Abstract

This study analyzes the criminal act of collecting public funds without a permit through online arisan (social savings and credit) in Decision Number 119/Pid.Sus/2017/PN Tdn. The issues examined are the qualifications of the crime and the judge's considerations in issuing the verdict. The study uses a normative juridical method with a statutory and case-based approach. The results show that the defendant's actions fulfill all elements of the crime of collecting funds without a permit, so that an 11-year prison sentence and a fine of IDR 10 billion are appropriate. It is recommended that supervision of illegal online arisan be increased and that the public verify the legality of organizers before participating.

Abstract

This study analyzes the regulation of powers of attorney in notarial practice through a comparative study of law between Indonesia and Sweden, using normative juridical methods and comparative, statutory and conceptual approaches. The results reveal fundamental differences in the regulation of absolute powers of attorney. Indonesia imposes restrictions on absolute powers of attorney, particularly in the transfer of land rights, to maintain order in land administration and prevent legal smuggling. In contrast, Sweden, through its fullmakt regulation in Avtalslagen, provides greater flexibility by emphasizing third-party protection and transaction certainty. The study also found that Indonesian notaries bear broader responsibility for the formal and material correctness of deeds, while the Swedish Notarius Publicus focuses on identity verification and signature authenticity. These findings suggest the need to strengthen digital verification systems and reformulate notarial accountability regulations to increase legal certainty and prevent fraud.

Abstract

The rapid development of genomic technology and the digitalization of healthcare systems have significantly increased the collection, storage and processing of genetic data across medical services, biomedical research, pharmaceutical industries and artificial intelligence-based health technologies. Genetic data possess distinctive characteristics compared to ordinary personal data because they are unique, permanent, immutable and biologically linked to family members. These characteristics place genetic data among the most sensitive categories of personal information and necessitate enhanced legal protection. Indonesia, through Law Number 27 of 2022 concerning Personal Data Protection, recognizes genetic data as a category of specific personal data. Nevertheless, the current regulatory framework remains general in nature and does not specifically regulate the processing, storage, utilization, cross-border transfer and deletion of genetic information. This study aims to analyze the legal protection of genetic data under the Indonesian Personal Data Protection Law and compare it with regulatory frameworks established under the European Union General Data Protection Regulation (GDPR), Singapore’s Personal Data Protection Act (PDPA) and South Korea’s Personal Information Protection Act (PIPA). This research employs normative legal research methods using statutory, conceptual and comparative approaches. The findings indicate that although the recognition of genetic data as specific personal data constitutes a significant advancement in Indonesian law, the existing framework lacks sector-specific safeguards comparable to those found in the European Union, Singapore and South Korea. The absence of detailed regulations may create legal uncertainty, facilitate genetic discrimination, enable misuse of health information and undermine individual privacy rights. Therefore, Indonesia requires more comprehensive implementing regulations and specialized oversight mechanisms to ensure adequate protection of genetic data within the evolving digital health ecosystem.

Abstract

This study aims to analyze the implementation of Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence (UU TPKS) in handling sexual violence against women in Banten Province. The research method used is empirical juridical through the study of legislation, case data and law enforcement practices. The results show that the implementation of the TPKS Law has provided a more comprehensive legal basis for victim protection, but obstacles remain in the aspects of legal structure, legal substance and legal culture. Strengthening the capacity of officials, harmonizing regulations and increasing public awareness are needed to realize effective legal protection for female victims of sexual violence.

Abstract

This study aims to analyze the resolution of fraud crimes through restorative justice at the Cirebon City Police Department and the obstacles encountered in its implementation. The study used an empirical juridical method with a qualitative approach through interviews, literature review and documentation. The results indicate that case resolution is carried out through mediation, reconciliation, victim compensation, and termination of investigations based on Police Regulation Number 8 of 2021. Obstacles encountered include investigators' unequal understanding of restorative justice, difficulty obtaining victim consent, limited ability of perpetrators to compensate for losses and complex administrative requirements. Improved investigator training and optimization of mediation mechanisms are needed to support the effectiveness of restorative justice.

Abstract

The guarantee of freedom of expression in Indonesia, including criticism of the President, confronts Articles 218 and 219 of Law Number 1 of 2023 on the National Criminal Code. The unclear boundary between criticism and insult creates a potential criminalization of constitutionally protected expression. This normative legal research, employing statutory and conceptual approaches, aims to analyze this boundary and to formulate interpretive parameters for preventing such criminalization. The findings show that criticism and insult cannot always be strictly distinguished because the two frequently overlap, so three interpretive parameters are required: the object of the expression, its relevance to the public interest and the proportionality of the criminal sanction. Articles 218 and 219 must therefore be applied carefully and proportionately so that criticism of public policy oriented toward the public interest is not criminalized.

Abstract

The Free Nutritious Meal Program (MBG) is a government policy to support the fulfillment of the public's right to food and nutrition. However, its implementation raises legal issues related to the state's constitutional obligations, budgeting and policy oversight. This study aims to analyze the implementation of the MBG from the perspective of human rights and the fulfillment of the community's social rights. The method used is normative legal research with a legislative and conceptual approach. The results show that the MBG has a strong constitutional basis in the 1945 Constitution as a manifestation of the state's responsibility to fulfill citizens' social rights. The novelty of this research lies in the analysis of the relationship between human rights, state authority, budgeting and oversight in the implementation of the MBG program.

Abstract

This study examines the limits of a notary’s authority in the preparation of authentic deeds based on the provisions of Law No. 2 of 2014 Amending Law No. 30 of 2004 on the Office of the Notary and analyzes the legal consequences that arise if such authority is exercised beyond the established provisions. This study employs a normative legal research method using a statutory approach and a conceptual approach. The findings indicate that a Notary’s authority in the preparation of authentic deeds constitutes an attributive authority directly granted by law and its exercise must adhere to the established boundaries. Exceeding a notary’s authority can occur in three forms: exceeding authority in terms of subject matter, territorial scope and procedural violations. Such actions have the potential to affect the validity of the deed, thereby reducing its probative value or even causing it to lose its authentic nature.

Abstract

This study analyzes the implementation of Article 17 Paragraph (1) of Pringsewu Regency Regional Regulation Number 07 of 2015 concerning the Protection of Women and Child Victims of Violence in efforts to prevent mental health disorders among children. The study employed a qualitative method through interviews with the DP3AP2KB and community members. The findings indicate that the policy implementation has not been optimal due to limited public outreach, the uneven implementation of the Child-Friendly School Program and the low level of public mental health literacy. The main obstacles include limited budget allocation and inadequate human resources. From the perspective of siyasah tanfidziyyah, these conditions are not yet consistent with the principles of hifz al-nafs (protection of life) and hifz al-‘aql (protection of intellect). Therefore, strengthening policy implementation is necessary through expanded public outreach, increased budget support and enhanced inter-agency collaboration.

Abstract

This article analyzes the problems and challenges faced by corruptors sentenced to prison terms in lieu of compensation. Using an empirical legal approach based on literature studies and combined with interviews, the findings reveal that, in decisions 37/Pid.Sus-TPK/2025/PN Amb and decision number 18/Pid.SusTPK/2024/PTAmb. In both cases, the sentence is one year in prison in lieu of compensation, but the compensation in both cases has a different nominal value. Suggestions can be submitted to the Supreme Court to issue a Supreme Court Circular regarding prison terms in lieu of compensation to serve as a guideline for judges in corruption cases in handling these issues.
