Abstract

The abolition of the Presidential Threshold through Constitutional Court Decision No. 62/PUU-XXII/2024 has sparked debate over political justice and governmental stability. This study analyzes the issue through Imam Al-Mawardi’s perspective on state politics, focusing on leadership, political legitimacy, and the principle of public interest (maslahah). Using a normative legal method with conceptual and case approaches, the findings reveal that removing the threshold risks producing leaders with weak legitimacy, while maintaining an excessively high threshold creates political injustice. The ideal position is to establish a proportional threshold aligned with maslahah and substantive justice.

Abstract

This study discusses the liability of a Notary, acting as a public official, in relation to the embezzlement of land ownership certificates entrusted to them during the process of a binding sale and purchase agreement. The issue arises when the Notary fails to hand over the certificate to the rightful party, thereby creating opportunities for misuse and resulting in legal harm. The purpose of this study is to analyze the elements of the criminal act of embezzlement as stipulated in Article 372 of the Indonesian Penal Code (KUHP) in connection with the Notary's responsibility, and to examine the legal protection available to parties who suffer losses due to the Notary’s lack of due care. This thesis employs a normative juridical method with a statutory approach, literature review, and case study based on court decisions. The findings show that a Notary can be held legally accountable—criminally, civilly, or administratively— if proven to have committed embezzlement or been negligent in the exercise of their authority. Storing land certificates without a legal basis or in bad faith constitutes a violation of the Notary’s obligations as regulated under the Notary Office Law (UUJN) and the Notarial Code of Ethics. The conclusion drawn from this research is that Notaries bear legal responsibility for documents entrusted to them, particularly in upholding trust and ensuring legal certainty for all parties involved. Strengthening oversight and the enforcement of sanctions is necessary to prevent abuse of authority by Notaries.

Abstract

Auctions have been present in Indonesia since the Dutch era. Over time, auctions have developed, which were initially auctions carried out conventionally with the direct presence of participants, now property auctions can be carried out online. In the implementation of online auctions with property objects, it is usually supervised by the Directorate General of State Assets and strictly regulated to ensure transparency and legal certainty. Meanwhile, in Vietnam, online property auctions are growing rapidly, but they are managed by private auction companies with various regulations. This journal discusses the comparison of online property auctions. The results show that Indonesia has a series of procedures that are fully structured and supervised by the DKJN while Vietnam is more adaptive and decentralized.

Abstract

This study employs a normative juridical method by examining legislation, court decisions, and relevant legal literature. The first finding shows that Article 27A of the Electronic Information and Transactions Law contains ambiguous elements that are inconsistent with constitutional guarantees of freedom of expression and the standards set under Article 19 of the ICCPR. The second finding demonstrates that limiting instruments such as the Joint Ministerial Decree (SKB), Constitutional Court decisions, and Anti-SLAPP regulations have not been fully effective in preventing misuse of defamation provisions in digital spaces. These findings underscore the need for normative harmonization to ensure balanced protection for reputation and freedom of expression.

Abstract

This research compares Indonesia's auction digitalization (lelang.go.id, LPSE) with South Korea's KONEPS using a comparative case study. It analyzes system architecture, regulations, and impacts on efficiency and transparency. The results show South Korea's KONEPS is superior: highly centralized, fully integrated (end-to-end), and supported by advanced technology (digital certificates, blockchain). Conversely, Indonesia, despite progress, faces system fragmentation between asset auctions and procurement, data interoperability issues, and uneven user adoption. South Korea's success lies in its single-window system integrity and strong political commitment, offering valuable lessons for Indonesia.

Abstract

Abuse of circumstances (misbruik van omstandigheden) is a jurisprudential doctrine not yet regulated in Indonesian written law. A normative juridical research method was used to analyze Decision Number 143/PDT/2016/PT. DKI. Research findings indicate characteristics of abuse of circumstances include special circumstances and awareness. Sale and Purchase Binding Agreement Deeds containing abuse of circumstances can be declared null and void. The Panel of Judges ruled that the use of absolute power of attorney exploiting deteriorating economic conditions constitutes abuse of circumstances causing defective consent. Legal reform of the Civil Code is needed to regulate this doctrine to provide legal certainty and protection.

Abstract

This study explores various traditional and cross-border crimes, focusing on Indonesia and Malaysia's legal cooperation to combat human trafficking in 2024. Using a legal approach based on laws and regulations, the research reveals both countries have employed tools like Mutual Legal Assistance, ACTIP, and treaties to collaborate. However, challenges persist including differences in legal systems, slow government processes, and limited resources. The study recommends improving legal harmonization and leveraging technology to enhance coordination, thereby strengthening crime handling and victim protection efforts.

Abstract

This study stems from copyright issues arising from advances in digital technology, which often lead to violations in the production, distribution, and publication of copyrighted works without the permission of the copyright owner. The researcher wanted to determine the effective mechanisms for resolving digital copyright disputes through the Copyright Claims Board (CCB) in the United States and how relevant they are in Indonesia. This study uses normative legal and comparative legal methods. This study obtained results related to effective mechanisms for resolving digital copyright issues in Indonesia by referring to similar resolutions in the United States through the CCB institution. In conclusion, this study shows that Indonesia is considered ineffective in resolving digital copyright disputes, so it needs to learn from the United States with its special institution that works effectively compared to litigation, namely the CCB, as well as the existence of special regulations such as the Digital Millennium Copyright Act (DMCA).

Abstract

This study examines the legal vacuum surrounding the confiscation of crypto assets derived from money laundering within Indonesia’s legal system. Although crypto assets are recognized as investment commodities, Indonesia lacks specific procedures that address their digital nature, resulting in technical obstacles and legal uncertainty. A comparative analysis with Australia and the United States shows that both jurisdictions have established comprehensive regulatory frameworks integrating AML/KYC obligations and digital asset confiscation procedures. This study highlights the need for Indonesia to reform its regulations to ensure legal certainty and adapt to the evolving crypto-asset landscape.

Abstract

Notarial acts of falsifying authentic deeds harm the interests of parties and are subject to criminal punishment. This normative juridical research analyzes the procedure for making notarial power of attorney to sell deeds, notaries' legal responsibilities regarding falsification, and legal consequences based on Decision No. 773/Pid.B/2021/PN.Smg. Research findings indicate procedures must comply with the Notary Law and Notary Code of Ethics. Notaries may face administrative, civil, and criminal sanctions. In this decision, the notary was found guilty of falsifying 4 power of attorney to sell deeds and sentenced to 1 year 6 months imprisonment under Article 264 paragraph (1) jo Article 55 paragraph (1) sub-1 of the Criminal Code.
