Abstract

This research examines the legal standing of the Petitioner, Gerakan Satu Visi, in filing a judicial review of the Copyright Law (UUHC) based on Thomas Hobbes’ Theory of Justice and its legal implications. Using a normative juridical method with statutory and conceptual approaches, the study finds that the Petitioner does not meet the legal standing requirements under Article 51 of the Constitutional Court Law, as it failed to show direct, actual, and causal constitutional harm. The alleged financial loss is indirect, and the Petitioner’s related-rights status is derivative. As a result, the UUHC remains in force, royalty obligations and LMKN’s role are strengthened, and disputes shift to commercial civil proceedings.

Abstract

This study aims to analyze the role of Koran Mandala as a local newspaper in performing the press watchdog function as part of civil society in Bandung City. This research is significant because existing studies on watchdog journalism in Indonesia have predominantly focused on national media, while the role of local newspapers in monitoring power and shaping democratic public spaces remains underexplored. Using qualitative descriptive method with a case study approach, data were collected through in-depth interviews with journalists and editors, observation of news production practices, and document analysis of investigative reports and opinion articles published by Koran Mandala between 2022 and 2024. The findings indicate that Koran Mandala plays a substantial watchdog role by critically reporting on local governance, alleged corruption, and public policies that directly affect citizens. Such investigative coverage contributes to public opinion formation, enhances civic awareness, and strengthens local government accountability. This study highlights the strategic importance of local media in reinforcing democratic values and the role of civil society at the municipal level.

Abstract

In the transfer of land rights through the making of land sales and purchases, criminal acts of forgery of documents in Article 263 of the Criminal Code to Article 266 of the Criminal Code. The problem in this study, regarding the position of the transfer and the imposition of mortgage rights after the Criminal Court Decision which decides the perpetrator is proven guilty of committing the crime of entering false information into an authentic deed and efforts to return the land object that has been burdened with mortgage rights as a form of legal protection for land rights owners who are unaware of the transfer and imposition of land rights after the court decision. The results of the study explain that the position of the transfer and imposition of mortgage rights can be null and void by law on the basis of not fulfilling the requirements of a lawful cause and the material requirements for making a deed. The form of legal protection for land rights owners who are unaware of the transfer and imposition of land rights after the court decision. The results of the study explain that the position of transfer and burden is to file a lawsuit for Cancellation of the Sale and Purchase Deed and cancellation of the ownership certificate issued by the National Land Agency to the State Administrative Court as well as an application for cancellation of the SHM to the BPN Based on a Court Decision that has Permanent Legal Force.

Abstract

Land rights holders are not permitted to use their land for their personal interests only, but must also pay attention to the interests of the community as intended by Article 6 of the UUPA regarding land having a social function. This study uses a normative method with qualitative analysis to obtain the results of this study, explaining that the principle of the social function of land rights as regulated in Article 6 in the application of servitude rights (yard devotion) for public road access has not provided legal certainty regarding the concept of compensation for land owners who provide road access. Closing road access for the community carried out by the heirs as owners of the land based on SHM No. 4435 is an unlawful act because the road access has been provided by the parents of the heirs at the time of the sale and purchase transaction supported by the Regent's Decree Number: 35 / EF-P / LF / VIII / 1997, dated August 27, 1997 concerning the provision of land for road access and parking lots.

Abstract

Tin mining activities in the Bangka Belitung Islands Province have significantly contributed to regional economic growth but have also caused severe environmental degradation. The main legal issue arises from the weak implementation of post-mining land reclamation obligations by tin mining companies, despite being clearly regulated under Law No. 3 of 2020 on Mineral and Coal Mining, Law No. 32 of 2009 on Environmental Protection and Management, and Law No. 40 of 2007 on Limited Liability Companies. This study aims to analyze the legal responsibilities of tin mining companies regarding post- mining land reclamation under Indonesia’s corporate legal system and to examine the legal consequences for companies that fail to fulfill such obligations within the framework of sustainable business responsibility. This research employs a normative juridical method with a business law and environmental law approach, supported by an analysis of legislation, legal doctrines, and literature review. The results show that the legal responsibility of tin mining companies includes administrative, civil, and criminal liabilities for negligence in reclamation activities. Normatively, reclamation implementation reflects the application of the corporate liability and strict liability principles, as well as the realization of Corporate Social and Environmental Responsibility (CSER) and Good Corporate Governance (GCG) within corporate law. Empirically, however, the enforcement of reclamation obligations remains weak due to limited supervision and law enforcement, resulting in a gap between legal norms and actual practice. This study concludes that the implementation of post-mining reclamation obligations is not merely a legal duty but also a moral and social responsibility of corporations to achieve sustainable, just, and environmentally conscious mining practices.

Abstract

This journal uses a normative legal research method. Amnesty is an act of pardon or removal of punishment granted by the President to individuals or groups of individuals who have committed certain criminal acts. Based on Emergency Law Number 11 of 1954, amnesty results in the removal of all criminal consequences for the person granted amnesty. Amnesty and legal certainty are interrelated, because legal certainty is essentially the main objective of law. Emergency Law No. 11 of 1954 on Amnesty and Abolition is considered to be inconsistent with the development of modern constitutional law because there are no implementing regulations for the granting of amnesty by the President, there are no restrictions or criteria regarding what is meant by the interests of the state by the President in granting amnesty, there is no time limit for granting amnesty to perpetrators of criminal acts, and there are no provisions governing the granting of amnesty to defendants as a result of decisions at the District Court level, the appeal level at the High Court, or the cassation level at the Supreme Court.

Abstract

Advances in information and communication technology have increased the involvement of children under the age of 13 in social media, such as creating creative content on TikTok and Instagram. To protect children from exploitation, Law No. 13 of 2003 on Manpower Article 69 prohibits child labor. However, this prohibition does not apply to positive digital activities of children. Discussions indicate that this inconsistency could lead to potential exploitation and consequences such as violations of the Child Protection Law. Compared to the US COPPA, Indonesian law needs to be revised to distinguish between exploitation and creative activities, ensure parental supervision, and protect children's privacy in the digital age.

Abstract

Notaries must ensure that all Acte they draw up fully comply with legal provisions, reflect the wishes of the parties, and are based on the facts of the case. As a public official, Notaries are not permitted to exceed the authority granted to them by law, and are prohibited from signing or certifying authentic Acte without the presence of the parties or without verifying their identities and signatures. However, the reality on the ground shows that there have been deviations from these provisions. In this case, the Notary did not thoroughly verify the presence of the parties or the authenticity of the signatures contained in the Acte. In fact, the Notary was known to have signed the Acte without ensuring the direct presence of the parties at the time of signing. This action not only contradicts the principle of prudence, but also causes the Acte in question to be legally flawed and lose its authenticity. The act of drafting and signing a power of attorney to sell without the presence of the interested parties, as well as using a forged signature, constitutes a violation of Section 264(1) of the Criminal Code in conjunction with Section 55(1)(1) of the Criminal Code, as well as Section 1365 of the Civil Code. Furthermore, violations of the provisions of the Notary Profession Law and the Notary Code of Ethics also indicate serious deviations in the performance of duties. The Panel of Judges has imposed a prison sentence, but dismissal as a notary without honor still requires a separate administrative process.

Abstract

Given the importance of the role of notaries in ensuring legal certainty and order through the preparation of authentic Actes, the author considers it necessary to examine in depth the aspects of legal responsibility attached to the position of notary. In particular, the author's attention is focused on the issue of notary responsibility in the issuance of Actes that later become the subject of legal disputes, such as in cases of default on the transfer of shares. This research falls under the category of normative legal research, also often known as doctrinal legal research. This approach views law as a set of norms that apply in society within the framework of the national legal system, and focuses on the study of legislation and other legal materials as the main sources of analysis. Due to its nature, which is not directly related to empirical objects, this research is also referred to as library research or document study, given that the data sources used come from studies of legal documents and scientific literature, and are secondary data. Supreme Court Decision Number 4812 K/Pdt/2024 shows that an authentic Acte, which should have full probative force, can be annulled by the court if there was negligence on the part of the notary in the process of its creation, particularly in ensuring that the formal requirements for holding a GMS were met. In this case, the Acte of GMS Decision was declared invalid because it was drawn up without the presence or power of attorney of the majority shareholders, which should have been the basis for the validity of a GMS decision. The notary's negligence in verifying the validity of the meeting caused the Acte to lose its authenticity and harmed the legitimate shareholders.

Abstract

Such actions by the curator could potentially fall under the category of unlawful acts (PMH) as stipulated in Article 1365 of the Civil Code. These actions are considered unlawful if they are carried out without a clear legal basis and without adequate verification of ownership. To be declared an unlawful act, the following elements must be fulfilled: the existence of an act, the act is unlawful, there is fault, loss has been incurred, and there is a causal relationship between the act and the loss incurred. This phenomenon indicates a gap between norms and practices in the administration of bankruptcy. The definition of the descriptive analytical method is a method that serves to describe or provide an overview of the object being studied through data or samples that have been collected as they are, without conducting analysis and making conclusions that apply to the general public. The curator's action of including third-party assets in the bankruptcy estate without a valid legal basis constitutes an unlawful act (PMH). This action violates the principles of property rights protection and legality in civil and bankruptcy law. The curator must ensure that the assets included in the bankruptcy estate truly belong to the debtor based on strong and valid legal evidence. Legal protection for third parties whose assets are included in the bankruptcy estate can be sought through commercial court proceedings, such as other lawsuits (Article 217 of the Bankruptcy Law) or third-party opposition (derden verzet). Third parties acting in good faith can submit proof of legal ownership through official documents such as a Sale and Purchase Agreement (PPJB), Deed of Sale and Purchase (AJB), or proof of full payment for the disputed object. Supreme Court Decision Number 311 K/Pdt.Sus–Pailit/2024 shows that the Supreme Court is increasingly consistent in providing protection for the property rights of third parties who have no debt relationship with the bankrupt debtor. This sets an important precedent in bankruptcy practice in Indonesia to prevent curators from exceeding their authority.
