Abstract

The purpose of this study is to reveal that divorce is contested as a result of domestic violence that has exceeded the limit, so that it is considered a crisis and crucial in family problems. There are two problems, namely how the judge considers in making a decision on a contested divorce case, and how to uphold the law and justice in a contested divorce case. Data analysis was carried out using the theory of law enforcement and gender justice, using a socio-anthropological approach. The results show that the consideration of judges in deciding divorce cases as harmonization in law enforcement is that the husband's position in the household. He cannot commit arbitrary acts and physical, psychological, sexual and financial violence, excessive burdens on wives, as the implementation of gender justice. Harmonization of law enforcement and gender justice in divorce cases is realizing and protecting the rights of wives with equal position with husband so they don't continue to be victims of violence, not in a marginal position in the household. This research can be recommended to continue to do research that is more perfect in uncovering cases of divorce due to domestic violence.

Abstract

This study aims to explain the thoughts of judges in the death penalty for narcotics crimes with the relevance of human rights and Islamic law. The application of the death penalty is a very urgent problem, because in narcotics crimes it is referred to as an extraordinary crime. This study is a qualitative research with a descriptive-critical analytical method. The results of the study show that the death penalty does not contrast with human rights for narcotics offenders, especially in Islamic law including hirabah as an extraordinary crime regarding narcotics crimes which can deprive other people of life with absolute rights that must be defended and protected by the state. The judge's opinion refuses to put down human rights if it hinders the imposition of capital punishment, the abuse of narcotics that imposes a death penalty is in line with Islamic law and the Constitutional Court's decision regarding constitutional review is not contrary to human rights, the death penalty cannot be abolished, but is maintained according to law Islamic law and law, because the death penalty is not an opponent of human rights, but a supporter of human rights in the right to life and human life.

Abstract

Menampilkan perkembangan pembelajaran di pesantren tentunya teramat susah, mengingat tidak adanya acuan standar baku yang dijadikan pegangan semua pondok pesantren yang ada. Artinya, tidak ada laju perkembangan keilmuan yang secara kontinyu dipakai oleh tiap-tiap pesantren. Semisal satu pondok tidak lantas mengubah dirinya untuk disesuaikan dengan perkembangan zaman, mulai dengan sistem pembelajaran wetonan, lantas ada pengkelasan, terus dengan manajemen organisasi modern dan seterusnya. Karena bahkan sampai di era millenium ini, masih bisa kita temukan pondok pesantren Salafi. Dimana sang kiai (sebutan bagi orang yang alim atau ahli dalam bidang agama) mewajibkan santrinya mengikuti jamaah tarekat, menolak peralatan modern seperti alat speker, dan lain-lain. Pada awal berdirinya, pesantren merupakan media pembelajaran yang sangat simpel. Tidak ada klasifikasi kelas, tidak ada kurikulum, juga tidak ada aturan baku di dalamnya. Sebagai media pembelajaran keagamaan, tidak pemah ada kontrak atau permintaan santri kepada kiyai untuk mengkaji sebuah kitab, apalagi mengatur secara terperinci materi-materi yang hendak diajarkan. Dua model pembelajaran yang terkenal waktu itu adalah model sistem pembelajaran hofdelijk atau sistem wetonan/ bandongan nonklasikal dan sistem sorogan.

Abstract

Penelitian ini bertujuan untuk menggali metode pendidikan Islam dalam perspektif Al Quran. Studi ini mengadopsi penelitian kepustakaan (Library Research) dimana berisi koleksi materi yang mendalam pada satu atau beberapa subjek. Studi pustaka ini menggaris bawahi bahwa terdapat beberapa prinsip pendidikan yang tercermin dalam al Qur’an yang mencakup prinsip tauhid, keseimbangan, keadilan, integral, universal, persamaan, dinamis, dan kebebasan. Prinsip pendidikan dalam perspektif Al-Qur’an ini tidak mungkin bisa berjalan tanpa ada aplikasi, karena prinsip saja belum bersifat operasional.

Abstract

Penelitian ini bertujuan untuk menjelajahi lebih jauh konsep keseimbangan sebagai azas pendidikan dalam perspektif Al-Qur'an. Melalui pemahaman yang lebih dalam tentang pandangan Al-Qur'an tentang keseimbangan, diharapkan kita dapat menggali prinsip-prinsip pendidikan yang seimbang dan berkelanjutan. Penelitian ini juga melibatkan kajian terhadap literatur yang relevan tentang konsep keseimbangan dalam pendidikan dalam perspektif Al-Qur'an. Hasil penelitian menunjukkan bahwa Substansi keseimbangan dalam kandungan ayat-ayat al-Qur’an menunjukan bahwa manusia memiliki potensi kekuatan yang independen, jiwanya dapat mengatur, mengomandoi kekuatan lainnya, dan jisim-nya mampu menempatkan segala sesuatunya pada kedudukannya yang seimbang.

Abstract

The policy of coaching the improvement of lecturer performance at the Faculty of Tarbiyah is: a) providing learning opportunities for lecturers at the S2 and S3 levels; b) seminars/workshops/workshops on improving academic abilities, increasing research skills and community service, increasing interest in reading and writing, improving work ethic and campus manners; c) Training/courses on improving the quality of lecturer performance and d) involvement of lecturers in setting institutional quality standards and performance improvement programs. One of the factors causing the low interest of lecturers to conduct research is due to lack of information and understanding of problems related to technical research and c) community service activities are still not optimally carried out, this can be seen from the findings that only a few lecturers carry out community service activities. There are several factors that affect the performance of lecturers, namely: a. Supporting factors ; which includes: 1) support from the leadership of both institutions and faculty leaders as well as cohesiveness and togetherness between lecturers; 2) the existence of policies and objectives of the institution to develop the quality of lecturers; 3) the amount of interest of lecturers to develop and improve the knowledge and skills of lecturers. b. Inhibiting factors include: 1) limited budget financial support that can be provided by IAIN Syekh Nurjati Cirebon institution to finance all further education needs for lecturers; 2) the institution has not been able to provide and provide maximum technical equipment assistance such as laboratories and others; 3) the development of similar universities in various places, and 4) lack of coordination with related institutions, so that good communication and cooperation do not occur.

Abstract

Bengkel Barokah Motor merupakan salah satu usaha keluarga yang bergerak dibidang retail dengan menjual sparepart motor. Proses administrasi penjualan merupakan salah satu kegiatan penting bagi proses penjualan sparepart motor di bengkel ini. Untuk mendukung sistem aplikasi penjualan ini, perlu adanya sistem komputerisasi untuk membuat laporan penjualan yang cepat, akurat serta efisien dalam pengerjaannya. Namun dalam kenyataannya, hal tersebut memang tidak sesuai dengan keinginan dan harapan yang ditentukan, karena belum adanya sistem komputerisasi yang digunakan di bengkel tersebut. Bengkel Barokah Motor masih menggunakan sistem manual dalam pengolahan data administrasinya. Sehingga masih seringnya terjadi kesalahan pada saat pencatatan data. Untuk itu perlu dirancang suatu sistem aplikasi penjualan. Sistem tersebut dirancang menggunakan metode OOAD, dan digambarkan melalui diagram UML seperti activity diagram, sequence diagram, use case diagram, class diagram dan state chart diagram. Sistem dibangun menggunakan bahasa pemrograman PHP, dan database yang digunakan adalah MySQL. Hasil penelitian ini adalah sebuah sistem aplikasi penjualan yang digunakan untuk mencatat setiap transaksi yang terjadi serta membuat laporan penjualan secara cepat dan akurat. Sehingga dengan adanya sistem tersebut, user akan sangat terbantu dalam mengerjakan pekerjaannya. Kata kunci : aplikasi sistem penjualan, sparepart motor Workshop Barokah Motor is one of the family businesses engaged in retail selling motor spare parts. Sales administration process is one of the important activities for motor spare parts sales process at this workshop. To support this sales application systems, the need for a computerized system to create sales reports are fast, accurate and efficient in the process.But in reality, it does not correspond with the wishes and expectations are determined, due to the lack of computerized systems used in the workshop. Workshop Barokah Motor still use manual systems in data processing administration. So it is still frequent errors during data recording. For that we need to design a system application sales. The system is designed using OOAD methods, and illustrated by diagrams like UML activity diagrams, sequence diagrams, use case diagram, class diagram and state chart diagrams. The system is built using the PHP programming language, and the database used is MySQL. The result of this research is a sales application system used to record each transaction and create sales reports quickly and accurately. Abstract

This research analyzes family law systems in Indonesia and Saudi Arabia regarding marriage from a Maqasid al-Sharia perspective. It examines issues such as serial marriage practice, implications in both countries, and Maqashid al-Shari'ah's view on marriage registration. The study aims to analyze serial marriage practice, its implications, and Maqashid al-Shari'ah's perspective on marriage registration. It employs a library research method with a normative juridical approach. Primary sources include Islamic marriage regulations, Legal Regulations on Marriage KHI, Saudi law, and library literature. Findings reveal reasons for serial marriages in Indonesia and Saudi Arabia, influenced by social, cultural, and economic factors. Both countries face legal and social challenges for children from such marriages. Implications of serial marriages include legal uncertainty, limited access to public services, and health risks. In Indonesia, marriage status is not officially recognized, while in Saudi Arabia, women lack legal protection against health and domestic violence risks. Abstract

This study discusses the importance of strengthening the legal understanding of underage marriage due to pregnancy out of wedlock for students in Parepare City. Consisting of two problems: what is the context of the impact of changes in the marriage age law due to pregnancy out of wedlock, and what is the reaction to the rejection of child marriage due to pregnancy out of wedlock for students in Parepare City? The research method is field research through a qualitative descriptive approach. This study uses data analysis with theories of legal change and social inequality. The results showed that students generally understand the context of the impact of changes in marriage age law to protect against the occurrence of underage marriage due to pregnancy out of wedlock with a very high risk. The reaction to the rejection of underage marriage due to extramarital pregnancy has built a paradigm to protect the rights and welfare of children, prevent forced marriage, and avoid adverse health and social risks.

Abstract

he property company PT. Farabi Global Construction is currently focusing on marketing the Paradise Park Residence housing, in addition to continuing to innovate to produce buildings, shophouses and other housing that is beneficial to the community. Problems occur when the existing housing marketing system is ineffective which causes sales to customers to continue to decline and therefore a marketing system is needed that facilitates the sale of housing units via the internet and Web-based. The method applied in this research is to apply the Incremental method in the form of a Software Development Method based on needs, with the Top-Down Decoupling standard. Besides that, UML is also used with Visual Paradigm, PHP, Discovery Testing, etc. to support research. The results of this research are Web-based Marketing Applications for Paradise Park Residence housing with the aim of increasing housing sales that can be implemented at PT. Farabi Global Construction.
