster and teacher, and the activity was create schedule cleanliness, community service two times in a month, and give cleanliness slogan. 2) the aim of coaching awareness about environment at Islamic boarding school Nurul Asna was: create cleanliness environment, student was more discipline and better than before, familiarize their selve to love the environment, and to prevent from various diseases especially skin diseases that usually suffered by studen. 3) Student has run a method of fostering environmental awareness that has been made. This is evidenced by the santri having maintained cleanliness by removing garbage, doing pickets according to the schedule and participating in the implementation of routine activities in two weeks.

Abstract

Indonesian nation, with its majority of Muslim population, should implement its local wisdom that is derived from the Holy Qur'an and the Prophet’s Sunnah in managing the nation and the state. In this way, it will be explicitly capable of developing built environment model based on the principle of sustainable architecture as an introduction to the implementation of the principle of Rahmatan lil Alamin in architecture. This can be pursued by starting to awaken an appreciation of the practice of the Qur'an and the Prophet’s Sunnah in everyday life,  including in the employment of architecture. The theory of sustainable development is not a very popular concept among both the public and the architects themselves. Sustainable architecture is defined as a concept applied in architecture to support the sustainable concept, namely the concept of maintaining natural resources in order to last longer, which is associated with the vital potential life span of the natural resources and the ecological environment of human beings.  Allah reveals in QS ar-Rum/30 : 41“Mischief has appeared on lands and seas because of (the meed)  that the hands of man have earned, that (Allah) may give them a taste of some of their deeds: in order that they may turn back (from evil).”  Architects should have awareness about this subject in order that in conducting professional practice they always carefully pay attention to the natural environment so that the results of their design could provide a blessing for the environment. That is the true meaning of Rahmatan Lil Alamin.

Abstract

This paper aims to describe the program implementation model conducted by Working Group IV, one of the Working Groups formed in SILE project of Makassar by considering the gender equality initiation of Cambaya’s community activities. One of the important results in ABCD approach is the establishment of Core Group derived from Cambaya own society. The group then organizes the society in advocating policies of institutions related to the public participation in public service. The entire processes of the activity stages are still controlled together by considering the aspect of gender equality. Generally, the practice of gender equality in the society has developed the awareness of respect and equality patterns in the societies’ daily activities and public services in the environment of Cambaya sub-district. The group was very actively in conducting the society mediation and mentoring related to the woman empowerment, the issues of domestic violence, the issues of child protection, and very actively help to mediate with the law enforcement officials when there were community members who had problems with the law.
