Abstract

This study aims to analyze Jakarta Governor Regulation No. 2 of 2025 concerning marriage and divorce permits for civil servants (ASN) as an instrument for shaping moral standards within the bureaucracy. This research employs an interdisciplinary qualitative approach, combining contemporary fiqh based on maqāṣid al-sharī‘ah and social analysis through netnography. Data were collected from legal documents, academic literature, and public discourse on digital platforms. The findings reveal that the regulation functions not merely as an administrative mechanism, but also as a state effort to construct moral standards in family life among civil servants, particularly through the protection of life, lineage, intellect, and property. Public discourse demonstrates diverse responses, ranging from support as a reinforcement of bureaucratic ethics to criticism viewing it as state intrusion into private life. This study contributes to the development of Islamic family law by demonstrating that state regulations can be understood as an actualization of maqāṣid al-sharī‘ah within modern public policy. It also highlights the importance of integrating legal, moral, and social dimensions in formulating responsive and equitable policies.

Abstract

The phenomenon of celebrity divorce in Indonesia during the 2024–2025 period has received extensive coverage in digital media and sparked public discourse. This study examines how media framing of celebrity divorce contributes to the construction of legal consciousness regarding Islamic family law in the public sphere. Employing an interdisciplinary approach, the research integrates socio-legal analysis with cognitive linguistics. The data consist of 15 widely reported celebrity divorce cases published in major Indonesian online media outlets between 2024 and 2025, selected through purposive sampling based on the intensity of media exposure and relevance to family law issues. The analysis focuses on the identification of conceptual metaphors, evaluative lexical choices, and framing patterns, which are subsequently interpreted within the framework of maqāṣid al-sharī‘ah and legal consciousness theory. The findings indicate that media narratives frequently frame divorce through metaphors of rationality (“the best decision,” “a new chapter”) and dramatization (“domestic storm,” “divorce drama”), discursively shifting its meaning from a normatively religious event to a rational and modern personal choice. While these representations do not directly determine legal behavior, they potentially contribute to a more permissive perception of divorce, particularly among younger audiences. This study proposes a conceptual model of “language as an instrument of social regulation” in Islamic family law, highlighting the circular relationship between media representation, cognitive construction, and public legal consciousness. The findings contribute to contemporary Islamic family law scholarship by incorporating linguistic and discursive dimensions into socio-legal analysis.

Abstract

Marriage is a physical and spiritual bond that aims to form a family based on sakinah, mawaddah, and rahmah in accordance with Law No. 1 of 1974. However, the phenomenon of infidelity on social media (cyber infidelity) has increased along with the development of digital technology, causing emotional closeness with a third party outside of the marriage bond. The impact is in the form of ongoing disputes, loss of trust, and separation, which disrupts household harmony. Previous studies have highlighted the social and psychological impacts of cyber infidelity, but normative juridical studies from the perspective of Islamic Family Law are still limited. The research questions in this study are how the judge assessed this behavior in the Probolinggo Religious Court Decision Number 140/Pdt.G/2025/PA.Prob and how Islamic family law analyzes divorce due to social media infidelity. This study uses a normative-analytical method based on library research, examining legal literature, the Qur'an, KHI, PP No. 9 of 1975, and court decisions. The results of the study show that cyber infidelity is a violation of marital obligations that damages loyalty, 'iffah, and trust, and can be classified as nusyuz if it causes continuous disputes. The panel of judges considers this behavior a substantial factor in broken marriages, so that divorce can be granted legally according to Islamic law and regulations, in order to maintain justice, benefit, and the rights of all parties involved.

Abstract

This study aims to analyze the livelihood strategies of fishermen families in Puger Kulon from the perspective of Shafi’i Islamic jurisprudence using a living law approach. This research employs a descriptive analytical qualitative field method through in-depth interviews, observation, and documentation involving fishermen families. The analysis uses Eugen Ehrlich’s living law theory to examine the relationship between Shafi’i jurisprudence as law in books and fishermen’s livelihood practices as law in action. The findings show that fishermen families in Puger Kulon develop adaptive livelihood strategies, such as accumulating income during abundant seasons, delegating financial management to wives, and adjusting livelihood patterns during lean seasons. These strategies emerge as responses to unstable income. Such practices result from the interaction between value-oriented rationality to obey religious teachings and instrumental rationality to survive economically. This study concludes that fishermen’s livelihood practices can be understood as a form of living fiqh, namely Islamic law that lives and operates within social reality. Although technically different from textual provisions of Shafi’i jurisprudence, these practices remain substantively valid because they fulfill the objectives of maqashid al-sharia, particularly in protecting life and sustaining family welfare. This study contributes to the discourse on Islamic family law by conceptualizing fishermen's livelihood practices as living fiqh within fluctuating economic contexts.

Abstract

The phenomenon of global migration has given rise to transnational families that face complex legal challenges, particularly concerning the recognition of marital status, child custody, and access to legal protection across jurisdictions. The lack of harmonization among national legal systems often leads to legal uncertainty and discriminatory practices against migrant families. This study aims to analyze legal protection for transnational families by integrating the perspective of Islamic family law and the principle of non-discrimination in international law. This research employs a qualitative approach through a systematic literature review of primary and secondary legal sources, analyzed using thematic analysis techniques. The findings indicate that although international legal instruments have affirmed the principle of non-discrimination, its implementation at the national level remains fragmented and inconsistent. From the perspective of Islamic family law, the protection of transnational families aligns with the principles of maqāṣid al-sharī‘ah, particularly the protection of lineage (ḥifẓ al-nasl) and property (ḥifẓ al-māl), which emphasize justice and protection for all family members without discrimination. Therefore, harmonization between national law, international law, and Islamic legal values is necessary to establish a fair, inclusive, and responsive legal protection system for transnational families in the context of global migration.

Abstract

The development of digital technology has introduced new forms of wealth in the form of digital assets, which possess economic value but are not yet fully accommodated within the Islamic inheritance law system in Indonesia. This condition creates a tension between normative legal provisions and evolving social realities. This study aims to analyze the status of digital assets as inheritance objects within the framework of Islamic inheritance law and to examine the challenges in their distribution within the context of Indonesian positive law. This research employs a normative juridical method using statutory and conceptual approaches. The findings indicate that digital assets can be classified as property (al-māl) as they fulfill the elements of economic value, ownership, and utility, despite their intangible nature. However, in practice, the distribution of digital assets faces several challenges, including limited access, digital security systems, and the absence of explicit regulation in the Compilation of Islamic Law. This situation reflects a gap between legal norms and social realities (legal lag) within the inheritance system. Therefore, a more adaptive approach is required through the integration of maqāṣid al-sharī‘ah principles to ensure that Islamic inheritance law remains responsive, just, and contextual in addressing the development of digital assets.

Abstract

This study aims to analyze the effectiveness of the implementation of the Supreme Court Circular Letter (SEMA) Number 3 of 2023 in reducing divorce rates at the Mataram Religious Court Class 1A, particularly divorces filed on the grounds of continuous disputes and quarrels. This research employs an empirical juridical method with a descriptive-analytical approach. Primary data were obtained through interviews with judges, court clerks, and court officials, as well as documentation of divorce case data at the Mataram Religious Court. Secondary data were collected through a literature review of relevant laws and regulations, books, and academic journals. The data were analyzed using Lawrence M. Friedman’s theory of legal effectiveness, which emphasizes three elements of the legal system: legal substance, legal structure, and legal culture. The results show that the implementation of SEMA No. 3 of 2023 at the Mataram Religious Court is carried out through two main stages: the filtering and educational stage at the One-Stop Integrated Service (PTSP) before case registration, and the case examination stage during court proceedings by the panel of judges. Empirically, the policy indicates a decrease in the percentage of divorces based on continuous disputes and quarrels in 2025, although the overall divorce rate remains relatively high. From the perspective of legal effectiveness theory, this policy can be considered relatively effective in terms of legal substance and legal structure due to clear regulatory provisions and proper implementation by judicial officials. However, its effectiveness is still constrained by the legal culture of society, where many litigants tend to seek quicker divorce processes and have limited understanding of the applicable legal provisions.
