Abstract

The history of community-based land use is a real and factual reality that can be seen from the past and present. Basically, the study of forest policy will not be far from understanding the relationship between the ruler (regulator), forest and society, which can be seen in two aspects, namely juridical and sociological. In the study of juridical aspects, it has been arranged in the legal framework that people who have a related right to forest (to customary forests or forest rights) obtain their legal status and must be protected over it. Such conditions are adjusted in Law No. 41 of 1999 on Forestry. While in the perspective of sociological aspects, forests and communities cannot be separated on the basis of forests as one of the buffers of life and prosperity of communities whose existence must be maintained optimally. But unfortunately, the small number of state activities reflected from forest management practices to article by article of Ministerial Regulations to The Law in the Constitutional Court's Decision reflects a dilemma in forest management. Departing from the understanding that the state in the behavior of the government to the district / city level is able to take the potential of forest resources constitutionally without reducing the rights of the community that leads to triggering systemic conflicts.

Abstract

In the case of whaling in Antarctica proposed by the State of Australia, the ICJ is faced with a very technical problem related to the interpretation and assessment of elements of a scientific nature. The court evaluated claims from Australia that Japan through a whaling program called JARPA II concealed commercial purposes behind false scientific research. This case then brought the world's attention in the international agenda, especially the correlation between law and science. On the other hand, the ICJ has also come under criticism for handling cases of a technical nature, so questions arise with regard to the jurisdiction of the International Court of Justice in handling the complexity of factual issues in a healthy and fair manner. Essentially, the ICJ should avoid two major hurdles: limiting judgment to only legal aspects or becoming a science judge by conducting technical analsis and considering the position of previously handled cases. This interesting case will be analyzed by the author in relation to his studies in the perspective of international law.

Abstract

Rapid technological development allows humans to utilize natural resources that were previously difficult to reach even those in space. With these advances, the law also contributes through international law governing aspects related to the use of space often known as the Five Nations Treaties on Outer Space. In 2017, the CEO of SpaceX (a private American aerospace company), Elon Musk, announced plans to use transportation previously used to move objects from Planet Earth to Space, namely Rockets, for use as public transportation used as a means of mobilization from one place to another on Earth. This is interesting because the concept uses Space after the air surface of Planet Earth, giving rise to new contemplation related to licensing and legality aspects. In this paper, the author intends to examine from the perspective of international law with international arrangements related to air and space law.

Abstract

The United Nations (UN) is a new international order organization formed after the failure of the Post-World War League of Nations (LBB). Within the UN, there are important organs, one of which is the Security Council with five permanent members including the United States, Britain, Russia, France and China. The five permanent members have the authority to issue veto power over the policies to be established. One of them is the policy of issuing resolutions to the case of armed conflict in Syria. This paper will discuss in more depth the policy of the resolution in view of international legal sources and related theories. Included in this regard are the authors criticizing the conception of veto power attached to the five permanent member states of the UN Security Council which should be aimed and used to achieve world peace and not for any particular interest.

Abstract

Acts of terrorism is a form of real crime that has been in the spotlight for some time. In fact, at the end of 2020, found traces of kingpins that allegedly constituted terrorism training in west Java. This encourages not only the study of the crime of terrorism but also the need to think about the fate of people who are victims of terrorism crimes as an Extra Ordinary Crime. Terrorism is said to be very evil because of its organized nature and can cause casualties, physical injuries, to losses both materially and non-materially. This is what needs to be discussed also in a legal perspective. Not only in terms of normative because basically, the arrangement regarding compensation for victims of terrorism still raises question marks in the condition of the perpetrator who died or has not been found syndication responsible for acts of terrorism. Therefore, in this paper will be discussed about the compensation of victims of terrorism not only from a normative but also socio-legal view.

Abstract

Indonesia is one of the countries that has a plurality of cultures in it, including religions embraced by the community. But the facts on the ground, only religion and belief of the majority are recognized by the community and the government. In the constitution, there is no law that requires every citizen to adhere to the six majority religions. That is, minority religions other than the six religions are allowed to develop in Indonesia as long as it is still within the limits of reasonableness. The Constitution which contains regulations that address religious freedom include Articles 28 and 29 of the Constitution of the Republic of Indonesia of 1945, Article 4 and Article 22 of Law No. 39 of 1999 on Human Rights and Law No. 1/PNPS/Year 1965 on Prevention of Abuse and/or Blasphemy. But if considered carefully, the Act contains statements that can cause misinterpretation. Such misinterpretation can be fatal especially for adherents of religious minorities outside the recognized religion in Indonesia. The most obvious consequence is discrimination against these minorities, both in terms of physical violence and in the field of administration. For example, the Ahmadiyya community is not calm in carrying out worship and the Sunda Wiwitan community which until now has been difficult to get official administrative papers because it is bumped with the problem of religious columns. During this time, religion and minority beliefs are less recognized and even tend to be considered heretical by society. In fact, they also have rights that include internal rights and external rights of religious freedom that should not be reduced by anyone. If traced back, it turns out that one of the causes is confusion in Law No. 1 / PNPS / Year 1965 on Prevention of Abuse and / or Blasphemy earlier.

Abstract

Recognition becomes fundamental and important in the concept of human rights through recognition of the fulfillment of other rights can only be realized optimally. However, the recognition of believers in Indonesia found a steep road because it did not get recognition from the state. Instead of recognition, even the state is often an actor who imposes restrictions on the right to freedom of religion and belief through the policies and regulations it makes. These restrictions lead to structural injustices that discriminate over the fulfillment of other rights. This paper will reflect how the state's recognition of the flow of trust and the long road that must be taken by adherents to be recognized by the state. A long effort from a series of discriminatory events to gain recognition and restoration of his basic human rights.

Abstract

Some examples of cases of client neglect by rogue advocates or black advocates are a reflection that the arrangements regarding the code of ethics for the advocate profession in Indonesia have not worked as they should. This becomes the initial urgency that professional ethics is an important role in the enforcement of discipline, honor and dignity of a profession in general, both associations and individuals who work as advocates. Then, the code of ethics as a form of professional ethics not only stops at the level of thought and theory, but also must be applied practically in the field. Professional ethics according to a comprehensive study of legal philosophy is needed to uphold the spirit of the advocate profession both from upstream to downstream, especially when discussing morality. In this paper, the author takes the example of Joko Sriwidodo as an illustration.

Abstract

Legal politics is a series of concepts, principles, basic policies and statements of the will of the state authorities that contain the politics of legal formation, the politics of legal determination and the politics of application and enforcement, regarding the function of institutions and the construction of law enforcement to determine the direction, form and content of the law to be formed, the laws that apply in its territory and regarding the direction of legal development built and to achieve the objectives of the state. Indonesian legal politics underwent changes and reconstruction after the transition or change of government regime from the Old Order and New Order to the reform era. Along with the change in political configuration from authoritarian to democratic post-reform regime, many demands are voiced by elements of society to improve the conditions and structure of statehood after the new order, including in terms of state institutions.

Abstract

The discourse regarding the mature arrangement of Character Education came to the fore in recent times. This is because academic education has not even though it affects intelligence but does not necessarily build the character of a human being. At this point, character education is needed that not only supports academic needs but also the nature and character so that the government through the Ministry of Education and Culture of the Republic of Indonesia begins to develop a character education system that is spelled out through the national education system and applied in Nusantara schools. Normatively, the regulation on Character Education is contained in Presidential Regulation No. 87 of 2017 on Strengthening Character Education. In this paper will be discussed the implementation of Character Education and its effectiveness adapted to the essential thinking of Ki Hadar Dewantara.
