Abstract

The Government has done several efforts in order to handling the Covid-19 virus, such as through an appeal to maintain personal hygiene, keep a safe distance, and do not come in direct contact with others. The spread of this appeal was carried out on various platforms, ranging from advertisements on television nor social media. The coverage through the media includes which areas have been exposed by Covid-19, the number of people who have been considered infected, recovered, and the number of people who have died from the virus. Oftentimes, the news is followed by the dissemination of the peoples identity, on the grounds that the public should be more careful, whereas the patient’s identity is strictly protected based on the patient’s right to privacy or medical confidentiality. This writing uses a normative juridical research method. The issues raised were related to the privacy rights and medical confidentiality in the handling of Covid-19. Article 51 of Law No. 29/2004 concerning Medical Practice stated that a doctor is obliged to keep all the information about the patient, even after the patient died. This uphold the fact that a medical confidentiality are closely related to human rights.Keywords: Covid-19; Medical confidentiality; Patient

Abstract

Dewan Perwakilan Daerah atau DPD merupakan lembaga legislatif yang lahir dari gejolak reformasi 1998 yang keberadaan yuridis terkait DPD dan kewenangannya didasarkan Pasal 22D UUD NRI 1945. Dalam regelende functie  maka sejatinya peran DPD sebagai perwakkilan daerah untuk mengimbangi adanya peran Dewan Perwakilan Rakyat sebagai political. Tujuan dari penelitian ini adalah untuk meninjau dan menganalisis kembali bagaimana seharusnya keberadaan DPD dengan menggunakan metode yuridis normatif melalui pendekatan perundang-undangan (statute approach) dan pendekatan analitis (analytical approch), bahwa keanggotaan DPD haruslah merupakan calon perseorangan yang terbebas dari jabatan dan fungsionaris partai politik. Hal ini untuk mempertegas serta mengoptimalkan peran regional representative supaya dari proses pencalonan, pengangkatan, dan perumusan kebijakan merupakan perorangan yang benar-benar concern terhadap permasalahan, dinamika, dan kepentingan daerah yang diwakilinya.

AbstractThe role of the people are needed to the development, because development success in a country is how the government to make a empowerment community. Local government policy in development has contributed by doing upaya­upaya serious. More indonesia is facing Asean economic community (MEA) in 2016, aimed at as an effort to increase stability the economy in Asean. Local governments have to make regulatory system warehouse related resinous to cut the tengkulak a highly lethal businesses fshermen in guarantees the availability of capital for the production of sustainable and stabilize commodity prices.IntisariPeran masyarakat sangat dibutuhkan untuk tercapainya pembangunan, karena keberhasilan pembangunan di suatu negara adalah bagaimana pemerintah menentukan model pemberdayaan kepada masyarakatnya. Kebijakan Pemerintah Daerah dalam pembangunan memiliki andil dengan melakukan upaya-upaya serius. Lebih lagi Indonesia menghadapi Masyarakat Ekonomi ASEAN (MEA) pada tahun 2016, yang bertujuan sebagai salah satu upaya untuk meningkatkan stabilitas perekonomian di kawasan ASEAN. Kesinambungan antara pemerintah daerah dan masyarakat guna menghadapi tantangan MEA sangat diperlukan. Pemerintah daerah harus membuat regulasi terkait sistem resi gudang guna memangkas jalur tengkulak yang sangat mematikan hasil usaha nelayan dalam menjamin ketersediaan modal usaha untuk produksi yang berkelanjutan dan menstabilkan harga komoditi.

Abstract

Consumer protection is a legal instrument created to protect and fulfill consumer rights. Article 7 of Law Number 8 of 1999 concerning Consumer Protection clearly stipulates the obligation of businesses to provide accurate and honest information regarding the warranty conditions of goods or services and to provide explanations of use, repair, and maintenance. Based on this background, the research problem is formulated as follows: "What is the legal protection for consumers regarding price differences between shelf labels and payment receipts at supermarket checkouts?" and "What are the Obstacles to Legal Protection for Consumers Regarding Price Differences Between Shelf Labels and Payment Receipts at Supermarket Cashiers in South Denpasar. This research is an empirical legal study with a juridical approach. Primary data was obtained through interviews with supervisors and consumers at a supermarket in South Denpasar. Secondary data was obtained from official documents, books, and relevant laws and regulations. Data processing and analysis in this study were conducted qualitatively, with an emphasis on understanding empirical reality in depth. The results indicate that the protection provided by supermarkets, as business actors, is preventive in nature, as stipulated in Article 7 of the Consumer Protection Law. Business actors must provide clear information regarding product prices, inform consumers when they inquire about expiration dates, and be honest about the quality of goods. Abstract

Textbooks are a crucial component in higher education as primary learning resources that support conceptual understanding and analytical skills. In legal education, their role extends to shaping systematic and critical legal reasoning. However, the availability of textbooks aligned with the Semester Learning Plan (RPS) remains limited, particularly in Constitutional Law courses, resulting in fragmented and less contextual learning experiences. This study aims to develop and test a Problem-Based Learning (PBL)-based Constitutional Law textbook integrated with legal protection and human rights perspectives. The research employs an experimental design by implementing a prototype textbook in the Undergraduate Law Program, Campus 5, State University of Surabaya, and collecting feedback from students and experts. The results indicate that the developed textbook enhances students' critical thinking, analytical skills, and understanding of constitutional issues, especially those related to legal protection and human rights. The PBL approach encourages active learning through case analysis and problem-solving activities, making the learning process more contextual and participatory. This study contributes both theoretically and practically to the development of innovative, adaptive, and context-based legal education materials that support academic competitiveness.

Abstract

Penelitian ini membahas penerapan mekanisme amicus curiae dalam persidangan di Mahkamah Konstitusi Republik Indonesia, serta mengkaji pertimbangan kebijakan hukum di balik ketidakhadiran peraturan eksplisit mengenai mekanisme ini dalam Undang-Undang Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi dan perubahannya. Dalam studi ini, penulis menggunakan metode yuridis normatif dengan memanfaatkan pendekatan legislatif, pendekatan kasus melalui analisis putusan Mahkamah Konstitusi yang menerima amicus curiae, dan pendekatan konseptual yang berfokus pada konsep negara hukum dan demokrasi konstitusional. Temuan studi ini menunjukkan bahwa praktik amicus curiae telah berkembang sebagai bentuk partisipasi publik dalam proses pengambilan keputusan konstitusional, meskipun belum memiliki dasar normatif yang sistematis. Situasi ini menimbulkan ketegangan antara prinsip kepastian hukum dan kebutuhan akan demokrasi deliberatif. Dari perspektif politik hukum, ketidakhadiran regulasi dapat dilihat sebagai manifestasi dari desain prosedural minimalis serta upaya untuk memberikan ruang bagi diskresi yudisial. Studi ini mengusulkan model regulasi hibrida, yaitu regulasi yang didasarkan pada undang-undang dan regulasi teknis melalui peraturan Mahkamah Konstitusi, dengan tujuan menyeimbangkan partisipasi publik dengan prinsip legalitas dalam kerangka demokrasi konstitusional yang berlandaskan pada negara hukum.

Abstract

Following the rise of issues like overlapping authority, regulatory inconsistency, inter-institutional contestation, and low public trust in election results, the institutional arrangement of election and regional head elections (Pilkada) organizers is a crucial component in bolstering the integrity of Indonesia's democracy. To guarantee the General Election Commission (KPU), the Election Supervisory Body (Bawaslu), and the Election Organizer Honorary Council (DKPP) can perform their duties competently and honestly, a thorough assessment of their institutional design is required under these circumstances. Finding a model of arrangement that may enhance the quality of procedural and substantive democracy is the urgent goal of this research, which also intends to assess the urgency of institutional arrangement of election and regional head elections (Pilkada) organizers. By reviewing statutes, case law, academic publications, and election administration practices throughout many election cycles, this study employs a normative legal research methodology that is conceptual, comparative, and based on statutes. The study shows that regulatory disharmony, unclear authority boundaries, overlapping conflict resolution systems, and insufficient election organizing institution coordination are the key issues. Independence, professionalism, accountability, and openness in elections also affect institutional integrity. The study finds that election and regional election organizers must align legislation, reinforce organized authority, build institutional capacity, and improve coordinating mechanisms to safeguard Indonesian democracy.    Keywords: Institutional Arrangement, Elections, Regional Head Elections, Democratic Integrity.

Abstract

Surabaya State University Campus 5 was established in 2024 and has 16 study programs with a total of 2,888 students from various regions. This campus provides a great opportunity for the community to build a residence in the form of boarding houses. Based on data from the Magetan Regency government, the number of rooms owned to date is 1,642 rooms spread across several local sub-districts and villages. These communities built boarding houses according to their own initiative without going through the licensing process, so there are different variants for each boarding house. They do not yet have rules and regulations that students must follow and the boarding house managers do not yet have the skills to do as boarding house managers. Problems faced related to boarding house management include social issues for students that require special handling, the lack of socialization to boarding house managers by the district government, diverse views from boarding house managers in managing their boarding houses, limited abilities in character education that must be carried out, and minimal ability to solve problems caused by students. The implementation methods used include providing workshops, lectures and role-playing methods, workshops and mentoring, and seminars. The results of this activity, namely the rules and SOPs for boarding house managers, can be a practical solution in maintaining harmony between the interests of the campus and the community, especially student boarding house managers and the government, especially student boarding house managers. Abstract

This study finds that there is a persistent legal conflict and regulatory disharmony between national provisions on disability employment quotas and their implementation at the company level. Empirical evidence shows that many companies fail to meet the quota obligation due to the absence of qualified applicants with disabilities, unprepared workplace environments, and the lack of operational technical guidelines. Furthermore, the absence of explicit sanctions in existing regulations creates legal uncertainty and weakens enforcement. Using a normative legal method with a statute and conceptual approach, this research analyzes the relevant legal framework and constructs arguments based on legal principles and theories in labor law concerning the rights of persons with disabilities. The study reveals that the current regulatory framework lacks integrated monitoring mechanisms, measurable evaluation indicators, and clear administrative sanctions, while also failing to provide incentives that could encourage compliance. The novelty of this research lies in offering a combined legal and policy framework that bridges the gap between normative provisions and practical implementation, supported by recommendations for detailed technical guidelines, accessibility audits, and structured incentive schemes. These findings contribute to strengthening inclusive labor policies in Indonesia, ensuring that the principle of inclusivity becomes a measurable and enforceable standard rather than a rhetorical aspiration.

Abstract

The phrase "sepanjang menurut kenyataannya masih ada" in Article 3 of the UUPA creates normative ambiguity that places indigenous peoples in a vulnerable position. This study aims to analyze the juridical implications of the phrase and formulate ius constituendum policies. The discussion results indicate that this phrase is a transitional arrangement resulting in sectoral regulatory fragmentation and complex administrative burdens of proof for indigenous peoples. In conclusion, a paradigm shift from conditional to inherent recognition is required. Future policies must remove the phrase, adopt self-identification principles and harmonize regulations to ensure legal certainty and justice for indigenous peoples.
