Abstract

Until now, the condition of the COVID-19 pandemic in Indonesia is still ongoing, this has caused the performance of BPRs to be disrupted. This study aims to analyze whether there are differences in the performance of BPR before the COVID-19 pandemic and during the COVID-19 pandemic at BPR during the period June 2018 to September 2021. BPR's performance is measured by six financial ratios, consisting of the ratio of return to return on assets (ROA), capital adequacy ratio (CAR), non-performing loan ratio (NPL), operating expenses to operating income (BOPO), loan to savings ratio (LDR), and Cash Ratio (CR). This research method uses a quantitative approach with a comparative nature. This type of data collection uses secondary data in the form of BPR financial reports sourced from www.ojk.co.id. The data analysis method used a paid sample-test analysis with the help of the SPSS version 25 program. The results of the study found that (1) there were differences in ROA before the COVID-19 pandemic and during the COVID-19 pandemic. (2) There were differences in CAR before the COVID-19 pandemic and during the COVID-19 pandemic. (3) There was a difference in BOPO before and during the COVID-19 pandemic. (4) There was no difference in NPL before and during the COVID-19 pandemic. (5) There was no difference in LDR before and during the COVID-19 pandemic, and (6) there is no difference in the Cash Ratio (CR) before and during the COVID-19 pandemic.

Abstract

The phenomenon of juvenile delinquency in Indonesia is increasing, especially in terms of narcotics abuse which is an extraordinary crime, so that it is threatened with a fairly heavy crime. But on the other hand, perpetrators who are still children have the right to the principle of the best interests of children. So it can be said that the imposition of imprisonment on children does not provide a sense of protection to children, besides that children are victims of narcotics abuse as stipulated in Article 67 of Law no. 35 of 2014 concerning Child Protection. The problems in this study are (1) what is the judge's consideration in imposing a prison sentence on children who are perpetrators of narcotics crimes in Decision Number 12/Pid.Sus.Anak/2017/PN.Dps? seta (2) How is the provision of criminal sanctions in prison for children who are perpetrators of criminal acts of narcotics abuse according to the principles of juvenile criminal justice in Decision Number 12/Pid.Sus.Anak/2017/PN.Dps? This research is a normative juridical research so that what is studied are legal principles and legal rules that are still valid but are also supported by empirical data so that what is studied is data originating from the literature and court decisions. In imposing a prison sentence on a child who is a narcotics criminal in Decision Number 12/Pid.Sus.Anak/2017/PN.Dps, the judge is of the view that a child who is a drug abuser for himself is also a perpetrator of a crime/crime, so he must also still sentenced, therefore the judge's consideration in making a decision only affects the length of imprisonment, not a reason that affects the type of sanction given. Where the perpetrators who are still at the age of children are only used as mitigating things in terms of the length of imprisonment. Based on this, it can be seen that the child perpetrators of narcotics abusers in this case are still treated as mere criminals, regardless of the child as a victim. (2) The provision of imprisonment for children who are perpetrators of criminal acts of narcotics abuse according to the principle of juvenile criminal justice in Decision Number 12/Pid.Sus.Anak/2017/PN.Dps is deemed inappropriate, because the type of narcotic crime is included in a crime without victims. (crime without victim) which means that children as perpetrators here are victims, so that the imposition of criminal sanctions on children as narcotics abusers can have a negative impact on children in society such as dehumanization and stigmatization.

Abstract

Islamic criminal law recognizes a kind of punishment called as diyat (compensation) for victims of murder and torture which has been apologized by the victim or family of victim. Diyat is amount of money or properties that should be paid by the perpetrator due to the death or damage of victim body. The legal basis for the determination of diyat can be found in Koran, chapter Al-Baqarah verse 178. Apart from that, there is Hadist of Muhammad Prophet written by Abu Dawud (peace be upon him), explaining the amount of diyat based on crime category whether murder or torture.Aceh Governance has implemented this kind of punishment as a solution on criminal offences in realizing and fulfilling justice for armed conflict victims since 2002. In providing the policy of such payment for the victims in Aceh is based on the assumption that they are under the responsibility of state, therefore the government has determined the compensation on them. The amount of the compensation provided for the victims is not equal to the amount ruled by Islamic criminal law. Therefore, it is interesting to explore regarding the concept becoming the basic for determining it by Aceh Government, and compared it to the amount ruled by the law.The research reveals that the sum of money for the compensation of what called diyat based on Islamic criminal law is the standard concept but it can be replaced by sum of money or properties that have equal price. The basic rules for this punishment in Islamic criminal law can be found in Al-Baqarah verse 178 of Koran. Moreover, regarding the sum of payment that should be provided can be found in Hadith of Prophet of Muhammad Peace be upon him which is told by Imam Abu Daud, mercy Allah for him. Practically, in Islamic criminal law the court, responsible persons and a due date for the payment must decide it.  The rule consisting in the Islamic law is really different from the implementation of compensation done by Aceh Government towards the victims in Aceh. It is recommended that the Aceh Government should realize the rules of the sum of compensation that should be received by the victims or the families based on the determination of the Court as a legal basis. In addition, the Central government as the main responsible party in repairing the condition of the society after the conflict should become the priority and absolute. The law enforcement in fulfilling the rights in Aceh should be done by involving some parties especially priest. Hence the society of the victims in Aceh obtains justice and legal certainty to get their rights.

Abstract

Artisanal mining communities around the world are diverse, dynamic and distinct in nature they vary from culture-to-culture, region-to-region and mine-to-mine, and change over the course of time.Women within these communities are also heterogeneous and unique; however, they tend to be engaged in specific roles throughout the world.A qualitative approach in form of a descriptive survey research design was adopted, in which purposive systematic sampling was used and qualitative data was generated. Semi-structured questionnaires were used to collect data from predominantly mining towns Kadoma, Kwekwe and Shurugwi as well surrounding areas. The sample size was compelled by the different mining areas which are a considerable distance from each other with sparsely distributed population. The focus of data collection was on women’s responsibilities in mineral processing activities range from crushing, grinding, sieving, washing and panning, to amalgamation and amalgam decomposition in the case of gold mining.Typically, women are labourers (e.g. panners, ore carriers and processors), providers of goods and services (for instance cooks, shopkeepers) and are often solely responsible for domestic chores. The total number of artisanal miners for the three mining towns was 1500 and a sample of 10% (150 miners) of the three towns, with each town having 50 was sampled. The artisanal miners taken to be part of the population sample were systematic selected till the last person. The composition of the miners was made up 41% of the females while the remaining 59% were male respondents.
