Abstract

Law Number 20 of 2016 concerning Trademarks and Geographical Indications provides protection against the use of famous persons' names, photos, and legal entity names in trademark applications submitted to the Directorate General of Intellectual Property. Article 21 paragraph (2) letter a stipulates that a trademark application will be rejected if such elements are used without written consent from the rightful party. However, this provision only results in an administrative sanction rejection of the application without any accompanying criminal sanctions for violations. This normative gap reveals a significant weakness in the legal protection system for intellectual property in Indonesia. This study aims to analyze this legal void and provide recommendations for a more comprehensive legal framework, including the possibility of imposing criminal sanctions. The method used is normative juridical, involving analysis of legal statutes, legal literature, and comparative studies. The findings indicate that criminal sanctions are necessary to ensure deterrence and provide effective legal protection for owners of famous names and legal entities from acts that exploit or damage their reputation.

Abstract

Overcrowding that occurs in correctional institutions encourages the need for alternatives to punishment that are more effective and oriented towards social reintegration. Community Based Corrections (CBC) is a new approach in the correctional system that is relevant to be implemented in the Nusakambangan Class IIB Open Prison. This study aims to analyze the implementation of Community Based Corrections in the Class IIB Nusakambangan Open Prison as a form of coaching that emphasizes the reintegration and rehabilitation of prisoners. The method used is a juridical-sociological approach with qualitative descriptive techniques, through document studies, interviews, and observations of the implementation of the CBC program. The results show that the implementation of CBC in Nusakambangan Open Prison has fulfilled basic principles such as community protection, proportionality, cost effectiveness, and restoration, although it still faces challenges in supervision and community participation. This research shows that CBC has the potential to become a future punishment policy that is more humane and efficient, and supports a correctional system that is oriented towards recovery and social integration.

Abstract

A minor is under the legal responsibility of their parents or guardians, as regulated in the Civil Code, the Marriage Law, and the Child Protection Law. This responsibility includes the obligation to care for, educate, and supervise the child until they reach adulthood or enter into marriage. In the context of unlawful acts (tort) committed by a child, this research is a normative juridical study using a statutory approach. It highlights the importance of parental supervision and the possibility of exemption from liability if it can be proven that the parents have exercised proper supervision. Through the case involving the child "R", this article emphasizes that parental negligence in supervision may result in legal consequences in the form of compensation obligations to third parties.

Abstract

This study aims to analyze the effectiveness of marriage announcements as stipulated in the Minister of Religious Affairs Regulation (PMA) Number 30 of 2024 concerning Marriage Registration, particularly at the Office of Religious Affairs (KUA) in Boyolali Regency. The announcement of marriage intentions has a strategic function as an instrument of social control and a mechanism for public information disclosure to prevent violations of marriage laws, such as manipulation of marital status. The research method used is empirical juridical with a qualitative descriptive approach, through document studies and in-depth interviews with KUA employees and the community. The results of the study show that although the new regulation provides a strong normative basis for transparency in marriage registration, its implementation is not yet effective and still faces several obstacles in the form of limited technological facilities, human resource capacity, and public awareness. Local socio-cultural factors also influence the level of public participation in expressing objections to marriage plans. These findings confirm that the effectiveness of policies depends not only on legal substance, but also on the readiness of institutional structures, adequate digital technology infrastructure, and budgetary support from the government. Therefore, infrastructure strengthening and affirmative policies from the Ministry of Religious Affairs are needed to realize more transparent and accurate marriage announcements.

Abstract

This study critically examines the implementation of marriage dispensation policies in Indonesia and their implications for women's empowerment, particularly in the context of achieving Sustainable Development Goal (SDG) 5 and its target 5.3, which emphasizes the elimination of child marriage. Although Indonesia revised the minimum legal age of marriage to 19 for both men and women through Law No. 16 of 2019, the continued application of marriage dispensations, as permitted under Article 7(2) of the Marriage Law and further regulated by Supreme Court Regulation No. 5 of 2019, still legitimizes early marriage based on the broadly interpreted notion of "urgent necessity." Employing a normative juridical methodology, this study utilizes secondary data comprising statutory regulations, legal doctrines, judicial decisions, and relevant international instruments. This analysis is further supported by an empirical case study involving the marriage of two junior high school students in Pemalang Regency, which illustrates the real-world implications of these policies. The findings reveal that legal ambiguities and insufficient oversight within the dispensation framework perpetuate the practice of child marriage, thereby restricting girls’ access to education, healthcare, and economic opportunities. Using a feminist legal approach and a child rights-based perspective, this study underscores the urgent need for legal reform, gender-responsive policy development, and cross-sectoral collaboration to eliminate child marriage. The study contributes to strengthening Indonesia's national legal framework in fulfilling its global commitment to achieving a gender-equitable development agenda.
