Abstract

The researcher aims to present a paper related to the criticisms raised by Fatima Mernissi against gender-biased misogyny traditions in accordance with her thoughts. Gender equality is a very hot issue discussed today. Equality of rights between men and women is increasingly being voiced. This also happens within the scope of Islam. The emergence of discussions about misogynistic traditions is also increasingly highlighted, especially by Fatima Mernissi who focuses on issues of gender equality. This research method uses a literature review of various relevant articles. The results of this study show that Fatima Mernissi criticizes gender-biased hadiths to be contextualized according to the conditions and situations of the times. This is to provide space for women to be more free in running their lives without being intervened by patriarchy. The importance of contextualization in understanding traditions is very important, so that all Muslims can live life better and there are no practices that override women's rights.

Abstract

AbstrackThe Indonesian Ulema Council (MUI) has three strategic roles: khodimul ummah, himayatul ummah, and shodiqul hukumah. Carrying out these three roles, MUI formulates religious fatwas that are also related to women's issues. Such as fatwa on halal ingredients for cosmetics and dress code, sexuality (abortion, female circumcision), and marriage (children and family relations). The two questions of this paper are whether women's life experiences are taken into consideration in the formulation and decision of fatwas? Why does MUI fatwa in fact get rejection from women's groups? To answer them, this paper uses a qualitative study, describing and analyzing MUI fatwas for the period 2010-2020 and several selected fatwas outside those years that are in accordance with the theme. This paper departs from the assumption that Indonesian society (including women's groups) actually needs MUI fatwas. This paper contributes to provide information on the strategic role of MUI for the protection of women through its fatwas and at the same time MUI still needs public input, especially women scholars, so that the fatwas produced are in favor, protecting women. And the importance of MUI making women as the subject of fatwa and not the object of fatwa, getting closer to women's experience; hearing and asking women's opinions or considering fatwas from women scholars, so that the fatwa produced by MUI suits women's needs and does not cause rejection. Key words: MUI fatwas, women ulama, women experiences AbstrakMajelis Ulama Indonesia (MUI) memiliki tiga peran strategis yakni khodimul ummah, himayatul ummah, dan shodiqul hukumah. Menjalankan ketiga peran tersebut, MUI merumuskan fatwa keagamaan yang juga terkait isu perempuan. Seperti fatwa bahan halal untuk kosmetika dan tata cara berpakaian, seksualitas (aborsi, sunat perempuan), dan perkawinan (anak dan hubungan keluarga). Dua pertanyaan tulisan ini adalah apakah pengalaman hidup perempuan menjadi pertimbangan dalam perumusan dan keputusan fatwa? Mengapa fatwa MUI kenyataannya mendapatkan penolakan dari kelompok perempuan? Untuk menjawabnya, tulisan ini menggunakan kajian kualitatif, mendeskripsikan sekaligus menganalisis fatwa MUI periode tahun 2010-2020 dan beberapa fatwa terpilih di luar tahun tersebut yang sesuai tema. Tulisan ini berangkat dari asumsi bahwa masyarakat Indonesia (termasuk kelompok perempuan) sejatinya membutuhkan fatwa MUI. Tulisan ini berkontribusi memberikan informasi peran strategis MUI untuk perlindungan perempuan melalui fatwa-fatwanya dan pada saat yang sama MUI tetap membutuhkan masukan masyarakat, terutama ulama perempuan, agar fatwa yang dihasilkan berpihak, melindungi perempuan. Dan pentingnya MUI menjadikan perempuan sebagai subyek fatwa dan bukan objek fatwa, mendekatkan diri pada pengalaman perempuan; mendengar dan meminta pendapat perempuan atau mempertimbangkan fatwa-fatwa dari ulama perempuan, agar fatwa yang dihasilkan MUI sesuai kebutuhan perempuan dan tidak menimbulkan penolakan Kata kunci: fatwa MUI, ulama perempuan, pengalaman perempuan

Abstract

This research aims to uncover the experiences and strategies of transgender individuals (waria) in facing economic challenges and social discrimination. The method employed is descriptive qualitative, utilizing data collection techniques including observation, interviews, and documentation. Analysis involves data reduction, presentation, and drawing conclusions.The findings reveal that waria often face discrimination in exercising their rights as citizens, encountering difficulties in obtaining employment, education, and healthcare. They frequently experience mockery and ridicule from their surroundings, even becoming subjects of online harassment. This arises due to a lack of societal awareness regarding the existence of waria, which is perceived as different from societal norms. Despite these challenges, waria employ various strategies to meet their economic needs. They engage not only in sex work or beauty industry management but, under necessity, seek assistance from their community that understands their circumstances. Notably, previous studies have yet to address the strategies employed by waria in meeting their needs amidst the discrimination they face.

Abstract

Kesetaraan gender dalam pendidikan Islam merupakan sesuatu yang urgen guna mengembangkan masyarakat yang inklusif dan adil. Budaya patriarki yang ada di masyarakat menjadikan perempuan dipandang sebagai manusia kelas dua yang tidak memiliki kesamaan hak dengan laki-laki. Dalam konteks mendapatkan hak, seharusnya perempuan memiliki hak yang sama terlebih dalam hak mendapatkan pendidikan. Karena itu, peneliti bertujuan untuk menganalisis bagaimana relevansi konsep kesetaraan gender dengan nilai-nilai pendidikan islam. Metode yang digunakan adalah penelitian ini adalah kepustakaan (library research), dengan mengacu pada karya-karya penting kedua tokoh yaitu "Islam Agama Ramah Perempuan, Perempuan Islam dan Negara" karya Hussein Muhammad dan "Perempuan" karya M. Quraish Shihab. Adapun teknik analis data, peneliti menggunakan teknik kajian isi (content analysis). Hasil penelitian menunjukkan bahwa berdasarkan pemikiran Husein Muhammad dan M. Quraish Shihab, kesetaraan gender merupakan ajaran esensial dalam Islam karena didalamnya terdapat penghormatan terhadap manusia. Hak dan kesempatan yang sama antara laki-laki dan perempuan berlaku di berbagai aspek kehidupan, termasuk pendidikan. Mereka meyakini bahwa konsep kesetaraan gender sesuai dengan nilai-nilai pendidikan Islam, seperti nilai amaliyah (praktik), khuluqiyah (akhlak), dan i'tiqodiyah (keyakinan). Abstract

This article aims to discuss the transformation of the roles of Muslim women in the era of Society 5.0 from theological and sociological perspectives. This study employs a qualitative approach using library research. The data collection technique used is documentation, with data analysis techniques including content analysis, induction, and deduction. The conclusions of this article are as follows. First, from a theological perspective, Islamic teachings inherently support gender equality and justice. Inclusive and progressive interpretations of religious texts can encourage positive social change and empower women. The Qur'an and Hadith offer a framework that supports the active role of women in society, both in domestic and public spheres. Second, the sociological perspective provides an understanding of the social and cultural dynamics that influence women's roles. Globalization and social media have shaped the identity of Muslim women and accelerated social change. Through social media platforms, Muslim women can express themselves, share experiences, and build supportive communities, enabling them to challenge stereotypes and prejudices that often hinder social progress.

Abstract

This study examines Quranic verses, especially Surah Al-Nisa, verse 34, which discusses the relationship between men and women in the household, focusing on the concept of qiwamah. It explores the interpretation of qiwamah using a linguistic approach. The interpretation of qiwamah sees the husband as a protector and provider for his wife, rejecting the idea of male superiority or absolute authority. This article argues that qiwamah is not based on individual competence, but rather, is a permanent responsibility for the husband, supported by the linguistic structure of the Quranic verse. This view contrasts with some Muslim scholars who see qiwamah as dependent on individual ability and not necessarily assigned to the husband. This perspective challenges patriarchal views, suggesting that qiwamah should not justify domestic oppression. Instead, it represents a financial and moral duty for the husband, emphasizing that Islam values women within the household. This interpretation places qiwamah in a broader Quranic context, offering a more comprehensive understanding of gender roles in Islam.

Abstract

The roles and positions of men and women have long been one of the most debated topics in society. This study examines Hind Shalabi's interpretation of the Qur'anic perspective on gender roles. Employing a qualitative methodology with library research as the primary data collection method, the study uses the Equilibrium Theory as an analytical framework. This theory emphasizes balance and mutual cooperation between men and women. The findings reveal that Hind Shalabi's interpretation of the Qur'an underscores the principle of equality between men and women, with her insights divided into several key themes. First, men and women are equal in dignity and standing (QS. Al-Hujurat [49]: 13). Second, both are obligated to maintain self-honor and chastity (QS. An-Nur [24]: 30–31). Third, men and women share equal accountability in fulfilling religious obligations (QS. Al-Ahzab [33]: 35). Fourth, they are encouraged to pursue knowledge together (QS. Al-Mujadila [58]: 11). Fifth, both are bound by the primordial covenant with Allah (QS. Al-Mumtahana [60]: 12). Sixth, men and women receive equal rewards for their faith and good deeds (QS. An-Nahl [16]: 97). Lastly, male and female thieves are subject to the same legal penalties (QS. Al-Maidah [5]: 38). By applying the Equilibrium Theory, Hind Shalabi asserts that men and women can effectively support and collaborate with one another in fulfilling their respective roles, fostering harmony and balance within society.

Abstract

This research aims to analyze the hegemony that occurs in the Islamic boarding school environment and whether it is related to the rise of sexual violence against female students. Power domination of kiai, patrilineal culture, and the rules of sami'na wa ato'na seemed to kill the right of the students to grow critical and only have to follow the orders of the kiai. The latest phenomenon, kiai’s power domination being the opportunity for rampant sexual violence to occur within the scope of special girls' pesantren education. The method used is literature study, which is tracing writing sources that have been made before. In other words, the term literature study is also very familiar with the term literature study. The purpose of this study is to determine the pattern of hegemonic communication by kiai y as the leader of pesantren towards the girl students.

Abstract

Abstrak: Penelitian ini menitikberatkan pada kajian yang berkaitan dengan peran perempuan khususnya istri eks narapidana terorisme binaan Yayasan Lingkar Perdamaian Lamongan sehingga mereka dapat survive, bertahan hidup serta mampu menguatkan ekonomi keluarga meski dengan stereotip dan stigma negatif yang membatasi ruang geraknya di masyarakat. Relasi suami istri yang terbentuk menjadi faktor penting dalam penguatan keluarga karena tantangan yang dihadapi jauh berbeda seperti tekanan sosial dan ekonomi. Dengan menggunakan pendekatan kualitatif, penelitian ini mengambil data melalui teknik wawancara mendalam, observasi dan dokumentasi kemudian dianalisis menggunakan teori gender dan ketahanan ekonomi. Hasil penelitian ini antara lain: Pertama, relasi keluarga yang terbangun mengalami pergeseran, artinya meskipun konstruksi patriarki melalui paradigma religius masih mengakar namun karena tuntutan agar kondisi ekonomi keluarga menjadi stabil, maka relasi tersebut lebih terbuka dengan keikutsertaan perempuan berkecimpung dalam ranah publik. Kedua, eksistensi jaringan terorisme ternyata tidak hanya karena faktor ideologi dan konsepsi mengenai negara-bangsa-agama, tetapi juga faktor ekonomi keluarga. Di bawah Yayasan Lingkar Perdamaian, para istri dan keluarga eks narapidana terorisme mendapatkan beberapa program penguatan seperti bidang pendidikan, psikologi keluarga, sosial dan ekonomi sehingga dapat mendukung program deradikalisasi dan rehabilitasi bagi mereka yang pernah terinfiltrasi jaringan terorisme. Abstract

Dalam Kompilasi Hukum Islam (KHI), ketentuan nusyūz -pembangkangan dalam rumah tangga- hanya berlaku untuk istri dan diatur secara rinci oleh Pasal 80, 83, dan 84, dengan konsekuensi hukum berupa gugurnya hak nafkah istri. Sebaliknya, Al-Qur’an Surah (QS) An-Nisa (4): 128 secara jelas mengakui kemungkinan nusyuz yang dilakukan oleh suami, mencakup sikap kasar, tidak memenuhi kewajiban materi (nafkah) maupun non-materi (kasih sayang, hubungan intim), hingga ketidakadilan dalam poligami. Dengan demikian, di sini terjadi ketimpangan antara al-Quran dan KHI, sehingga dibutuhkan kajian ulang terhadap QS 4: 128 untuk mengaudiensi KHI pasal 80-84 sehingga tercipta peraturan yang didasarkan kepada ‘pandangan dunia al-Quran’ (Quranic worldview). Penelitian ini menggunakan pendekatan relativisme budaya untuk menganalisa data primer yang dikumpulkan melalui investigasi dari undang-undang serta konteks dan fitur linguistic QS 4: 128. Penelitian ini menemukan terjadinya kekosongan hukum positif mengenai nusyuz suami yang berpotensi menciptakan ketidakseimbangan dan ketidakadilan bagi istri yang menghadapi perilaku nusyuz dari suaminya. Kekosongan ini terjadi karena apabila pembangkangan dalam rumah tangga dilakukan oleh istri, maka disebut nusyuz, sementara apabila pembangkangan dilakukan oleh suami, maka disebut KDRT (Kekerasan Dalam Rumah Tangga). Ini menunjukkan kepada kerancuan pemahaman terhadap dua terminology ini, karena istri bisa saja melakukan KDRT, sementara suami bisa saja melakukan nusyūz. Penelitian ini memberi rekomendasi agar pengaturan hukum positif Indonesia perlu ditinjau ulang untuk mencerminkan prinsip keadilan Islam yang lebih inklusif dan seimbang, sebagaimana pandangan dunia al-Quran, guna memastikan perlindungan hukum yang setara bagi kedua belah pihak dalam perkawinan.
