Abstract

This study analyzes judicial considerations in sentencing mob assault (pengeroyokan) offenses under Indonesian positive law. This study employs a normative legal research method with statutory and conceptual approaches. The results indicate that judicial considerations rely heavily on proving the elements of Article 466 of the Criminal Code (KUHP), valid evidence, and the perpetrator's guilt. However, differing interpretations of the element "collective force" (tenaga bersama) still persist, leading to consistency issues in court judgments. From the perspective of legal objectives, legal certainty has been achieved, whereas the aspects of justice and utility remain suboptimal. Therefore, the Supreme Court needs to formulate clearer implementation guidelines for mob assault offenses to enhance judgment consistency and achieve a balanced alignment among justice, legal certainty and utility.

Abstract

The debate on judicial activism and judicial restraint represents a crucial issue in constitutional interpretation practices in Indonesia, particularly regarding the role of judges in balancing constitutional supremacy and democratic principles. This study aims to analyze the limits of judicial legitimacy in constitutional interpretation by examining the tendency toward activism and restraint in constitutional court decisions. This research employs a normative juridical method using statutory and case approaches, focusing on decisions of the Constitutional Court. The findings indicate that judicial activism is necessary in certain circumstances to fill legal gaps and protect constitutional rights, but it risks exceeding legitimate boundaries without strong reasoning and prudential principles. Conversely, judicial restraint helps maintain legal stability but may hinder legal development if applied rigidly. Therefore, a balance between these approaches is essential, grounded in the constitution, the rule of law, and principles of justice. This study concludes that the limits of judicial legitimacy lie in maintaining independence while ensuring accountability in constitutional interpretation.

Abstract

The controversy surrounding the hijab requirement for non-Muslim female students at SMKN 2 Padang has garnered significant public attention. This undermines the values of tolerance, particularly in education, which plays a key role in character development, particularly for students. The legal framework outlined in Minister of Education, Culture, Research, and Technology Regulation No. 46 of 2023, which includes the Violence Prevention and Handling Team (TPPK) and the Task Force, plays a crucial role in preventing and addressing violence in educational settings. This represents an effort by the central government to minimize similar discrimination and protect human rights values, which must be respected and upheld amidst the diversity of society.

Abstract

Unadministered estates create legal uncertainty if left unmanaged. The Balai Harta Peninggalan (BHP) is authorized to administer and settle such estates to protect heirs and related parties. This study uses an empirical juridical approach with data from literature and interviews at BHP Medan. The results show that BHP acts as a state representative until lawful heirs are identified, working with courts, notaries and other institutions. Challenges include limited information on heirs, low public awareness of BHP’s role and administrative obstacles. Therefore, improved inter-agency coordination, public outreach and stronger regulations and work mechanisms are needed to optimize estate administration and ensure legal certainty.

Abstract

This study examines the implementation of Article 178 of Law Number 23 of 2007 concerning Railways at PT KAI in Bandar Lampung City from the perspective of siyasah tanfidziyyah. The study is motivated by the continued presence of buildings located within railway-owned land. This condition has led to increased risks of accidents, disruptions to railway operations, and a decline in public safety and order around the railway tracks. This research employs a descriptive qualitative method using interviews, observations, and documentation techniques. The findings indicate that the implementation of the policy has not been optimal, as the community continues to utilize the area for residential and business purposes. PT KAI has the obligation to ensure safety by clearing and sterilizing the area; however, the enforcement process faces obstacles, particularly due to the lack of coordination with local government and law enforcement authorities. From the perspective of siyasah tanfidziyyah, this policy aims to achieve public welfare (maslahah ‘ammah), especially in maintaining public safety, while still considering the principles of social justice and the well-being of affected communities.

Abstract

The relocation of Indonesia's capital city to Ibu Kota Nusantara through Law Number 3 of 2022 triggered the largest wave of judicial review in Indonesian constitutional history. This article analyzes the constitutionality of this policy through the lens of living constitution theory, focusing on the ratio decidendi of Constitutional Court Decision Number 34/PUU-XX/2022. Using normative legal research with statutory, case and conceptual approaches, it finds that the Court employed judicial restraint via the open legal policy doctrine, yet applied the meaningful participation parameter inconsistently compared to Decision Number 91/PUU-XVIII/2020. The ruling carries ambivalent implications for SDG 11 and SDG 16.

Abstract

This study examines the legal certainty of using electronic documents as evidence in divorce cases through the e-court system at the Barru Religious Court. The research problem lies in the lack of uniformity in the verification process, assessment of authenticity, and evidentiary value of electronic documents submitted by the parties. In divorce cases, electronic documents such as claims, responses, chat records, and other digital files are increasingly used in court proceedings. If this issue remains unresolved, it may lead to legal uncertainty, differences in judges’ assessments, and potential prejudice to the parties in proving their claims. Normatively, the use of electronic documents has a clear legal basis, particularly Article 5 paragraph (1) of the Law on Electronic Information and Transactions, which states that electronic documents and/or their printouts constitute valid legal evidence, as well as Supreme Court Regulation Number 1 of 2019 concerning Electronic Case Administration and Trial Proceedings in Court. This study employs an empirical method with a field approach. Data were collected through interviews, observation, and documentation at the Barru Religious Court. The results show that electronic documents have been used in e-court practice, but they have not fully provided legal certainty. The main obstacles include doubts regarding document authenticity, the potential for data manipulation, limited digital literacy, and the absence of uniform parameters in judges’ assessment. Therefore, clearer verification standards and improved digital competence of court officials are needed.

Abstract

Maritime security and safety are critical issues for Indonesia as an archipelagic nation with vast maritime territories and an ever-evolving landscape of threats. Stemming from overlapping jurisdictional issues among agencies, particularly Bakamla, there appears to be a lack of harmony in the applicable legal framework, which is further exacerbated by the ambiguity of Bakamla’s jurisdictional boundaries. This has led to arbitrary coercive actions, such as the detention and seizure of vessels, carried out without clear procedures. This study employs a normative approach through a literature review, demonstrating that such regulatory fragmentation triggers jurisdictional conflicts and contributes to weak maritime law enforcement. Consequently, a restructuring is necessary through the strengthening of Bakamla’s authority, regulatory harmonization, integration of command systems, institutional oversight and alignment with the 1982 UNCLOS based on the values of Pancasila.

Abstract

The Puri Asih Sejahtera housing land dispute (Bekasi) reveals a fundamental dilemma between formal legal certainty and substantive justice within Indonesia's agrarian legal system. Residents who had fully paid for their properties and occupied them for 34 years (1983-2018) were nevertheless evicted because they only held a Sale and Purchase Binding Agreement (PPJB), while the new developer (PT TPI) won the case based on the ne bis in idem principle. This study aims to analyze the weaknesses of the layered land registration system, the contradiction between Supreme Court Circular Letter (SEMA) No. 4/2016 (which recognizes a fully paid PPJB as a basis for substantive justice) and the application of the ne bis in idem principle, and to formulate legal protection recommendations for housing consumers. The method used is normative legal research with a case and statutory approach. The novelty lies in identifying the direct conflict between two legal instruments in Indonesian judicial practice. The results show that the negative-publicity system tending toward positive, layered formalities (PPJB-AJB-Certificate of Ownership), and the expansive interpretation of ne bis in idem have harmed good-faith buyers. Main recommendations include: (1) simplifying the system by integrating PPJB and AJB; (2) more progressive application of SEMA No. 4/2016; (3) government mediation and compensation/relocation; and (4) regulatory reform to provide legal certainty for fully paid buyers.

Abstract

This research discusses the study of execution in debt settlement with a comparison of several executions. The research method used is normative juridical with a legislative approach and a conceptual approach. The research results show that execution in fiduciary law can be carried out in three ways, namely the implementation of an executorial title, sale thru public auction (parate executie) and private sale, while still considering the Constitutional Court Decision Number 18/PUU-XVII/2019. In mortgage law, execution can be carried out thru parate execution, an executorial title and private sale, which have more definite legal force. Execution thru debt collectors cannot be justified because it lacks a valid legal basis.
