Abstract

This study examines the dynamics of religiously-based marriages and divorces across several nations, including Indonesia, Tunisia, Turkey, the United States, and the United Kingdom. The study is driven by the varied methodologies about marriage and divorce, influenced by a confluence of statutory regulations, cultural customs, and religious tenets. The primary concern is how these nations manage the multiplicity of religious traditions while upholding justice and safeguarding individual rights. The study seeks to analyze the regulation of religious marriages and divorces by legal systems in various countries and to pinpoint best practices that could inform the reform of marriage laws in Indonesia. The research utilizes a literature review methodology to assess secondary data from books, research reports, and legal laws in the chosen nations. We employ a descriptive normative methodology to deliver an extensive investigation of the interaction of law, culture, and religion concerning marriage and divorce. The findings indicate that certain countries have effectively delineated the functions of religion and the state in the governance of marriage and divorce while preserving religious values. These regulations emphasize justice, encompassing the safeguarding of individual rights in divorce procedures, the fair allocation of assets, and the welfare of children. This study emphasizes the necessity of enacting legislation that honors cultural and religious diversity while guaranteeing equal protection for all individuals. This research provides valuable insights for establishing an inclusive and equitable marriage law system in Indonesia.

Abstract

The customary courts in Aceh have long served as a traditional mechanism for dispute resolution, prioritizing deliberation and consensus. Although formal recognition through Aceh Qanun No. 9 of 2008 has strengthened the role of customary institutions in maintaining social order and resolving disputes quickly and simply, its implementation still faces challenges that affect its consistency and effectiveness. This study aims to analyze the role of customary courts as an effective instrument for dispute resolution, identify the challenges encountered, and contribute to developing dispute resolution mechanisms based on customary practices in Aceh. The research employs a qualitative method with a descriptive approach. Data were obtained through interviews with the Deputy Chair of the Aceh Customary Assembly of Langsa City and an analysis of official documents, such as customary mediation records. Based on the data, out of 82 cases handled between 2021 and 2023, 73 were successfully resolved through customary mediation, including family disputes and interpersonal conflicts. These findings highlight the significant role of customary courts in fostering peaceful solutions accepted by the community. The main challenges identified include insufficient administrative support, inadequate documentation, and differing procedural understandings among customary leaders. This study contributes by offering strategic recommendations, such as strengthening the capacity of customary leaders through training, developing documentation systems, and enhancing coordination with law enforcement agencies. These efforts aim to ensure that customary courts continue to evolve as an effective, sustainable, and relevant mechanism for dispute resolution within the national legal system.

Abstract

Knowledge is a fundamental human necessity that enables individuals to navigate various challenges in life. However, throughout history, a dichotomy has often been drawn between religious knowledge and secular knowledge, leading to a conceptual division of science. This dichotomy has had a detrimental impact on the intellectual and scientific development of the Muslim world, contributing to its decline in science and technology in comparison to the West. This stands in stark contrast to the Islamic Golden Age, during which Islamic civilization served as a center of knowledge and a beacon for Europe, which was then in a period of intellectual stagnation. This study aims to critically examine the dichotomy of knowledge within Islamic thought and to explore integrative solutions for Islamic education in the modern era. Employing a qualitative method through library research, this study reveals that for Islamic education to meet the demands of an increasingly dynamic and globalized world, a balanced integration of religious and secular knowledge is essential. Thus, in addition to understanding religious principles, learners must also acquire practical knowledge and skills applicable to everyday life and relevant to the global labor market.

Abstract

The concept of distributive justice in Islamic economics presents an alternative to capitalist economic systems that often lead to inequality and social disparity. While capitalism prioritizes profit and market freedom, Islamic economics emphasizes equitable wealth distribution grounded in the values of tauhid (oneness of God), khilafah (stewardship), and maslahah (public interest). This study aims to critically analyze how the principles of distributive justice in Islamic economics can address contemporary issues of economic inequality and social injustice. Employing a descriptive qualitative method through an integrative literature review, this research examines classical Islamic economic texts and contemporary scholarly works, focusing on themes of justice, wealth redistribution, and ethical governance. The findings indicate that Islamic economic justice requires not only the prohibition of exploitative practices such as riba and monopoly but also active state involvement in regulating distribution and promoting social welfare. The integration of moral values such as justice, amanah (trust), and social responsibility into policy-making is essential for achieving sustainable and inclusive economic development. The study concludes that the framework of Islamic distributive justice offers a holistic and value-driven approach to economic policymaking, with potential applications in addressing structural poverty and fostering a just society.

Abstract

Self regulation is an individual effort to self-regulate in an activity by involving the ability of metacognition, motivation, and active behavior. These three aspects are applied in learning. One of the methods used to increaseself regulation students in learning is an approachUswah hasanah, where the teacher gives a good example and is seen directly by students. The purpose of this study was to determine the effect of the approachUswah hasanahon self-regulation students at MA Mathla'ul Huda Bandung. The study used a quantitative approach with a sample of 61 students (22 boys and 39 girls) in class XII. Sampling through questionnaires or questionnaires with techniquesprobability sampling by methodrandom sampling. Data analysis used a simple linear regression technique with the help of IBM SPSS 25for windows. The results of the study show that there is a significant influence between the approachesUswah hasanahon self-regulation of students in MA Mathla'ul Huda, with a significance value of 0.000 (ρ <0.05) and an influence level of 27.7%.

Abstract

Compensation money handed over by new residents to old residents of official residences in Langsa City as well as handover transactions for official residences have caused problems related to the status of the contract and ownership rights which occurred after payment of a sum of money which was also recognized as compensation money. Through a qualitative approach with descriptive methods, this research aims to determine the status of contracts, compensation money and ownership rights for official residences in Langsa City from a muamalat fiqh perspective. This research reveals that an official residence transaction that is recognized as a sale and purchase agreement is a false sale and purchase agreement because the old occupant as a seller is not the owner of the official residence as al-mabi' so the status of ownership of the official residence does not transfer to the buyer, but remains ownership. National Police. Furthermore, handing over compensation money is not appropriate because it is contrary to the concept of al-ta'widh, causing the transfer of assets from the party giving compensation money to be illegal to own and not permissible to use.

Abstract

This research has the following objectives: to describe how childfree is debated and to find out how childfree can be used as propaganda material. The type of research used in this research is library research to collect and analyze data sourced from libraries in the form of books, articles, journals, documents and other library materials that can be used as reference sources by collecting data. secondary in the form of documentation, data reduction, data presentation and drawing conclusions. The research results show that the childfree phenomenon in Indonesia is not well known and still often receives negative responses from the public, giving rise to pros and cons to this day. The results also show that 1) there is a need for da'wah material to rectify the childfree issue by giving direction to the community by delivering childfree material that is correct and easy for the public to understand. 2) It's time for preachers to return society's mafahim (understanding), maqayis (standards of thinking), and qanaat (feelings of love and hate) to Islamic mafahim, maqayis, and qanaat which are based on the material of preaching, namely aqidah, law, morals, and shariat Islam.

Abstract

This research explores integrating multiculturalism and Intercultural Communicative Competence (ICC) in modern Islamic education. This research method is a qualitative study of existing literature. This research uses a literature review approach to explore the definition and dimensions of ICC, the challenges and opportunities in its integration into Islamic education, and the impact of multiculturalism on forming the Islamic education paradigm using thematic analysis of the Miles and Huberman model. Findings suggest a different understanding of ICC, which includes cultural awareness, cross-cultural sensitivity, and adaptive capacity. Despite efforts, challenges like resistance to Western influence and conceptual barriers still exist in integrating ICC into Islamic education. Promising practices, including collaborative approaches between Islamic and non-Islamic educational institutions, show potential for increased integration. Multiculturalism significantly influences educational approaches, offering opportunities to foster cross-cultural understanding and tolerance. Recommendations for future research include further exploration of effective teaching strategies, the development of inclusive learning methods, and longitudinal studies to assess the long-term impact of ICC integration in Islamic educational settings.

Abstract

National education has the goal of shaping the morals of students who are truehearted and dedicated to God. As part of national education, Islamic-integrated mathematics learning becomes a bridge to achieve this goal. This study aims to explore the concept of mathematics in the hadith with the theme of the virtue of reciting shalawat. This research uses a qualitative approach with literature study methods. Data were obtained from hadith books, hadith applications, articles, and relevant documents. The results showed that there are three mathematical concepts in the hadith related to the virtue of reciting shalawat. The mathematical concepts found include the concept of numbers (natural numbers, integers, positive integers, odd numbers, and even numbers), arithmetic operations (addition operations), and the concept of relations and functions (bijective functions). The results of this study can be used as a reference for learning resources related to Islamic integrated mathematics derived from hadith with the theme of the virtue of reading shalawat.

Abstract

Al-hajatu tanzzilu manzilata al-dharurah (the need to occupy an emergency position) is a fiqh rule that is often misunderstood in its use in an effort to justify changes to a law. The reason for using this method is often based on an urgent need that seems to be the same as or at least approaching an emergency. On the basis of an emergency, a law or legal procedure can be "violated" temporarily. This study will focus on the Al-hajatu tanzzilu manzilata al-dharurah fiqh rules in order to understand the difference between the terms al-dharurah (emergency) and al-hajah (need), so that it can be ascertained which legal acts can change due to necessity and which cannot changed. After reviewing various ushul fiqh literature, it can be concluded that this rule can be developed in its application to various emergencies in life both in the fields of economics, energy, food, education, human rights, politics and worship.
