Abstract

The development of the digital music industry has given rise to increasingly complex forms of song copyright infringement through digital platforms and electronic monetization. This study aims to analyze civil liability for song copyright infringement and the effectiveness of copyright regulations in Indonesia. The method used is normative legal research with statutory, conceptual, case-based and comparative approaches. The results indicate that the protection of creators' economic rights, the distribution of digital royalties and the responsibilities of digital platforms still face implementation challenges. The Indonesian copyright legal system is also not fully capable of addressing the complexity of legal relationships in the modern digital music ecosystem.

Abstract

The practice of unauthorized parking attendants in Medan City gives rise to issues concerning public order and legal certainty. This study aims to analyze the legal framework, law enforcement and the role of criminal law regarding this practice, employing a normative legal research method alongside statutory and conceptual approaches. The findings indicate that fees collected by unauthorized parking attendants are not automatically categorized as acts of corruption, as they do not necessarily involve an abuse of authority or financial loss to the state; instead, such actions are more appropriately classified as illicit levies, extortion, or other criminal offenses, depending on the specific legal facts. It is recommended that the local government strengthen integrated supervision, implement electronic parking systems, conduct periodic law enforcement operations and take firm action against unauthorized parking operators to enhance legal certainty and public protection. Consequently, a collaborative synergy between the local government, law enforcement and the public is essential to foster a parking management system that is orderly, transparent and just.

Abstract

The regulation of State Universities with Legal Entity Status (PTN-BH) through Government Regulations as university statutes raises a theoretical issue within the framework of legislative theory, particularly concerning the boundary between the function of Government Regulations as implementing legislation and their role as instruments governing fundamental institutional matters. Existing studies on PTN-BH have primarily focused on university autonomy and governance, while limited attention has been given to the legitimacy of Government Regulations serving as university statutes within the hierarchy of laws and regulations. This study aims to analyze the legal position of Government Regulations as PTN-BH statutes and their implications for academic autonomy, financial autonomy and organizational structure. Employing normative legal research with statutory, conceptual and comparative approaches, the study finds that Government Regulations on PTN-BH do not merely function as delegated legislation but also contain constitutive norms governing organizational structures, institutional authority and university governance. This condition raises concerns regarding the compatibility between the type of regulation and its substantive content within Indonesia’s legislative system. Therefore, regulatory reform is needed through a limited standardization model that establishes basic norms on academic autonomy, financial autonomy and organizational structure at the statutory level, while leaving technical arrangements to the respective PTN-BH statutes.

Abstract

This study examines the juridical analysis of unlawful acts arising from unilateral changes in a build-sharing agreement dispute legalized by a notary based on Decision Number 550/Pdt.G/2024/PN Medan. The issue arises from inconsistencies between the parties’ initial agreement and its implementation, particularly the emergence of a deed of rights release transferring land ownership to the developer, causing losses to the landowner. This study aims to analyze the fulfillment of the elements of unlawful acts, the legal consequences, legal protection for the injured party, and the judge’s legal considerations. This research employs a normative legal method with statutory, conceptual, and case approaches through qualitative library research. The findings indicate that unilateral changes fulfill the elements of unlawful acts under Article 1365 of the Indonesian Civil Code. Notary legalization potentially violates the principle of prudence, causes material losses, and was judicially classified as an unlawful act due to violations of consensualism, good faith, and contractual justice principles.

Abstract

This article examines the rights of Indigenous Peoples from the perspective of Pancasila’s social justice by positioning Pancasila as the philosophical foundation for the protection of communal rights. The research employs a normative juridical method with philosophical and statutory approaches. The findings indicate that the values of social justice, humanity and national unity embodied in Pancasila provide a normative basis for the recognition and protection of Indigenous Peoples’ rights. However, their implementation continues to face various challenges, including regulatory constraints, exploitative development orientations and weak legal recognition mechanisms. Therefore, stronger regulatory frameworks and policies that are more aligned with the values of Pancasila’s social justice are required to ensure the sustainable protection of Indigenous Peoples’ rights.

Abstract

This article focuses on the views of prominent figures who consider female circumcision inhumane because of its health impacts and its basis in gender discrimination, giving the impression that these figures are absolutely opposed to the Sharia ruling on female circumcision. The research question is: How can the mashlahah perspective on female circumcision be applied through study of scholars’ texts and medical explanations to reconstruct the legal ruling on female circumcision? The author employs literature review method supported by empirical data. The data types and sources utilized follow a qualitative approach, yielding descriptive data. The research findings indicate that Imam Abu Hanifah, Yusuf al-Qardhawi and Wahbah Az-Zuhaili rule that female circumcision is makrumah; Imam Malik and Imam Ahmad consider it sunnah; while Imam Shafi’i and the majority of the Salaf deem it obligatory. Medically, female circumcision is permissible. Its benefits include hygiene, purity and balancing sexual desire by reducing excessive sensitivity to optimize the duration of intercourse; thus, female circumcision falls under al-mashlahah tahsiniyah and is part of Islamic law.

Abstract

This study examines legal protection for customers regarding the practice of credit installment collection without recording by Bank Mekar Bima officers. Collection practices that are not accompanied by official recording can cause losses for customers, such as the occurrence of credit installment arrears. This study aims to determine and analyze the mechanism of credit installment collection carried out by bank officers according to applicable legal provisions, as well as examine the form of legal protection for customers regarding the practice of credit installment collection without recording by Bank Mekar Bima officers. The results of the study indicate that there are indications of collection practices that are not accompanied by official recording evidence, resulting in complaints from customers regarding their payment status. Because proof of payment that should be the basis for legal accountability is not legally documented.

Abstract

The Constitutional rights of citizens are the rights regulated in the 1945 Constitution which includes the right to life, the right to have a family and continue the lineage, the right to develop oneself, the right to obtain justice, the right to personal freedom, the right to a sense of security, the right to welfare and the Indonesian government is obliged to guarantee and protect the rights of its citizens. Therefore, for Drug Users, Addicts and Victims of Drug Abuse, their constitutional rights must still be given, part of the form of guarantee of fundamental rights guaranteed by the constitution. As a state of law, Indonesia is obliged to guarantee and protect the rights of its citizens, as referred to in Article 28A and Article 28 H of the 1945 Constitution. The elaboration of constitutional rights for Drug Users, Addicts and Victims of Drug Abuse is outlined hierarchically through Law No. 35 of 2009, concerning Narcotics. In the Narcotics Law, where Article 54 and Article 103 focus more on rehabilitation, while Article 127 provides criminal penalties, but also opens up opportunities for rehabilitation for victims, so that the handling is comprehensive. Drug abusers need to undergo rehabilitation as a form of recovery aligned with criminal liability. From a legal and normative perspective, drug addicts are essentially victims suffering from a disease and require physical and psychological treatment, as well as community support, to return to a normal life. Imprisonment alone is insufficient, consistent with the perspective of Law Number 35 of 2009 concerning Narcotics.

Abstract

This study aims to analyze the legal status of the Wi’i Nggahi tradition as a form of prenuptial agreement from a civil law perspective and to examine the legal consequences that arise if the agreement is not fulfilled by the time of marriage. This study employs an empirical legal research method with a sociological approach. Data were collected through interviews with traditional leaders and members of the Donggo tribe. The results of the study indicate that the Wi’i Nggahi tradition contains elements that meet the requirements for a valid agreement as stipulated in Article 1320 of the Civil Code, namely the existence of an agreement between the parties, legal capacity, a specific object and a lawful cause.

Abstract

A notary, as a public official, is authorized to create authentic deeds that serve as perfect evidence in civil law. In carrying out their duties, notaries may face lawsuits or legal proceedings related to the deeds they have executed. To provide legal protection in the performance of notarial duties, the Notary Position Act establishes the Notary Honorary Council (Majelis Kehormatan Notaris/MKN), which has the authority to grant or deny requests from investigators, public prosecutors, or judges concerning the summoning of notaries and the examination of deed protocols. This study aims to analyze the effectiveness of legal protection provided to notaries through the Notary Honorary Council in civil litigation and to identify the factors affecting the effectiveness of such protection. The research employs a normative legal research method using statutory and conceptual approaches. The findings indicate that the existence of the Notary Honorary Council provides both preventive and repressive legal protection for notaries in the exercise of their professional duties. However, the effectiveness of such protection still faces several challenges, including differing interpretations of the Council’s authority, limited understanding among parties regarding the scope of notarial liability and suboptimal coordination among law enforcement institutions. Therefore, strengthening the regulatory framework and enhancing legal awareness are necessary to ensure legal certainty, protect the notarial profession and maintain a balance between law enforcement interests and the proper execution of notarial duties.
