BUSTANUL FUQAHA: Jurnal Bidang Hukum Islam is a national e-journal published by Pusat Penelitian dan Pengabdian Masyarakat (P3M), Sekolah Tinggi Ilmu Islam dan Bahasa Arab (STIBA) Makassar. All submitted papers are put through double-blind review process. The journal accepts both research and non-research articles, which will be peer-reviewed by at least 2 (two) reviewers. Once a manuscript is submitted trough the online process, a journal editor examines the manuscript and determines its appropriateness for the full peer review. If it passes the initial screening, the manuscript will be sent to peer reviewers. The journal’s editorial board will then consider the peer reviewers’s reports and assemble the final decision to accept or reject the manuscript for publication. Language used in this journal is Indonesian, English, and Arabic. BUSTANUL FUQAHA: Jurnal Bidang Hukum Islam focused on Islamic Studies and present developments through the publication of articles and research reports. BUSTANUL FUQAHA: Jurnal Bidang Hukum Islam specializes on Islamic law, and is intended to communicate original research and current issues on the subject. This journal warmly welcomes contributions from scholars of related disciplines. FOCUS BUSTANUL FUQAHA: Jurnal Bidang Hukum Islam focused on Islamic Law (Hukum Islam) and present developments through the publication of articles and research reports. Abstract

The research is talking about a virus spread across the world with her being taken from the government and MUI as the Islamic regime. The government itself has issued a hand-to-hand lockdown system and also a PSBB or social distaff to fight the spread of the virus covid-19, so is the counter measures done by MUI by canceling traditional player in the mosque and by reducing Friday prayer in regular. Even though this circular became a pro and cons for most of society especially at the rings of MUI. The purpose of this research is to help the public understand whether the government?s existence and MUI?s treatment of the plague corresponds to or even contradicts the Islamic regime. Research methods will be used with literature literature review with the normative approarch and supported by the historial approach. Research shows that the rule imposed by the government and MUI in handling the outbreak did not include an investigation into Islam.

Abstract

Azan is an important matter in performing obligatory prayers; it is an announcement of the beginning of five-time daily prayers. However, problems arise when covid-19 pandemic occurs in the midst of society and a particular way (kaifiyat) of azan recommended in the Shari'a is required. The aim of this research was to describe the law and the characteristics of azan during the covid-19 pandemic. Therefore, descriptive qualitative research methods were used in this study so were content analysis techniques and library research approaches in the analysis process. The results of the study show that the law of azan in the midst of the covid-19 pandemic is fardu kifayah (collectively obligatory), while the additional enunciations of azan that was prescribed in the excused condition of the congregational prayer include: Shallu> fi> riha>likum, Shallu> fi> buyu>tikum, Ala> Shallu> fir riha>l, and Ash Shala>h fir Riha>l. The pronouncement of the additional enunciations of azan is after the usual as usual, and this is based on the clearest passage according to the narration of Ibn Umar radhiyallahu anhuma. However, the scholars also allow the muezzin to pronounce those enouncements in place of "Hayya? ala ash shala> h" when azan is called out.

Abstract

This research was conducted with the aim to explain the law of fasting during the Covid-19 pandemic upon those who are Covid-19 positive, those who were Covid-19 positive yet asymptomatic, and health workers who treat Covid-19 patients. This research used a qualitative approach using content analysis and library research. The results showed that, first, people who are Covid-19 positive are considered sick so that they have excuse to break the fasting; Second, those who are Covid-19 positive but show no symptoms are considered sick people so that they may not fast; Third, those who are still healthy and have not been infected with Covid-19 and have met the conditions of fasting and have no excuse that prevent them from fasting then it is obligatory upon them to fast; Fourth, medical workers who treat Covid-19 patients are still required to fast. If in conducting their duties they are very thirsty, hungry, or exhausted who are feared to be vulnerable to falling ill and be infected with Covid-19, then they may break their fast.

Abstract

Id prayer is one of the prayers recommended to be done in congregation, but in abnormal conditions sometimes Muslims are prevented from conducting it in congregation, so it must be conducted in their homes either individually (munfarid) or in congregation with family members in one house. This study aimed to recognize the law of conducting id prayer at home in the midst of covid-19 outbreak. In this study the author employed library research method with a juridical normative approach to get accurate results from different perspectives described in numbers of works by classic scholars to be applied in the current situations. The results show that Id prayer may be done at home either individually or in congregation with family members in order to avoid the spread and transmission of covid-19.

Abstract

This study elaborated one phenomenon that occurs in Indonesia, particularly after the appeal issued by Indonesian Government and Indonesian Council of Ulama (MUI) for people to avoid crowded places including the mosques. People responses vary greatly so is with community leaders; of course, the response is the result of their understanding so far. This research used a descriptive qualitative method by using data related to theology that develops in Islam, namely Qadariyah, Jabariyah, and Ahlussunnah in particular in response to the policy of government and scholars on preventing the outbreak of Covid-19. The results of this study show that there are three groups who address the issue of destiny in different ways. First, Jabariyah is a group that only relies on Allah, but denies effort. Second, Qadariyyah, is a group that denies destiny, only does efforts but forget the reliance on God. Third is the middle group, Ahlu Al Sunnah wal Jamaah, which combine reliance with effort in matters of destiny. If it is analyzed carefully, among the three theological schools, the easiest one to support the maximization of government policy and the instructions of scholars in Indonesia is Ahlusunnah wal Jamaah. They combine belief in destiny with effort to maximize the achievement of the reliance process towards destiny.

Abstract

This study aimed to elaborate and examine the procedures for purification and prayer for health workers when using personal protective equipment (PPE). This research used a descriptive qualitative approach through content analysis techniques and library research. The results show that: First, it is an emergency condition that PPE is not applied, it will threaten the safety of his or her life in which he or she is vulnerable to infected with the virus; Secondly, before using PPE, health workers should have themselves purified from small hadas (impurity) through ablution or from the big one through bathing; Third, in the state of purity and nothing breaks the ablution, health workers can immediately pray as usual; Fourth, if their ablution is broken and they still must wear PPE while it is feared that time for prayer be over, then they should pray according to their circumstances even though they are obstructed from purification; Fifth, under certain situation, due to the job, health workers cannot perform prayers on time or cannot merge their prayers then they should immediately perform prayers whenever it is possible.

Abstract

This study aimed at analyzing the fatwa of the Indonesian Council of Ulama (MUI) regarding the management of Muslim dead body infected with Covid-19 regarding the Shafi'i School. This research used descriptive qualitative approach with content analysis techniques and library research. The results showed that the fatwa of MUI regarding the management of Muslim dead body infected with Covid-19 in general had been conducted in accordance with the established fiqh of Shafi'i School, even based on the agreement of the four schools.

Abstract

This study aimed to provide explanation and overview related to the law of tarawih prayers at home in an pandemic situation (Covid-19), the law of performing prayers at home with the intention of participating in congregation in the mosque, and the law of reciting the mushaf or mobile phones while leading tarawih prayer. This research used a descriptive qualitative approach using content analysis techniques and library research. The results show that if in an area where the potential for outbreaks of the covid-19 outbreak is high and there has been an appeal from the local government and scholars (MUI), then in these state the more important thing is to perform tarawih prayers at home, both congregationally with family members, and this is the preferred, or individually; (2) invalidity of the prayers of a person who follows the congregational prayers outside the mosque building, where the scholars agree that he must go to the mosque; and (3) it is permissible to recite from the mushaf in the sunnah (optional) prayers, such as tarawih prayer for imams who do not memorize the Koran. As for the obligatory prayers, it is disliked because there is no need to do so. This law also applies to someone who wants to recite the Koran with the software of Koran on mobile phones.

Abstract

This study aimed to identify the process and purpose of the grave pilgrimage tradition after marriage in Manisa village, Baranti subdisctrict, Sidrap district, South Sulawesi, and also to examine the law of the custom in the view of Islamic law. This research employed a qualitative approach with the field study method (Field Research) and library research. The study shows that: 1. People ini Manisa village after celebrating their wedding they make grave pilgrimage in forms of such as: Determining a certain time according to the agreement of the bride and groom, preparing the necessary preparations such as water, kettles, and pandanus leaves, making ablution before going to the graveyard, praying before entering the cemetery, watering the grave with water mixed with pandanus leaves, holding the gravestone, praying for the late by reciting certain chapters finalized by surah Al-Fatihah. 2. Grave pilgrimage is one of the prescribed acts of worship but it should be in accordance with the guidance of the Prophet. As for what is found in the people of Manisa Urban Village, there are still a number of differences between what they do and what had been exemplified by the Messenger of Allah such as the determination of a special time for the grave pilgrimage, watering the grave, and seeking for blessing from the graves visited.

Abstract

The condition of the corona virus pandemic (covid-19) in Indonesia has an impact on religious life for Muslims, such as Friday prayers. The government issued a regulation on Friday prayers at mosques in areas where the distribution of the prayers was controlled with a prayer distance of one meter to prevent the spread of the virus, resulting in the mosque being unable to accommodate many worshipers at a time. The purpose of this study is to describe the opinions of the scholars regarding the two waves of Friday prayer in one mosque and the Friday prayers in addition to the mosque during the Covid-19 pandemic, and also aims to respond to community questions about these two issues in order to find the right answers so that the community can perform worship calmly. This type of research is a qualitative descriptive study using a literature review method with a normative approach. The results of this study are that the scholars disagreed about the law of the two-wave Friday prayer in one mosque during the covid-19 pandemic. A strong opinion is that it is permissible to carry out two waves of Friday prayers in one mosque, due to emergency or urgent conditions such as the covid-19 pandemic conditions, with the condition that the mosque is narrow and there is no other representative place to accommodate worshipers, the number of worshipers in the second wave is as much as the number of pilgrims in the first wave, as well as getting approval or permission from the government. The implementation of this research is expected to provide theoretical and practical contributions to scientists and society in general.
