Abstract

This study aims to identify the reasons and considerations of judges in granting marriage dispensation applications in the midst of changes to the marriage law regarding marriage age limits. The research method used was qualitative with a philosophical juridical approach, involving interviews, observation, and document analysis. Data were analyzed inductively, starting from data collection to the development of hypotheses that were tested iteratively using triangulation techniques. The results revealed several factors behind the marriage dispensation applications, such as the existence of sexual relations and pregnancy outside marriage, love and dating relationships, lack of parental supervision, and low economic and family education. The judge looked at the application to make sure it wouldn't have even worse effects. He used maqashid sharia and fiqhiyah rules to decide that stopping mafsadat (damage) was more important than getting maslahah (benefits). Another consideration is the obligation to marry for those who are worried about falling into adultery. The decision on marriage dispensation is a dilemma for judges because it contradicts child protection and the prohibition of underage marriage but is necessary to avoid worse consequences

Abstract

This study examines the dynamics of religiously-based marriages and divorces across several nations, including Indonesia, Tunisia, Turkey, the United States, and the United Kingdom. The study is driven by the varied methodologies about marriage and divorce, influenced by a confluence of statutory regulations, cultural customs, and religious tenets. The primary concern is how these nations manage the multiplicity of religious traditions while upholding justice and safeguarding individual rights. The study seeks to analyze the regulation of religious marriages and divorces by legal systems in various countries and to pinpoint best practices that could inform the reform of marriage laws in Indonesia. The research utilizes a literature review methodology to assess secondary data from books, research reports, and legal laws in the chosen nations. We employ a descriptive normative methodology to deliver an extensive investigation of the interaction of law, culture, and religion concerning marriage and divorce. The findings indicate that certain countries have effectively delineated the functions of religion and the state in the governance of marriage and divorce while preserving religious values. These regulations emphasize justice, encompassing the safeguarding of individual rights in divorce procedures, the fair allocation of assets, and the welfare of children. This study emphasizes the necessity of enacting legislation that honors cultural and religious diversity while guaranteeing equal protection for all individuals. This research provides valuable insights for establishing an inclusive and equitable marriage law system in Indonesia.

Abstract

Domestic violence remains a significant issue in Aceh, largely influenced by the prevailing patriarchal culture and the limited protection available for victims. This study aims to examine the forms of domestic violence occurring within communities in East Aceh and evaluate its impacts on victims in physical, psychological, and social dimensions. Furthermore, the research analyzes the out-of-court resolution processes involving the roles of customary institutions, community leaders, and village governments. Employing a descriptive qualitative approach, data were collected through in-depth interviews with victims, perpetrators, and stakeholders involved in resolving domestic violence cases. The findings reveal various forms of domestic violence, including physical, psychological, sexual, and economic violence, with diverse impacts on victims depending on the social context of each village. Out-of-court resolutions are primarily facilitated through customary mediation, emphasizing a family-centered approach to prevent further conflict escalation. This study contributes to the literature on the role of customary conflict resolution systems in addressing domestic violence. It also highlights the need for more systematic and inclusive strategies to ensure justice for victims and reduce the prevalence of domestic violence in a sustainable manner.

Abstract

The customary courts in Aceh have long served as a traditional mechanism for dispute resolution, prioritizing deliberation and consensus. Although formal recognition through Aceh Qanun No. 9 of 2008 has strengthened the role of customary institutions in maintaining social order and resolving disputes quickly and simply, its implementation still faces challenges that affect its consistency and effectiveness. This study aims to analyze the role of customary courts as an effective instrument for dispute resolution, identify the challenges encountered, and contribute to developing dispute resolution mechanisms based on customary practices in Aceh. The research employs a qualitative method with a descriptive approach. Data were obtained through interviews with the Deputy Chair of the Aceh Customary Assembly of Langsa City and an analysis of official documents, such as customary mediation records. Based on the data, out of 82 cases handled between 2021 and 2023, 73 were successfully resolved through customary mediation, including family disputes and interpersonal conflicts. These findings highlight the significant role of customary courts in fostering peaceful solutions accepted by the community. The main challenges identified include insufficient administrative support, inadequate documentation, and differing procedural understandings among customary leaders. This study contributes by offering strategic recommendations, such as strengthening the capacity of customary leaders through training, developing documentation systems, and enhancing coordination with law enforcement agencies. These efforts aim to ensure that customary courts continue to evolve as an effective, sustainable, and relevant mechanism for dispute resolution within the national legal system.

Abstract

Knowledge is a fundamental human necessity that enables individuals to navigate various challenges in life. However, throughout history, a dichotomy has often been drawn between religious knowledge and secular knowledge, leading to a conceptual division of science. This dichotomy has had a detrimental impact on the intellectual and scientific development of the Muslim world, contributing to its decline in science and technology in comparison to the West. This stands in stark contrast to the Islamic Golden Age, during which Islamic civilization served as a center of knowledge and a beacon for Europe, which was then in a period of intellectual stagnation. This study aims to critically examine the dichotomy of knowledge within Islamic thought and to explore integrative solutions for Islamic education in the modern era. Employing a qualitative method through library research, this study reveals that for Islamic education to meet the demands of an increasingly dynamic and globalized world, a balanced integration of religious and secular knowledge is essential. Thus, in addition to understanding religious principles, learners must also acquire practical knowledge and skills applicable to everyday life and relevant to the global labor market.

Abstract

Negative stigma becomes problematic for wives who have husbands who are non-congenitally blind, thus affecting the developmental process of their adjustment. These obstacles cause a low sense of adjustment, less ready to accept the husband's condition, so it is necessary to provide individual guidance and motivation to them in an effort to improve their adjustment. This research aims to find out how individual guidance is implemented to increase the wife's adjustment to her non-congenital blind husband. The results of the research show that the stages of implementing individual guidance are, first, providing motivation to clients who are experiencing problems in life, creating inspiration for familiarity with clients. In the middle stage, the client has begun to know the solution to the problem, support from close friends and family. The final stage (follow-up) is carried out after the individual guidance activity is about to end, the supervisor carries out a follow-up plan and discusses success after carrying out individual guidance. Abstract

Internalizing Islamic values in school learning. During this time, the responsibility has been placed more on the teacher of Islamic Religious Education, while teachers of other subjects are more focused on the general learning material. This led to the internalization of Islamic values through one path considered less successful in shaping student religious behavior. Indicators of this failure are the rise in criminal acts, asylum, drug use, and other violations among students and adolescents. So, there needs to be a change in the school curriculum that places the cultivation of Islamic values at the centre of attention from an early age, by integrating religious values into all subjects, including mathematics. This research aims to find an effective method of dealing with the moral problems faced by elementary school students. Several previous studies have explored mathematical concepts in the Qur'an, and the results show that Islamic values in the learning of mathematics can be internalized by paying attention to the relevant verses of the Quran. The research is carried out through descriptive methods with the study of literature, using various sources such as theses, research reports, articles, and books. The results show that the Islamic values in mathematical learning integration al-Qur'an can be internalized to students by applying the strategy of infusion, analogy, narration, and uswah hasanah.

Abstract

Indonesia is highlighted as the third-ranked "fatherless country." A fatherless country refers to a nation where the role and presence of fathers in childcare are minimal. The lack of paternal involvement in the upbringing and education of children is driven by deeply rooted societal stigmas. This phenomenon is rooted in a strong patriarchal culture, in which childcare is seen entirely as the mother’s responsibility. Based on the above, a solution is needed to respond to this phenomenon. The fatherless issue calls on society to re-evaluate the parameters of a father’s role in the family, especially toward children. The Qur’an, as a guide for Muslims, contains indicators and answers to all of life’s problems. Therefore, seeking solutions to the fatherless phenomenon through the Qur’an becomes crucial to implement. This research is qualitative in nature, using a library research approach. The data is presented using descriptive analytical techniques. The study finds that the fatherless phenomenon contradicts the substance of the Qur’an. The interpretation (Tafsir) by Indonesia’s Ministry of Religious Affairs (KEMENAG RI) contains numerous verses that imply exemplary behavior and ideal values a father should embody toward his child. The interpretation by the KEMENAG RI team of these verses is relevant for application in the Indonesian context. Based on the analysis, the involvement of fathers in the childcare process has a significant positive impact on the child's growth and development. By highlighting various examples of the ideal father figure from the KEMENAG RI Tafsir, it is hoped that these can be implemented to help reduce the percentage of fatherlessness in Indonesia.
