Abstract

Konstitusi merupakan hukum dasar yang menjadi landasan penyelenggaraan pemilihan umum, termasuk pelaksanaan pemilihan umum presiden dan wakil presiden. Ambang batas pencalonan presiden dan wakil presiden (presidential threshold) tidak sejalan dengan amanah konstitusi. Penelitian ini bertujuan untuk menganalisis norma presidential threshold yang terdapat pada UU No. 7 Tahun 2017 tentang Pemilu terhadap Ketentuan UUD UUD NRI 1945 dan sistem presidensial di Indonesia. Metode penulisan menggunakan metode normative, dengan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan kasus. Hasil penelitian menunjukkan bahwa ketentuan presidential threshold bertentangan dengan ketentuan UUD NRI 1945 dan menderogasi hak konstitusional partai polittik untuk mencalonkan presiden dan wakil presiden. Ketentuan presidential threshold juga bertentangan dengan semangat penguatan sistem presidensial dan cenderung quasi parlementer.

Abstract

Qadzf ikhtilath jinayah an act that is set up in Aceh Qanun No. 6 of 2014 concerning jinayah, Qadzf ikhtilath are accusing others of committing ikhtilath or two-pair, and making out. The type of research used is library research (library research) Accusing others of committing acts of ikhtilath, including intentional acts because they have intended and done those acts. Although berikhtilat is forbidden in religion but do not accuse others. Exxon ikhtilath in Aceh in accordance with canon law if it could not prove the act of the accused offender qadzf will be chargedcaning and a fine of 30 times the gold. The accuser is also obliged to bring 4 witnesses at the same time if the accuser is unable to bring witnesses then the accuser will also be under the law of ta'zir. Witnesses who must be present must not come alone because they will be declared as accusers so the witnesses who must be present must come together. And the perpetrator of qadzf ikhtilath will lose his sentence if the accused person admits his robbery, so the one who gets the punishment is the person who is accused because he has admitted his deeds. To avoid the act of qadzf ikhtilath has been regulated in Law No.6 of 2014 on Crimes as a warning to the perpetrators not to hurt others and protect the community who are the victims of the accusation.

Abstract

This study aims to determine the views of Islamic law on the inheritance of children in the womb. This research is a descriptive qualitative research with data collected from various literature sources with a juridical normative approach. The results show that the position of the child in the womb with respect to inheritance in Islamic law is largely determined by two conditions that must be met, namely that he must be proven alive when the person who gave the inheritance dies, by paying attention to the minimum and maximum limits of the content. The second condition is that the child in the womb should be born alive at least a few minutes after birth marked by screams and movements. While the distribution of inheritance for children in the womb based on Islamic law, can be done in two ways, namely waiting until the birth of the baby is real or distributing the inheritance without waiting for the birth of the baby, by suspending the most part for the fetus if he is included in one of the an heir.

Abstract

This study aims to determine silariang from the perspective of Islamic law and customary law in Bontocani District, Bone Regency. This research is a type of normative legal research using a juridical approach and a sociological approach. This study indicates that crossbreeding in Islamic law is invalid because the marriage is legally flawed and does not fulfill the legal requirements of marriage, namely without the consent of the guardian. In other words, a marriage that is held in a crossbreeding marriage is considered null and void. While silariang in Customary Law in the Bugis community in Bontocani District, Bone Regency is seen as an act that brings Siri’ (shame). Those who commit such violations may be subject to sanctions, either in the form of light sanctions such as expulsion and expulsion or severe sanctions, namely being killed

Abstract

One of the problems faced by a judge when deciding on a divorce case is the case of refunding spending money. Regarding spending money, it becomes a new problem and legal case when a wife files for divorce (khulu) to her husband in court (especially if the wife has not been interfered with), then her husband demands a refund of the spending money.This study uses a type of field research (field research), namely research in which data collection is carried out in the field, in this study is a legal sociology approach. The sociology of law approach is used to evaluate and examine the influence of law on social behavior, the beliefs held by people in the social world in relation to customary justice, social organizations, social developments and legal institutions, social conditions that give rise to law.The results of the study show that (1) the basis for the judge's consideration in deciding cases of demands for a refund of expenditures to settle cases of demands for a refund of expenditures there are 3 methods, namely: The method of juridical considerations bases its decision on the provisions of the legislation formally in the form of evidence. namely, documentary evidence (written), witness evidence, suspicion (allegations), confessions and oaths, the Sociological Method. And Philosophical Methods. (2) The judge in handling the demands for the refund of spending money is based on Islamic law, by conducting ijtihad or legal discovery by tying up or analogizing spending money with a dowry because of Qobla Dukhul. Because no legal basis is found in the Qur'an and al-Hadith.
