Abstract

The social assistance of the Family Hope Program (PKH) is closely related to the cultural poverty that exists in beneficiary women. PKH carries out empowerment by using all the potential, natural resources or even human resources with the support of the government, so that the community becomes more independent. Based on the concept of empowerment theory with the using dimension and the theory of women’s empowerment from the Impact dimension, research data show PKH could not empower women individually or in groups (KPM). This research uses a qualitative approach, with data collection techniques are observation, interviews, and Focus Group Discussion (FGD). The results showed that 32 people could not understand and implement this independence because of education and understanding of the program or training provided. Social capital is a form of strengthening among these components.

Abstract

The purpose of this study is to reveal that divorce is contested as a result of domestic violence that has exceeded the limit, so that it is considered a crisis and crucial in family problems. There are two problems, namely how the judge considers in making a decision on a contested divorce case, and how to uphold the law and justice in a contested divorce case. Data analysis was carried out using the theory of law enforcement and gender justice, using a socio-anthropological approach. The results show that the consideration of judges in deciding divorce cases as harmonization in law enforcement is that the husband's position in the household. He cannot commit arbitrary acts and physical, psychological, sexual and financial violence, excessive burdens on wives, as the implementation of gender justice. Harmonization of law enforcement and gender justice in divorce cases is realizing and protecting the rights of wives with equal position with husband so they don't continue to be victims of violence, not in a marginal position in the household. This research can be recommended to continue to do research that is more perfect in uncovering cases of divorce due to domestic violence.

Abstract

This study aims to discuss the issue of pregnant women out of wedlock in Bugis community in the modern era in relation to the shift in the value of customary sanctions from the perspective of human rights and Islamic law. This study consists of two problems, namely the application of customary sanctions against women who are pregnant out of wedlock and the shift in the value of customary sanctions against women who are pregnant out of wedlock in the modern era from the perspective of human rights and Islamic law. The research methodology was carried out using a qualitative-descriptive field research approach. Data collection by way of observation, interviews, documentation. Sources of data are from the Bugis community, both academics and traditional leaders. Data processing is carried out with data related to the study and data analysis carried out by the theory of legal change and the theory of human rights. The results of the study show that 1) The application of customary sanctions against pregnant women out of wedlock in Bugis community is seen as a disgrace and shame so that customary sanctions called dipaoppangi tana apply, namely women are considered dead and the lineage from their family is erased, unless men are willing marrying a woman who causes her to become pregnant, or it can be with another man who is commonly known as pattongko siri, and 2) Traditional sanctions against women who become pregnant out of wedlock have experienced a shift in values both in the system of norms after being studied in Islamic law and human rights.
