Abstract

Perjudian online kini semakin marak dan mengalami pertumbuhan yang cepat di Indonesia, membawa dampak yang signifikan terhadap berbagai aspek sosial dan hukum. Meski Pasal 303 KUHP dan UU ITE menjadi landasan hukum dalam menangani aktivitas ini, regulasi yang ada dianggap belum memadai untuk menanggulangi kejahatan berbasis teknologi ini secara efektif. Penelitian ini bertujuan untuk menganalisis penerapan Pasal 303 KUHP dalam menanggulangi perjudian online di Indonesia serta mengidentifikasi urgensitas terhadap kebutuhan pembaruan regulasi pada UU ITE. Melalui pendekatan normatif, penelitian ini menemukan bahwa regulasi saat ini memiliki kelemahan mendasar, seperti tidak adanya definisi khusus mengenai pemain perjudian online, kekosongan hukum yang mencakup aktivitas lintas batas, dan sanksi yang tidak memberikan efek jera. Kendala dalam penegakan hukum mencakup keterbatasan yurisdiksi internasional, keterbatasan teknologi aparat penegak hukum, dan minimnya kesadaran masyarakat mengenai bahaya perjudian online. Maka dari itu, diperlukan pembaruan regulasi yang lebih komprehensif dan penegakan hukum yang didukung oleh teknologi seperti AI dan Big Data Analytics untuk mendeteksi transaksi judi online, firewall dengan deep packet inspection untuk memblokir situs ilegal, forensik digital untuk melacak aliran dana, serta kerja sama internasional dalam intelijen siber guna menutup platform judi berbasis luar negeri.

Abstract

Terorisme merupakan kejahatan luar biasa yang perlu diwaspadai, timbulnya residivis terorisme menimbulkan ancaman terhadap masyarakat dan negara. Permasalahan timbul pada kebijakan mengenai residivis tindak pidana terorisme. Hal itu terlihat dalam perbedaan putusan pengadilan pada kasus terorisme yang mempertimbangkan keadaan residivis dan tidak mempertimbangkan residivis. Permasalahan tersebut menimbulkan legal gap yang perlu dilakukan pengkajian. Tujuan penulisan ini agar mengetahui kebijakan pertanggungjawaban pidana bagi pelaku tindak pidana terorisme berkualifikasi residivis di Indonesia. Penelitian menggunakan metode penelitian normatif dengan pendekatan undang-undang, kasus, dan komparatif memungkinkan dalam pengambilan argumentasi yang mendalam. Hasil penelitian menunjukan bahwa terdapat ancaman nyata oleh residivis terorisme akibat belum adanya peraturan terkait pertanggungjawaban residivis pelaku tindak pidana terorisme di Indonesia. Formulasi terhadap pertanggungjawaban residivis terorisme sangat diperlukan sebagai upaya peningkatan pemberantasan tindak pidana terorisme. Pengaturan pertanggungjawaban residivis terorisme setidaknya memuat mengenai definisi, delik apa saja yang dapat dikenakan, syarat dan daluwarsa dalam pengulangan tindak pidana, sistem pemberatan, dan pedoman pemidanaan bagi pengulangan tindak pidana dengan ancaman pidana seumur hidup atau pidana mati. Ide formulasi tersebut juga harus didukung dengan program deradikalisasi dan kontraradikalisasi yang baik.

Abstract

Pencurian merupakan salah satu tindak kejahatan yang marak terjadi di Indonesia khususnya di Kota Medan, meskipun sudah ada sanksi hukum yang tegas terlihat bahwa kejahatan ini masih marak terjadi sehingga hal ini menarik untuk diteliti lebih dalam mengenai bagaimana efek jera dari kebijakan pelaksanaan pidana penjara bagi pelaku tindak pidana pencurian ini apakah sanksi ini bisa memberikan efek jera dan mengurangi residivis atau sebaliknya. Penelitian ini merupakan penelitian kualitatif dengan jenis penelitian yuridis empiris dengan menggunakan dua sumber data yaitu primer dan sekunder. Hasil dari penelitian ini menunjukkan bahwa kedudukan pidana penjara dalam KUHP baru dan lama mengalami pergeseran signifikan, KUHP baru memberikan alternatif pidana yang lebih humanis. Tujuan utama dari pidana penjara adalah untuk memberikan efek jera bagi para pelaku namun tidak semua mantan narapidana yang setelah keluar tidak mengulangi kesalahannya kembali dan berujung menjadi residivis, Lembaga Pemasyarakatan Kelas 1 Medan menunjukkan bahwa terdapat 33 orang narapidana pencurian dan 13 orang diantaranya merupakan residivis. Dalam pandangan hukum pidana Islam hukuman bagi pelaku pencurian adalah had potong tangan yang sesuai dengan Q.S al-Maidah ayat 38 apabila sudah mencapai nisabnya yaitu ¼ dinar atau setara 1 gram emas dan memenuhi unsur serta syarat yang lainnya. Meskipun sanksi potong tangan diatur, penerapannya di Indonesia menghadapi masalah etika dan kemanusiaan, sehingga hukuman penjara menjadi alternatif.

Abstract

Dengan kemajuan teknologi, media rekam pun berkembang menjadi Rekam Medis Elektronik (EMR) yang tunduk pada aturan Peraturan Kementerian Kesehatan Nomor 24 Tahun 2022. Namun, kesediaan institusi layanan kesehatan untuk memberikan akses kepada pemerintah terhadap ESDM berisiko melemahkan hak asasi manusia dan privasi, perlindungan data pribadi, dan pengungkapan informasi publik. Terdapat 94 kasus kebocoran data di Republik Indonesia sejak tahun 2019, dan 35 diantaranya terjadi pada tahun 2023. Terkait dengan kewajiban membuka akses ESDM kepada pemerintah, perlu ditinjau kembali perlindungan hukum terhadap kerahasiaan data pasien, Penilaian kepatuhan akses terhadap prinsip perlindungan hukum pasien dan penerapan perlindungan kerahasiaan data RME. Penelitian normatif merupakan metode penelitian deskriptif yang bertujuan untuk menyediakan data yang sistematis dan rinci berdasarkan unsur-unsur yang terkait dengan perlindungan data pribadi. Hasil penelitian menunjukan bahwa banyak peraturan di Indonesia mengenai perlindungan data pribadi yang telah diberlakukan, namun gagal mengatasi tantangan terkait permasalahan yang muncul. Hal ini menciptakan kepastian hukum sebagai salah satu tujuan dari hukum itu sendiri.

Abstract

The development of application-based transportation platforms (ride-hailing) in Indonesia has significantly transformed urban mobility. However, the registration process for platform driver-partners remains largely administrative and does not involve standardized physical vehicle inspections, creating a category of “illegal taxis,” namely, officially registered vehicles that may not comply with statutory operational and emission standards. This study analyzes this issue from an environmental justice perspective and evaluates whether transportation law enforcement is aligned with Indonesia’s commitment to achieving Net Zero Emissions by 2060. The study employs normative juridical and socio-legal methods using statutory, conceptual, and case approaches. The findings indicate that the absence of physical vehicle inspections produces three dimensions of environmental injustice: distributive injustice, because environmental and health costs are borne by the public; procedural injustice, due to unequal regulatory burdens between licensed transportation operators and platform partners; and recognition injustice, because vulnerable groups face greater risks of transport poverty. Law Number 22 of 2009 concerning Road Traffic and Transportation, Minister of Transportation Regulation Number 118 of 2018, Presidential Regulation Number 55 of 2019, and Presidential Regulation Number 79 of 2023 incorporate emission standards into vehicle roadworthiness requirements, but their implementation remains ineffective. This study proposes a transformative legal paradigm integrating legal certainty, environmental protection, and just transition principles so that law enforcement against illegal transportation supports responsible, safe, and sustainable urban mobility.

Abstract

The transformation of the maritime sector towards a blue economy in Teluk Tomini, Gorontalo Province, is often characterized by a top-down approach that may ignore the local wisdom of coastal communities. The Gorontalo fishing community possesses traditional technologies, katinting and Soma pajeko, classified as Communal Intellectual Property (KIK). Although recognized under Government Regulation No. 56 of 2022, this KIK has not been integrated into marine space utilization permits and maritime investment schemes. This normative legal research, using legislative, conceptual, and comparative approaches with studies of Kenya and Peru, aims to analyze the implications of regulatory gaps and formulate an ideal legal reconstruction model. The results show that the absence of specific regulations triggers overlapping claims, risks of biocultural piracy (biopiracy), and legal uncertainty, thereby reducing investor interest. Furthermore, the absence of a KIK appraisal agency creates obstacles to bank financing. As a solution, progressive legal reconstruction is formulated through the concept of Securing Blue Investment in Gorontalo Province. This model integrates four main elements: (1) a sui generis Perda based on living law in accordance with the 2023 National Criminal Code; (2) local governments as legal trustees through Maritime KIK Centers; (3) institutionalization of Access and Benefit Sharing (ABS) contracts based on Prior Informed Consent, managed by Regional Public Service Agencies (BLUD); and (4) legalization of KIK certificates as objects of banking fiduciary security. This concept transforms KIK protection from passive cultural preservation into an active legal shield, ensuring investor legal certainty and economic justice for traditional fishermen.

Abstract

This study aims to analyze the effectiveness of Corporate Social Responsibility (CSR) implementation by PT Bridgestone Sumatra Rubber Estate (BSRE) in accordance with Article 74 of Law Number 40 of 2007 and Government Regulation Number 47 of 2012. The study employs a normative-empirical legal research method, utilizing data from literature reviews and interviews analyzed qualitatively. CSR effectiveness is assessed based on five indicators: legal compliance, targeting accuracy, community participation, program sustainability, and community impact. The findings indicate that, regarding legal compliance, PT BSRE has implemented CSR by allocating budgets and executing programs outlined in the company's work plan. In terms of targeting accuracy, programs covering the environment, infrastructure improvements, social assistance, and disaster response have addressed some community needs; however, interview results reveal that needs related to education, skills, employment opportunities, and economic empowerment have not been optimally met. Community and government participation in program planning remains limited, as CSR implementation tends to rely on proposals and immediate needs. Regarding sustainability, some programs remain routine and short-term in nature, limiting the long-term impact on community self-reliance. Thus, PT BSRE’s CSR initiatives are considered reasonably effective, having fulfilled legal obligations and delivered tangible benefits in environmental, infrastructure, and social sectors, yet they fall short of optimal performance regarding participation, sustainability, economic empowerment, and long-term community impact.

Abstract

The enactment of Law Number 3 of 2025 concerning the Indonesian National Armed Forces has generated considerable controversy, as it has been regarded as potentially inconsistent with the principles of the rule of law and democracy. Furthermore, the legislative process did not fully satisfy the three essential elements of meaningful participation. The amendment to Article 47, which expands the number of civilian positions that may be occupied by active military personnel to fourteen positions, has also raised concerns regarding the potential re-emergence of the Dual Function of the Armed Forces (Dwifungsi ABRI) doctrine. Accordingly, this study aims to examine whether the enactment of Law Number 3 of 2025 concerning the Indonesian National Armed Forces complies with the principles of proper law-making and whether the substance of Article 47 is consistent with the principles of the rule of law and democratic governance in the post-Reform era. This study employs normative legal research using statutory, conceptual, and historical approaches. The findings indicate that the legislative process was inconsistent with the Law on the Formation of Laws and Regulations and the principle of meaningful participation and was not fully aligned with the objectives of the 1998 Reform of the Indonesian National Armed Forces. Therefore, a comprehensive evaluation of the legislative process undertaken by the Government is necessary to ensure that the formation and implementation of the law remain consistent with the principles of the rule of law, democratic governance, meaningful public participation, and the objectives of military reform.

Abstract

The DS640 dispute between Brazil and the United States raises important questions in international trade law concerning the limits of WTO members’ authority to impose tariff measures on national-security grounds under Article XXI of the GATT 1994. The United States imposed additional tariffs on Brazilian steel products through the Section 232 mechanism, claiming that the measures protected national-security interests, whereas Brazil argued that they violated the principle of non-discrimination and the United States’ bound-tariff commitments. This article examines the legality of the tariff measures through three principal GATT disciplines: most-favoured-nation treatment under Article I, national treatment under Article III, and bound-tariff obligations under Article II. The study concludes that the tariffs are discriminatory because selective exemptions were granted to certain countries without an objective basis related to product differences, thereby contravening Article I. The measures also reflect protection of the United States’ domestic steel industry, which is inconsistent with Article III. In addition, the additional tariffs exceed the bound rates recorded in the United States Schedule of Concessions and therefore violate Article II. The national-security justification under Article XXI is considered inapplicable because the measures do not satisfy the “emergency in international relations” standard articulated in Russia – Traffic in Transit. Accordingly, the article argues that the United States’ measures in DS640 are inconsistent with its multilateral obligations and underscores the role of the WTO Dispute Settlement Body in preventing the national-security exception from being used as an instrument of protectionism.
