Abstract

Islamic Civil Law plays a significant role in regulating social, economic, and religious relations in Indonesia. In the context of rapid social transformation, the application of Islamic civil law within Indonesia’s pluralistic society requires critical examination from both juridical and philosophical perspectives. One of the main challenges lies in ensuring that Islamic civil law remains responsive to dynamic social change while preserving its foundational religious and moral principles. Accordingly, this study aims to analyze the relevance of Islamic civil law in addressing social change in Indonesia and to examine its application through juridical and philosophical approaches. This research employs a qualitative library-based method with normative analysis, drawing on legal literature, scholarly books, academic journals, and other relevant sources related to Islamic civil law and social change in Indonesia. The findings indicate that Islamic civil law remains highly relevant in responding to social change, particularly in the regulation of family relations, economic activities, and social interactions. From a juridical perspective, Islamic civil law demonstrates adaptability in accommodating evolving societal conditions. Philosophically, it maintains a balance between adherence to religious values and responsiveness to contemporary social needs. This combination of juridical flexibility and philosophical consistency is essential to sustaining the effectiveness and relevance of Islamic civil law within Indonesia’s continually evolving social context.

Abstract

The recognition of living law in Indonesia’s 2023 Criminal Code (KUHP 2023) has sparked significant debate regarding its compatibility with the principle of legality and human rights protection. Existing studies largely approach this issue descriptively, leaving a gap in normative analysis concerning the transformation of legality and its constitutional limits. This study critically examines the incorporation of living law in the KUHP 2023 by analyzing its implications for the shift from formal legality toward material legality and the resulting tension between legal certainty, human rights, and communal justice. Employing normative legal research, this study applies statutory, conceptual, and philosophical approaches, drawing on theories of material legality, legal pluralism, and constitutionalism. The analysis focuses on relevant provisions of the KUHP 2023, legal doctrines, and international human rights principles to assess the conditions and limits of applying living law within criminal law. The findings reveal that the recognition of living law represents a deliberate move toward a socially responsive criminal justice system. However, this shift also generates inherent human rights challenges, particularly concerning the foreseeability of criminal norms and the risk of arbitrary enforcement. This study argues that such tensions cannot be eliminated but must be managed through constitutional interpretation, judicial restraint, and human rights–based oversight. The study contributes a normative framework for balancing legality, human rights protection, and communal justice within Indonesia’s plural legal system, offering guidance for legislators, judges, and law enforcement authorities.

Abstract

The increasing participation of wives in professional and economic activities has become a significant phenomenon in contemporary Muslim society, including Langsa City. A career wife refers to a married woman who works outside the home to support family income, develop personal potential, and apply her skills and knowledge. This study addresses the issue of how the rights and obligations of career wives are fulfilled in family life and examines these practices from the perspective of fiqh munakahat. This research aims to analyze the implementation of marital rights and obligations toward career wives and to assess their conformity with Islamic family law principles. The study employs a normative-empirical research method. The normative approach examines Qur’anic verses, Hadith, and classical juristic opinions related to fiqh munakahat, while the empirical approach explores social realities through the lens of family sociology within the community of Gampong Paya Bujok Seulamak, Langsa City. The findings indicate that wives’ participation in work is largely driven by the husbands’ insufficient income to meet household needs. However, the practice of financial maintenance (nafkah) often deviates from Islamic legal provisions. Many husbands cease providing nafkah due to the wives’ independent income and higher earnings. Such practices demonstrate a misunderstanding of Islamic legal norms, as fiqh munakahat affirms that the obligation of nafkah remains with the husband regardless of the wife’s employment status. Economic limitations do not nullify this obligation but require adjustment according to the husband’s financial capacity. This study highlights the need for strengthening public understanding of marital responsibilities to ensure household harmony based on Islamic legal principles.

Abstract

This study examines the impact of E-Accounting on the revenue of MSMEs in North Sumatra Province, addressing gaps in the existing literature regarding the role of accounting literacy. The study also explores the challenges faced by MSMEs in adopting E-Accounting. Using a mixed-methods approach with an exploratory sequential design, quantitative data were collected through structured questionnaires from 271 MSMEs across seven districts and cities and analyzed using PLS-SEM. Qualitative data were obtained through in-depth interviews with 20 purposively selected MSMEs. The results indicate that E-Accounting has a significant positive effect on MSME revenue; however, accounting literacy does not function as a significant moderating variable. This suggests that the benefits of E-Accounting in increasing revenue do not depend solely on users’ accounting knowledge. Qualitative findings reveal that although MSMEs acknowledge the benefits of E-Accounting, its use remains largely administrative rather than strategic. Key challenges include limited digital infrastructure, insufficient training, and a strong reliance on intuitive decision-making. The novelty of this research lies in the integration of Sharia principles, such as trustworthiness and the protection of wealth, providing insight into how Islamic values influence MSME financial practices. This study offers practical and culturally relevant recommendations to improve E-Accounting adoption and strengthen MSMEs’ financial resilience through the alignment of technology and ethical principles.

Abstract

Abstract

This article aims to analyze the theological beliefs that have an impact on the formation of political movements and political movements that realize theological schools. This study uses a qualitative approach. The source of the study comes from related references, particularly regarding the development of theology in Islam and its relation to power politics. The findings of the article show that differences in understanding of theology have created the emergence of many groups. Every theological thought has its own argumentation basis. Differences in theological understanding are determined by the understanding of the Qur'an and Hadith. Differences in the meaning of religion are largely determined by reasoning ability and the patron of religious authority that is followed. Each group builds political power to defend and spread its theological understanding. In the early generations, religious patrons had a great opportunity to lead their group's political movements. In the period of its development, the spread of theological schools needed to be integrated with politics. In contrast to the early generations, in later periods, the development of theology depended on the ability of religious authorities to offer an integrative meaning of religion with political power.

Abstract

The development of Artificial Intelligence (AI) has brought significant changes to various aspects of human life, including education, social, economic, and religious fields. This phenomenon raises fundamental questions about the relationship between intelligent technology and Islamic theology, a scientific discipline that addresses the relationship between humans, God, and the universe. This article analyzes the relationship between Islamic theology and Artificial Intelligence, highlighting the challenges and opportunities that arise in contemporary Muslim society, particularly within the State Islamic Religious Colleges (PTKIN). The research method used is a literature review with a normative-philosophical approach and a conceptual analysis of Islamic theological literature and studies on the ethics of technology. The results of the study indicate that AI poses theological challenges regarding the authority of knowledge, humanitarian ethics, and the meaning of moral responsibility. However, AI also opens strategic opportunities for the development of contextual Islamic theological studies, for strengthening humanitarian values, and for integrating science and religion within PTKIN. This article emphasizes the crucial role of Islamic theology in providing an ethical and spiritual framework for the responsible development and utilization of AI.

Abstract

The development of religion and culture-based tourism in Langkat Regency positions the community as the primary actor in creating authentic tourism experiences. The attractiveness of a destination is determined not only by its natural or cultural heritage, but also by the quality of interactions between tourists and local residents. This study aims to describe the development of community potential, forms of tourism communication, and the image and optimization of the community's role in religion- and culture-based tourism in Langkat. The study used a qualitative descriptive method through the collection of field data and related literature. The results indicate that local communities play a significant role as the primary drivers in destination development, particularly in religious tourism areas. The developing tourism communication pattern remains traditional through informal channels, primarily word-of-mouth. In the Besilam region, the dissemination of tourism information relies heavily on the social networks of religious orders, religious leaders, and the local community. To optimize community potential sustainably, strategic collaboration is necessary between the local government, religious leaders, tourism managers, and the community. This synergy is crucial for building tourism governance that not only boosts the economy but also preserves local religious and cultural values.

Abstract

The 2024 Batubara Regency Regent Election highlighted the use of religious and cultural identity-based political communication in digital spaces, particularly social media. This article aims to analyze the forms, strategies, and impacts of identity political communication constructed by political actors in the contest. Using a critical phenomenological approach and digital content analysis, this study explores how symbols, narratives, and representations of religious and cultural identity are produced, disseminated, and received by the multi-ethnic, predominantly Muslim community of Batubara. The results reveal three main patterns: (1) the use of religious symbols for the moral legitimacy of candidates; (2) the affirmation of local cultural identity as an emotional connection with voters; and (3) the representation of ethnic identity that is sometimes exploited in negative campaigns. Social media, such as Facebook, Instagram, and TikTok, have become primary platforms for the dissemination of identity narratives through hashtags, visual content, and short videos. This study also found a dual impact of identity politics, strengthening the consolidation of support but also causing emotional polarization and social fragmentation. These findings emphasize the importance of identity politics in the Batubara contest, as well as the need to improve political and digital literacy to minimize its negative impacts.

Abstract

The rapid expansion of digital financial technology has increasingly influenced the landscape of Islamic social finance, including the emerging discussion on the use of crypto assets for zakat payments. While cryptocurrencies such as Bitcoin are widely used in global financial transactions, their status as zakatable wealth (māl zakawī) remains contested among Muslim scholars and regulators. Existing studies have largely focused on the legality of cryptocurrency in Islamic finance, yet limited attention has been given to its practical implications for zakat governance and institutional regulation. This study therefore examines the permissibility of crypto assets as objects of zakat from the perspective of fiqh al-muamalah and compares the regulatory approaches adopted in Indonesia and Malaysia. This research employs a qualitative library-based method through the analysis of classical and contemporary Islamic legal literature, relevant fatwas, and regulatory frameworks related to cryptocurrency and zakat administration. A comparative approach is used to explore differences in institutional responses between the two countries. The findings indicate that Malaysia has adopted a more adaptive regulatory approach by facilitating crypto-based zakat payments through authorised institutions such as Lembaga Zakat Selangor (LZS) and Pusat Pungutan Zakat (PPZ). In contrast, Indonesia maintains a more cautious stance due to ongoing scholarly debates and regulatory uncertainties surrounding the classification of crypto assets. From an Islamic legal perspective, crypto assets may be regarded as zakatable wealth when they fulfil the criteria of māl mutaqawwim, including lawful ownership, recognised economic value, and compliance with Sharia principles. These findings highlight the potential role of blockchain technology in improving transparency, accountability, and public trust in zakat management while expanding financial inclusion among digitally engaged Muslim communities.
